A SAN MARCOS STORY Art, education, protest, leadership: Latinos leave their mark on the city over the years

I

n 1979, after giving a speech at Palomar College, Cesar Chavez ate dinner at John Valdez’s home, where he held Valdez’s toddler son on his lap.

John Valdez remembers that story well, like so many others anchored in the city of San Marcos.

Valdez was a Chicano Student Movement of Aztlán (MEChA) historian at UCSD La Jolla. His first time in San Marcos was at a MEChA protest in 1971.

In 1971, “I came with the president to Palomar in my beat-up VW. As we came into the parking lot, we ran into a whole range of protestors... We just joined the march,” he tells North County Informador.

San Marcos was a different place back then.

“MEChA was extremely powerful and active throughout the county. And they called for a protest on behalf of the MEChA students at Palomar.”

Valdez remembers that the school administration had left, and Dr. Theodore Kilman was the only one who remained, speaking to the students in the cafeteria.

“The protest was a march through the plaza,” he remembers.

He says the movement brought thousands of high school students to the campus over five years—from Encinitas, Fallbrook, San Marcos, Escondido, and Vista.

“We had big events, busloads of students. Some of the people on campus that worked for the college were not happy seeing so many Mexicans, Latino students,” he adds.

The fight for Latinos in education gained strength during those years, and San Marcos, especially Palomar College, played a leading role.

The birth of Chicano Studies

B

ack in the 1950s and 1960s, says Valdez, Latinos did not enjoy many educational opportunities.

“They didn’t really educate you for college. You were being trained, vocational arts,” he says.

Valdez was able to get a classical, pre-philosophy, spiritual training to become a priest at University of San Diego, after having felt excluded at the high school level.

Four years later, he realized he wanted a family, so he shifted gears and went back to USD, and later to UCSD. “There were so few Latinos at UCSD. There were only about 12…Only two graduated one year, two Latinas in the early 70s,” he remembers.

At UCSD, Valdez found his true calling. “We’re

creating basically Chicano Studies,” he said. “I have to get my hands on books, go to conferences, learn the subject…they didn’t have these classes. We were pioneers…putting these classes together.”

He says the class offerings he helped design were unique at the time—African Studies, Chicano Studies, Multicultural Studies, Judaic Studies, Asian Studies… “But it was a struggle,” he says.

“It was controversy. One controversy was the union, the Farmworkers’ Union. César Chávez.

We wholeheartedly supported the UFW, the Farmworker Union. We would picket Safeway, boycott lettuce, wine, grapes.”

These protests led him to Palomar and San Marcos in 1971.

“

Studies. And the Latino presence was beginning to be felt off campus as well.

“I remember driving off the 78,” he said. “You go through San Marcos, then you go over the hill, to the backroad… I remember driving to Encinitas… no buildings. No houses. Open, beautiful hills. Just no houses at all in the 70s. Nothing. I remember when I reached Encinitas, there was a farm, and there was an Emiliano Zapata poster, with his rifle, right there, off the road. I thought, well, this is amazing to see an Emiliano Zapata poster in Encinitas off El Camino Real.”

The first time I arrived in San Marcos was through the back country. I thought, where is it?... Rural, open fields, maybe a cow here, a cow there…”, Valdez tells us.

“But we found Palomar, and we were united, we were focused, and we were energetic,” he adds.

“There was a lot of resistance to us,” he says.

“We were lowering the standards, we were bringing the ghetto, we were bringing the barrio to beautiful Palomar.”

The city of San Marcos would be the site of the showdown.

“San Marcos really was a very rural, very quiet…

It was open fields, and there were some small stores. But there was an office building with a huge Mexican flag. And it was the off-campus MEChA office in this field.”

Valdez explains that this MEChA room was the main heart of Palomar for Latinos and Chicano

aldez remembers when the Cal State San Marcos campus was being built, in the 1980s.

“The Latino population was present,” in the city, he says. “It wasn’t organized. There were no groups.”

The early 1980s brought more controversy with a mural at Palomar campus.

“One of the first major contributions from our students was a mural on Cinco de Mayo, 1980…The first major mural in North County by our students as an artistic, intellectual contribution to the college…”

The response was, “we don’t want this mural…

It’s going to detract from the beauty of Palomar. It’s going to draw graffitists and put their marks on the wall.”

Still, the artists Edgar Olivares, George Papciak, and Manuel Sepulveda created a four-paneled MEChA mural on a wall of the campus racquetball courts. Valdez called it “Spherical Transformation.”

But things would get harder for Latinos in San Marcos.

The 2000s

T

n the early 1990s, there was a rash of shootings. A high school student was shot sitting at the bus stop and another at a home in San Marcos.

To face this threat, MEChA called for a meeting of the communities. “The sheriff came, some parents came, and a priest came,” he says.

It was then that Vince Andrade stepped up in San Marcos. He was also elected to the City Council, where he served until his death from cancer in 1999. His voice stood out in defense of the Latino and Spanishspeaking communities in the city.

“Vince Andrade came up as a leader, concerned about what was happening among the youth. We started some Boy Scout troop for Latinos, for Spanishspeaking Boy Scouts,” remembers Valdez.

“Vince Andrade came out as a leader for the concern of what was happening in the community among the youth,” says Valdez. “The threat went away over time, thankfully.”

he Latino struggle for a place in San Marcos continued into the 2000s, when the resistance began to back down some, according to Valdez.

“That’s a long time we had to battle our situation,” he says.

When a new dean came on, “He speaks for us. He doesn’t like to hear degrading comments about our department,” he explains.

“Since then, we have another mural. I was inspired to call it ‘Adelante, MEChA, adelante’. Forward, MEChA, Forward,” says Valdez.

This second mural is located in the homeroom of the Multicultural Studies Department and MEChA. Valdez says it represents a new generation of students.

Valdez, who retired in 2015, hopes another will be painted soon, “to have a trilogy” and continue to preserve the Latino and Chicano history and culture from the area.

San Marcos today

T

oday, Palomar College has come a long way from those days of protest, boasting its first Latina president/ superintendent, Star Rivera-Lacey.

Valdez says having a Latina president of Palomar “is absolutely glorious. She’s such a wonderful person, and we support her 100%. It’s not easy being a leader…”

He says there are other community leaders today.

“I see great potential,” he says. “These kids are getting a good education. They have dedicated teachers.”

What advice does Valdez have for Latinos in San Marcos today?

“Be patient,” he says. “Trust your feelings. Continue to dream; ask questions. Believe in yourself. Appreciate all those that love you. And do the best you can. Read. Strive to learn. Help the community. Help your family.

And have faith in your future.”

He is hopeful for that future. “When [Andrade] passed, we didn’t really have a leader. But now we have María Núñez [of Universidad Popular and the district representative], the new generation. Articulate, smart. And the whole family, Arcela Núñez…They get along with people” he says.

“And they love San Marcos. A great combination.”

UNA HISTORIA DE SAN MARCOS Arte, educación, protesta, liderazgo: Los latinos dejan su marca en la ciudad a través de los años

E

n 1979, después de dar un discurso en Palomar College, César Chávez cenó en la casa de John Valdez, donde cargó al hijo pequeño de Valdez en su regazo.

John Valdez recuerda bien esa historia, como tantas otras ancladas en la ciudad de San Marcos.

Valdez fue historiador del Movimiento Estudiantil Chicano de Aztlán (MEChA) en UCSD La Jolla. Su primera vez en San Marcos fue en una protesta de MEChA en 1971.

En 1971, “Vine con el presidente a Palomar en mi Volkswagen todo estropeado. Cuando entramos al estacionamiento, nos encontramos con varios manifestantes... Acabamos por unirnos a la marcha”, cuenta a North County Informador.

San Marcos era un lugar diferente en aquel entonces.

“MEChA fue extremadamente poderosa y activa en todo el condado. Y llamaron a una protesta a favor de los estudiantes de MEChA en Palomar”.

Valdez recuerda que la administración de la escuela se había ido y que el Dr. Theodore Kilman era el único que quedaba, hablando con los estudiantes en la cafetería.

“La protesta fue una marcha por la plaza”, recuerda.

Dice que el movimiento atrajo a miles de estudiantes de high school al campus durante cinco años, de Encinitas, Fallbrook, San Marcos, Escondido y Vista.

“Tuvimos grandes eventos, autobuses llenos de estudiantes. Algunas de las personas en el campus que trabajaban para la universidad no estaban contentas de ver a tantos mexicanos, estudiantes latinos”, agrega.

La lucha por los latinos en la educación cobró fuerza durante esos años, y San Marcos, sobre todo Palomar College, jugó un papel protagónico.

El nacimiento de los Estudios Chicanos

E

n las décadas de 1950 y 1960, dice Valdez, los latinos no disfrutaban de muchas oportunidades educativas.

“Realmente no te educaban para la universidad.

Estabas siendo entrenado, artes vocacionales”, dijo.

Valdez pudo obtener una formación espiritual clásica, prefilosófica, para convertirse en sacerdote en la Universidad de San Diego, después de haberse sentido excluido en la escuela secundaria.

Cuatro años más tarde, se dio cuenta de que quería una familia, así que cambió de rumbo y volvió a USD y luego a UCSD. “Había muy pocos latinos en UCSD. Solo había como 12… Solo dos se graduaron un año, dos latinas a principios de los 70”, recuerda.

En UCSD, Valdez encontró su verdadera vocación.

“Estamos creando básicamente estudios chicanos”, dice. “Tengo que conseguir libros, ir a conferencias, aprender del tema… ellos no tenían estas clases. Fuimos pioneros... armando estas clases”.

Dice que la oferta de clases que ayudó a diseñar era única en ese momento: estudios africanos, estudios chicanos, estudios multiculturales, estudios judaicos, estudios asiáticos... “Pero fue una lucha”, dice. “Fue una polémica. Una de las controversias fue el sindicato, el Sindicato de Trabajadores Agrícolas. César Chávez.

Apoyamos de todo corazón a la UFW, la Unión de Trabajadores Agrícolas. Hacíamos huelgas en Safeway, boicoteábamos la lechuga, el vino y las uvas”.

Estas protestas lo llevaron a Palomar y San Marcos en 1971.

La lucha por un lugar

“

La primera vez que llegué a San Marcos fue por el campo. Pensé, ¿dónde es?... Rural, campos abiertos, tal vez una vaca aquí, una vaca allá…”, nos dice Valdez.

“Pero encontramos Palomar, y estábamos unidos,

estábamos enfocados y teníamos energía”, agrega.

“Había mucha resistencia hacia nosotros”, dice.

Decían que “Bajábamos los estándares, traíamos el ‘ghetto’, traíamos el barrio a la hermosa Palomar”.

La ciudad de San Marcos sería el escenario del enfrentamiento.

“San Marcos realmente era muy rural, muy tranquilo… Era campo abierto, y había algunas tiendas pequeñas. Pero había un edificio de oficinas con una enorme bandera mexicana. Y era la oficina MEChA cerca del campus en este campo”.

Valdez explica que este salón MEChA era el corazón principal de Palomar para los estudios latinos y chicanos. Y la presencia latina también comenzaba a sentirse fuera del plantel.

“Recuerdo haber salido de la 78”, dice. “Pasas por San Marcos, luego cruzas la colina, hacia el camino apartado... Recuerdo haber manejado hasta Encinitas... sin edificios. Sin casas. Colinas abiertas y hermosas.

Simplemente no había casas en absoluto en los años 70.

Nada. Recuerdo cuando llegué a Encinitas, había una finca, y había un cartel de Emiliano Zapata, con su fusil, ahí mismo, fuera de la vía. Pensé, bueno, es increíble ver un cartel de Emiliano Zapata en Encinitas frente a El Camino Real”.

La década de 1980

V

aldez recuerda cuando se estaba construyendo el campus de Cal State San Marcos, en la década de 1980. “La población latina estuvo presente”, en la ciudad, dice. “No estaba organizada. No había grupos”.

Los primeros años de la década de 1980 trajeron más controversia con un mural en el campus de Palomar.

“Una de las primeras contribuciones importantes de nuestros estudiantes fue un mural el cinco de mayo de 1980… El primer mural importante en el

norte del condado hecho por nuestros estudiantes como una contribución artística e intelectual a la universidad…”

La respuesta fue, “no queremos este mural… Va a restarle valor a la belleza de Palomar. Va a atraer a grafiteros que pondrán sus marcas en la pared”.

Aun así, los artistas Edgar Olivares, George Papciak y Manuel Sepúlveda crearon un mural MEChA de cuatro paneles en una pared de las canchas de ráquetbol del campus. Valdez lo llamó “Transformación esférica”.

Pero las cosas se pondrían más difíciles para los latinos en San Marcos.

La década de 1990

A

principios de la década de 1990, hubo una ola de tiroteos. Un estudiante de high school fue baleado sentado en la parada del autobús, y otro en una vivienda en San Marcos.

Para enfrentar esta amenaza, MEChA convocó a una reunión de las comunidades. “Vino el sheriff, vinieron algunos padres y vino un sacerdote”, dice.

Fue entonces cuando Vince Andrade tomó las riendas en San Marcos. También fue elegido para el Concejo Municipal, cargo que ocupó hasta su muerte por cáncer en 1999. Su voz se levantó en defensa de las comunidades latinas y de habla hispana de la ciudad.

“Vince Andrade surgió como líder, preocupado por lo que estaba pasando entre la juventud. Comenzamos una tropa de Boy Scouts para latinos, para Boy Scouts de habla hispana”, recuerda Valdez.

“Vince Andrade salió como líder por la preocupación de lo que estaba pasando en la comunidad entre los jóvenes”, dice Valdez.

“La amenaza desapareció con el tiempo, afortunadamente”.

La década de 2000

L

a lucha latina por un lugar en San Marcos continuó hasta la década de 2000, cuando la resistencia comenzó a disminuir un poco, según Valdez. “Eso es mucho tiempo que tuvimos para luchar contra nuestra situación”, dice.

Cuando entró un nuevo decano, “Él habla por nosotros. No le gusta escuchar comentarios degradantes sobre nuestro departamento”, explica.

“Desde entonces, tenemos otro mural. Me inspiré

para llamarlo ‘Adelante, MEChA, adelante”, dice Valdez.

Este segundo mural está ubicado en el salón de clases del Departamento de Estudios Multiculturales y MEChA. Valdez dice que representa una nueva generación de estudiantes.

El mural original de 1980 todavía se ve en el plantel.

Valdez, quien se jubiló en 2015, espera que se pinte otro pronto “para tener una trilogía” y continuar con la preservación de la historia y cultura de la región.

San Marcos hoy

P

alomar College ha recorrido un largo camino desde esos días de protesta, y cuenta con su primera presidenta/superintendente latina, Star Rivera-Lacey.

Valdez dice que tener una presidenta latina en Palomar “es absolutamente glorioso. Es una persona maravillosa y la apoyamos al 100%. No es fácil ser un líder…” Él dice que hay otros líderes comunitarios hoy.

“Veo un gran potencial”, dice. “Estos niños están recibiendo una buena educación. Tienen maestros dedicados”. ¿Qué consejo tiene Valdez para los latinos en San Marcos hoy?

“Tengan paciencia”, dice. “Confíen en sus sentimientos. Continúen soñando; hagan preguntas.

Crean en sí mismos. Aprecien a todos los que los aman.

Y hagan lo mejor que puedan. Lean. Esfuércense por aprender. Ayuden a la comunidad. Ayuden a sus familias. Y tengan fe en su futuro”.

Tiene esperanzas en ese futuro. “Cuando [Andrade] falleció, realmente no teníamos un líder. Pero ahora tenemos a María Núñez [de Universidad Popular y representante del distrito], la nueva generación.

Articulada, inteligente. Y toda la familia, Arcela Núñez…

Se llevan bien con la gente”, dice.

“Y aman San Marcos. Una gran combinación.”

Oscarin Ortega’s Lived Experiences Hardship, mental health, and stereotypes: The uphill battle in helping others find their own way

O

scar “Oscarin” Ortega once lived on the streets of Oceanside. Today, he represents the nonprofit Lived Experiences.

Oscarin tells North County Informador that his organization “started something that I wish I’d had when I was younger.”

He grew up on Center Street in Crown Heights. “We come from an ethnic background, hardship background, a struggle background…always an uphill battle,” he tells us.

His experiences led him to where he is today. “When it first started, I was like 13, 14… having this freedom of being a kid in the wilderness of the streets…My dad had two jobs, my mom had two jobs…They loved us, but it was hard for them to be parents because they were always working.”

Having to make a lot of choices as a child, “No one ever taught me how to make a wise decision based on my future. It was always based on how can I make myself feel better and safe and happy at that moment,” he says.

“I became a perpetrator. I became a nuisance…And it wasn’t good.”

He believes his choices were rooted in traumatic events over which he had no control and that he didn’t realize he suffered from anxiety, ADHD, and depression. “I had no idea what my body was going through, my brain was going through…I was lost. I was confused…I ended up losing everything.”

Becoming a father at 22 led him to take control of his decisions. “I had to learn how to love a girl,” he said.

“That turned me to education and mental health.

There’s a big piece of mental health, the brain piece, there’s a big piece of the brain that I never understood, that I understand now,” he tells us.

“It’s taken me 23 years to get to this point… being a community leader, liaison, whatever you want to call me…have a better life, other choices.”

NO JUDGMENT Oscarin tells us about the nonprofit Lived Experiences. “I think the work that we’re doing is important because it’s different,” he says.

“I like to do a lot of community work…build the trust within the community because I live in the

He believes fear is the biggest issue facing communities today. “The fear piece of it that doesn’t let us breathe.

It doesn’t let us dream. It doesn’t let us walk down the street without having the fear of being removed from this city or being arrested, or fear of not being able to have a job,” he notes.

“I want people to know that it’s okay to be where you’re at right now… that you can have an open setting to say, hey, dude, I’m not feeling okay.”

He wants Lived Experiences to provide that space. “You’re still a member of society. You’re a human.

You belong somewhere. And it’s my responsibility as a leader to do whatever I can…make sure that path to belonging somewhere, to something…that I create that path for the individual,” he states.

“I can’t ask for somebody to be someone who I think they should be. But if I can create that space for individuals to make sure that they know that it’s okay, that’s the goal.”

IT’S OKAY TO ASK FOR HELP “I want to make sure that people know that it’s not about me, or my story…it’s about us. There’s an us thing, there’s a we thing,” says Oscarin.

Oscarín dice a North County Informador que su organización “fue algo que desearía haber tenido cuando era más joven”.

“Venimos de un origen étnico, un entorno de dificultades, un entorno de lucha... siempre una batalla cuesta arriba”, nos dice.

Sus experiencias lo llevaron a donde está hoy. “Cuando todo empezó, yo tenía como 13, 14 años... con esta libertad de ser un niño en la naturaleza salvaje de las calles... Mi papá tenía dos trabajos, mi mamá tenía dos trabajos... Ellos nos amaban, pero era difícil para ellos ser padres porque siempre estaban trabajando”.

Cuando tenía que tomar muchas decisiones siendo un niño, “Nadie me enseñó cómo tomar una decisión sabia basada en mi futuro. Siempre se basó en cómo puedo hacerme sentir mejor, seguro y feliz en ese momento”, dice.

“Me convertí en un perpetrador. Me convertí en un maleante… Y no fue bueno”. rubey Lopez’s father was a seasonal agricultural worker in avocados in the North County, from the state of Guerrero. He took advantage of the immigration reform in 1986 to bring his family to the United States, including his six-year-old son Erubey, who grew up in Vista.

“Back then…the border was different,” he told North County Informador.

Today, people’s problems are not just immigration. “They need somebody who understands their life and their struggles,” said Lopez. “The Law tries to take away our dignity. … That can be dehumanizing.”

Lopez, who attended UCLA Law School, does what he can to “get in touch with their human struggle.”

He told, us, “When I go to court, a lot

of times people don’t have as strong a case as they hoped. And they just want to be treated fairly.”

Today, he works mainly with adjustments, family petitions, and citizenship processes and is confident he can deliver to his clients what they want and need. “People want to be told that they have a winning case. And when they don’t, I don’t want to give them expectations…”

He recommends an individual approach. “This issue is important enough that you should not know what is good for everyone, but you should know what is good for you,” he said.

For that, he said, it is best to talk to an immigration attorney about your particular case.

He said immigration has changed and people are being misled. People WWW.NORTHCOUNTYINFORMADOR.COM

used to come and hide in the shadows, but today many people come with “absolutely nothing. They show up at the border completely destitute trying to be let in, with the expectation that there is something for them. And there is nothing for them, for the most part,” he said. “They’re stuck at the border in the cold… they were chasing a false hope.”

Still, he recommends getting all the facts by talking to an immigration attorney.

“If you try hard enough, you’re going to find an attorney or a notario who will give you the false hope that you need,” he said, but “Being undocumented is the biggest obstacle in your life. It needs to be important enough for you to have an individualized look at your case.”

dward “Ed” Perez is an immigration attorney with an office in Chula Vista; on Fridays he shares an office in Vista with Las Valientes.

Edward says he is an Immigration Attorney because of “a sense of responsibility on my part, that my parents were undocumented when they first came into the country, and except for winning life’s lottery and being born in this country, my life would’ve been different.”

Once a deputy sheriff in Imperial Beach, he became a lawyer, a prosecutor, and then a criminal defense attorney, which introduced him to Immigration Law. Besides his private practice law

offices, Perez is an assigned counsel for the San Diego County Office of Assigned Counsels, through which the county offers pro bono legal services for immigration detainees or immigration matters. And he volunteers at the Mexican Consulate.

Pérez recommends talking to two or three attorneys. “After you talk to a few, they’ll pretty much tell you about the same thing. Whatever your matter is. That’s how you know if you’re on the right track,” he said.

Perez warns people to be wary of fraud. “There’s a lot of people doing legal work, like family petition things, and even asylum claims, who are not attorneys.” So, in the state of California, they are allowed to be ‘document preparers’,

but they’re not allowed to actually take a set of facts and apply the law…And that’s where people get in trouble.”

He warns that taking the wrong path “comes out more expensive in the long run.” If you sign something, you are responsible even if you don’t understand what you’re signing.

He notes that the best course of action is to talk to an attorney about your options. “I always tell people that my job is to tell you the truth, not what you want to hear.”

Also, he said, “The law may change.

DACA, we didn’t see DACA coming. If you were law-abiding, that door is still open to you, but if you went and got into shenanigans, then you’re going to miss the boat.”

first generation MexicanAmerican, Maricela Amezola was born to migrant parents and witnessed the raids in the Central Valley. “The farmers on Fridays would call back in the eighties, and even early nineties, they would call Immigration instead of paying their workers.”

Today, she is an immigration attorney. “I took my first pro bono case out of the detention facility representing an individual who was losing their green card and was going to be deported. And I won that case…

It felt surreal that this family now was hugging me…”

Later, she opened her own firm, where she says she “started from zero…”

Soon, she was winning every case.

Today, she also works with nonprofits like Universidad Popular,

offering her services and explaining people’s rights to them, while advocating for more Spanish-speaking lawyers in general.

“Our goal is to try to naturalize as many people as we can because there are so many green card holders that don’t have enough information as to really what you need to become a US citizen, or sometimes they’ve just relied on what the neighbor or the compadre the comadre are telling them as to why they shouldn’t apply. And that a lot of times is just fake rumors,” she said.

Amezola also warns people to choose representation carefully.

She explains that, unlike notarios, attorneys offer liability protection. “If we mess up…As attorneys, we have a higher burden. We definitely need to make sure that we do things right.”

For low or no-cost help, she recommends nonprofit organizations.

“At least these nonprofits for the most part are tied to lawyers.”

She added that reputable attorneys have good reviews from past clients.

Amezola has a good deal of experience talking to the community about their rights. “An hour and a half presentation, followed by sometimes having the ACLU present as well to provide pamphlets and other information or resources that they can carry with them.”

Today, it can be more difficult to have access to people being deported, so she says it is important to plan ahead. “Let’s fill them up with information so they know what their rights are, those that do have a right to fight. And have them fight,” she said.

HOPE IN IMMIGRATION Maricela Amezola told us about a client who came to the United States in the early 1990s and became a victim of fraud, but later saw success.

A notorio filed a frivolous asylum application for him, along with several fake documents, and the client was completely unaware. He never received notifications because they all went to the notario, who did not inform him.

By the time he visited Amezola around 2015, he told her, ‘I just need to know what’s going on with my case. I just remember I paid this guy…” He has signed something without knowing what it meant.

Amezola recognized the name of the notario, who had been prosecuted for fraud. Even though the client then had a deportation order, Amezola was able to team up with the Office of Chief Counsel in Los Angeles to file a motion to reopen the case and dismiss it, based on the prosecution of the notario involved.

“Not only were we going to take away the deportation, he was going to be here, be able to get a green card,” said Maricela.

Through a series of legal actions, he was eventually able to become a US citizen, which he celebrated with his child who is in the military. “…and just the glow on his face of how proud he was that he was now a US citizen…”

l padre de Erubey López era un trabajador agrícola temporal en aguacates en el Condado Norte, procedente del estado de Guerrero.

Aprovechó la reforma migratoria de 1986 para traer a su familia a Estados Unidos, incluido su hijo Erubey, de seis años, quien creció en Vista.

“En ese entonces… la frontera era diferente”, dijo Erubey Lopez a North County Informador.

Hoy, la gente tiene más problemas que solo la inmigración. “Necesitan a alguien que entienda su vida y sus luchas”, dijo López. “La Ley trata de quitarnos la dignidad. … Eso puede ser deshumanizante”.

López, quien asistió a la Facultad de Derecho de la UCLA, hace lo que puede para “ponerse en contacto con su lucha humana”.

Nos dijo: “Cuando voy a la corte, muchas veces las personas no tienen un caso tan sólido como esperaban. Y solo quieren

ser tratados con justicia”.

Hoy, trabaja principalmente con ajustes, peticiones familiares y procesos de ciudadanía y confía en poder entregar a sus clientes lo que quieren y necesitan.

“La gente quiere que le diga que tiene un caso ganador. Y cuando no es el caso, no quiero darles falsa esperanza…”

Recomienda un enfoque individual.

“Este tema es lo suficientemente importante como para no saber lo que es bueno para todos, sino saber lo que es bueno para ti”, dijo. Para eso, dijo, lo mejor es hablar con un abogado de inmigración sobre su caso en particular.

Dijo que la migración ha cambiado y que hay muchas estafas. Antes, la gente venía y se escondía en las sombras, pero hoy muchos vienen sin “absolutamente nada. Se presentan en la frontera completamente desamparados tratando de que los dejen entrar, con la expectativa de que haya algo para ellos. Y no hay nada para

ellos, en su mayor parte”, dijo. “Están atrapados en la frontera en el frío… estaban persiguiendo una falsa esperanza”.

Aun así, recomienda obtener todos los datos al hablar con un abogado de inmigración.

“Si te esfuerzas lo suficiente, encontrarás un abogado o un notario que te dará la falsa esperanza que necesitas”, dijo, pero, “Ser indocumentado es el mayor obstáculo en tu vida. Tiene que ser lo suficientemente importante como para que tengas una visión individualizada de tu caso”.

dward “Ed” Pérez es un abogado de migración con una oficina en Chula Vista; los viernes comparte una oficina en Vista con Las Valientes.

Pérez dice que es un abogado de inmigración debido a “un sentido de responsabilidad de mi parte, ya que mis padres eran indocumentados cuando llegaron por primera vez al país, y al no haber ganado la lotería de la vida y haber nacido en este país, mi vida habría sido diferente.”

Una vez fue ayudante del alguacil en Imperial Beach; después, se convirtió en abogado fiscal y más tarde en abogado defensor penal, lo que lo incursionó en la Ley Migratoria.

Además de su bufete de abogados, Pérez es abogado asignado de la Oficina de Abogados Asignados del Condado de San Diego, a través de la cual el condado ofrece servicios legales pro bono para inmigrantes detenidos o en asuntos de migración. Y es voluntario en el Consulado de México.

Pérez recomienda hablar con dos o tres abogados.

“Después de hablar con algunos, prácticamente te dirán lo mismo. Sea cual sea tu asunto. Así es como sabes si estás en el camino correcto”, dijo.

Pérez advierte a la gente que tenga cuidado con el fraude. “Hay mucha gente haciendo trabajo legal, como peticiones familiares e incluso solicitudes de asilo, que no son abogados”. Entonces, en el estado de California, se les permite ser ‘preparadores de documentos’, pero no se les permite considerar los hechos y aplicar la ley...

Y ahí es donde la gente se mete en problemas”.

Advierte que tomar el camino equivocado “sale más caro a la larga”. Si usted firma algo, es responsable aun cuando no entienda lo que está firmando.

Señala que el mejor curso de acción es hablar con un abogado acerca de sus opciones. “Siempre le digo a la gente que mi trabajo es decirte la verdad, no lo que quieres escuchar”.

Además, dijo, “La ley puede cambiar. DACA, no vimos venir DACA. Si usted hizo caso a las leyes, esa puerta todavía está abierta para usted, pero si fue y se metió en líos, entonces se perderá el tren”.

na mexicoamericana de primera generación, Maricela Amezola nació de padres inmigrantes y fue testigo de las redadas en el Valle Central. “Los agricultores los viernes, en los años ochenta, e incluso a principios de los noventa, llamaban a Inmigración en lugar de pagarles a sus trabajadores”.

Hoy es abogada de inmigración.

“Saqué mi primer caso pro bono del centro de detención representando a una persona que estaba perdiendo su tarjeta de residencia e iba a ser deportada. Y gané ese caso… Se sentía surrealista que esta familia ahora me abrazara…”

Más tarde, abrió su propio bufete, donde dice que “empezó de cero…” Pronto, estaba ganando todos los casos.

Hoy, también trabaja con organizaciones sin fines de lucro como Universidad Popular, ofreciendo sus servicios y explicando los derechos de las personas, mientras lucha por más abogados de habla hispana en general.

“Nuestro objetivo es tratar de naturalizar a tantas personas como podamos porque hay tantos titulares de tarjetas verdes que no tienen suficiente información sobre lo que realmente necesitan para convertirse en ciudadanos estadounidenses, o a veces simplemente se han basado en lo que el vecino o el compadre o la comadre les están diciendo de por qué no deben hacer la solicitud.

Y muchas veces son rumores falsos”, dijo.

Amezola también advierte a las personas que elijan la representación con cuidado. Explica que, a diferencia de los notarios, los abogados ofrecen protección de responsabilidad. “Si nos equivocamos… Como abogados, tenemos una carga mayor. Definitivamente tenemos que asegurarnos de hacer las cosas bien”.

Para obtener ayuda a bajo costo o sin costo, recomienda organizaciones sin fines de lucro. “Al menos estas organizaciones sin fines de lucro en su mayor parte están vinculadas a abogados”.

Agregó que los abogados de renombre tienen buenas recomendaciones de clientes anteriores.

Amezola tiene mucha experiencia hablando con la comunidad sobre sus derechos. “Una presentación de hora y media, seguida de la presencia a veces de la ACLU para proporcionar folletos y otra información o recursos que puedan llevarse”.

Hoy en día, puede ser más difícil tener acceso a las personas que están siendo deportadas, por lo que dice que es importante planear. “Vamos a llenarlos de información para que sepan cuáles son sus derechos, los que sí tienen derecho a luchar. Y que peleen”, dijo.

UNA HISTORIA DE ESPERANZA Maricela Amezola nos contó sobre un cliente que vino a Estados Unidos a principios de la década de 1990 y fue víctima del fraude, pero más tarde tuvo éxito.

Un notario presentó una solicitud de asilo frívola para él, junto con varios documentos falsos, y el cliente no estaba al tanto. Nunca recibió notificaciones porque todas llegaron con el notario, quien no le informó.

Cuando visitó a Amezola en 2015, le dijo: ‘Solo necesito saber qué está pasando con mi caso. Solo recuerdo que le pagué a este tipo…” Había firmado algo sin saber lo que significaba.

Amezola reconoció el nombre del notario, que había sido procesado por estafa. Aunque el cliente tenía una orden de deportación, Amezola pudo asociarse con la Oficina del Abogado Principal en Los Ángeles para presentar una moción para reabrir el caso y desestimarlo, con base en el enjuiciamiento del notario involucrado.

“No solo íbamos a quitarle la deportación, él iba a estar aquí, podría obtener una tarjeta verde”, dijo.

A través de una serie de acciones legales, finalmente pudo convertirse en ciudadano estadounidense, lo que celebró con su hijo, quien estaba en el ejército. “…y solo le brillaba su rostro de lo orgulloso que estaba de ser ahora un ciudadano estadounidense…”
