VALLARTA INSURANCE DAY 2020 WILL FEATURE A SERIES OF CONFERENCES RELATED TO AUTO, HOME, BOAT, HEALTH AND TRAVEL INSURANCE PROGRAMS.

ON FRIDAY, FEBRUARY 28, 2020, Novamar Insurance Mexico will hold the fourth edition of Vallarta Insurance Day at the Sheraton Buganvilias Resort & Convention Center. This free admission event, scheduled to take place from 9:00am to 5:00pm, is intended to publicize the insurance policies available in the region, as well as their most recent updates, coverage and claims processes.

Vallarta Insurance Day 2020 will feature national and international representatives from the best insurance companies, who will hold a series of conferences related to auto, home, short-term rental, boat, health and travel insurance programs.

Iñiguez shared that his first closing motivated him to prepare more to become one of the agency’s top real estate agents, a goal he accomplished in the short term. “It was very gratifying when Claudio Leone (CEO of Domus Fine Real Estate) commented that my sales volume was high, as that reaffirmed my capacity for marketing. This was the main reason I decided to focus on boosting the promotion of PUERTARENA, the new real estate project my family is working on.”

PUERTARENA “This is a well located development, offering spacious two and three bedroom apartments. It is a project that I trust and even more so because, since my arrival in March 2019, sales began to be more dynamic, so much so that we have already sold the entire first phase, which has caused the delivery of these units to be in June 2020, some months earlier than expected. MEXICO’S NATIONAL DOMAIN EXTINCTION LAW LEY NACIONAL DE EXTINCIÓN DE DOMINIO By / Por Jorge Chávez

To learn what it is and the implications of the new National Domain Extinction Law, Vallarta Real Estate Guide visited Débora Espinosa, an independent bilingual lawyer, who explained its origins, as well as the rules and assets that are subject to this legal mechanism. Para conocer en qué consiste y las implicaciones que conlleva la nueva Ley Nacional de Extinción de Dominio, Vallarta Real Estate Guide visitó a Débora Espinosa, abogada independiente bilingüe, quien explicó sus orígenes, así como las reglas y bienes que están sujetos a esta figura legal.

THE PUBLICATION OF THE LEY NACIONAL DE EXTINCIÓN DE DOMINIO (LNED) (National Domain Extinction Law) created a stir among the representatives of the private initiative a few months ago; however, this legal mechanism already existed in Mexican legislation. This new law replaces the Federal Domain Extinction Law and the 32 local laws that existed on the matter.

The scope of this new law is stricter and more precise than the previous versions, as it is a legal resource with which the government plans to combat organized crime and its various cells more efficiently.

To learn what it is and the implications it entails, we visited Débora Espinosa, an independent bilingual lawyer graduated from the University of Guadalajara with a master’s degree in Tax Analysis who works in the fiscal, administrative, real estate and immigration fields.

ORIGIN OF THE NATIONAL DOMAIN EXTINCTION LAW “This law arises following a request made by the United States through the United Nations (UN). As the general development of Latin America is sought, they proposed that all Latin countries adopt this model law in their legal systems. On the other hand, since 2008, important reforms in Mexico have been very significant, as our old inquisitorial criminal system has changed to an accusatory and adversarial one, where more parties intervene with the objective of combating corruption and compensating the victims,” she explains.

WHAT IS DOMAIN EXTINCTION? “It is the legal instrument with which a person can lose the right to own property of illicit origin and/or used to commit illegal acts. The assets pass to the power of the State, after the sentence of a judicial authority, without any type of compensation or consideration for its owner or whomever for any circumstance possesses said property. With the sale of these assets, the government seeks to compensate and/or repair the damage to the victims.”

This mechanism was introduced in Mexico in 2008 through the reform of Article 22 of the Constitution.

LA PUBLICACIÓN DE LA LEY NACIONAL DE EXTINCIÓN DE DOMINIO (LNED) creó cierto revuelo entre los representantes de la iniciativa privada hace unos meses; sin embargo, esta figura legal ya existía con anterioridad en la legislación mexicana.

Esta nueva ley sustituye a la Ley Federal de Extinción de Dominio y a las 32 leyes locales que había al respecto.

Los alcances de esta nueva ley son más estrictos y precisos que las versiones anteriores, pues se trata de un recurso jurídico con el que el gobierno planea combatir de manera más eficiente al crimen organizado y sus diversas células. Para conocer en qué consiste y las implicaciones que conlleva, visitamos a Débora Espinosa, abogada independiente bilingüe egresada de la Universidad de Guadalajara con una Maestría en Análisis Tributario, quien se desenvuelve en el ámbito fiscal, administrativo, bienes raíces y migratorio.

ORIGEN DE LA LEY NACIONAL DE EXTINCIÓN DE DOMINIO “Esta ley surge a raíz de una solicitud que hizo Estados Unidos a través de la Organización de las Naciones Unidas (ONU). Como se busca el desarrollo general de América Latina, propusieron que todos los países latinos adoptaran esta ley modelo en su sistema legal. Por otra parte, a partir de 2008, en México se han tenido reformas muy importantes que han sido muy trascendentes, pues nuestro antiguo sistema penal inquisitorio ha cambiado a uno acusatorio y adversarial, donde intervienen más sujetos con el objetivo de combatir la corrupción y resarcir el daño a las víctimas”, explica.

Los bienes pasan al poder del Estado, luego de la sentencia de una autoridad judicial, sin ningún tipo de compensación o contraprestación para su propietario o para quien por cualquier circunstancia posea dichos bienes. Con la venta de estos bienes, el gobierno busca resarcir y/o reparar el daño a las víctimas”.

Esta figura se introdujo en México en 2008 a través de la reforma al Artículo 22 constitucional.

“Good faith is a fundamental principle in law that implies acting with honesty and rectitude to perform actions with good intentions, without altering or damaging the rights of another,” explains our expert.

In order to enjoy the good faith of the destination and acquisition of the goods, the defendant and/or affected persons must sufficiently prove the following: • That the document is dated and prior to the occurrence of the illicit act, in accordance with the applicable regulations;

Although many people have the talent and skills for interior design, Gallo and Pérez say that professional advice is a great help to save time and make the most of the space where a successful business will be developed.

“Having the advice of professionals is very helpful for businesses that are just starting out, because when you hire an interior design studio, the owner can rest assured that the project will be completely finished in two to four weeks, especially if it’s someone who rents the space, because time plays a crucial role there,” says Pérez.

“Opening any business is a risk; therefore, it is necessary to have good advice, which should be seen as an investment, because in the end it is something that will generate more profits.

A person who is professionally dedicated to decoration can correctly distribute three or four durable elements and create a great impact on the future client,” adds Gallo.

“La apertura de cualquier negocio es un riesgo y por ello es necesario contar con una buena asesoría, la cual debe ser vista como inversión, pues al final es algo que generará más ganancias. Una persona que se dedica de forma profesional a la decoración puede distribuir correctamente tres o cuatro elementos duraderos y crear un gran impacto en el futuro cliente”, complementa Gallo.

Both designers concur that it is a multidisciplinary job that must be done as a team to save time and ensure that everything is carried out efficiently.

Ambos diseñadores aseguran que se trata de un trabajo multidisciplinario que debe realizarse en equipo para economizar tiempo y que todo se lleve a cabo de manera eficaz.

RETROALIMENTACIÓN

According to Gallo and Pérez, once the project is completed and the business opens its doors, a feedback period is necessary, in which the different elements implemented in the design are analyzed to combine harmoniously.

De acuerdo con Gallo y Pérez, una vez que el proyecto queda concluido y el negocio abre sus puertas, es necesario contar con un período de retroalimentación en el que se analicen que los distintos elementos implementados en el diseño combinen de una manera armónica.

“A period of six months is usually provided for the owner to analyze the needs of his business. Most of the cases are adjustments or complements to what you already have, but this does not mean that you have to redesign from scratch, rather they are issues that may not have been thought of, because sometimes the place exceeds the contemplated capacity of customers or products and it is necessary to add some other furniture,” explains Pérez.

“I consider that feedback period to be the most important phase because certain details are refined then, such as the rearrangement of some decorative elements to make them more attractive.

Ultimately, the design must always be consumer-oriented, since they are the final judges, because the goal of the store is to make the customer feel comfortable with the brand and return regularly,” adds Gallo.

REMODELING Gallo and Pérez agree that once the business has gained a certain degree of recognition for its design, it is advisable to avoid drastic changes in appearance, since these can cause confusion for the consumer.

“In reality, there is no set time, especially if the project has been well developed, because this is how the brand is positioned and people begin to relate to it through certain details such as the range of colors, its decorative elements or even its aromas.

That is why good advice is important, because in addition to providing good space management, an expert knows the materials that are durable and will remain in place,” says Gallo.

“Por lo regular se brinda un tiempo de seis meses para que el propietario analice las necesidades de su negocio. La mayoría de los casos se trata de ajustes o complementos a lo que ya se tiene, pero esto no quiere decir que se tenga que rediseñar desde cero, sino que son cuestiones que posiblemente no se tenían en mente, pues a veces el lugar rebasa la capacidad de clientes o productos que se tenían contemplados y es necesario agregar algún otro mueble”, explica Pérez.

“Considero que la retroalimentación es la fase más importante porque allí se afinan ciertos detalles, como el reacomodo de algunos elementos decorativos para que resulten más atractivos. A fin de cuentas, el diseño siempre debe estar pensado en los consumidores, quienes son los últimos jueces, porque el objetivo de la tienda es hacer que el cliente se sienta cómodo con la marca y regrese paulatinamente”, añade Gallo.

REMODELACIÓN Gallo y Pérez coinciden en que una vez que el negocio ha ganado cierto grado de reconocimiento por su diseño, es conveniente evitar cambios drásticos de apariencia, ya que estos pueden causar confusión al consumidor.

“En realidad no existe un tiempo determinado, en especial si se hizo un buen desarrollo de proyecto, porque así se posiciona la marca y las personas comienzan a relacionarla por algunos detalles como la gama de colores, sus elementos decorativos o incluso sus aromas. Por ello es importante una buena asesoría, porque además de brindar un buen manejo del espacio, un experto conoce los materiales que son duraderos y continuarán vigentes”, comenta Gallo.

ONCE THE BUSINESS HAS GAINED A CERTAIN DEGREE OF RECOGNITION FOR ITS DESIGN, IT IS ADVISABLE TO AVOID DRASTIC CHANGES IN APPEARANCE, SINCE THESE CAN CAUSE CONFUSION FOR THE CONSUMER.

“After the feedback stage, once you check that the design and product work well together, the only thing you have to do is preventive maintenance, so there is no need to redesign or buy new furniture in a short time, because the fact that the business changes its image in a constant or radical way, even if it retains the same name, can be confusing for consumers, who might wonder if it’s the same store, if the business line is different or if the owners have changed,” adds Pérez.

IDEAL DESIGN AND DECORATION Before concluding our visit to DECO Designers, Gallo and Pérez mentioned that the ideal design and decoration project is one that manages to make a connection between the product and the space where it is presented, with balanced elements.

“Basically, it is about matching all the elements to achieve a balance that combines the tastes of the owners, covers the needs of the space, represents what is offered and is attractive to those who are going to buy,” Gallo concludes.

“There must definitely be a balance between the brand, the product and the space, with the idea of the design respecting and enhancing the essence of the product so that it is pleasing to customers and they want to come back more frequently,” concludes Pérez.

“Después de la etapa de retroalimentación, una vez que se comprueba que el diseño y el producto se llevan bien, lo único que se debe hacer es un mantenimiento preventivo de las cosas, para que no haya necesidad de hacer rediseños o comprar muebles nuevos en poco tiempo, pues el hecho de que el negocio cambie su imagen de forma constante o radical, aunque conserve el mismo nombre, puede llegar a ser confuso para los consumidores, quienes se podrían preguntar si se trata de la misma tienda, si el giro comercial es distinto o si cambiaron los dueños”, añade Pérez.

DISEÑO Y DECORACIÓN IDEAL Antes de finalizar nuestra visita a DECO Designers, Gallo y Pérez mencionaron que el proyecto de diseño y decoración ideal es aquel que logra hacer una conexión entre el producto y el espacio en donde se presenta, con elementos balanceados.

“Básicamente se trata de cuadrar todos los elementos para lograr un equilibrio que combine los gustos de los propietarios, que logre cubrir las necesidades del espacio, que represente lo que se ofrece y resulte atractivo para quien vaya a comprar”, finaliza Gallo.

“Definitivamente debe existir un equilibrio entre la marca, el producto y el espacio, que la idea del diseño respete y potencialice la esencia del producto para que sea agradable a los clientes y deseen regresar con mayor frecuencia”, concluye Pérez.

El desarrollo de proyectos que disminuyan el consumo energético, promuevan la energía renovable, reduzcan residuos/emisiones y mejoren la calidad de vida de las personas se ha convertido en la directriz de la arquitectura actual.

SUSTAINABILITY IS AN AGENT OF CHANGE FOR CITY PLANNING, WHERE PRIORITY IS GIVEN TO THE REUSE OF RESOURCES, RENEWABLE NATURAL RESOURCES AND SOCIAL INTEGRITY.

SUSTAINABLE CONSTRUCTION HAS GAINED prominence in the country as a factor in transforming people’s quality of life, since it is part of a sustainable vision aimed at satisfying the needs of the market and achieving, in a balanced manner, economic and social development, as well as protection of the environment.

For Víctor Ramírez Orozco, sustainability manager at Construcciones Sustentables Orendain (CSO), in the field of architecture and construction, sustainability is an agent of change for city planning, where priority is given to the reuse of resources, renewable natural resources and social integrity.

“For example, in the care of water, how can we make the new developments require less drinking water? How are we going to reduce that? With rainwater collection, but at the city level.”

LA CONSTRUCCIÓN SUSTENTABLE EN EL PAÍS ha ganado protagonismo como factor para la transformación de la calidad de vida de las personas, pues es parte de una visión sostenible que busca satisfacer las necesidades del mercado e intenta lograr, de manera equilibrada, el desarrollo económico y social, así como la protección al medio ambiente.

Para Víctor Ramírez Orozco, gerente de sustentabilidad de Construcciones Sustentables Orendain (CSO), desde el campo de la construcción, la sustentabilidad es un agente de cambio en la planificación de las ciudades, donde se prioriza la reutilización de los recursos naturales renovables, la redensificación y la integridad social.

“Por ejemplo, en el cuidado del agua, ¿cómo hacer para que los nuevos desarrollos requieran menos agua potable?, ¿cómo vamos a reducir eso?, pues con captación pluvial, pero a nivel ciudad”.

In addition to water, another major aspect of the reuse of resources to consider in sustainable constructions (and demanded by regulations and certifications) is reducing energy consumption, which is determined by the architectural design of the project.

“That is, if the largest facade faces west, I know that I will get more heat and, therefore, the air conditioning will work harder, translating into higher energy consumption. So, a well-executed architectural design requires less energy.”

Ramírez says that sustainability depends not only on how the building is used, but also on how it is planned and constructed. During these stages, a large interdisciplinary team focuses on specific areas that help to minimize execution times, avoid planning errors and improve action plans.

“The issue of sustainability has to be considered before drawing the first lines of the project. The ideal design method for a sustainable building is the integrative process, an interdisciplinary exercise where everyone participates. If you include the air-conditioning specialist when the design is already very advanced, you cannot contribute the same as if you had involved him from the beginning.”

The sustainability manager of CSO, a consultancy firm and developer of sustainable projects in the Guadalajara city, notes that these teams are made up of contractors, architects and

“Esto es, si la fachada más grande está hacia el poniente, de entrada, ya sé que voy a recibir más calor y, por lo tanto, el aire acondicionado se va a esforzar más, traduciéndose en un consumo energético más alto. Entonces, un diseño arquitectónico bien llevado a cabo requiere menos energía”.

Ramírez Orozco compartió que la sustentabilidad radica no solo en cómo se usa el edificio, sino también en cómo se planea y se construye. Durante estas etapas interviene un amplio equipo interdisciplinario enfocado a áreas específicas que ayudan a minimizar tiempos de ejecución, evitar errores de planificación y mejorar planes de acción.

“El tema de sustentabilidad se tiene que considerar desde antes de poner las primeras líneas de dibujo en el proyecto.

El método de diseño ideal para un edificio sustentable es el proceso integrativo, que es un ejercicio interdisciplinario donde todos opinan. Si tú incluyes al especialista del aire acondicionado cuando el diseño ya va muy avanzado, no podrá aportar lo mismo que si lo hubieras involucrado desde el inicio”.

El gerente de sustentabilidad de CSO, empresa asesora y constructora de proyectos sustentables en la ciudad de Guadalajara, dijo que estos equipos están conformados por contratistas, arquitectos y proveedores, además de otros perfiles que, de la mano de la tecnología, han encontrado un nicho de oportunidad

THE PRACTICE GAINS STRENGTH Although it is true that sustainable construction is not a new practice, it has gained strength at the local and national levels over the last seven years due to various factors, among them society’s demand for eco-friendly spaces and economic payback from multiple fiscal incentives.

“A fiscal incentive can be obtained when you collect rainwater or reuse the water in your building. With this you can get a 10 percent reduction. Another incentive is when you reduce the consumption of energy.”

Ramírez says that, based on these incentives, the number of projects seeking sustainability has multiplied.

“Although it is a significant capital outlay at the beginning, in the long run it brings greater benefits. Some see the opportunity in making a larger investment at first, because they know that by investing now, significant savings will be obtained in the future. There will be solar cells and bathroom fixtures that will reduce water consumption. It is true that at the beginning you will spend more, but you will recoup it in operation and maintenance.”

“Anteriormente, el arquitecto era un todólogo que decía: ‘Yo voy a hacerte un diseño sustentable’; sin embargo, desde hace 20 años se empezaron a formar oficinas especializadas para asesorar exclusivamente en el tema de la sustentabilidad”.

PRÁCTICA QUE TOMA FUERZA Si bien es cierto que la construcción sustentable no es una práctica nueva, durante los últimos siete años ha tomado fuerza a nivel local y nacional por diferentes factores, entre ellos la fuerte demanda de la sociedad por ocupar espacios en pro del medio ambiente y la retribución económica por los múltiples incentivos fiscales.

“Un incentivo fiscal se puede obtener cuando captas agua de lluvia o reutilizas el agua de tu edificio. Con esto puedes tener un 10 por ciento de descuento en el pago del predial. Otro incentivo que también se obtiene es cuando reduces el consumo de tu energía”.

Ramírez Orozco dijo que a partir de esos incentivos se ha multiplicado el número de proyectos que buscan la sustentabilidad: “Aunque al principio es un desembolso de capital importante, a largo plazo trae mayores beneficios. Hay quien ve como oportunidad hacer, en un primer momento, una inversión más alta, porque culturalmente se sabe que al invertir ahora se obtendrán ahorros significativos en el futuro. Se va a invertir más porque habrá celdas solares y muebles de baño que reducirán el consumo de agua. Es cierto, al inicio vas a gastar más, pero te lo vas a ahorrar en la operación y mantenimiento”.

Para Ramírez Orozco, la construcción sustentable es una realidad que, aunque comenzó a visualizarse en otros países desde los 60, en México ha crecido fuertemente en los últimos años a partir de un proceso de evolución que comenzó con la necesidad de cuidar el medio ambiente y satisfacer las necesidades de la sociedad, la creación de normativas públicas por parte del gobierno y la implementación de certificaciones internacionales, así como la puesta en marcha de prácticas sustentables por parte de la industria de la construcción.
