SOME OTHER GUY’S OPINION By Phil Thornberry

Since I was 22, I have been a contractor, inspector, or instructor in some capacity. Early on, my knowledge base was limited, but luckily, through research, I was able to fill in the gaps and expand my knowledge beyond a basic “just good enough” level. Most people are perfectly capable of doing the same. Unfortunately, capability to research does not always coincide with the will to do it.

What I have found in my professional life is that many who can research, choose not to, even when they should. I have heard it said that instructions are just “some other guy’s opinion.” Other favorites are “we’ve been doing it that way for 30 years” and “they don’t require that here.” Construction, like most fields, has rules or “codes,” as they are commonly referred to. Codes are a minimum standard. There are codes for just about all aspects of construction. Most of these also indicate that all manufactured products should be installed per the manufacturer’s instructions. You might ask why a home inspector is writing about these things when codes and manufacturer’s instructions are not required to be reported on by the industry or even the Home Inspector License Law. My answer is: it is hard to separate our job from at least some of these. I have also been the victim of this issue. Many of the things that we report on are safety-related and are covered in the codes and manufacturer’s instructions as well. Inspectors are constantly challenged by contractors on both sides of an issue.

Roof shingles -The nailing pattern is usually off. By the way, there is a full set of instructions on each shingle package. 2. Ranges without anti-tip devices - Despite being required since 2000, most anti-tip brackets are left in the drawer. 3. Truss and joist hangars - Each hole should have a nail installed in it. 4. Those flexible drainpipes under your sink - Not approved, and yes, they sell them, anyway. Builders today are better than ever when it comes to doing it right. Most issues that I noted occur from contractors hired to work in an existing home. Most homeowners do not know the product, how it should be installed, or what a problematic install looks like. Each contractor working on a home can unknowingly add additional problems to the home. The end result over time is a home that is less safe and reliable than it could be. I will be adding a clause to all my contracts, personal and business. “All work to meet local building codes and normal building practices. All products are to be installed per the manufactures installation instructions.” Also, I recommend you look up the instructions online and know them before the work starts. It is much easier to correct something as it happens than after the job is done. This is also a good reason to hire a home inspector during remodel projects.

Interestingly, home inspectors in Indiana are required to obtain 32 hours of continuing education credits every two years. General, plumbing, electrical, and HVAC contractors have no continuing education requirements. Most contractors are qualified and are serving the public well, but for some, their knowledge is limited and sometimes inspections shed light on this. If there is a difference of opinion, please get both parties together. We want the right answer for your clients. Sometimes, research will be required, but the beauty of all this is that most of the time, the correct answer is written in black and white. By the way, these codes are adopted by the state. There are no exempt areas except federal land and structures. Local governments may adopt additional administrative requirements only if they are more stringent. If you or your client run into a “he said; she said” situation, simply look it up. Here are a few items that are commonly and unknowingly installed incorrectly.

It is hard to believe that it is already December! As I look back at 2021 and my year as president of MIBOR REALTOR® Association, the first thing that comes to my mind is The MIBOR Ball – not just any ball, but a “virtual” ball! To have a party where everyone is invited, but the guests must stay home is really unnerving, to say the least. I must admit that being in the Indiana Roof Ballroom with no guests in attendance and speaking to a video camera was awkward, so I just imagined that all the virtual attendees were out there smiling back at me. I really appreciated all the supportive texts, emails, and calls on the days leading up to the event. One aspect of the ball is the inauguration of the incoming president, which was very exciting. I quickly realized there were two things that were most important to me regarding the Ball, and they had nothing to do with me. It wasn’t about my ballgown or my speech. It was about the award nominees having a special moment and being recognized, and it was about raising funds for the REALTOR® Foundation. The ball normally raises around $70,000 in an average year. The thought of getting close to that amount at a virtual event brought a little pressure, but as they say, “no pressure, no diamonds.” The 2021 event not only raised $65,000, but we were also able to donate 400 meals to homeless Hoosiers in need. Donating the meals was so wonderful, and it added a meaningful touch to the event. All the success of the virtual ball was due to the efforts of the sponsors, supporters, guests, the emcee, entertainers, MIBOR staff, and the ball committee. Not only did we accomplish what we set out to do, but it also turned out better than I could have imagined; it really set the tone for the year. If I had to pick one word to describe 2021, that word would be “collaboration.” The collaborative effort that made the Ball such a success was

something that I have experienced throughout my year as President. All year, MIBOR’s leadership stepped up in so many ways and when it really mattered. That type of commitment from volunteer leaders is inspiring and elevates everyone. I am excited about some of the additions that MIBOR announced this year. First is BrokerBay, a next-generation showing management platform and one of the fastest-growing showing management companies in North America. There are also two new committees that have been added: the diversity, equity & inclusion committee, and the risk reduction committee. The purpose of the DEI Committee is to identify activities to increase diversity within the real estate profession, volunteer leadership, and membership. The purpose of the Risk Reduction Committee is to facilitate discussion and determine areas of risk and related potential legal liability facing members. MIBOR’s position statement was recently released, and the Breaking Barriers Scholarship will be available in 2022. Serving with the leaders in our industry at every level has been so rewarding. I am thankful for the opportunity: from the board room to the committees to the divisions and to all the engaging events – golf outing, mystery dinner, cornhole, coat drive, book drive, REALTOR® Week of Service, and the list goes on. These people and events show our industry and our community how amazing we are when we come together. Tom Peters’ quote, “Leaders don’t create followers, they create more leaders,” really captures MIBOR and the great things that I see happening within our membership. I am looking forward to next year and my role as the immediate past president. I am also excited and grateful to continue to serve with MIBOR’s leaders, to support MIBOR’s 2022 president, Stacy West, and to attend the MIBOR Ball on January 22, 2022! As MIBOR continues to reinvest in our association and in the future of our industry, my call to action to all MIBOR members is to get involved!

Nearly every resident at Pathway to Recovery, a substance-free housing program, has obtained healthcare. Our grantee organizations, such as the O’Connor House in Carmel, provide a continuum of care that lasts long after their residents move out. Many come seeking help with just a few possessions, if any, and move out of their program as independent, self-sufficient, working individuals who can now contribute back to their community. LORI CROSLEY Always Remain a Valuable Asset Lori Crosley is a loyal, fun, hard-working agent who truly cares about others, and she, like many, went through all the stages of grief upon losing a career from a company where she thought she would retire. GINA ROE No Regrets: Everything is a Lesson In the Fellowship of the Ring by J.R.R. Tolkien, there is a saying that “short cuts make long delays.” While most people try to find a way to bypass intense labor and find the easy path, Gina Roe knows that being tenacious and working hard and smart is vital for success. She learned from her seventh-grade teacher that everything in life is a lesson whether good or bad, and so she embraces all that life offers with no regrets and with a positive outlook.

LAURA WATERS It’s Not Just Me; It’s We Helen Keller said, “Alone we can do so little; together we can do so much.” If you were to ask Laura Waters about her emergence on the real estate scene, she would quickly point you to her appreciation of her brokerage and her business partner. TRACY RIDINGS It Is Not Sales; It’s Service When Tracy Ridings was making her decision regarding her next career move, her husband told her that she would really excel at selling real estate. She had the opportunity to speak with the agent who sold them their home, and one phrase became a moment for her – an epiphany. When he said, “I do not see it as sales but rather as service – that is helping others meet their goals,” she was hooked. For Tracy, helping others is a way of life, and the shift to this servant mentality was a game-changer in her professional life.

GABBY O’CONNOR From Surgery to Selling Properties My passion for helping others has been a desire of mine ever since I was a young girl. I grew up with a handicapped brother who has helped shape the person I am today. Growing up with him gave me the opportunity to volunteer in Best Buddies throughout high school, which is where you get to work and hang out with handicapped friends inside and outside of school. During this time, I learned so much about different personalities and how to react during certain situations. This has helped me tremendously in life, and I could not be more thankful! MATTHEW COREY If You Are Happy, I Am Happy! It is what he tells his clients, and Matthew Corey of Carpenter lives it and means it. For Matthew, happy clients not only give repeat business and referrals, but they are part of his reason to sell real estate. “It is great to have a job where I can propel people to a different stage of life. KEVIN DURFEE From Percussion to Discussion Kevin traded some of his quest for percussion (his favorite part of his music education) for discussions with people about their housing needs. He still plays locally with the Indianapolis Brass Choir and Fisher’s Music Works, but his focus now is helping clients solve their housing goals, and he has found his niche. Sure, learning real estate can be a steep curve, and getting started can be a challenge, but Kevin came up with a no-fail plan: just keep talking. He notes that he genuinely loves people, and his honest and sincere conversations with them about their housing plans have led to some great sales.

JAKE BASKER You Be You! “In order to have what you really want; you must first be who you really are.” Tim Grover It was a message or more of a mantra that Jake Basker’s parents taught him while growing up, but it is something that has shaped his life; He teaches it to others whom he mentors today. Dr. Suess said that there is no one who is more “you-er” than you, and we should certainly embrace the unique gifts and talents that we have, celebrate our design and by all means not allow others to make us have doubts. Jake’s philosophy of life allows him to be confident in his pursuits and to create his business in a way that fits him and his clients the best.

JAMES ROBINSON Always on Target! “A person should set his goals as early as he can and devote all his energy and talent to getting there. With enough effort, he may achieve it. Or he may find something that is even more rewarding. But in the end, no matter what the outcome, he will know he has been alive.” Walt Disney James Robinson has always been on target. From the time he was emerging from primary school (elementary school in England), he was developing a clear strategic sense for what he wanted to accomplish on a daily basis, and when he graduated from high school, he took his father’s advice and pursued a job as an “estate agent,” which is comparable to a real estate agent in the USA. His father told James that it was a good occupation for his propensity to talk – a lot.

JOSH NEUMAN If It Hurts, It Is Probably Worth It! Ironically, my mom and dad literally met one another at a closing table. Mom brought the buyer to my dad’s listing. They’ve been together ever since. I’ve probably been on more showings and in more closings as a child than I have as an agent between my parents! One distinct memory I have is sitting underneath the closing table playing with my toy cars eating McDonald’s french fries, being a good boy because “Momma has to help people find a house so she can make some money.” I was probably about 3 years old. I didn’t grow up wanting to be a real estate agent though. In hindsight, it’s exactly what I was supposed to do; I just took the long way.

JUSTIN BLOXOM Swinging for the Fences and Homes! The amount of people that have touched my life over the years makes me feel incredibly blessed, but, a big influence is my wife. Angela Raab Shepherding People, being Passionate, Intentional, and Present Angela will never define the concept of success for an agent, for it is up to them to create their own explanation. She is glad, however, to labor ceaselessly to help those agents to uncover and achieve what they think success is. She notes that the great agents are relentless in the pursuit of relationships and that they are willing to be coached and take advice. Mike Jones Finding Your Niche Nate Parker has said, “Identify your niche and dominate it. And whenever I say dominate, I just mean work harder than anyone else could possibly work at it.” It is the same philosophy that Mike Jones of RE/MAX At The Crossing has, and he has been asking the same question of himself for almost a decade and a half now, “How can I make this work?” The truth is, Mike has been making real estate work since his inception in his career. He does not like to take “no” for an answer, and when someone says that he cannot do something, he considers it a challenge to prove them wrong.

Cheryl Stuckwish Learn First: Then Lead When it comes to dispensing some advice, Cheryl always tells newer agents to “just show up – come to work every day” and to take the advice that others give. To seasoned agents, she encourages them to keep their eyes on their business, not listen to outdated information, and always remain loyal. She says that the best agents make the most of every day, care about others more than themselves, forgive the shortcomings of others and follow through with the advice that she gives.
