Home Protection for Seniors, Severely Disabled, Families and Victims of Wildfire & Natural Disasters Initiative
Proposition 19 in California expands property tax benefits for seniors, disabled individuals, families, and wildfire/disaster victims. It allows homeowners over 55 or with disabilities, as well as those affected by wildfires or natural disasters, to transfer their primary residence’s taxable value to a replacement property anywhere in California, regardless of value, with certain conditions. Additionally, it modifies inheritance rules, requiring recipients of inherited property to use it as their primary residence or family farm to retain the taxable value, with adjustments for properties valued over $1 million. Overall, Proposition 19 aims to provide greater flexibility and protection in property transfers and inheritance in the state.
How does Proposition 19 affect property tax base transfers?
Starting April 1, 2021, Proposition 19 allows an owner of a primary residence who is over 55 years of age, severely disabled, or a victim of a wildfire or natural disaster to transfer the taxable value of the primary residence to a replacement primary residence:
• Anywhere in California
• Purchased or newly constructed within 2 years
• Of any value with an upward adjustment for a more expensive replacement
• The property tax base can be transferred up to three times for persons over 55 years old or with severe disabilities and once for wildfire or disaster victims.
How does Proposition 19 affect inherited properties?
Starting February 16, 2021, Proposition 19 narrows the rules for parent-to-child or grandparent-to-grandchild exemption for inherited properties. The child or grandchild can transfer the taxable value of the inherited property if:
• The property is the principal residence of the child or grandchild or is the family farm.
• The homeowner’s or disabled veteran’s exemption is claimed within one year of the transfer to the child or grandchild.
• The property is used as the principal residence and has a market value above $1 million, in this case an upward adjustment in assessed value would occur.
Replacement Homes
• Homeowners must purchase a replacement home or newly construct one within two years of the sale of their original home in its damaged condition.
Tax base transfers
• Homeowners can purchase a replacement home of greater value than their original home and transfer their tax base with an adjustment to account for the value difference.
Inter-county transfers
• An inter-county transfer can occur between any two counties in the state of California.
Gray Divorces (couples over 50 years old)
• For some divorcing couples, Prop 19 allows them to transfer their tax assessment anywhere in California.

Bottom line, for anyone considering transferring property in California, especially those eligible under Proposition 19, it’s essential to thoroughly understand the new regulations and eligibility criteria. I am not an accountant, and not qualified to provide tax advice, this information was provided via the internet. Prioritize consulting with a real estate attorney or tax advisor to navigate the complexities of the process effectively and how they affect you personally. Take advantage of Proposition 19’s provisions, such as transferring taxable values for eligible individuals and families, but ensure compliance with the requirements and deadlines outlined in the proposition. A sold-out crowd of 350 key decision makers in education, government, land use planning and affordable housing development gathered at the end of February for Housing Trust Fund Ventura County’s (Housing Trust Fund VC) Annual Meeting and “A Home for Education” symposium. The latter was presented in collaboration with the County of Ventura, CSU Channel Islands, Ventura County Office of Education and Ventura County P-20 Council.
Held at CSU Channel Islands (CSUCI), the crowd was welcomed by Dr. Richard Yao, President of CSUCI, and Dr. Cesar Morales, Ventura County Superintendent of Schools. The Annual Meeting highlighted accomplishments by Housing Trust Fund VC, including $27.5 million in funded or committed loans since 2013 and $40 million raised, including $22.9 million from State and Federal government grants, with just over $14 million of that from California State Proposition 1 matching funds, $9 million provided by local government and $8.5 million in donations, grants and community impact note investments from private business and individuals. The resulting impact has brought 1,177 affordable

apartments and homes committed, funded and produced throughout Ventura County in just over a decade. The meeting also provided an opportunity for community members to provide comments about Housing Trust Fund VC’s products and services.
Following the Annual Meeting, “A Home for Education” was presented, informing attendees of current issues surrounding the development of affordable housing on educational properties and providing an opportunity for discussion. Keynote presentations by Abraham Galvan Sanchez of Best, Best, and Kreiger LLP and Al Grazioli of the Los Angeles Unified School District offered clarity and guidance to the legislative hurdles surrounding affordable housing development on educational land.
Grazioli, an expert in site selection and planning, spoke directly to the need for school districts and governments to use as many avenues as necessary to address the housing crisis, including developing affordable housing on underutilized educational properties. By leveraging these valuable resources, local governments and school districts can provide affordable housing near schools to the education workforce they depend on.
A panel discussion followed, moderated by Linda Braunschweiger, CEO, Housing Trust Fund VC and Housing Land Trust VC, and included Sanchez and Grazioli as panelists along with Scott Kolwitz, City of Thousand Oaks; Ken Triguerio, People's Self-Help Housing; and Chelsee Russell, County of Ventura. Local case studies were presented by Dr. Kimberly Hoffmans, of Ventura College, Sabrena Rodriguez of the Ventura County School District, and Laurie Nichols from CSUCI.
The event concluded with a guided shuttle tour of two developments adjacent to the CSUCI campus, Anacapa Canyon (mixed-residential community consisting of Market-Rate Apartments, Age/Income Restricted Apartments and a combination of For-Sale Single Family Homes and For-Sale Attached Townhomes by developer Kennedy Wilson) and the currently under construction, University Glen (170 affordable senior apartments). Both developments were built for CSUCI by McCarthy Companies, a local developer of affordable housing and are home to nearly 2,000 residents, including CSUCI employees, educational allies, alumni, military partners and the general public. The communities represent a unique public-private partnership between developers and California State University Channel Islands (CSUCI) that generates a significant revenue stream to benefit the campus while delivering much-needed housing to the local community.

The guided tours shuttled groups to the nearby developments where attendees witnessed the effects firsthand. Both Anacapa Canyon and University Glen were examples of the mission set forth by “A Home for Education” and Grazioli, demonstrating the ability to turn underutilized educational properties into affordable housing solutions, helping to bring vibrant community and vital economy to local schools, and the value of investing in affordable housing. Solutions such as these are possible and necessary in addressing the housing crisis and providing educators with the housing they deserve at prices they can afford.

1. Eat in. Cooking as a couple is a bonding experience and fun. I believe that when two hearts and four hands are preparing a meal together, it becomes food for the soul as well as the body.
2. Share dinners. Splitting an appetizer, an entrée and a dessert is good for your body as well as your wallet. There’s also something bonding about sharing food.
3. Watch movies at home. These days going to the movies can cost as much as filling up your gas tank (if you include popcorn). Streaming a movie and sharing some Orville Redenbachers is an inexpensive and fun evening, especially if you cuddle up.
4. Go on a weekday picnic. Don’t just brown bag it, but take the time to make a nice lunch with things you really enjoy, and eat outside under a friendly tree with the one you love.
5. Share a series. Find a television show that you both like and make a date to watch it together for the entire run. On nights when your show doesn’t air, make a pact to do something else together for that time.
6. Grow your own. Whether it’s vegetables, herbs or flowers, harvesting your own food or décor gives you a wonderful feeling. Even if you live in an apartment, you can grow tomatoes and herbs in a window box.
7. Buy/sell used books. Again, you’re helping the environment by recycling, and even if you just donate old books, you can get a tax deduction.
8. Walk and talk. Grab your partner and hit the streets. Exercise is one of the cheapest, easiest, and emotionally bonding activities you can engage in.

Sacbé Beach Shack, located in the adjoining Marriott property was beyond belief. Situated directly on the sandy beaches beneath the hotel, the "beach shack" is a whimsically designed bar and dining room offering a perfect oceanside culinary experience. The freshest local ingredients were artfully combined to create a scrumptious offering that highlights regional Mexican cuisines. The mezcal lab experience with famed Master Mezcalier, Chef Benjamín Nava Vargas was an unexpected treat and opened a door to a delicious understanding and appreciation of small-batch mezcals.
Other JW Marriott Resort and Spa culinary treasures include Hana Polynesian Grill’s themed dining room. Perfectly crafty cocktails paired wonderfully with the authentic Polynesian Islands menu. The evening’s festivities were highlighted by a completely themed costumed troupe of singers and dancers performing time-honored Polynesian fire dances. While visiting, be sure to explore Kasai Izakaya, Club 91, and Bravo, a very fresh take on modern Spanish cuisine.
And, when it feels like it’s time to leave the hotel again, check out Chambao Cancún. Just think of it as an interactive curated dinner theatre experience with pop-up music, dance, fashion, and acrobatic activations staged throughout the evening.
