Future of hire? Look to the circular economy

WITH BUSINESSES AND CONSUMERS ACROSS THE COUNTRY LOOKING FOR WAYS TO IMPROVE SUSTAINABILITY OUTCOMES, WHAT ROLE DOES OUR INDUSTRY PLAY AND CAN WE DO MORE?

The question is, how can we further capitalise on this business model and help our customers improve their sustainability outcomes? Firstly, we’ve got a role to play in helping educate our customers, so they better understand the benefits of hiring equipment over purchasing it. Reaching new markets and growing the hire industry are strategic goals of the HRIA. The ‘Why Hire’ campaign is one way we help members promote their businesses.

What’s driving the larger, tier one customers is how to deliver on net zero or emissions targets and they’re looking for innovations from OEMs to make the move from diesel to battery, hydrogen, HVOF or other power sources. As suppliers, that means understanding customer and government demands, especially in relation to emissions and sustainability, and taking a longer-term view when investing in new products and equipment.

For the tradies or DIY customers, it’s potentially a different story. Sustainability won’t always be top of mind — a focus for this market segment is to get a job done quickly, reliably and at minimal cost. But with a growing number of operators now becoming more aware of their carbon footprint, they’ll be looking for products powered by cleaner, more sustainable energy. Fortunately, with new technologies and innovations entering the market to cater to tier one customers, these will flow on to other end users of hire equipment.

Customers, from tier one construction firms to a weekend DIY enthusiast who hire equipment, know that owning it is not a necessary condition of getting the job done. HRIA member companies have access to resources to promote this message. This in turn will help their customers understand the role that hiring equipment plays in the circular economy.

We will continue to be an integral part of the solution by helping our customers meet their sustainability targets, reduce emissions and capital investment. And with support for the growing circular economy, we are uniquely positioned to deliver.

Across Australia and around the world, business, industry and governments are grappling with ways to waste less and recycle more. It's a complicated problem with no quick or easy fix, yet there are ways to extract more value and reduce environmental impact by using – and reusing – products for as long as possible. A circular economic model differs from the more traditional linear model of resource extraction, production, distribution, consumption and waste. The circular model looks to reuse, repurpose, remanufacture and recycle, which reduces overproduction, over-consumption and waste. This is referred to as the circular economy and at its heart is the hire industry.

I’ve just completed a Cambridge University course on the topic of the circular economy and sustainable business strategies. This was a great chance to connect with people from different industries around the world and learn more about how they’re tackling the issues of sustainability. The good news is that in many ways, we’re ahead of the game. The hire industry was operating several decades before the likes of Uber and Airbnb when it came to selling the service an asset provided. Circular economies work when there’s greater utilisation of assets and that’s exactly what we offer our customers.

As a business, 75 years is definitely a milestone worth celebrating. Bill says it’s a testament to the hard work and dedication of their people, past and present, and to the trust their customers have placed in them over the years.

Success, he says, comes down to meeting customer needs and being able to adapt to changing environments.

“It’s pretty simple,” says Bill. “You have to ask yourself every day, is this decision going to make the customer’s job easier? It’s why customers keep coming back — we’re problem solvers. So, yes, we hire out equipment but at Kennards Hire, we also provide solutions.”

Bill’s been with Kennards Hire since 1989, joining as a trainee manager after a nine year

career in the military. He says empowerment and strong people leadership are key to the company’s success, under the guidance of four values which are front and centre of every decision they make: one family, fair dinkum, taking hire higher and every customer a raving fan.

Everyone who joins the company, as part of their induction, is introduced to the Kennards Hire culture and the company’s purpose.

“At the end of the day, our decisions are based within the framework of our values,” says Bill.

“We live and breathe our values because they’re real. People can remember them: we're fair dinkum in what we say and do; every customer a raving fan which has always been an area of differentiation because we go that extra mile to provide great customer service; taking hire higher which is about continuous improvement in everything you do; and one family says we’re all in this together.”

He says that’s the special thing about Kennards Hire.

“We put a lot of work, time and effort into our journey around culture. Our people can not only recite what our values are but live and breath them, and to me, that’s precious and really powerful.”

There’s also a commitment to clear communication and explaining the ‘why’ behind their decisions.

“When there is clarity around your purpose and communication is clear, people understand and come on the journey with you,” says Bill. “Leaders need to be respectful, courageous and inspire hearts and minds. They also need to celebrate the wins with their teams on the way through.”

With low unemployment rates across Australia and New Zealand, Kennards Hire has,

like every company, faced challenges recruiting staff, especially over the last few years. It’s why maintaining a stable employee base has become such a priority.

In 2023, Kennards Hire are working on a number of fronts that seek to support staff with hours, work life balance and other benefits that support their wellbeing and comfort at work, ensuring staff feel like they have the right balance between work and home.

“By supporting wellbeing, we’ll reduce staff turnover which means more experienced people providing better customer service and delivering better solutions.”

After more than three decades at Kennards Hire, Bill has seen the product range evolve to meet the needs of their customers.

Back when he started, their customers were mainly tradies, builders and DIY looking for ladders, small hand tools and concrete mixers. Since then, the customer base has grown into larger commercial industry sectors. He’s also seen products come to market which have collectively transformed the industry over time, making it easier, safer and more efficient for customers.

“Access is a growth market that provides a safer, more convenient way to work at heights,” says Bill. “You also don’t see the old air jack hammers now because they’ve been replaced by hydraulic hammers on the end of excavators. That really highlights the excitement of working in the hire and rental industry as you never know what’s coming next!”

Technology has been a huge growth area, especially in how data is used to increase efficiencies and business decision-making.

“We have tech that supports our clustered transport system which means we can do the same number of deliveries with fewer vehicles,” says Bill.

“We were also the first to market in the hire industry ecommerce space, enabling a customer to book equipment live online, which was a pretty significant change in the industry.”

Kennards Hire were also one of the first to introduce large battery packs to run a site. For customers, this means that instead of running a large diesel generator 24/7 and pumping out emissions, they can significantly reduce the generator run-time, and have a positive impact on the environment.

It’s these kinds of initiatives which inform and contribute to the company’s ESG plan and strategic direction.

“This is an area we need to embrace,” says Bill. “As a business, we try and use innovation and tech in products to help our customers, but it’s got to be fair dinkum."

“ESG should be on everybody’s radar because we’ve all got a part to play and all reputable companies should start their journey by designing their ESG framework with a sensible whole-ofbusiness approach.”

As a family business, Kennards Hire never wanted to be the biggest, but they always wanted to be the best. Today, they have more than 1,800 employees and almost 200 branches across Australia and New Zealand.

Their business model is designed to deliver on the needs of the different customer segments and markets they serve, which is fundamental to their success.

“It used to be that a customer would ring up and ask for a pump and we’d say, ‘no worries, we’ll hire you a pump’ and that was it. Now, we try and understand more about what they are doing.If the customer needs to pump a million litres of water in three days, it’s not just a pump they want, it’s a solution. That’s where the change has come in and that’s what we offer.”

“There are also times the customer doesn’t know what they require so it’s great that we can provide the right equipment and the right advice. It has to be safe, reliable and efficient. It's a heartland position for Kennards Hire where we can recommend and help the customer.”

After more than three decades in the business, Bill is still a great advocate for the industry.

“If people want to build a career around customer service, understanding markets, products, hire and rental is a great industry,” he says. “It also provides a great grounding and training for working in teams, which is essential for any job.”

With new industry initiatives now in place, including Young Professionals and Women in Hire, he’s excited about the opportunities opening up to people who may have never previously considered a career in hire.

“We have a very mature industry that works well, but we also understand that the decisionmakers of the future are Gen Z. As well as a focus on career and the salary on offer, they’ll be judging potential employers on the work environment, their culture and importantly, their ESG credentials.”

As he reflects on a business that’s just celebrated 75 years of operation, and his 30 plus years with them, he says that of all the challenges he’s faced, the biggest was Covid.

“In my time, I’ve seen the laughter, the tears, the successes, the failures but the challenge of Covid was unlike anything any of us had ever seen.”

But with challenge, there’s always opportunity.

“Our priority was always the wellbeing of our people and ensuring our the business continued operations,” he says.

“However, to meet the needs of a new operating environment, we had to adapt. That created opportunity to bring forward innovation and ideas that have now tweaked our operating model and the way we work.”

“The hire industry has and will continue to adapt to global changes in the years ahead, but one thing will always be a constant — success is always connected to the people."

Inheriting the Future: How to set up the next generation to succeed

According to the Productivity Commission, inheritances and gifts have more than doubled since 2002 and could rise four-fold in real terms between now and 2050. That’s an estimated $3.5 trillion dollars changing hands between now and 2050!

This transfer of wealth will have wide reaching implications for those inheriting this wealth, those leaving it behind, their businesses and the economy in general. In fact, this transfer of wealth could have a profound impact on Australia and what it looks like over the rest of this century and beyond.

As there are a high proportion of family businesses in the hire industry, the subject of wealth transfer aligns closely with the businesses succession planning.

With that in mind, what may this future look like?

T he great wealth transfer may sound like a windfall, and it is for many, but it

also carries the burden of responsibility. The incoming generation will have a responsibility to their family, any businesses that they control and those that rely on them to not ‘stuff it up’.

This may mean that they will feel the obligation to carry on a family business, even it is not what they enjoy doing — and the responsibility to not squander any wealth that has been passed to them.

This great wealth transfer comes at a time of uncertainty. There is uncertainty about how the ageing population will impact our societies, how artificial intelligence will change the nature of work, how climate change will impact our lives and uncertainty about future conflicts between global superpowers.

Indeed, it’s difficult to make precise predictions about what this all means and what the future holds, but these trends are likely to shape the future of Australia over the next few decades and those with the

wealth will play a big part in shaping it.

How then can the current and future generations set themselves up to succeed?

Here we explore four key steps to consider.

1. Discover your legacy

The first thing that you should contemplate is the legacy you want to leave behind. Get clear on what you want for your business, for your family and for yourself. How do you want to be remembered? What is important to you? Should your succession plan be implemented while you are still here? What do you want for your children? What do you want for your business and all of those that it supports? How will your estate be split?

These are all fundamental questions to ask yourself when trying to discover your legacy. Knowing the answers to these can often be difficult and can take

time, but the sooner you start thinking about it the clearer it will become and the greater the likelihood that you will achieve it. If you want a good legacy, then don’t leave it to chance!

2. Set up a structure that can stand the test of time

It’s all well and good to know what you want your legacy to be, but how you structure your affairs can make or break it. If it is not structured correctly, it can lead to family conflict, result in excessive taxes being paid and could even threaten the long-term viability of your business and your family wealth.

All too often do we see families stop talking to each other as a result of a poorly structured succession plan. Therefore, get your structure right. Design it so that

Often times conflict arises from a lack of communication and misunderstanding. Talk to your successors often and make a point of including them in the process. Does your family know what your wishes are? Does your family know what the plan is for your succession? Do you speak with your successors regularly about this these matters?

It is often helpful to get an adviser involved in with these discussions. We often find that while both generations are thinking about this issue, they are hesitant to discuss as they do not know how to bring it up in a constructive manner. (Possibly worried that it could cause conflict or that it is a taboo topic.)

4. Prepare the next generation to succeed

Wealth can do strange things to people. It’s important that your successors are prepared to handle the responsibility that comes with significant wealth.

To assess this, you should conduct an inventory of your successors preparedness to handle the transition. Consider how money and responsibility may affect them and their lives. If there is a family business, consider if there are any knowledge gaps in respect to the business.

It may be necessary for your successors to undergo further training or study. They may need to work in another business for a while to bridge some of their knowledge gaps. It is also important to start to get them involved in the decision-making processes within your business so they can see how you make decisions and manage.

There are many moving parts here, some of which you will not know about or have the expertise in. That’s why it’s important to get advice along the way.

This is not a simple task, that’s why it’s important to have the right advisers and governance structure in place to support you. The governance structure may include an advisory board for your family business, maybe a family council or you may even need to set up a family office. The point is, every situation is unique, getting the right advisers and governance structure in place is vitally important in making sure you get it right.

3. Communicate and document everything

Communication should be at the heart of your planning process. Whatever the vision that you have for your business and your family, it’s important to know and

Succession can be an emotionally charged topic that is difficult for families to discuss. While it can be an awkward topic to bring up, the reality is that succession is one of the biggest risks to the ongoing viability of a family business and your family wealth. By putting things on the table ahead of time and creating transparency amongst the family, you can minimise potential conflict down the track. Once the issues are all out in the open, it can also help

Every family is different, and every transition is unique. However, if you can go through the above steps then you can drastically increase the chance of a successful transition.

With that in mind, the best thing that can do right now is to actually get started. It takes time, and the more time you invest in it, the better the future they will be inheriting.

Blue Diamond Powers the Formula 1 using Hydrogen Fuelled Generators

A big step towards Net Zero future was the first fully sustainable activation at this year’s Australian Formula 1 Grand Prix. Working together with Australian Grand Prix Corporation iEDM, Blue Diamond & Net Zero Equipment, EODev, the organisers sampled a taste of the future by using Hydrogen Fuel Cells to sustainably power the Grand Prix Tech Hub. The EODev GEH2 Hydrogen fuelled generator is powered by Toyota Fuel Cells, which combine Hydrogen and Oxygen to produce usable electricity. With the only exhaust material being water. The fuel cells operated over the event, producing approximately 1.8MWh of green energy. With zero carbon emissions, and whisper quiet operation. It’s been great to see this technology in action and taking greater steps towards achieving Net Zero targets in Formula 1.

Organisational fraud: your obligations as a director or officer

However, the hidden cost to an organisation runs much deeper, including the loss of business reputation and new business opportunities, and the impact on employee morale.

Organisational fraud is therefore serious business, raising questions about where responsibility lies and if there’s any come-back on directors or officers.

A note to HRIA member directors

Director duties arise from common law and commonwealth legislation, particularly the Corporations Act 2001 (Cth) (Act). After the initial shock of finding organisational fraud and subsequent urgent endeavours to mitigate the impact, what responsibility do the directors and officers bear for what has occurred? The main directors’ duties that come into play are:

• the duty to act with t he degree of care and diligence that a reasonable person, in that position and in the corporation’s circumstances, would exercise.

• the duty to act in good faith in the best interests of the corporation and for proper purpose

There’s a common misconception that fraud is outside an organisation’s control and that a director or officer bears no responsibility for the incident or consequences. However, this may not always be the case. Directors and officers may be personally liable for losses suffered by an organisation if they fail to ensure the risk of fraud is not sufficiently mitigated. The cost of fraud to an organisation includes: the fraudulent activity, where money is redirected by an employee; forensic investigation and remediation of the fraud; and managing the fallout with media or through introducing new systems.

These two duties also apply to ‘officers’ of a corporation. This includes a company secretary and anyone who makes or participates in decision making that affects the whole, or a substantial part of the business, or who has the capacity to affect significantly the corporation’s financial standing or in accordance with whose directions or instructions the directors usually act. For example, this could potentially extend the duty to the CEO, and other key players in executive management.

Directors and officers have a duty to ensure adequate processes, systems and policies are in place to minimise the risk of fraud and create a culture of compliance. With cyber fraud recently in the global spotlight, does that mean directors and officers expected to be IT experts? The short answer is no, however, they are expected to understand the risk presented to cyber security by these threats. Yet a recent survey of 600 board members in 12 countries

showed that only 54% of Australian responders were confident their board of directors understood the system risks presented by cyber threats.

A risk management framework can help to identify areas of risk with a focus on fraud. The framework requires an analysis of the internal and external fraud risks to the business, and encompasses all aspects of the business, including physical, financial and cyber security. The Fraud and Corruption Control AS 8001:2001 is a good guide to assist in this risk assessment exercise.

Are duties a ‘one size fits all’?

Director duties are not a ‘one size fits all’. The standard of care and diligence is an objective test measured against what a reasonable director or officer would do, considering the position held, the responsibilities of the particular director or officer and the corporation’s circumstances.

There is, however, a minimum standard of care, in that HRIA members should take a ‘diligent and intelligent interest’ in the information provided to them (or appropriately ask for) in looking at fraud risk to the organisation and what systems and processes the organisation has in place. If an organisation has no policies dealing with areas of fraud risk, disaster recovery plan, checks and balances, auditing procedures to monitor compliance or similar items commensurate with the size of the organisation, how will a director or officer satisfy themselves, any regulator or court that they can meet the minimum standard? Remember, there is no point in having compliance programs if they have no practical effect.

In terms of what an organisation should spend on systems and controls, this will depend on what is reasonable in the organisation’s circumstances and whether what they put in place reasonably addresses the risk.

Risky business

A key part of carrying out duties that apply to directors and officers, is to make risk a regular agenda item at meetings. An organisation should understand:

• what the risks are

• the impact of the risk

• the likelihood of the risk occurring

• the consequences of the risk against the likelihood (to determine the risk exposure level)

• if the risk level is acceptable

• the effectiveness of the controls the organisation has in place

• whether after implementing those controls the risk level is still within an acceptable level.

Organisational fraud risk can happen in all shapes and forms. Directors and officers should have a good understanding of the risks and ask questions that test the organisation’s exposure.

Taking action

Are you satisfied that your processes, policies, controls and compliance systems would reasonably mitigate the risks posed by organisational fraud? Members should conduct reviews regularly, especially as new risks emerge.

Fair Work Act changes from 6 June 2023

SINCE LATE 2022, THE AUSTRALIAN GOVERNMENT HAS BEEN STEADILY INTRODUCING CHANGES TO THE FAIR WORK ACT 2009 WHICH WILL HAVE SIGNIFICANT IMPACTS ON HRIA AND EWPA MEMBERS. THIS ARTICLE SUMMARISES SOME OF THE KEY CHANGES COMING INTO EFFECT FROM 6 JUNE 2023 WITH WHICH MEMBERS MUST COMPLY.

Termination of Zombie Agreements

The Australian Government has determined that all ‘Zombie Agreements’, being those registered workplace agreements which commenced operation prior to 1 January 2010, will automatically terminate on 6 December 2023.

To comply with their obligations, all members who are subject to a pre2010 agreement (such as a Collective Agreement or Certified Agreement) must advise their employees, no later than 6 June 2023, that their agreement will cease operation on 6 December 2023.

Additionally, members who are subject to a ‘Zombie Agreement’ must now consider whether they wish to (a) enter into a new enterprise agreement or (b) operate under the modern award system.

Irrespective of which option that a member chooses, they will need to understand which modern awards apply to their business and employees.

provides an HRIA Modern Award summary in June each year which provides members with a summary of the most commonly applicable modern awards. A copy of this summary is available on the HRNet website.

Pay Secrecy Clauses

From 6 June 2023, members must not enter into an employment agreement with a new employee that contains a clause prohibiting an employee from discussing their wage rate with another employee, or asking that employee their wage rate. Pay secrecy provisions are often contained in confidential information clauses in employment agreements. Penalties will apply to employers who enter into an employment agreement which contains a pay secrecy clause from 6 June 2023.

In circumstances that an employee is already employed, and their employment agreement contains a pay secrecy clause, there is no requirement to update their

employment agreement. Rather, the pay secrecy clause will be read as if it does not exist.

Further, from 6 June 2023, all employees will have the right to tell an employee their wage rate and ask another employee their wage rate. As a result, employers will not be able to take adverse action (such as the termination of their employment) against an employee for doing so, otherwise they face the risk of the employee bringing a General Protections claim.

Section 65 - Flexible Work Arrangement Requests

Since the commencement of the Fair Work Act, employees in a discrete list of categories have been entitled to request a flexible work arrangement, including a request to vary their employment to part-time.

The categories have been expanded over the duration of the Fair Work Act and currently include:

1. The employee is a parent, or has responsibility for the care, or a child who is of school age or younger;

2. The employee is a carer (within the meaning of the Carer Recognition Act 2010);

3. The employee has a disability;

4. The employee is 55 or older;

5. The employee is experiencing violence from a member of the employee’s family; or

6. The employee provides care or support to a member of the employee’s immediate family, or a member of the employee’s household, who requires care or support because the member is experiencing violence from the member’s family.

Currently, members are only required to consider the employee’s request and provide a response within 21 days. If the member chooses to reject the request, they must do so on reasonable business grounds (a non-exhaustive list of which exists in the Fair Work Act).

From 6 June 2023, members who receive a flexible working arrangement request and have decided to refuse the request, must have taken the following steps prior to doing so:

• discuss the request with the employee;

• genuinely try to reach agreement about the flexible work arrangement request;

• detail the reasonable business grounds relied upon; and

• write to the employee within 21 days:

- refusing the request;

- detailing changes that the employer could accommodate (if any); and - providing information on a right for the employee to refer the matter to the FWC to deal with the dispute.

These changes make refusing a flexible work arrangement request more onerous on members and provides the employee with an ability to seek assistance from the Fair Work Commission, which may result in a FWC member directing a member to provide a flexible work arrangement to an employee.

The changes also make the flexible

work arrangement request sections of the Fair Work Act civil remedy provisions. This means that if a member fails to comply with the above obligations they can be subject to penalties.

Annual Leave during a shutdown period

On 1 May 2023, the Fair Work Commission introduced, into 78 modern awards, a model clause that will have the effect of prohibiting an employer from requiring an employee to take unpaid annual leave during a shutdown period. Members must now be more vigilant than ever that if they have a shutdown period, all employees have sufficient annual leave to cover that period.

To protect themselves, members should review any annual leave request in light of the expected shutdown period and in circumstances that the employee will not have sufficient leave to cover the either (a) reject the annual leave request or (b) require the employee to sign a written agreement confirming that they will take unpaid leave over the shutdown period.

If an employee does not have sufficient leave to cover the shutdown period, and refuses to sign an agreement to take unpaid leave, the member must (a) provide work to the employee over that period, or (b) provide them with additional paid leave (which is not to be counted as leave in advance).

Life lessons from base camp

Shane Mathias, General Manager of Chadwick Forklifts, has just completed one of the most challenging and difficult experiences of his life…but also one of the most rewarding.

“I was privileged to undertake the gruelling Everest Base Camp trek a few weeks ago,” said Shane.

“We navigated 70 kms over 10 days, in below freezing conditions with snow and rain, on cliff-edge terrain, gaining 5,500 metres while on a basic diet.

Without assistance, this would have been extremely difficult, however, our group of 13, along with a lead guide, three assistant guides and six porters, made it to Base Camp because we worked together as a team.”

Shane said the trek reinforced three fundamental principles for business and life.

1. Have a clear shared and wellarticulated vision/goal.

“We all knew exactly where we were going from day one and all our efforts were directed at this vision/goal,” said Shane. “Subsequent group and individual tasks become easier and more focused when we kept the end goal in mind. ”

2. Trust in your team and have respect/ patience.

“Not everything goes to plan, least of all in the timeframes we envisage,” he says. “When this happens, don’t try and take on the burden yourself. Sometimes people need time to grow into the role so focus on being supportive and nurturing. Be there to help them and, all things being equal, the reward will most certainly be realised.”

3. Have fun.

“This is especially true because if we don’t have fun and enjoy what we do, what’s the point of it all?"

Shane was full of praise for his team members, guides and porters. “Thank you for reinforcing these three lessons and I will see you on the next adventure!”

Queensland well placed as Australia’s most attractive city for building investment

IT’S AN EXCITING TIME FOR QUEENSLANDERS WITH THE 2032 OLYMPICS AND PARALYMPICS GAMES. SOME MAY SAY, WE ARE ON THE GREEN AND GOLD RUNWAY… OR ARE WE?

There is still confusion in and around the redevelopment of The Gabba. Originally the stadium was to be demolished and rebuilt ready for the opening ceremonies of the 2032 Olympics and Paralympics; but it seems that we may only see a facelift at best and not a redevelopment as promised by the state government. It now looks like the cost of the games is around $7 billion, up from $5 billion as previously thought.

Queensland already has 80% of the venues required for the upcoming games in 2032, with the infrastructure expected to stay useful well into the future. As we plan for the games, experts are looking ahead further into the future, shaping Brisbane to be recognised as a new world city.

Nonetheless, this can only mean one thing... more business for local and interstate companies which is fantastic news for the Queensland economy. Some experts have predicted that the next 9 years of infrastructure building and development in Brisbane to be “off the charts” and the games could fuel the biggest real estate renaissance in Brisbane’s history.

No doubt many companies are going to want a piece of the action and I’m sure there will be plenty to go around, but to get your foot in the door you are going to need to tick a few boxes first; one of those boxes is "carbon neutral", and what your business is doing to meet this criteria, especially if companies are to tender for any aspect of the hospitality venues or construction of anything new that needs to be built.

Having spoken to a number of local businesses in Queensland, all are eagerly waiting for the action to commence, by all accounts, it's going to be a couple of years until we really see any movement. Local government is predicting works will commence on The Gabba sometime in 2027.

I think this is a great win for all Australians, especially the people of Queensland.

With these ending in just under six months, there’s potential for businesses to see significant savings with some strategic planning.

Temporary full expensing of depreciating assets (TFEDA)

The Government will support businesses by enabling them to deduct the full cost of eligible capital assets acquired from 7:30pm AEDT on 6 October 2020 (Budget night) and first used or installed by 30 June 2023.

Full expensing in the year of first use will apply to new depreciable assets and the cost of improvements to existing eligible assets. For SMEs (with turnover less than $50 million per annum), full expensing also applies to second- hand assets (See Table 1 below).

Small businesses (turnover less than $10 million per annum) can deduct the balance of their simplified depreciation pool at the end of 2021, 2022 and/or 2023. The provisions which prevent small businesses from re-entering the simplified depreciation regime for five years if they opt-out, will continue to be suspended.

Table 2 below is a simple table and summary of the Loss Carry Back opportunities, as announced in the Federal Government’s 2020 Budget.

The Government will allow eligible companies to carry back tax losses from the 2019-20, 202021, 2021-22 or 2022-23 income years to offset previously taxed profits in years later than 2018-19. Corporate tax entities with turnover less than $5 billion per annum can apply tax losses against taxed profits in a previous year, generating a refundable tax offset in the year in which the loss is made. The tax refund would be limited by

requiring that the amount carried back is not more than the earlier taxed profits and that the carry back does not generate a franking account deficit.

The tax refund will be available on election by

eligible businesses when they lodge their tax returns for 2020-21, 2021-22 and 2022-23 income years.

Currently, companies are required to carry losses forward to offset profits in future years. Companies that do not elect to carry back losses under this measure can still carry losses forward as normal.

To simplify and provide clarity, a conversation with your finance broker and accountant could certainly benefit those making capital purchases in the near future.

Where to now, Big Brother?

Australia ranks among the worst in the world for data breaches with around 22 accounts hacked every minute.1

With the recent spate of high-profile data breaches, the government is looking to enhance data protections and protect the privacy of citizens. In February 2023, the Attorney-General released a much anticipated report that included 116 proposals to reform and modernise the Privacy Act 1988 (Cth)(Act). This was the culmination of an ACCC report into Australia’s privacy laws in 2019, and a review undertaken by the AttorneyGeneral’s office in 2020, to bring Australia’s

privacy laws into the digital era, strengthen privacy protections for individuals and streamline compliance for businesses working across international borders.

2022 amendments to Australia’s privacy law

In December 2022, the federal government increased penalties and strengthened the enforcement powers of the Office of the Australian Information Commissioner (OAIC) under the Act. The OAIC also has a wider set of regulatory tools and information-gathering powers at its disposal. Information sharing has

also been improved within the OAIC and among Australian and foreign regulators.

Australian privacy law also now applies to organisations doing business in Australia regardless of whether information is collected in Australia

Findings of 2023 review

The 2023 report into Australia’s privacy laws considered whether the Act was still fit for purpose.

The proposed reforms will impact most, if not all, aspects of the Australian economy and businesses that fall under the Act. Key changes proposed include:

• 30% of the corporation’s ‘adjusted turnover’ during the ‘breach turnover period’ (if the court cannot determine the value of benefit obtained)*

• expanding the definition of ‘collection’ to include information obtained from any source and by any means, including inferred or generated information

• removing the small business exemption (for organisations with an annual turnover of less than AU$3 million)

• requiring regulated APP entities to ensure all collections, uses or disclosures of personal information are fair and reasonable, while ensuring increased safeguards are in place for certain high-risk information handling activities, or that these are prohibited.

Other proposals include:

• introducing a new 72-hour window for APP entities to report eligible data breaches to the OAIC

• bolstering individuals’ rights concerning their personal information, including the right to request the

• requiring APP entities to improve the quality of their privacy collections notices and consents, including data retention timeframes

• mandating privacy impact assessments for activities that attract high privacy risks

• introducing a right for individuals to apply directly to a court for relief of privacy interferences

• creating a statutory tort for serious invasions of privacy

• creating standard contractual clauses for use in relation to cross-border data transfers

• heightening the OAIC’s regulatory powers.

Staying compliant

While it’s uncertain how many of the proposed reforms will be implemented, it’s an area that’s undergoing significant change. HRIA members, large and small

and determine how it may impact their business and operations. To prepare for the inevitable changes, members should:

• map their data footprint and consider the volume and types of data currently being held

• identify what security and protective data measures may need to be enhanced going forward

• consider whether any exemptions are currently being relied on under the Act and if they may be earmarked for change

• look at their existing contracts

• determine their data breach responses and how eligible data breaches will be assessed, including whether these can be notified within the newly proposed 72-hour window.

The Chinese government is also easing tariff levels on many of our exports adding billions of dollars to our export income.

On the flip side, more home builders are going into administration, closely followed by several construction companies, with talk of quite a few more to follow. This is at a time when the Reserve Bank (RBA) Governor is saying we are not building enough houses to meet the needs of the new immigrants. We have occupancy rates in the residential rental sector in the high 90 per cent bracket, with a severe shortage of rental properties. While consumer spending fell to the lowest levels in 10 years a few weeks back, it’s now bouncing back on the news that interest rates are on hold.

As the RBA tries to put the brakes on the economy, interest rates on chattel mortgages for equipment have risen, as an example, from 3 per cent to over 7 per cent, adding significantly to monthly repayments. There is a huge number of fixed rate home loan mortgages about to rollover onto variable rate, jumping from below a 3 per cent rate to, in some cases, the high 5 per cent bracket, adding significantly to monthly repayments.

The cost of living has climbed rapidly for all Australians, offset by modest wage increases (lower than the RBA anticipated) and further exacerbated by the OPEC decision to cut oil production forcing fuel prices up. An economist once said, a 10 cent rise in the fuel price is equal to a 1 per cent increase in the interest rate. The money sucked out of the economy was at the same level, so if the impact of the RBA interest rate increases is still filtering through and the fuel price jumps 10-20 cents a litre, what impact will that have?

When asked to deputise for John Glover, your EWPA President for this edition, my mind started racing to all the things that might be of interest. The topic occupying my thoughts of late is the degree of mixed messages in the economy and how this will impact our industry.

Talking to others in our industry — rental companies, OEMs and customers — it’s clear that the current level of activity is very high with indications this will continue for the foreseeable future, in one case well into 2025. And most are seeing full order books for the next 24 months at the very least.

The latest reports show immigration at the highest level in recent years and unemployment at a record low of 3.5 per cent. The economists in the past called 5 per cent unemployment ‘full employment’, so we are well past the full employment threshold. The good news is that there are also plenty of people entering the country looking for work and anyone unfortunate enough to be out of work, can probably find a job.

The supply chain challenges seem to be easing but the impact on the cost of capital and components has been somewhere around 15 per cent, and in some cases as high as 28 per cent. The availability of equipment however, seems to be improving quickly.

So where does that leave us? In short, very busy and very positive, albeit slightly confused!

This level of articulation is possible thanks to a revolutionary self-levelling chassis with independent control arms and drive to all four wheels, which also helps boost stability and traction, and provides the model with impressive 45% gradeability.

Adding to the 670SJ’s appeal is its ability to be driven at a class-leading full platform height of 67 feet (approx. 20.36m) while the platform remains perfectly stable and level. Reach on the machine is also generous at over 57 feet or approximately

17.40 metres. Power for the unit comes courtesy of a proven Deutz T4F engine that produces healthy output of 67hp / 50kW.

The 670SJ will not be the only new machine on display at the JLG stand. Also on show will be the recently released DaVinci™ AE1932, which offers another industry’s first as a fully electric scissor lift.

Being fully electric, the AE1932 Electric Scissor Lift has no hydraulics therefore eliminating the risk of oil leaks, which makes the machine ideal for use in food production facilities, clean rooms, medical buildings or on carpeted floors.

It also features the latest electric drivetrain including AC drive motors for zero emission power and low draw, meaning more work on a single charge. Further extending run time is an energy recovery system that uses gravity to recapture power as the platform descends.

Capping off the new product showcase is a new Australian designed and made Solar Lighting Tower, the SSL-50, which is manufactured at JLG’s facility in Port Macquarie, on the mid north coast of New South Wales.

10-year inspections, the Aussie way

THE AUSTRALIAN LEGISLATION REQUIRES A MAJOR INSPECTION OF ALL MEWPS AFTER 10 YEARS OF SERVICE. IN THIS ARTICLE FIND KEY INFORMATION ABOUT THIS INSPECTION AND HOW YOU CAN TURN THIS OBLIGATION INTO AN OPPORTUNITY FOR THE SAFETY OF YOUR TEAMS!

An Australian regulation

The Australian Standards of Safety, (AS25) provide for a Major Inspection for all EWPs after 10 years of service and every 5 years thereafter. This includes the dismantling and thorough examination of the machines, needing the skills of experienced technicians. If the decennial control is not performed and an accident occurs, the owner of the machine is responsible for the damage.

What are the tangible benefits of such an inspection?

By passing the ten-year inspection, you:

• Reduce your financial risk.

How much does it cost?

The cost of an inspection depends on the type of MEWP, generally it can be considered that the inspection cost is 1522% of the purchase price of the machine.

What is involved in an inspection?

It is always beneficial to use the manufacturer to complete a 10 years inspection because they have better knowledge of the machine’s specifications, even the oldest. Using the manufacturers’ recommendations and various R&D files at their disposal, they live evaluate the condition of the platforms with absolute precision. Thanks to their experience, machine downtime is reduced to a minimum.

For example, Haulotte 10-years inspection is conducted in 3 stages:

The machine is washed, and a full function test is performed, a visual inspection is made and a report on any

abnormalities is written. Technical teams ensure that there are no leaks in the cylinder seals or counterbalance valves and test pressures.

The machine is dismantled, and all internal components are stripped to allow a complete and thorough inspection. Crack tests and magnetic particle tests, checks of all critical components are performed to detect signs of fatigue. All components are inspected, tested, cleaned, lubricated… The tolerance of all wear components is tested. Components are refurbished, systems repaired and upgraded if necessary.

Only original spare parts are used to ensure optimum safety.

Components that are heavily rusted are sandblasted and prepared for painting.

Once all components are cleaned and repaired, assembly begins, and a full service is performed. New decals and a compliance plate ensure the machine meets the Australian standards. The machine undergoes several functional tests before leaving our workshops. Haulotte provide a certificate confirming the completion of the 10-years test with a checklist of the work done certifying the machine conforms to standard.

Alfasi Hire Operations Manager Daryl Steer describes the benefits they see when completing a 10-year inspection.

“It is getting harder and harder to source new machines, so by renewing key items of plant we are able to increase fleet availability to the customer,” said Daryl. “When we look for a service provider, we look for someone that is reliable and gets the unit completed in a timely manner to minimize loss of income, but most importantly a supplier that does a thorough job. Haulotte standards are industry leading so we feel confident to send them any machine, from any manufacturer”, adds Daryl.

LGMG to bring multiple new MEWPS to HIRE23

AS THE LARGEST EVENT FOR CONSTRUCTION AND MACHINERY IN AUSTRALIA, LGMG WILL DEFINITELY NOT BE MISSING THIS YEAR’S HIRE23.

Covering a demonstration area of 108 square meters, even larger than last year, LGMG will show off 8 products at the booth 24, including its first vertical mast lift in Australia, along with one diesel-powered articulating boom and a telehandler making their debut on the continent.

Booms

The high-powered, diesel AR20J (AR65J) is one of LGMG’s newly launched articulating boom lifts with the max height of 21.58 meters and the max horizontal outreach of 12.37 meters. HIRE23 is the first time the AR20J will be seen in the Australian market.

The machine has a large platform with a dual capacity design of 260/350kg. It benefits from four-wheel drive and fulltime floating wheels to grip the ground when driving on hard, uneven terrain, providing 45% gradeability and max 4 degrees tilt angle.

Vertical masts

M0810JE (M2640JE) is the LGMG’s first mast model for the Australian market, launching at HIRE23.

M0810JE (M2640JE) has a maximum working height of 10m and offers a width of 1m and a stowed length of 2.6m for easy transport.

The vertical mast has a 0.98m by 0.72m platform, with a capacity of 200kg, allowing two people to work indoors at the same time and one person outdoors.

The battery-powered machine with zero tail-swing is compact in size, lightweight, weighing only 2720kg, and is easy to maneuver in tight spaces. Its 3.2m jib can move 130° vertically up 70° and down 60°, offering a larger working range.

Telehandlers

Telehandlers are one of LGMG’s strategic launches. Integrating the features seen in the best telehandlers from all over the world, LGMG is planning a series of platform developments. Currently LGMG has finalised the development of telehandlers with a lifting height ranging from 6 meters to 20 meters, and a max. capacity ranging from 2.5 tons to 5 tons.

The H1840 features a high-power Perkins engine for maximizing material handling capacity with lower consumption. It has a max lifting height of 17.6 meters and a max capacity of 4000kg. The four-wheel-drive system and the fourwheel-steering mode making the machine perfect for different working conditions, especially for the restricted job sites, offering 65% gradeability under unladen condition.

Genie Lithium-Ion Battery for Genie GS E-Drive Scissor Lifts

Rigorously tested for longevity and reliability — even in extreme environments

— Genie® Lithium-Ion batteries have been specifically designed for MEWPs and are UL certified against fire, electric shock and explosion. The zero-maintenance

Genie Lithium-Ion battery’s fully-sealed IP67 housing protects it from water and dust contamination. Based on extensive testing, it has an expected lifespan of about 10 years, making it the only battery you’ll need for the normal life of your scissor lift.

Monitor Lifts opens new Queensland showroom & workshop

As any hire company operator knows, a properly maintained spider lift or EWP is a must for ensuring safe operation for both customers and employees. Hire companies need maintenance carried out when and wherever it’s necessary, to preserve their investment and operational capability.

The new branch is completely equipped with experienced technicians and a full range of spare parts to provide rapid response, routine maintenance and support to hire companies throughout South East Queensland.

It’s backed up by their fully equipped service trailer that is available to visit hire companies on-site. The state-of-the-art trailer carries the tools, parts and everything the Monitor Lifts team need to perform a full service at hire company sites. It’s designed to support hire companies in keeping their spider lift fleet running at maximum capacity, ensuring downtime is kept to a minimum.

“The Caboolture branch is designed to assist hire companies that want to be a one stop shop,” Chad Firth said. “We want to help them build on their relationships and ensure they can continue to offer great service and support to their customers.”

How hire companies can sub-hire machines to meet demand

One of the constant challenges for hire companies is maintaining their reputation as the ‘go-to guys’ for customers who need to hire an EWP at short notice. So when a certain lift is out on another job, hire companies risk damaging that reputation.

“When demand is high for a hire company, they may not have every required machine on hand,” Chad Firth said. “In that case, their customers may look elsewhere — which is never ideal.”

To solve this challenge, Monitor Lifts will subhire out EWPs from the Caboolture facility to hire companies in urgent need of lifts.

“With our sub-hire offering, you can essentially use our stock as your stock,” Chad Firth said. “We aim to help you ensure repeat business, and maintain those essential relationships with your regular customers.”

2023 is flying by and as you read this, we are about to congregate at Sydney Olympic Park for our annual HRIA convention. I’m looking forward to catching up with many of you.

In 2023, there have been some incredible events across the country proving that our industry is back in full swing! The Australian Open, Ed Sheeran and Harry Styles tours, as well as the Formula 1 Grand Prix have kept the big companies busy, while smaller events and weddings are equally as busy. It really is all happening which is great to see.

A key outcome from the focus groups we did last year was to provide more access to other like-sized and like-minded businesses and HIRE23 is the opportunity! We have an amazing panel of event industry peers speaking in various sessions — including the Events Workshop and Future of Hire — and I’d

encourage you to take the time to ask questions. I also want to personally thank the panel for giving up their time to participate.

Our Women in Hire and Young Professionals programs will conclude at HIRE23. This means it’s time to start thinking about who in your business is ready to take on the challenge of either of these incredible programs in 2023/2024. Access to these programs are a benefit of your membership and are an amazing resource for growth and learning for the next generation of shining stars. We typically don’t see a huge representation from the events sector in these programs and I’d love to see that change. With at least three dedicated mentors from the events space, it would be great to see some leaders take on the challenge.

SCPH helps build a global village

A team from South Coast Party Hire (SCPH) is heading to Cambodia this May as volunteers in Habitat for Humanity’s Global Village Build.

It’s a program that’s helping vulnerable families in Cambodia improve their access to safe, dignified and affordable housing.

Over a week, the team will participate in building homes for families living in extreme poverty. Along with an experienced team of locals and other volunteers in the program, they’ll build homes of concrete block or wood stilts.

SCPH’s Erin Johnston said they’ve had a long-term goal to send a team to participate in the program.

“Our hope at SCPH is to be able to fund our team to attend each year, building the experiences for our incredible staff while also having a huge impact on others who are less fortunate,” she said.

Despite COVID pushing their goal back a couple of years, in 2023, they’re sponsoring three team members (Nathan, Chelsea and Daniel) to participate in the program.

Once in Cambodia, the SCPH team will contribute in any way they can.

“It is going to be a tough but very rewarding experience,” said Erin.

“Our team will be guided to undertake tasks such as mixing

concrete and mortar, smoothing bamboo, building walls and timber cladding and digging and pouring concrete footings.”

SCPH is covering all participation costs, such as flights and accommodation, however they’re also looking to fundraise $5,400 to go directly to Habitat for Humanity.

“This will help them continue the amazing work they do all over the world to achieve their goal of a world where everyone has a decent place to live,” said Erin.

“2023 will be our first year of many!”

KUBOTA’S NEW U10-5 COMPACT DIGGER A 10 OUT OF 10!

Kubota Australia is transforming the construction scene through the launch of its U10-5 Ultra-Compact Digger with advanced performance and comfort features.

The new U10-5 excavator will replace the existing K008-3 and has been updated with a range of new features. The U10-5 is a zero-tail swing machine designed to operate safely in the tightest of spaces along with an improved operator control layout and modern exterior design.

Kubota ANZ Product Manager, Nathan Thomas, said the hydraulic controls, zero-tail swing and variable track-width features mean there are not many jobs the U10-5 can’t get to.

“The previous K008-3 had a front mechanical operation lever design which has now been updated on the new U10-5,” said Nathan. “The U10-5 now features hydraulic control levers which are positioned to the sides of the seat for a better, more relaxed operator working experience, ensuring comfort of operation and reducing operator fatigue.”

With a strong focus on safety, the U10-5 also has an engine safety start system preventing the engine from starting when the levers are lowered, meaning no unexpected excavator and attachment movement when starting the machine.

“The machine features an adjustable track gauge from an easy single-lever operation,” said Nathan. “The hydraulically

adjustable tracks reduce down in seconds to 750mm, to allow for navigation in tight spaces. The track gauge can also be widened to a full extension of 990mm.”

“Machine height can often restrict excavators on the job site but that’s not the case here. Thanks to a newly designed front foldable Roll-Over-Protection-System (ROPS), the U10-5 can easily fit under doorways or low-hanging branches.

SOIL COMPACTION: FLEXTOOL AND MIKASA EQUIPMENT

SOIL COMPACTION IS A CRUCIAL ELEMENT OF MOST CONSTRUCTION PROJECTS, FROM SMALL DOMESTIC APPLICATIONS, SUCH AS LANDSCAPING AND PAVING, TO LARGER CIVIL PROJECTS INCLUDING ROADWAYS AND TRENCHES.

Soil compaction equipment generates a downwards force helping to remove air voids from the substrate, and providing a solid foundation. This reduces the risk of substrate settlement in the weeks and months after the job is completed. With many types of soil compaction equipment available, here are some considerations when selecting the right piece of equipment for the job.

There are two types of plate compactors — forward and reversible. Forward Plate Compactors operate in a forward direction only and are ideal for use in confined spaces and for compacting thin layers such as granular soils including gravel, road

base and asphalt. They are usually lighter and smaller than Reversible Plate Compactors, ranging in weight from a portable 40 kg unit to a larger 100 kg machine. Options to consider include if there’s a need for: a water tank for asphalt and dust suppression; a wheel kit for on-site manoeuvrability; and a folding handle for easy transportation and storage.

Reversible Plate Compactors operate in both a forward and reverse direction. They are ideal for use on larger civil and commercial projects requiring deeper compaction or on large areas requiring compaction. This includes deep compaction of road base and the

backfilling of trenches. They come in larger sizes of up to 600 kg. Options to consider are the required weight and working width of the machine to suit the job application and whether a petrol or diesel engine is preferred.

Tamping Rammers (AKA Jumping Jacks) are used for a specific range of projects. They are ideal for confined spaces, such as trenches and deep excavations when compacting cohesive soil and backfill, and are especially good for soil with a high clay content. Ranging from 45 kg to 95 kg, they come in petrol and diesel options with a range of working widths to suit any job. Find one with a wheel kit option for ease of getting around the job site and low vibration handles to reduce vibration transfer to the operator.

AUSSIE URBAN JETTER

Australian Pump has set out to produce a ‘hire industry’ orientated trailermounted Jetter that is both practical and capable. It will eliminate the mobility issues of using trolley-mounted Jetters, without the need to compromise on performance.

Kennards Hire was the first rental company to offer trolley-mounted Aussie Jetters, knowing that blocked sewer lines and stormwater drains are not only inconvenient, but can be extremely unhealthy.

Generally, homeowners and businesses call a plumber to clear a choke. If they’ve got a Jetter mounted on their ute, they can get the drain cleared promptly. It may cost up to $480 and can take less than an hour, yet irrespective of cost, the customer is pleased that the job is done.

A hire opportunity

Aussie’s design team came up with the idea of mounting a Jetter on a lightweight,

stable and well-engineered trailer for urban work. John Hales, Aussie’s Chief Engineer, named it the “Urban Jetter” and the two-wheel trailer adds a new level of practicality for the rental market.

The trick is to make sure the job site has a good town water supply for the Jetter. This eliminates the need for the trailer to accommodate a large water tank.

Aussie’s King Cobra Deluxe Cube Jetter was used for the prototype. The plan is to move the big stainless steel reel, mounted high on the top of the machine, to a deck mounted stainless steel ‘stacker’. This will lower the centre of gravity of the machine for stability.

The trailer kit includes a mini stainless steel portable reel with 60m of sewer hose fitted. A small integrated toolbox securely holds the Nozzle Box and other jetting accessories. The Nozzle Box includes a range of nozzles to combat the various challenges faced in clearing blocked drains. Every machine also comes with a Safety Plate.

The new Urban Jetter is not only versatile, but is a Class A category Jetter so no operator certification is required. That’s a huge advantage for hire companies!

Aussie safety program

HUSKI CONSTRUCTION EQUIPMENT HELPS ALLELEC SERVICES REACH NEW HEIGHTS

SYDNEY-BASED ELECTRICAL MAINTENANCE AND REPAIR SPECIALIST,

For three decades, Allelec Services has provided electric maintenance and repair to commercial businesses such as supermarkets and shopping centres.

Around 18 months ago, Allelec Director, Alan Borland, needed to upgrade his mini-excavator to a bigger unit, and landed on the Huski M-38U mini-excavator with its 3.8-tonne capacity.

Mr Borland reached out to the local TMHA team, led by area sales manager Peter Bower, choosing Huski Construction Equipment thanks to its excellent reputation for reliability.

Following the purchase of the Huski excavator, Mr Borland was impressed and added a Huski SV08ENL scissor lift to the fleet earlier in 2022.

“We had a smaller scissor lift but wanted the Huski one for the height —

it’s a 26-footer — and its slimline design helps with things like accessing signage while still being manoeuvrable without a monstrous deck,” he said.

“The scissor lift is very handy, it’s a narrow unit but with the extra height, it’s been very good. We used it for lighting upgrade works at Macquarie shopping centre and for a new signage installation at Chipping Norton, so that’s been very versatile as well.”

Mr Borland said he enjoyed owning his own equipment as it allowed the business to be flexible and respond quickly to any issue, eliminating the need

to find suitable contractors which can be costly and time consuming.

TMHA prides itself on offering excellent customer service by developing real relationships with clients. Peter Bower helped establish a strong relationship with Allelec Services early on by assisting with the purchase process.

“There were a couple of little questions at the start when understanding the machine, so I rang Peter about it,” Mr Borland said.

“Peter and his boss came out the following day and saw us straight away. They helped us out identified the problem and sorted it out. It was very immediate.”

“I’ve been super happy,” he said. “I wouldn’t have any hesitation purchasing again from them. They’ve always responded to us straight away, no problems at all.”

Mr Borland said he has begun recommending Huski products to friends and colleagues due to their excellent performance.

“I’ve mentioned to a few people about the Huski excavator, that I’m very happy about it,” he said. “I’d have no hesitation in recommending it.”

He also stated that Peter Bower would be his first port of call if Allelec ever wanted to add more equipment to its stable, due to the performance of the existing machines and the service provided.
