We Can Be Human
ecently, I was called for a second opinion. The individual had some concerns with how his case was going with another lawyer and wanted to run the scenario by me. A chief concern was that his lawyer was friendly with the opposing party’s attorney, and both lawyers had known each other for a long time. The very concern that gave this individual such anxiety gave me great delight. Too frequently, we only hear the news about bad behavior in the legal profession. I knew both attorneys in question, and I felt very confident that nothing inappropriate was going on. They were just being nice.
How unfortunate that we live in a society where civility amongst attorneys may be considered suspect. Or worse – that civility would result in inferior or compromised representation. I told the individual that in my experience, the adage is true – one gets more flies with honey. I explained that with his attorney knowing the other, and – gasp – being friendly with the other, it was possible that it could result in a more responsive opposing counsel. An attorney who is quick to pick up the phone when the other calls, because he or she is not dreading the discussion that lies ahead. More communication, in turn, could lead to quicker resolutions. The caller admitted he had not thought about this; indeed he indicated he was looking for a “bulldog” of an attorney and felt that his counsel was not quite fitting such description. He emailed a week or so later to inform me that the disputes were resolved in his matter.
RBeing an attorney is a privilege, but it does not come without an undue amount of stress. We help people. But, that frequently means helping them through very difficult times in their lives, often with unexpected conflicts. We sometimes hear and experience the worst from our clients due to the challenges they face. It can be really hard not to take their pain home with us or project it onto other relationships. Being angry, aggressive, and unreasonable for several hours every workday will undoubtedly spill into our personal lives and negatively impact our physical and mental health. Aside from the benefits civility may have in conflict resolution and case management, I also consider it a survival mechanism in this profession. We cannot control the Court. We cannot control how the opposing party or counsel behaves. We cannot control our clients’ reactions. But we can control ourselves.
As attorneys, we can be both civil and effective. We can be both firm and fair. Exercising civility does not equate to rolling over on opposing counsel’s demands or ignoring missed deadlines. We can exchange pleasantries and conversation with other attorneys before walking into a hearing where we oppose each other. We can grab a meal or a drink. We can serve on committees and in civic organizations together. We can even be friends. We can choose not to be reduced to the terrible lawyer stereotypes of being an animal such as a bulldog, a shark, or a pit bull. Instead, we can be human.

Support the Florida Clerks of Court 2023 Legislative Priorities
As this year’s Florida legislative session kicks off this month, I’m again optimistic that legislators will do all they can to continue to stabilize the system that funds Clerks’ offices to protect critical services we provide the community and support the Court System.
First, I greatly appreciate the commitment legislators have shown to help and support the Clerk of Courts funding structure. We are very grateful the legislature worked with us on significant structural changes enacted over the past few years through the passage of SB 838 by Senator Boyd (2021) and HB 397 by Representative Clemons (2022). The incremental changes captured in those bills have no doubt brought more stability to the system that funds Clerk services.
These bills provided assistance to the Clerk’s statewide budgeting process, established a new process in statute to improve the cost and workload for mental health and substance abuse case types, enhanced payment options, and improved efficiency and customer service for certain driver’s license reinstatements.
However, Clerk budgets are still largely dependent on funding from fines, fees, and court costs – especially civil traffic citations. Even with all the help and the backfill appropriations, Clerks
across the state essentially have the same statewide budget as we had about a decade ago.
This upcoming session, Florida’s Clerks of Court are rallying behind the 2023 Clerk Legislative Priorities to create a more sustainable, long-term solution. Our new proposals are mostly captured in three main pieces. We are seeking to:
• Diversify Clerk Revenues by redirecting the statutory distribution of certain revenues for court-related services, enabling Clerks of Court to retain more revenue for the services they provide (ex. Foreclosure filing fees, Issuance of Summons, Dissolution of Marriage)
• Support Staffing Needs by providing new mechanisms to handle increases in the Florida Retirement System (FRS) for Court-related employees; and
• Account for Additional No-Fee Services by providing a state reimbursement process for certain public services and approved civil indigency cases where fees are currently waived.
I am pleased we have been able to work together with legislators to make progress in recent years. I am thankful this year’s proposed legislation builds on the framework set in the 2022 legislative session to further stabilize funding sources for Florida Court Clerks and Comptrollers.

OCBA 2023 Professionalism Awards Recipients
The Orange County Bar Association strives to increase the civility and professionalism of its members by offering seminars, publishing articles in The Briefs, and reaching out to local law schools, elementary, middle, and high schools, and the community at large with activities that promote the profession and our system of justice. Through our annual Professionalism Awards, we recognize three members of the legal community whose practice, services, professionalism, ethical conduct, demeanor, and high moral standards best embody the qualities we all seek to emulate. The OCBA is proud to announce the following individuals as this year’s awards recipients.
The Honorable Roy B. “Skip” Dalton, Jr. James G. Glazebrook Memorial Bar Service Award
The Honorable Roy B. “Skip” Dalton, Jr. served as a Federal District Judge since 2011. He currently serves as Senior District Judge, United States District Court, in the Middle District of Florida. He is board certified as a civil trial lawyer by both the Florida Bar and the National Board of Trial Advocates.
As a lawyer, Judge Dalton was a tireless servant to the profession. He served as a Member and Chair of the Fifth District Court of Appeal Nominating Commission; Member and Chair of the Grievance Committee of the Florida Bar for the Ninth Judicial Circuit; Member, Florida Supreme Court Committee on Standard Civil Jury Instructions; and Member, Board of Directors, Florida Trial Lawyers.
Mary Ann Morgan, Esq. William Trickel, Jr. Professionalism Award
Mary Ann Morgan has been practicing law for over 30 years. She currently focuses on consumer justice as a Florida Trial Attorney at Morgan Trial Law where she is a managing partner.
Ms. Morgan has been an active member of her legal community, leading by example. She recently completed her ninth year on the Florida Bar Board of Governors and is the Past Chair of the Disciplinary Review Committee and of the Communications Committee for the Florida Bar. Ms. Morgan also served on the Executive Committee for the Board of Governors and was only the second woman from the Ninth Judicial Circuit to serve on the Board of Governors. In 2017 she was awarded the Tony Boggs Excellence in Discipline Award by Bill Schifino, President of The Florida

Your 2023 Circuit Family Court Divisions
We’re almost through the first quarter of 2023, and I’m sure you’ve already begun to see some of the exciting changes happening this year. We have new judges, we have some new courtrooms, and we have a few things up in the air!
As of this writing, Division 30 is “unmanned” with Judge Mize’s ascension to the appellate bench (congrats!). Until a new judge is appointed/assigned, I am managing Division 30 with the help of Senior Judges, an awesome support staff, and my generous colleagues. Please, continue to use 30Orange@ninthcircuit.org for all communications about those cases.
On February 6, we expanded our Domestic Violence (DV) divisions to four judges – Judge Kraynick (also the Associate Administrative Judge for Family), Judge Leach, Judge Kerestes, and Judge Laurent. This expansion enables us to return related Domestic Relations (DR) cases to the DV division with companion injunctions to ensure efficiency and consistency of judicial orders.
Division 41 is now the fourth DV division. All cases in 41 that do not have active injunctions will be distributed among the remaining DR divisions helmed by Judge Deen, Judge Nix-Walker, Judge McCarthy, Judge Barbour, myself, and the newly assigned judge to Division 30 - TBA. I have Division 38 and the role of Administrative Judge over Circuit Family Divisions. To minimize a backlog and confusion, I will continue to cover preset hearings from Division 41 in my new Courtroom 10C throughout February and March. If you have a case in 41, look it up now to see where it has landed! Yes, this is a busy spring!
And, yes, our family judges in Osceola County are up to three full DR/DV dockets helmed by Judge Netcher, Judge Snure, and Judge Collins.
All of the Family Judges are endeavoring to make sure posted policies and procedures are reflective of your experience with our offices. After the year-plus of innovation in DV by Judge Rodriguez,
we are continuing to make improvements in the DV division. There will be changes in how we refer cases to magistrates in the DR divisions, and we hope to make that process more expedient. If you do not find the Family Court information you need on my page of the Ninth Circuit website, feel free to contact my office. As your Family Admin. Judge, I would love to solve all problems and solve them quickly, but there are limits to what I can do in most situations. Sometimes a sounding board is not what an aggrieved lawyer is looking for – but that’s all that we can offer. Having spent 24-years in your oft-beleaguered shoes, I do understand many of your day-to-day frustrations. Now, being on the other side of things, I ask you to consider the following.
Family law work is different. We know that the outcomes of family cases can have lasting impact on children and adults. How we get to those outcomes also has impact. Typically, the child’s behaviors that litigants want to blame on the other parent are the exact behaviors the experts tell us are resulting from high-conflict divorce. At the risk of stating the obvious: the stress, sickness, and polarization of the last few years have left an indelible mark on the consciousness of all of us. The mental health professionals you work with will tell you – we are stressed out. No one makes the best discernments or decisions when overworked, overwhelmed and under the proverbial gun. Not every phone call from a high maintenance client must, or should, result in an emergency motion. Stay neutral and remember you were not there and do not know what happened, and folks in these situations are often not practicing the highest order of self-insight. When their meltdown does not seem to fit the facts as you know them – slow down. Get help for them, take care of yourself, and remember to breathe. Tomorrow fixes many problems.

The Honorable Roy B. “Skip” Dalton, Jr.
While on the bench, Judge Dalton has served as a Member of the Judicial Conference Committee on Information Technology; Chair of the Space and Facilities Committee of the Middle District of Florida; Administrative Judge of the Orlando Division; Chair of the Court’s Congressional Relations Committee; and Member of the District Executive Committee.
Judge Dalton headed the effort to establish the Court’s Intensive Re-entry Program for felons released from prison. The program provides incentives and encouragement to those trying to reintegrate back into society. Once the program was up and running, Judge Dalton continued working on its improvement. The Florida Bar News referred to his leadership in this effort as a “Herculean Task.” And in 2020, The Florida Bar Foundation presented him with the President’s Award for excellence for promoting ethical representation and access to justice. But perhaps more important than any official recognition is that Judge Dalton has won the respect, admiration, and affection of all his judicial colleagues.
Orange County Bar Association members: John Antoon and Ava Doppelt nominated Judge Dalton for his dedication to professionalism. As Richard Dellinger, Esq., wrote in a letter of recommendation, “In all areas, Judge Dalton was committed, dedicated and professional. As a jurist, Judge Dalton was always prepared and knowledgeable on the subject matters before him. Judge Dalton’s knowledge of the Rules of Evidence stands out in my mind; Judge Dalton knows the Rules of Evidence as good as Professor Ehrhardt. Judge Dalton is committed to serving the Bar and is always available for Bar presentations and community outreach activities.”
As Warren Lindsey, Esq., states, “In my 42 years of practice, I have found Judge Dalton to be among the most outstanding judges, lawyers, and individuals I have has the honor of knowing. He treats all litigants, attorneys, witnesses, parties, and court personnel with respect at all times. His integrity and ethics are a beacon for all lawyers and other judges. Judge Dalton is
extremely deserving of the 2023 James G. Glazebrook Memorial Bar Service Award.”
Judge Dalton received his Bachelor of Arts from the University of Florida, and his Juris Doctor from the University of Florida Levin College of Law. He is married to his college sweetheart. They have four children and six grandchildren.
Mary Ann Morgan, Esq. Florida Bar. She was one of only five recipients of the award (and the only woman) which recognizes “dedication, integrity, intellectual excellence and extraordinary work in and on behalf of the lawyer discipline efforts of The Florida Bar.” She is currently on the Pro Bono Legal Services Committee for The Florida Bar and The Florida Bar’s Campaign Oversight Committee, fielding complaints for The Florida Bar President and Board of Governors Elections.
In 2001 through 2002, Ms. Morgan served as President of the Orange County Bar Association where she oversaw the complete renovation of the Bar building. She also served as President of the Legal Aid Society of the Orange County Bar Association where she has been a pro bono volunteer since 1986. She also served as the CFAWL State Representative to FAWL. However, to Mary Ann, far more important than these accomplishments, is her desire to mentor young lawyers. Her motto is “no lawyer left behind.” Mary Ann has a heart to ensure that young lawyers are feeling plugged into their legal community so they can immediately start making contributions and feel included. She has a policy of always sending a personal letter to job applicants offering to meet them, if they are in the Orlando area, to give tips on job hunting and bar events. She has become a mentor to dozens of attorneys in this way. Additionally, many years ago Mary Ann started noticing that the CFAWL luncheons did not provide an adequate forum for young women to get to know each other since time was short and there was usually a program agenda. Mary Ann began a successful program called “A Table for Eight” which she called a program without an agenda. A Table for Eight pairs young lawyers with “seasoned attorneys” in an informal dinner setting conducive to fos-
tering true camaraderie. The program has become so successful it has been mirrored throughout the state.
Jamie Billotte Moses, Esq., remarks in her recommendation, “Mary Ann is an exceptional attorney who has conducted herself with the utmost professionalism during her lengthy and esteemed career. I don’t know a single person who has ever complained about litigating against her. She’s also been a dedicated Bar servant and advocate for the Ninth Circuit on TFB Board of Governors.”
Ms. Morgan received her Juris Doctor from Florida State College of Law. She has been married to her husband, Patrick, for 26 years. They have one child and one grandchild. She and her husband have close ties to St. Margaret Mary church in Winter Park.
Annie Po Lam Kwong, Esq. Award of Excellence-Pro Bono Service; Orange County Bar Association Young Lawyer Section-Pro Bono Award of Excellence Winter 2017; Florida Association of Women Lawyers 2017 Leader in the Law Award; and a Ninth Judicial Circuit Pro Bono Award Certificate of Recognition of 3 Years Pro Bono Service for Legal Aid Tax Clinic. In her nomination, Onchanto Am, Esq. stated there is not an ounce of pride or vanity in Ms. Kwong. She continues to invest her time to voluntary bar organizations and pro bono activities. For the past five years, she has volunteered her time with the Legal Aid Society of the Orange County Bar Association’s VITA tax clinic. As Michael Barber, Esq., describes in his recommendation, “Despite all of her successes, Annie has always remained the humblest attorney that I can imagine. Annie is content to strive for success without needing to seek recognition for her work, which is one of many reasons that I am proud to advocate on her behalf for her to be awarded the Lawrence G. Mathews, Jr. Young Lawyer Professionalism Award.”
Ms. Kwong received her Bachelor of Arts from the University of Florida in criminology, and her Juris Doctor from Florida Coastal School of Law. She is married with one child.

If not, you are missing a great opportunity to have lunch with the leadership of OCBA, local voluntary bar associations, fellow OCBA members and the judiciary.
Committee meetings focus on upcoming bar events, division updates from Administrative Judges, and Ninth Judicial Circuit policy updates. Attendees are also encouraged to present ideas to help develop or improve the relationship between the judiciary and the bar as well as bring questions or concerns about issues in the Ninth Circuit.

Legal Aid’s VALOR Project is Back!
Chances are you know a military veteran, or at least know that sense of pride and appreciation you feel when in the presence of a veteran. There are few things less controversial than the high reverence in which we hold our veterans.
For seven years prior to the COVID pandemic, Legal Aid proudly served our low-income veteran community with our Veteran’s Advocacy Legal Outreach & Representation (VALOR) Project. The VALOR Project is a medical-legal partnership with the local VA Hospital system through which Legal Aid holds twice monthly, in person, walk-in legal clinics at both the Lake Baldwin VA Clinic and the Orlando VA Medical Center in Lake Nona. Sadly, the pandemic ended those in-person legal clinics in March 2020. However, Legal Aid is very happy to announce these much needed, life-changing legal clinics are once again being held on-site at both the Baldwin Park and Lake Nona VA campuses! We also want to thank the Bob Woodruff Foundation Grants Program for their assistance in making our 2023 clinics possible. These in-person civil legal clinics provide low-income veterans with an opportunity to receive legal help they otherwise would not be able to afford. All veterans who attend these clinics will have the opportunity to meet face-to-face with a pro bono attor-
ney to discuss their civil legal issues. In many cases, the pro bono attorney can provide advice and brief assistance right on the spot. For more complex cases, or for clients that need more tailored aid, the pro bono attorney will gather information and refer the case on to Legal Aid staff for further assistance. As always, veterans can also contact our office directly to request help.
These vital clinics have helped many veterans avoid foreclosures and evictions, escape from domestic violence, obtain a divorce, and other ways to help veterans thrive after service. Unfortunately, the pandemic and recent storms have only increased the need for legal assistance for our veteran population, many of whom are elderly and have limited means.
Please help Legal Aid spread the word about this much needed resource for our low-income veterans in Central Florida. Our clinic schedule is below, and you can also contact me directly at jmobley@ legalaidocba.org for a press ready digital flyer which you can post on your social media or pass on to anyone in need.

The Federal Bar Association, Orlando Chapter
On December 16, 2023, The Federal Bar Association, Orlando Chapter, (FBA Orlando) held a presentation led by The Honorable Paul Bryon titled: The Relationship Between the International Criminal Tribunal for the Former Yugoslavia and the Conflict in Ukraine.
Then on January 10, 2023, FBA Orlando hosted a group of children from Lawton Chiles Middle School as part of their Civil Discourse Program. As a part of this program, FBA Orlando regularly coordinates visits from local schools in furtherance of community and educational outreach goals.
Finally on January 20, 2023, FBA Orlando attended the “State of the District” luncheon at the Federal Courthouse where attendees heard from The Honorable Timothy Corrigan, Chief Judge, The Honorable Roy Dalton, Jr., The Honorable Tiffany Geyer, FBA Orlando President Jeremy Bloor, and Immediate Past President Patrick Brackins.
The Hispanic Bar Association of Central Florida
On January 19, 2023, The Hispanic Bar Association of Central Florida (HBACF), hosted a Zumba night at South Econ Community Park.
Then on January 26, 2023, HBACF hosted their incoming board member installation at Eola Lounge. Congratulations to all of the incoming board members and job well done to outgoing board members.
The Greater Orlando Asian American Bar Association
On January 13, 2023, the Greater Orlando Asian American Bar Association (GOAABA), along with the National Association of Asian American Professionals (NAAAP) attended the Asian Lantern Festival at the Central Florida Zoo and Botanical Gardens.
The Paul C. Perkins Bar Association
The Paul C. Perkins Bar Association (PCPBA) started 2023 on a high note with its first General Body Meeting of the year on January 12, 2023. At the meeting, Dr. Ruth Edwards led PCPBA in the “The Line of Privilege/The Race” activity. The activity opened attendees eyes to all the differences, similarities, and obstacles they had to overcome.
Also, in January, the PCPBA hosted their Annual Judicial Reception on January 31, 2023. It was such a beautiful evening honoring our local Judiciary.
Then PCPBA kicked off Black History Month
with their first February Joint Luncheon of the Year with the Central Florida Association for Women Lawyers (CFAWL) on February 3, 2023. Attendees heard from the Honorable Pauline Drake, a retired longtime judge and active community/bar leader from Jacksonville, FL. Judge Drake shared personal stories from her life and career and spotlighted the need for diversity in the Bar and on the bench.
The Central Florida Association for Women Lawyers
On February 3, 2023, the Central Florida Association for Women Lawyers, cohosted a luncheon with the PCPBA in honor of Black History Month. The luncheon featured Pauline Drake, a retired longtime Judge and active community and bar participant from Jacksonville Florida.
Then on February 9, 2023, CFAWL teamed up with HBACF to participate in the annual “Walk a Mile in her Shoes” event. Attendees walked to raise awareness of domestic violence and the resources available to survivors through Harbor House of Central Florida.
On February 13, 2023, CFAWL celebrated Galentine’s and Valentine’s Day with a Valentines Day “Color Party” hosted by CFAWL past presidents Jamie Moses and Mary Walter. Guests were assigned a color and asked to dress in that color and bring a coordinating snack/drink to match.
Then on February 16, 2023, CFAWL once again teamed up with PCPBA and read books to children at Mollie Ray Elementary School to educate our youth on the contributions African Americans have made in history. The books were then donated to local elementary school libraries.
Finally on February 23, 2023 CFAWL, PCPBA, and GOAABA got together for a fun night out at Wall Crawl.
