13. Plaintiffs however are no longer certain that the copy given them is a faithful reproduction of the same document they signed in 1996 when they received the initial down payment from the defendant. As far as their recollection is concerned, the provisions written in the unnotarized “Contract To Sell” does not express the correct conditions they agreed upon when they were asked to sign a document; 14. Sometime in 2016, some of the plaintiffs went to visit the subject properties but were not allowed entry by the security guards posted by the defendant. Plaintiffs filed a complaint before the Barangay to compel the guards to leave the area. As of date however, it appears that defendant has already vacated the properties pursuant to the Certificate of Non- Tenancy, copy of which is hereto attached as ANNEX ‘G”, forming an integral part hereof; 15. Subsequently, sometime on January 2018, some of the plaintiffs once again visited the defendant at his office in Makati City, but like before, defendant did not face them but instead sent a certain Mr. Robert Bolodo who informed them that defendant wanted a return of the amount previously paid plaintiffs in 1996 or after over twenty-one (21) years with interests; 16. For over twenty-one (21) years therefore, defendant never exerted any effort to comply with the terms imposed in the Contract To Sell he asked the plaintiffs to sign. Neither did he make any additional offer to pay the remaining balance of the original purchase price agreed upon with the plaintiffs; 17. On March 18, 2018 counsel for the plaintiffs sent a demand letter (via registered mail with return card) to the defendant notifying him of their intent to cancel the Contract To Sell they entered with the latter and to cause the cancellation of the adverse claim it caused to be annotated in the Tax Declarations of the properties. Said demand letter was initially sent to the address provided by the defendant in the Affidavit of Adverse Claim he executed, i.e., Unit 803, Orient Mansion, Tordesillas St., Salcedo Village, Makati City. However, no return card was ever received back by counsel. Copy of the demand letter with the post office receipt are hereto attached and marked as ANNEXES “H” to “H-1”, forming integral parts hereof; 18. Impatient with the delay, counsel sent his messenger Preny Dador to personally serve the demand letter to the defendant but much to his surprise, a foreigner is now occupying as the latter’s residence at Unit 803, Orient Mansions, Tordesillas St., Salcedo Village, Makati, the same address defendant indicated Affidavit of Adverse Claim. Upon query, the foreigner claimed that he has been occupying the unit as his residence; 19. After research however, another demand letter dated March 13, 2018, was sent to the respondent at the 5th Flr. Crown Center, 158 Jupiter cor. N. Garcia, Makati City. Said demand letter was received by a certain Cindy Flores. To date however nothing has been heard from the defendant. Copy of the 2nd demand letter is hereto attached and marked as ANNEX “I”, forming an integral part hereof; 20. On account of tax mapping conducted by the Office of the Municipal Assessor of Sto. Tomas, Batangas, new tax declarations were issued by the said office increasing the size of the two properties and issuing new tax declarations but containing the same adverse claim filed by the defendant as follows: ARP No. 008-00438 ARP No. 008-00439

Copies of the new Tax Declarations are hereto attached and marked as ANNEXES “J” to “J-1”, all forming integral parts hereof.

CAUSE OF ACTION 21. Clearly, more than twenty one (21) years have elapsed for the defendant to exercise his rights under the “Contract To Sell” he asked the plaintiffs to sign. This is a clear manifestation that he is no longer interested in pursuing the purchase of the properties from the plaintiffs; 22. Under Article 1144 of the New Civil Code an action based upon a contract must be filed within ten (10) years from the time the right of action accrues. Defendant’s right of action to recover based on the “Contract to Sell” he asked the plaintiff’s to sign is now barred by prescription; 23. Plaintiffs are therefore now entitled to cancel the intended sale with the defendant, and be considered relieved of their obligations thereto and may now freely convey, transfer or encumber said properties without any legal obstacle; 24. Plaintiffs likewise should now be entitled to cause the cancellation of the Adverse Claim annotated in the ARP Nos. 008-00438 and 008-00439, derivatives of ARP Nos. 2006-008-02002 and 2006008-01998, duly recorded at the Office of the Municipal Assessor of the Municipality of Sto. Tomas, Batangas under the name of Cirilo Villanueva and Andrea Manzanilla Villanueva; 25. By reason of the inaction of the herein defendant, plaintiffs are unlawfully being deprived of the enjoyment and use of their property and prospective buyers are behooved from buying the property in view of the annotation of adverse claim made by the defendant on the tax declaration of the properties; 26. By reason of the malicious refusal of the defendant to address the demands made by the plaintiffs, the latter were constrained to engage the services of counsel to whom they are obligated to pay the amount of Seventy Thousand Pesos (P70,000.00) by way of acceptance fees and Seven Thousand Pesos (P7,000.00) by way of appearance fees for every appearance; 27. By reason of the malicious failure of the defendant to comply with what was incumbent upon him under his contract with the plaintiffs, the latter were unreasonably deprived of the use and enjoyment of their property for over twenty-one (21) years, the defendant must be made to pay the plaintiff by way of liquidated damages in the amount of P500,000.00. 28. The real property taxes due on the properties subject matter hereof are all duly paid. Copies of the official receipt of real property payments are hereto attached and marked as ANNEX “K”, forming an integral part hereof; 29. The properties are not subject of any levy or attachment by the government or any private entity for any obligation whatsoever.

PRAYER

PREMISES CONSIDERED, it is most respectfully prayed that, after due notice and hearing, judgment be rendered:

1. Declaring the Contract to Sell executed by the parties as CANCELLED by reason of the failure of the defendant to comply with what is incumbent upon him under the said contract; 2. Declaring the plaintiffs relieved from their obligation under the Contract to Sell they signed; 3. Ordering the cancellation of Adverse Claim annotated in the ARP Nos. 2006-008-02002 and 2006-008-01998, formerly ARP Nos. 008-0043 and 008-00439, respectively; 4. Ordering the defendant to pay attorney’s fees in the amount of P70,000.00 and reasonable appearance fees in the amount of P7, 000.00 per appearance; 5. Ordering the defendant to pay the plaintiff’s the amount of P500, 000.00 by way of liquidated damages;

Other relief just and equitable under the circumstances.

DAR creates Anti-Corruption Task Force

The Department of Agrarian Reform (DAR) recently created an anti-corruption task force in support of the initiatives of President Rodrigo Duterte to combat corruption in government. Agrarian Reform Secretary John R. Castriciones directed the DAR Anti-Corruption Task Force to conduct thorough investigations into information received by the department. He said there have been intelligence reports of persons and organizations claiming connections and influence in the resolution of cases and applications pending with the DAR. These unscrupulous groups and individuals then demand monetary compensation in exchange for their services. “The task force will conduct the necessary investigation so that it can weed out erring personnel and those outside the department involved in unlawful transactions,” Castriciones said. Castriciones also enjoined DAR employees to cooperate in this drive against corruption. “Alam naman po natin na ang ating Pangulo ay mahigpit ang kanyang pagpapatupad ng batas at ayaw niyang ang kanyang administrasyon ay magkaroon ng bahid tungkol sa korapsiyon kaya ako ay nakikiusap at humihingi ng kooperasyon sa ating mga empleyado at mga opisyal sa departamento na tayo ay magtulong-tulong,” Castriciones said. “Gawin po natin ang ating tungkulin nang naaayon sa batas at huwag po tayong gagawa ng mga bagay na labag sa batas at hindi kaayaaya sa mga alituntunin ng ating administrasyon upang maiwasan po natin ang mga sigalot at mga korapsiyon na siyang nagiging ugat ng mabagal na serbisyo sa ating mga mamamayan,” he added. Heading the DAR Anti-Corruption Task Force is the agency’s director for internal audit, Director Alexander Alimmudin J. Ali. Meanwhile, the Internal Audit Division shall serve as the Secretariat of the task force. Director Ali said the task force shall accept and evaluate all complaints regardless of their source. This includes anonymous and confidential sources. HINIKAYAT ni Labor Secretary Silvestre H. Bello III ang lahat na employer na mahigpit na ipatupad ang Kasambahay law na poprotekta sa household service workers (HSW). Ito ang naging panawagan ni Bello sa ginanap na Araw ng Kasambahay sa Quezon City na pinangunahan ng Department of Labor and Employment sa tulong na rin ng Bureau of Workers with Special Concerns (BWSC) sa pamamagitan ng paglulunsad ng mga bagong information material na magbibigay ng kamalayan sa mga karapatan at benepisyo na nararapat para sa household service workers o kasambahay. Sakop ng RA 10361 o ng Kasambahay law, ang pagbibigay ng minimum requirements at benefits para sa household service workers tulad ng standard minimum wage na P2,500 sa mga kasambahay na nasa National Capital Region; P2,000 naman sa mga lungsod at 1st class na mga munisipalidad; at P1,500 sa iba pang mga munisipalidad. Kabilang sa karapatan ng HSW ang pagkakaroon ng mandatory social benefits tulad ng 13th-month pay, limang araw na incentive leave kada taon at isang buong araw na pahinga kada linggo. BINIGYANG-PANSIN ni Senador Nancy Binay ang transportation department dahil sa mabagal na pamamahagi ng “Pantawid Pasada” aid program na may layon na mapigilan ang epekto ng pagtaas ng presyo ng gasolina sa mga drayber at operator ng jeep. Ayon sa solon, nakakasakit sa mga bulsa ng mga nasa sektor ng pampublikong transportasyon ang mabagal na pamamahagi, kasabay ng pagtaas ng presyo ng gasolina at ang epekto ng ikalawang round ng pagtaas ng excise tax ngayong Enero. “Patuloy pong umaaray ang mga kasama nating jeepney driver at operators dahil sa muling pagtaas ng presyo ng petrolyo, kung kaya’t kailangan nating tanungin ang DOTr at LTFRB kung kamusta na ang distribution nila ng ayuda,” ani Binay. Sa panahon ng mga pagdinig para sa iminungkahing badyet ng transportation department noong Disyembre sa nakaraang taon, nalaman na 69,000 lamang ang nakinabang sa kanilang mga kard, mula sa 171,000 na dapat tumanggap. Sinabihan rin ni Binay ang LTFRB na mahigpit na imonitor ang paggamit ng card dahil sa may ilang draybers ang nagrereklamo dahil sa hindi sila nakatatanggap ng subsidiya mula sa kanilang operators. “May mga naririnig na rin po tayo sa mga driver na hindi ibinibigay ng mga operator ang dapat na subsidy, kaya napipilitan silang i-shoulder ng buo ang presyo ng gasolina o diesel,” diin ng solon. SANG announcement ang ipinalabas ng Malacañang nitong nakaraang linggo tungkol sa appointment kay Atty. Aldwin F. Alegre bilang bagong Deputy Commissioner ng Bureau of Immigration (BI).

Si Atty. Alegre, pumalit sa dating posisyon ni Atty. Aimee Torrefranca-Neri na ngayon ay undersecretary ng DSWD, ay isang Certified Public Accountant (CPA) lawyer at naging managing partner and co-founder ng Paredes, Alegre and Quiño Law Offices na matatagpuan sa Mandaluyong City. Nakapasa siya sa Philippine Bar noong 2007 bago sumabak sa private practice at naging eksperto siya sa Civil, Criminal, Labor and Corporate Law. Mahilig din siya sa photography at paglalaro ng basketball kaya siguradong suportado niya ang mga darating na sports activities sa Bureau. Gaya nina BI Commissioner Jaime Morente at Deputy Commissioner Tobias “Toby” Javier na kilalang malapit sa puso ng mga kawani, inaasahan na susuporta si Depcom Alegre sa magandang layunin ng kagawaran tungo sa pagsusulong nang mas maayos na ahensiya gaya ng BI. Layon umano nito na iligwak ang reports tungkol sa illegal activities ng ilang ACOs, section and unit heads na nabuking matapos magpagawa ng imbestigasyon si BI

Commisioner Jaime Morente. Ito umano ‘yung mga binansagang ‘paminta angels’ noon sa BI. Unang tinamaan ang ‘juicy position’ na Tourist Visa Section (TVS) na ang dating hepe ay si Immigration Officer Jennifer Seneca ay pinalitan ni IO Mark Leslie Gonzales. Naging under na rin ng Immigration Regulation Division (IRD) ang TVS na isinailalim noon sa Office of the Commissioner (OCOM). Ligwak din sa kanyang puwesto si IO III Justin Galvez ng BI-SM North Satellite Office na pinalitan naman ni Aileen Sta. Ana. Nabukelya na marami raw pinalusot na special working permits (SWP) sa kanyang dating opisina si IO Galvez kahit hindi sakop ng kanyang jurisdiction?! Nandiyan din ang Seaport Operations Section (SOS) na dati ay pinamamahalaan ni IO Dennis Opiña na pinalitan naman ni IO III Aljun Decampong na galing naman sa BI-Davao City Field Office. Rumaine Pascual ang ipinalit sa kanyang puwesto at ini-appoint si Editha Mercader bilang bagong SM-Aura Alien Control Officer. Balita natin ay “on-leave” ngayon si Atty.
