The National Benefit Fund believes it is a “grandfathered health plan” under the Patient Protection and Affordable Care Act (the “Affordable Care Act”). A grandfathered health plan can preserve certain basic health coverage that was already in effect when that law was enacted in 2010. Being a grandfathered health plan means that this plan may not include certain consumer protections of the Affordable Care Act that apply to other plans, for example, the requirement for an external review process for claims appeals. However, grandfathered health plans must comply with certain other consumer protections in the Affordable Care Act, for example, the elimination of lifetime limits on benefits. The Wage Class III plan is not a grandfathered health plan. At the end of last year, I asked you to join me in taking a health journey in 2023. Why? Because good health is the key to unlocking life’s joys. Leading a healthier life gives us the opportunity to live a more fruitful, happier life that we can share with the people we love. Although each person’s journey is different, they all start with taking that first step. I took my first step—along with more than 3,600 of you—by signing up for WeightWatchers®, our new wellness benefit.
Like many of you, I have good days and difficult days. I know it can seem intimidating to stretch yourselves when you already do so much. But taking the time to care for yourself is empowering, and it’s something that is within our control. When we ask ourselves “Why” is living a healthier life important—we can use the answer as motivation to start and stay on our health journey.
I believe life is precious. We only get one life to live. And that is the inspiration behind my “Why.” My “Why” is that I want to make the best of the one life I’ve been given. And for me that means living a long life to be here with my loved ones. Although longevity runs in my family, it is up to me to care for my health and give my body—my temple—the best chance of fulfilling my “Why.”
I would love to take this health journey with all of you, who give of yourselves every day to care for others. So, let’s do it! Together!

your journey. You will hear from three members who joined WeightWatchers and are ready to share their “Whys.” In addition, we explore the idea of “food as medicine” and that what we eat has the power to help us feel better and live longer, fuller lives.
Additionally, for those who are living with Type 2 diabetes, we are pleased to introduce you to Virta, an alternative nutritional program to help reverse the condition of Type 2 diabetes.

We all know that what we eat affects how we feel physically. But did you know that what we eat also impacts our mental and emotional health? In fact, studies have found that a diet consisting of mainly whole, unprocessed foods can help lower the risk of depression, anxiety and even attention-deficit/hyperactivity disorder (ADHD).
Good food makes us feel good. Let’s face it. Eating the foods that we grew up with keeps us connected to who we are, our families and our heritage. We just need to make the foods that we love healthier. And we can. Not only am I a doctor, but I am a cook. I love to prepare meals for my family, especially around the holidays. Over the years, I have learned to introduce healthy swaps for certain ingredients in my traditional Haitian-Creole dishes, like substituting plant-based sausage for pork sausage or changing some of my preparation methods, like baking instead of frying. I have also tried new ingredients, like flaxseed, which can stabilize blood sugar levels, reduce blood pressure, lower cholesterol levels and improve our mood! It has a mild, nutty flavor with a crisp, crunchy consistency and can be added to almost any breakfast or baked good. I use it in smoothies, oatmeal, cereals and on occasion muffins that I like to bake with my daughter.
As your Benefit Fund doctor, I really encourage you to try new ingredients and learn simple, healthy food swaps, like replacing white rice with brown rice, quinoa or even a sweet potato.

3 main ingredients plus everyday pantry items and veggies
Serves 6-8 people
Gumbo—5-7 points per serving ½ cup of rice—3 points
Ingredients
½ cup of all-purpose flour
1 pound of plant-based Impossible Italian link sausage, cut in half-inch pieces
1 pound of chicken breasts, cut in 1-inch pieces
1 pound of medium-size shrimp
1 cup of diced onion
½ cup of diced celery
½ cup of diced green peppers
2 tablespoons of minced garlic
1 tablespoon of kosher salt
½ teaspoon of ground black pepper
1 teaspoon of fresh thyme, chopped
1/4 teaspoon of cayenne pepper
2 bay leaves
1 tablespoon of file powder (spicy herb) or corn starch
6 cups of chicken broth (you can use fat-free)
Directions
1. Preheat oven to 400ºF.
2. Pour flour into a baking pan and bake for about 20 minutes. You will need to stir the flour every 5 minutes until it is dark brown in color.
3. In large non-stick pan coated with vegetable cooking spray, cook the Impossible sausage until crispy brown.
4. Use same non-stick pan and spray again with cooking spray. Add the chicken and cook, stirring until it begins to brown.
5. Add the onion, garlic, green peppers, and celery to the same pan, cooking until tender.
6. Stir in the browned flour.
7. Add the chicken broth, thyme, cayenne, salt, pepper and bay leaves.
8. Bring to boil, and then lower the heat and simmer until chicken is tender. This usually takes about 30 minutes.
9. Add the sausage and shrimp and continue to cook for about 5 more minutes.
10. Stir in file powder or corn starch in to thicken.
11. Serve over rice. I like wild or brown rice, but you can also use red. The magic is not in the rice but in the flavors of the gumbo—enjoy!

Tykar Williams is a physical therapy technician who’s been with Mount Sinai Health System for over 25 years. He noticed over time that he had put on weight. His casual observation turned to concern last summer, when his primary care physician told him he had prediabetes.
Weight loss and pain-free knees have allowed Tykar to fully engage in life.
“I feel more energetic now, so I can spend more time with my kids,” he says. “I can even go to hip-hop concerts as often as I like. It’s great!”
“I wanted to be the best version of myself again and avoid unexpected things sneaking up on me,” Tykar says. Following his doctor’s recommendations, he changed his diet—cutting down on fast food and eating more fruits and salads. Then he started exercising, going to the gym and walking more. It wasn’t long before he began to see results, which he calls lifechanging. “When I started losing weight,” he explains, “I felt less pressure on my knees, like I was turning back the clock. I started to look better and feel better.”
Tykar has lost over 50 pounds and has no intention of looking back. That’s why he joined WeightWatchers through the Benefit Fund’s new partnership. “Having lost that weight, I want to do what I can to keep it off,” he says. He particularly likes the WeightWatchers app, which helps him track his meals using the Points® system. “That system guides me to choose healthy options,” he says. “The meal I’m thinking of may not be worth the points! These two 1199SEIU members are part of a group of coworkers from Long Island Community Hospital who have joined WeightWatchers together.
Joanne Russo has been a Unit Secretary at Long Island Community Hospital for over 37 years and is not ready to stop any time soon. When she learned about her Benefit Fund’s partnership with WeightWatchers, Joanne was thrilled. The Training and Employment Funds (TEF) provide you with education to advance your career. Through TEF, you can use your education benefits to increase your earnings and advance into hundreds of high-demand health careers.
TEF programs prepare you to return to school at various levels of education, including high school and college. Classes focus on reading comprehension, essay writing, math and science. Programs are available to you on test testing, digital literacy and other topics to support entry into collegelevel work. TEF also partners with the City University of New York and other college campuses to offer three-credit math and English courses.
The Health Careers College Core Curriculum (HC4) Program is a supported program for adult learners with little or no experience in higher education who are pursuing undergraduate degrees in various allied health fields. The HC4 Program works with college partners to enable you to take “core” prerequisite courses required to complete your degree.
TEF makes college affordable and offers an array of options to support your success in healthcare degree programs, including associate, bachelor’s, master’s, PhD and professional degrees. Lori Jimenz-Estrada, Licensed Practical NurseThe 1199SEIU/Employer Child Care Corporation’s Future of America Learning Center (FALC) celebrated its 27th Annual Science Fair with a full week of children’s project presentations, virtual displays and “in-house” field trips from Monday, March 27, through Friday, March 31. This is the first time since the COVID-19 pandemic began that FALC opened its doors to families and invited guests to visit the center floor to view STREAM (Science, Technology, Relationship, Engineering, Art and Math) exhibits and handson experiments, based on the science fair’s overarching theme “How Do the Elements of Nature Affect Us?”
The fair offers students the opportunity to showcase their scientific learning, experiments and family projects about nature’s elements of earth, air, water, fire and space, as well as answer questions.
This year, young scholars, ages two to five, took a scientific journey of land, air, sea and space to unravel some mysteries of our world. With their teachers as trusted guides, students made authentic connections to sensorial exploration, mindfulness/ spiritual wellness, natural disasters and phenomena, current events, technological advances/inventions, relative professions, and health, safety and security matters. In their classroom learning stations and on-site STREAM lab, students presented their action-based research, sharing knowledge about their experience and process. The fair offers students the opportunity to showcase their scientific learning, experiments and family projects about nature’s elements of earth, air, water, fire and space, as well as answer questions.
FALC continuously strives to serve as a catalyst of change and transformative learning. The annual science fair has long been a staple of program’s curriculum and family engagement activities, focusing on the quality of process and interaction versus the product. This interdisciplinary approach to learning exemplifies FALC’s Plant-A-Dream curriculum, in which children are connected to the real and natural world. Using varied activities and materials based on the theory of multiple intelligences as the entry point, students are encouraged to ask questions, make hypotheses, reflect, explore, observe, collaborate and integrate their curiosity, creativity and learning into their everyday lives.

3 ingredientes principales, más artículos cotidianos de la despensa y verduras
Para 6 a 8 personas
Gumbo (5 a 7 puntos por porción), ½ taza de arroz (3 puntos)
Ingredientes
½ taza de harina sin polvo de hornear
1 libra de salchicha italiana Impossible de origen vegetal, cortada en trozos de media pulgada
1 libra de pechugas de pollo, cortadas en trozos de 1 pulgada
1 libra de camarones medianos
1 taza de cebolla en trocitos
½ taza de apio en trocitos
½ taza de pimientos verdes en trocitos
2 cucharadas de ajo molido
1 cucharada de sal kosher
½ cucharadita de pimienta negra molida
1 cucharadita de tomillo fresco, picado
1/4 cucharadita de pimienta de cayena
2 hojas de laurel
1 cucharada de gumbo filé (hierba picante) o almidón de maíz
6 tazas de caldo de pollo (puede usar caldo bajo en grasas)
Instrucciones
1. Precaliente el horno a 400 ºF.
2. Vierta la harina en un molde para hornear y hornee durante aproximadamente 20 minutos. Deberá revolver la harina cada 5 minutos hasta que esté de color marrón oscuro.
3. En una sartén antiadherente con aceite vegetal en aerosol, cocine la salchicha Impossible hasta que esté dorada y crujiente.
4. Use la misma sartén antiadherente y rocíe una vez más con aceite en aerosol. Agregue el pollo y cocine, revolviendo hasta que comience a dorarse.

Tykar Williams es un técnico en fisioterapia que ha confiado en Mount Sinai Health System durante más de 25 años. Con el tiempo, se dio cuenta de que había subido de peso. El Centro de Aprendizaje del Futuro de los Estados Unidos (Future of America Learning Center, FALC, por sus siglas en inglés)/la Corporación de Cuidado Infantil de Empleadores de 1199SEIU celebró su 27.ª Feria Anual de Ciencias con una semana completa de presentaciones de proyectos, exhibiciones virtuales y excursiones para niños en las escuelas, que se llevó a cabo desde el lunes 27 de marzo hasta el viernes 31 de marzo. Esta es la primera vez desde la pandemia de la COVID-19 que el FALC abre sus puertas a las familias e invita a todos a visitar el piso del centro para ver las exhibiciones y los experimentos prácticos del programa Ciencia, Tecnología, Relaciones, Ingeniería, Arte y Matemáticas (Science, Technology, Relationship, Engineering, Art and Math, STREAM, por sus siglas en inglés), basado en el tema general de la feria de ciencias: “¿Cómo nos afectan los elementos de la naturaleza?”.
La feria ofrece a los estudiantes la oportunidad de mostrar su aprendizaje científico, experimentos y proyectos familiares sobre los elementos de la naturaleza de la tierra, el aire, el agua, el fuego y el espacio, así como también respuestas a sus preguntas.

The total number of participants in the Plan as of the Plan’s valuation date was 276,508. Of this number, 106,339 were active participants; 83,836 were retired or separated from service and receiving benefits; and 86,333 were retired or separated from service and entitled to future benefits.
Every pension plan must have a procedure for establishing a funding policy to carry out the plan objectives. A funding policy relates to the level of assets needed to pay for benefits promised under the plan currently and over the years. The Plan is funded by contributions made by employers pursuant to collective bargaining agreements with 1199SEIU United Healthcare Workers East and other written agreements.
Once money is contributed to the Plan, the money is invested by Plan fiduciaries. Specific investments are made in accordance with the Plan’s investment policy. Generally speaking, an investment policy is a written statement that provides the fiduciaries, who are responsible for Plan investments, with guidelines or general instructions concerning investment management decisions. Under federal pension law, a plan generally will be considered to be in “endangered” status if, at the beginning of the plan year, the funded percentage of the plan is less than 80 percent or in “critical” status if the percentage is less than 65 percent (other factors may also apply). If a pension plan enters endangered status, the trustees of the plan are required to adopt a funding improvement plan. Similarly, if a pension plan enters critical status, the trustees of the plan are required to adopt a rehabilitation plan. Rehabilitation and funding improvement plans establish steps and benchmarks for pension plans to improve their funding status over a specified period of time.
The Plan was not in endangered or critical status in the Plan Year.
A pension plan is required to file with the U.S. Department of Labor an annual report (called the “Form 5500”) containing financial and other information about the plan. Copies of the annual report are available from the U.S. Department of
Labor, Employee Benefits Security Administration’s Public Disclosure Room at 200 Constitution Avenue, NW, Room N-1515, Washington, DC 20210, or by calling (202) 693-8673. For 2009 and subsequent plan years, you may obtain an electronic copy of the Plan’s annual report by going to www.efast.dol.gov and using the Form 5500 search function. Or you may obtain a copy of the Plan’s annual report by making a written request to the Plan administrator. The Plan’s annual report for the 2022 Plan Year will not be available until mid-October 2023.
Annual reports do not contain personal information, such as the amount of your accrued benefit. You may contact your Plan administrator if you want information about your accrued benefits. Your Plan administrator is identified below under “Where to Get More Information.”
Federal law has a number of special rules that apply to financially troubled multiemployer plans that become insolvent, either as ongoing plans or plans terminated by mass withdrawal. The Plan administrator is required by law to include a summary of these rules in the annual funding notice. A plan is insolvent for a plan year if its available financial resources are not sufficient to pay benefits when due for that plan year. An insolvent plan must reduce benefit payments to the highest level that can be paid from the plan’s available resources. If such resources are not enough to pay benefits at the level specified by law (see “Benefit Payments Guaranteed by the PBGC,” below), the plan must apply to the PBGC for financial assistance. The PBGC will loan the plan the amount necessary to pay benefits at the guaranteed level. Reduced benefits may be restored if the plan’s financial condition improves.
A plan that becomes insolvent must provide prompt notice of its status to participants and beneficiaries, contributing employers, labor unions representing participants and the PBGC. In addition, participants and beneficiaries must receive information regarding whether, and how, their benefits will be reduced or affected, including loss of a lump-sum option. This information will be provided for each year the plan is insolvent.
The maximum benefit that the PBGC guarantees is set by law. Only vested benefits are guaranteed. Specifically, the PBGC guarantees a monthly benefit payment equal to 100 percent of the first $11 of the plan’s monthly benefit accrual rate, plus 75 percent of the next $33 of the accrual rate, multiplied by each year of credited service. The PBGC’s maximum guarantee, therefore, is $35.75 per month, multiplied by a participant’s years of credited service.
Example 1: If a participant with 10 years of credited service has an accrued monthly benefit of $500, the accrual rate for purposes of determining the PBGC guarantee would be determined by dividing the monthly benefit by the participant’s years of service ($500/10), which equals $50. The guaranteed amount for a $50 monthly accrual rate is equal to the sum of $11 plus $24.75 (.75 x $33), or $35.75. Thus, the participant’s guaranteed monthly benefit is $357.50 ($35.75 x 10).
Example 2: If the participant in Example 1 had an accrued monthly benefit of $200, the accrual rate for purposes of determining the PBGC guarantee would be $20 (or $200/10). The guaranteed amount for a $20 monthly accrual rate is equal to the sum of $11 plus $6.75 (.75 x $9), or $17.75. Thus, the participant’s guaranteed monthly benefit would be $177.50 ($17.75 x 10).
The PBGC guarantees pension benefits payable at Normal Retirement Age and some early retirement benefits. In calculating a person’s monthly payment, the PBGC will disregard any benefit increases that were made under the plan within 60 months before the earlier of the plan’s termination or insolvency (or benefits that were in effect for less than 60 months at the time of termination or insolvency). Similarly, the PBGC does not guarantee the following: pre-retirement death benefits to a spouse or beneficiary (e.g., a qualified pre-retirement survivor annuity) if the participant dies after the plan terminates; benefits above the normal retirement benefit; disability benefits not in pay status; or non-pension benefits, such as health insurance, life insurance, death benefits, vacation pay or severance pay.

funding deficiencies in each subsequent year. In an effort to improve the Plan’s funding situation, the Trustees adopted a rehabilitation plan on May 31, 2009. The rehabilitation period began on January 1, 2012, and is projected to last for 18 years. The rehabilitation plan provides two alternative schedules, the Preferred Schedule and the Default Schedule, that require changes in Plan benefits and contribution rates. Employers that have not adopted either schedule must pay surcharges. Generally, the rate at which an employer contributes to the Plan will determine which Schedule of Benefits applies to its employees. Please refer to the rehabilitation plan for further details and for the meaning of certain capitalized terms not defined below.
1. Preferred Schedule: The Preferred Schedule applies to an employer and its employees when that employer contributes at the applicable rate provided in the Preferred Schedule.
Contribution Rate: The contribution rate for employers adopting the Preferred Schedule was 9.1% of gross payroll, effective September 1, 2014, and increased to 11.7% of gross payroll, effective July 1, 2015. Consistent with a collective bargaining agreement, effective from October 1, 2017, to September 30, 2018 (the “2017 Collective Bargaining Agreement”), employer contributions to the Plan were further increased by $18 million in 2018 in lieu of increasing the rate of contribution. Effective with a new collective bargaining agreement, the contribution rate remained at 11.7% until September 30, 2019, and pursuant to a collective bargaining agreement that was made effective as of October 1, 2018 (the “2018 Collective Bargaining Agreement”), the contribution rate increased to 12.9%, effective October 1, 2019. Pursuant to a collective bargaining agreement effective October 1, 2021, the contribution rate decreased to 11.1%. For employers that were subject to the 2017 Collective Bargaining Agreement or a collective bargaining agreement containing the same terms as the 2018 Collective Bargaining Agreement regarding contributions to the Plan, the Preferred Schedule Contribution Rate was 11.7% for the period from October 1, 2017, through September 30, 2019, and, pursuant to the 2018 Collective Bargaining Agreement, effective October 1, 2019, the rate increased to 12.9%. For employers not subject to the 2018 Collective Bargaining Agreement or a collective bargaining agreement containing the same terms as the 2018 Collective Bargaining Agreement regarding contributions to the Plan, the Preferred Schedule Contribution Rate increased from 11.7% to 12.9%, effective January 1, 2018.
No Change in Benefit Accruals Except for New Plan Participants: For employees that participated in the Plan prior to August 1, 2009, to whom the Preferred Schedule applies, there is generally no change in the basic benefit structure that existed before the Plan entered critical status. For employees that became Plan participants on or after August 1, 2009, the monthly benefit accrual rate (payable as a single-life annuity at Normal Retirement Age) that applies to all pension credits earned on or after January 1, 2010, is $19 per year of credited service, effective January 1, 2010, with a maximum of 27 years of credited service, effective January 1, 2011.
Effective July 1, 2015, for new Plan participants hired as licensed practical nurses (LPNs) or registered nursed (RNs) on or after August 1, 2009, the monthly benefit accrual rate (payable as a single-life annuity at Normal Retirement Age) that applies to all pension credits earned on or after August 1, 2009, is $30. The rate is increased to $37 retroactive to the date of hire for each LPN and RN who acquires 10 pension credits.
Effective January 1, 2022, for employees in covered employment on or after such date, the accrual rate for employees hired on or after August 1, 2009, who are earning $19 per year of service as of that date shall be increased to $30 per year of service retroactive to the date of hire and after accruing 10 years of service credits, shall be increased to $37 per year of service retroactive to the date of hire.

Under federal pension law, a plan generally will be considered to be in “endangered” status if, at the beginning of the plan year, the funded percentage of the plan is less than 80 percent or in “critical” status if the percentage is less than 65 percent (other factors may also apply). If a pension plan enters endangered status, the trustees of the plan are required to adopt a funding improvement plan. Similarly, if a pension plan enters critical status, the trustees of the plan are required to adopt a rehabilitation plan. Rehabilitation and funding improvement plans establish steps and benchmarks for pension plans to improve their funding status over a specified period of time.
The Plan was certified by its actuary to be in critical status in 2009. The Plan continued to be in critical status in subsequent years because the Plan had accumulated
2. Default Schedule: The Default Schedule applies to an employer and its employees if an employer contributes at the applicable rate provided in the Default Schedule. The effective date of the Default Schedule for a given employer is referred to as the “Default Schedule Effective Date.”
Contribution Rate: Contributions required under the Default Schedule increased from 9.9% to 10.9%, effective January 1, 2018.
Reduction in Benefit Accruals: The monthly benefit accrual rate that applies to all pension credits of participants that left covered employment before January 1, 2004, is not changed. The monthly benefit accrual rate (payable as a single-life annuity at Normal Retirement Age) that applies to all pension credits earned before the Default Schedule Effective Date, if the participant left covered employment after January 1, 2004, is reduced to the accrual rate that was in effect as of January 1, 2004, (i.e., $35 if your employer was obligated to contribute at the “prevailing rate,” as defined in the Plan document, and $26 if your employer was not). The monthly benefit accrual rate that will be applied to all pension credits earned on or after the Default Schedule Effective Date is $19. The maximum number of pension credits that can be earned under the Default Schedule is 25. In calculating monthly pension payments, the Plan will first count the pension credits to which the highest monthly benefit accrual rate applies. Notwithstanding the foregoing, there will be no accruals for the 2008 and 2009 plan years.
Reduction and/or Elimination of Adjustable Benefits: The Default Schedule requires the reduction and/or elimination of the following “adjustable benefits”:
• Subsidies provided under the Early Retirement Pension;
• The Disability Pension;
• The 60-month benefit guarantee;
• The $1,000 lump-sum death benefit; and
• Other similar benefits, rights or features under the Plan.
These reductions will only apply to participants whose benefit commencement date is on or after April 30, 2009, and will only take effect on a prospective basis beginning on a participant’s Default Schedule Effective Date.
The normal retirement benefit (i.e., the “Regular Pension,” as defined in the Plan) payable at Normal Retirement Age is not an adjustable benefit and will not be reduced or eliminated.
This is not a complete summary of the benefits or other provisions under the rehabilitation plan. Please refer to the rehabilitation plan for more detailed information. A pension plan is required to file with the U.S. Department of Labor an annual report (called the “Form 5500”) containing financial and other information about the plan. Copies of the annual report are available from the U.S. Department of Labor, Employee Benefits Security Administration’s Public Disclosure Room at 200 Constitution Avenue, NW, Room N-1515, Washington, DC 20210, or by calling (202) 693-8673. For 2009 and subsequent plan years, you may obtain an electronic copy of the Plan’s annual report by going to www.efast.dol.gov and using the Form 5500 search function. Or you may obtain a copy of the Plan’s annual report by making a written request to the Plan administrator. The Plan’s annual report for the 2022 Plan Year will not be available until mid-October 2023.
Annual reports do not contain personal information, such as the amount of your accrued benefit. You may contact your Plan administrator if you want information about your accrued benefits. Your Plan administrator is identified below under “Where to Get More Information.”
Federal law has a number of special rules that apply to financially troubled multiemployer plans that become insolvent, either as ongoing plans or plans terminated by mass withdrawal. The Plan administrator is required by law to include a summary of these rules in the annual funding notice. A plan is insolvent for a plan year if its available financial resources are not sufficient to pay benefits when due for that plan year. An insolvent plan must reduce benefit payments to the highest level that can be paid from the plan’s available resources. If such resources are not enough to pay benefits at the level specified by law (see “Benefit Payments Guaranteed by the PBGC,” below), the plan must apply to the PBGC for financial assistance. The PBGC will loan the plan the amount necessary to pay benefits at the guaranteed level. Reduced benefits may be restored if the plan’s financial condition improves.
A plan that becomes insolvent must provide prompt notice of its status to participants and beneficiaries, contributing employers, labor unions representing participants and the PBGC. In addition, participants and beneficiaries must receive information regarding whether, and how, their benefits will be reduced or affected, including loss of a lump-sum option. This information will be provided for each year the plan is insolvent.
The maximum benefit that the PBGC guarantees is set by law. Only vested benefits are guaranteed. Specifically, the PBGC guarantees a monthly benefit payment equal to 100 percent of the first $11 of the plan’s monthly benefit accrual rate, plus 75 percent of the next $33 of the accrual rate, multiplied by each year of credited service. The PBGC’s maximum guarantee, therefore, is $35.75 per month, multiplied by a participant’s years of credited service.
Example 1: If a participant with 10 years of credited service has an accrued monthly benefit of $500, the accrual rate for purposes of determining the PBGC guarantee would be determined by dividing the monthly benefit by the participant’s years of service ($500/10), which equals $50. The guaranteed amount for a $50 monthly accrual rate is equal to the sum of $11 plus $24.75 (.75 x $33), or $35.75. Thus, the participant’s guaranteed monthly benefit is $357.50 ($35.75 x 10).
Example 2: If the participant in Example 1 had an accrued monthly benefit of $200, the accrual rate for purposes of determining the PBGC guarantee would be $20 (or $200/10). The guaranteed amount for a $20 monthly accrual rate is equal to the sum of $11 plus $6.75 (.75 x $9), or $17.75. Thus, the participant’s guaranteed monthly benefit would be $177.50 ($17.75 x 10).
The PBGC guarantees pension benefits payable at Normal Retirement Age and some early retirement benefits. In calculating a person’s monthly payment, the PBGC will disregard any benefit increases that were made under the plan within 60 months before the earlier of the plan’s termination or insolvency (or benefits that were in effect for less than 60 months at the time of termination or insolvency). Similarly, the PBGC does not guarantee the following: pre-retirement death benefits to a spouse or beneficiary (e.g., a qualified pre-retirement survivor annuity) if the participant dies after the plan terminates; benefits above the normal retirement benefit; disability benefits not in pay status; or non-pension benefits, such as health insurance, life insurance, death benefits, vacation pay or severance pay.

This is to inform you that on March 30, 2023, the Plan actuary certified to the U.S. Department of the Treasury and to the Plan sponsor that the Plan is in critical status for the Plan Year beginning January 1, 2023. Federal law requires that you receive this notice.
The Plan is considered to be in critical status because it has funding problems. More specifically, the Plan’s actuary determined that the Plan has an accumulated funding deficiency for the current Plan Year.
Federal law requires pension plans in critical status to adopt a rehabilitation plan aimed at restoring the financial health of the plan. This is the 13th year the Plan has been in critical status. The law permits pension plans to reduce, or even eliminate, benefits called “adjustable benefits” (described below) as part of a rehabilitation plan. On May 31, 2009, the Trustees adopted a rehabilitation plan that includes two schedules, a Preferred Schedule and a Default Schedule. Under the Default Schedule, the Plan reduced or eliminated adjustable benefits.
The Plan is not permitted to pay lump-sum benefits (or any other payment in excess of the monthly amount paid under a single-life annuity) while it is in critical status. If the Trustees of the Plan determine that further benefit reductions are necessary, you will receive a separate notice in the future identifying and explaining the effect of those reductions. Any reduction of adjustable benefits (other than a repeal of a recent benefit increase, as described below) will not reduce the level of a participant’s basic benefit payable at Normal Retirement Age.
The adjustable benefits that were reduced or eliminated under the Default Schedule include the following:
• Subsidies provided under the Early Retirement Pension;
• The Disability Pension;
• The 60-month benefit guarantee;
• The $1,000 lump-sum death benefit; and
• Other similar benefits, rights or features under the Plan.
The law requires all contributing employers that do not have collective bargaining agreements incorporating either the Preferred or Default Schedule to pay to the Plan a surcharge to help correct the Plan’s financial situation. The amount of the surcharge is equal to a percentage of the amount an employer is otherwise required to contribute to the Plan under the applicable collective bargaining agreement. With some exceptions, a 5 percent surcharge is applicable in the initial critical year and a 10 percent surcharge is applicable for each succeeding Plan Year thereafter in which the Plan is in critical status. As noted, the surcharge ends for an employer once its collective bargaining agreement incorporates one of the schedules of the rehabilitation plan.
