l martes 4 de junio, el presidente Joe Biden firmó una orden ejecutiva que cierra de manera temporal la entrada de solicitantes de asilo a través de la frontera con México. La decisión afecta a los miles de migrantes que todos los días solicitan asilo, un remedio legal que protege a personas que han sufrido persecución en sus países de origen. ¿Qué significa la nueva orden de Biden de cerrar temporalmente la frontera si está buscando asilo? Las acciones ejecutivas firmadas por Biden “prohíben a los migrantes que crucen la frontera sur de manera ilegal para recibir asilo”. Estas acciones, explica la Administración, “entrarán en vigor cuando se registren altos niveles de encuentros (detenciones) en la frontera con México que excedan nuestra capacidad de procesarlos oportunamente, como ocurre hoy”. Conforme la nueva decisión, la frontera con México se cerrará para solicitantes de asilo una vez que el promedio semanal de entradas ilegales llegue a 2,500 por día. Actualmente los ingresos ya superan esa cifra. El decreto otorga además un mayor poder discrecional a los agentes de inmigración “para deportar a aquellos extranjeros
que no tienen una base legal para permanecer en el país”. En contraposición, hasta la sanción de esta orden ejecutiva, los solicitantes de asilo tenían permitido esperar la tramitación de su caso en los Estados Unidos, lo cual les permitía vivir años en el país y acceder a permisos de trabajo mientras aguardaban. Ahora los agentes fronterizos podrán devolver a los migrantes a través de la frontera hacia México en cuestión de horas o días. El documento emitido por la Casa Blanca, sin embargo, advierte que “esto no puede lograr los mismos resultados que la acción del Congreso, y tampoco proporciona el personal crítico ni los fondos necesarios para asegurar aún más la frontera sur”. Pero el legislativo “aún tiene tiempo para actuar”, precisa. ¿Hasta cuándo permanecerá cerrada la frontera con México para solicitantes de asilo? Según lo establecido en la orden ejecutiva, la frontera con México recién se abrirá para solicitantes de asilo una vez que el número de cruces disminuya significativamente. La cifra tendría que mantenerse por debajo de un promedio diario de 1,500 durante siete días seguidos. Recién dos semanas después de registrar esa cifra se abrirá nuevamente la frontera.

n Tuesday, June 4, President Joe Biden signed an executive order temporarily closing asylum seekers entry through the border with Mexico. The decision affects thousands of migrants who every day apply for asylum, a legal remedy that protects people who have suffered persecution in their countries of origin. What does Biden’s new order to temporarily close the border mean if you’re seeking asylum? The executive actions signed by Biden “prohibit migrants from illegally crossing the southern border to receive asylum.” These actions, the Administration explains, “will come into force when there are high levels of encounters (detentions) on the border with Mexico that exceed our capacity to process them in a timely manner, as is the case today.” Under the new decision, the border with Mexico will be closed to asylum seekers once the weekly average of illegal entries reaches 2,500 per day. Currently the crossings already exceed that figure. The executive order also gives immigration agents greater discretionary pow-
er “to deport those aliens who do not have a legal basis to remain in the country.” In contrast, until the enactment of this executive order, asylum seekers were allowed to wait for their case to be processed in the United States, which allowed them to live in the country for years and access work permits while they waited. Now border agents will be able to return migrants across the border into Mexico in a matter of hours or days. The document issued by the White House, however, warns that “this cannot achieve the same results as congressional action, nor does it provide the critical personnel or funding necessary to further secure the southern border.” But the legislature “still has time to act.” How long will the border with Mexico remain closed to asylum seekers? As established in the executive order, the border with Mexico will only be opened to asylum seekers once the number of crossings decreases significantly. The figure would have to stay below a daily average of 1,500 for seven consecutive days. Only two weeks after registering that figure will the border be reopened.
