GOODBYE NEGATIVITY G I dito.

OVER-ANALYZING.

JOINED the 3rd Weight Loss Challenge of Senator Manny Pacquiao before Christmas, a time when food was abundant everywhere and oh-so-hard to resist. I needed to join to shed weight because I was becoming obese. Senator Pacquiao’s contest in which many of my coworkers had previously joined and are still joining is the only way that could motivate me to go on a diet. I wouldn’t do it alone after all. I have several officemates who signed up and we would monitor each other’s progress. Senator Pacquiao started his Weight BY JOJIE CODILLA Loss Challenge before his fight with Floyd Mayweather in April 2015. He did this initially among the members of his team, the winner of which would receive US $2,000. Realizing the success of his first initiative, he launched the same Weight Loss Challenge among Senate employees in 2016 to inspire them to have a healthier lifestyle. It attracted a lot of employees, including janitors and security guards, primarily because of the cash prizes of $5,000 each for the first prize (women and men categories), $3,000 each for the second prize, and $2,000 each for the third prize. While the duration of Senator Pac quiao’s past weight loss challenges were more than two months long, this time it would take less than two months, starting with the weigh-in on December 10 & 11, 2018 and ending on the final weigh-in a week or so after his fight against Adrien Broner at the MGM Grand Arena in Las Vegas, Nevada on January 19 this year. Aside from having to shed—in a little over a month’s time—at least 15% of one’s weight during initial weigh-in to earn at least P10,000, the greatest challenge was to stay away from food at a time when almost all Filipino families were celebrating reunions, weddings, birthdays, Christmas, and New Year. At this point in my dieting, I have lost only 10 pounds since I started dieting on December 14 using the Keto Diet. While the cash prize is truly a motivator and a great incentive, I don’t think I can lose as much as 23 pounds, or at least15% of my weigh-in weight, until the final weigh. Nonetheless, I will try my best during the remaining weeks, if only to regain my ideal Body Mass Index and stay fit and healthy for my own and my family’s sake. Wish me luck. I am excited to tell you how I will fare about three weeks from now when final weigh-in is done. Thank you, Senator Pacquiao, for this challenge that would surely change our lives for the better.

THE AZKALS: CHASING FOOTBALL GLORY THE Philippine Azkals bows out of the 2018 ASEAN Football Federation (AFF) Suzuki Cup as the tournament draws to a close. It’s been a thrilling and inspiring journey, indeed. The Philippine national team has been participating in the AFF Championship since 1996. And over the years, they have progressed from the group stage to the semi-finals. The Azkal’s proudest claim to fame was the so-called “Miracle of Hanoi,” where they beat defending champions Vietnam 2-0 at the 2010 AFF Suzuki Cup. Despite a fueled desire for the finals, the team has yet to taste the sweetness of the elusive championship. “We’ve come a long way since Vietnam [during the Miracle of Hanoi],” says team captain Phil Younghusband. “There were some wins, some losses, but we’ve pushed through and worked hard to be successful and to draw more fans to Philippine football.” The recently concluded 2018 AFF Suzuki Cup was held from November 8 to December 15, 2018. Group A consisted of Laos, Cambodia, Myanmar, Malaysia, and Vietnam. The Philippines was placed in Group B with Timor-Leste, Indonesia, Singapore, and defending champions Thailand. During the group stage, the Philippines started strong, beating Singapore 1-0, last November 13, at the Pana-ad Stadium in Bacolod. It was

German-born Filipino Patrick Alcala Reichelt who scored the goal. The Azkals went on for another win against TimorLeste, 3-2, at an away game in Kuala Lumpur Stadium, Malaysia. Top scorer P. Younghusband, Swiss-Filipino Martin Steuble, and Spanish-Filipino Carlos de Murga scored the three critical goals. Returning to Pana-ad Stadium, the Azkals tied with Thailand, 1-1, where proud Iloilo-native Jovin Bedic made a stunning point against the defending champs. Before graduating from the group stage, the Azkals once more dealt a draw with Indonesia at an away game in Gelora Bung Karno Stadium, Jakarta. At the 2018 AFF Championship knockout stage, where the two teams from each group advance to compete in a single-elimination tournament,

the Philippines competed against Group A’s Vietnam. During the first leg in a home game in Bacolod, the Azkals faced off against Vietnam but lost with a score of 1-2. Right-winger Reichelt again managed to score the goal. “Losing in the finals can be really heartbreaking; but we are always progressing as a team,” James Younghusband shares. During the second leg, the team traveled to Mþ þình National Stadium in Hanoi to square off once again against Vietnam. Driven and required to produce twice the number of goals against their opponent, the Azkals battled it out in a long drawn-out deadlock against Vietnam. But during the last 10 minutes of the game, Vietnam scored two goals ensuring their seat at the 2018 AFF Suzuki Cup Championship Finals. The Philippines nevertheless did not concede, managing one goal thanks to midfielder J. Younghusband, but it wasn’t enough to make them advance to the finals stage. Finishing as semi-finalists for the fourth time, after 2010, 2012, and 2014, the Azkals continue to persevere and inspire. As they gain more experience on the field, so do they become better players. “Most of all, I enjoy being part of the group and being part of this team. We have amazing talents and you can expect greater things from us in the future,” P. Younghusband says.

Port of Manila Formal Entry Division Chief Karin Mercado handed the certificate of commendation to Customs Operation Officer III Eva Victoria M. Castaneda for being the 3rd best performing Customs Examiner of the Port of Manila for the month of November 2018 by collecting a total duties and taxes for the government amounting to P111,882,470. The awarding took place during the Year End celebration of the Assessment Division of Port of Manila. DEXTER GATOC

PETITION

NOTICE OF INITIAL HEARING

Petitioner, by counsel and to this Honorable Court, respectfully states:

Confronting this court is a petition filed by Jose Aristotle C. Rodriguez, of legal age, Filipino, and a resident of Block 5, Lot 21, A Kamagong St., Manila Doctor’s Village, Almanza Uno, Las Piñas City represented by his sibling and attorney-in-fact, Maria Teresa Victoria R. Dela Llarte. They pray that after due notice and hearing, an Order be issued, declaring as null and void the lost Owner’s Duplicate Certificate of TCT No. T-25646 and directing the Registry of Deeds for Las Piñas City, to issue a new one with the same terms and conditions that may be found thereon and which shall in all respects be entitled to like faith and credit as the lost one.

1. Petitioner JOSE ARISTOTLE C. RODRIGUEZ, is of legal age, Filipino and a resident of Block 5, Lot 21, A Kamagong St., Manila Doctors Village, Almanza Uno, Las Pinas City, herein represented by his sibling and Attorney-In-Fact, MARIA TERESA VICTORIA R. DELA LLARTE. Petitioner may be served with notices and other legal processes of this Honorable Court through the undersigned counsel at the address indicated below; 2. Petitioner is an heir of the late Jose Rodriguez and is the adjudicated owner of the parcel of land situated at Manila Doctors Villages, Almanza Uno, Las Pinas City covered by Transfer Certificate of Title (TCT) No. T-25646 by virtue of a Compromise Project of Partition on the Estate of Jose L. Rodriguez duly approved on March 27, 1998 by Judge Raul E. de Leon of the Regional Trial Court of Paranaque City, Branch 258 in the case entitled “In the Matter of the Estate of Jose L. Rodriguez” docketed as Sp. Proc. Case No. 97-029; 3. Sometime in August 2000, the Owner’s Duplicate Copy of TCT No. T-25646 was delivered and entrusted to Ferdinand B. Estolloso (“Mr. Estolloso”) for safekeeping. Subsequently, Mr. Estolloso discovered that the Owner’s Duplicate Copy of TCT No. T-25646 delivered and entrusted to him was missing. Despite diligent efforts to locate it, Mr. Estolloso could no longer found it. For all intents and purposes, the Owner’s Duplicate Certificate of TCT No. T-25646 was considered irretrievably lost; 4. After having exerted all efforts to find the lost Owner’s Duplicate Certificate of TCT No. T-25646 and having been convinced that the same is lost beyond recovery, Mr. Estolloso executed an Affidavit of Loss and caused the annotation of the same in the original copy TCT25646 on file with the Registry of Deeds for Las Pinas City; 5. The absence of Owner’s Duplicate Certificate of TCT No. T-25646 is not attributable to any sale, transfer or conveyance to any person by way of assignment, mortgage or otherwise; nor was it presented to the Registry of Deeds for transfer or registration. It has not been levied upon or confiscated by any officer of the law; 6. Petitioner has no other recourse but to petition the court for the issuance of a new Owner’s Duplicate Certificate of TCT No. T-25646 in order to protect his interest over the said property from unscrupulous person/s who would utilize or use the lost original duplicate copy of TCT No. T-25646 for illegal purposes to the prejudice of the petitioner.

Finding said petition to be sufficient in form and substance, the same is GIVEN DUE COURSE. NOTICE is given that said Petition shall be heard on January 21 & 28, 2019, both at half past eight in the morning, before this court located at the Ground Floor, Hall of Justice, City Hall Compound, Las Piñas City, where all interested parties are cited to appear and show cause why the petition should not be granted. Not unaware of the dictum of the Court in Republic of the Philippines vs. Court of Appeals, et. al., G.R. No. 128531, October 26, 1999, that the OSG need not be heard/notified in proceedings for the issuance of owner’s duplicate certificate of title, the court deems it acceptable that it be furnished with court processes relative thereto. Let copy of this Notice with the Petition and all its annexes be furnished to the Office of the Solicitor General, Office of the Land Registration Authority, the Bureau of Lands and the Register of Deeds of Las Piñas City. Likewise, let a copy of this Notice together with the petition be published once a week for three (3) consecutive weeks in any newspaper of general circulation duly accredited by the Office of the Clerk of Court, Regional Trial Court, Las Piñas City, to be determined by raffle, and let the same Notice be posted in three (3) conspicuous places within the City at least thirty (30) days prior to hearing at the expense of the petitioner. So Ordered, November 12, 2018, Las Piñas City. Phoeve C. Meer Judge Copy furnished:

PRAYER WHEREFORE, petitioner respectfully prays that the Honorable Court, after proper proceedings, renders a judgment: a. CANCELLING the lost Owner’s Duplicate Certificate of TCT No. T-25646; b. ORDERING the Registry of Deeds for Las Pinas City to issue a new Owner’s Duplicate Certificate of TCT No. T-25646 with the same terms and conditions that may be found thereon and which shall in all respects be entitled to like faith and credit as the lost TCT25646.

Copies of the said Tax Declarations are hereto attached and marked as ANNEXES “B” and “B-1”, respectively, all forming integral parts hereof; Las Piñas City, this 19th day of December 2018. 7. Sometime in 1996, defendant offered to purchase the said parcels of land from Andrea Manzanilla and they agreed at the purchase price of P110.00 per square meter. The plaintiffs were asked to sign a ”Contract To Sell” by the defendant’s staff at their residence in Sto. Tomas, Batangas. However, after obtaining their respective signatures, they were never given any copy thereof nor were they asked to appear before notary public to have it notarized; ATTY. VLADIMIR BERLA S. DARAL 8. By way of down payment, defendant paid plaintiff Andrea Manzanilla a total amount of One Million Six Hundred Four Thousand and Eight RONALD C. CORDOVA Clerk of Court VI Hundred Forty-Five Pesos (P1604, 845.00), copy of the Voucher signed by plaintiff Andrea Manzanilla Villanueva and the checks Deputy Sheriff and Ex-Officio Sheriff representing payments are hereto attached and marked as ANNEXES “C” to “D”, all forming integral parts hereof; 9. Pursuant to the understanding of the parties, the balance of about One Million Six Hundred Thousand (P1, 600, 000.00), will be paid within six (6) months after the release of the approved plan and all expenses for the conversion of the land from agricultural to other purposes and the Warning subsequent titling thereof will be at the expense of the defendant; 10. After making a down payment, defendant took possession of the property and plaintiffs never heard from him again; 11. Subsequently, plaintiffs discovered that defendant executed an It is absolutely prohibited to remove, deface Affidavit of Adverse Claim and had the same recorded in the Register of Deeds of Tanauan City and that of the Office of the Municipal or destroy this Notice of Sale on or before Assessor of Sto. Tomas, Batangas, copy of which is hereto attached and marked as ANNEX “E”, forming an integral part hereof; 12. Sometime in 2006, to clarify the status of their contract, some of the The date of sale under penalty of law. herein plaintiffs paid the defendant a visit at his address at Orient Mansion, Unit 803, Tordesillas St., Salcedo Village, Makati City, but defendant did not face them. Instead his staff, a certain “Romasanta” gave them a photocopy of a purported Contract to Sell which was not notarized. Copy of which is hereto attached and marked as ANNEXES DIYARYO PINOY Dates: January 7, 14 & 21 2019 “F” to “F-5”, all forming integral parts hereof;

LUNES Enero 07, 2019|7 13. Plaintiffs however are no longer certain that the copy given them is a faithful reproduction of the same document they signed in 1996 when they received the initial down payment from the defendant. As far as their recollection is concerned, the provisions written in the unnotarized “Contract To Sell” does not express the correct conditions they agreed upon when they were asked to sign a document; 14. Sometime in 2016, some of the plaintiffs went to visit the subject properties but were not allowed entry by the security guards posted by the defendant. Plaintiffs filed a complaint before the Barangay to compel the guards to leave the area. As of date however, it appears that defendant has already vacated the properties pursuant to the Certificate of Non- Tenancy, copy of which is hereto attached as ANNEX ‘G”, forming an integral part hereof; 15. Subsequently, sometime on January 2018, some of the plaintiffs once again visited the defendant at his office in Makati City, but like before, defendant did not face them but instead sent a certain Mr. Robert Bolodo who informed them that defendant wanted a return of the amount previously paid plaintiffs in 1996 or after over twenty-one (21) years with interests; 16. For over twenty-one (21) years therefore, defendant never exerted any effort to comply with the terms imposed in the Contract To Sell he asked the plaintiffs to sign. Neither did he make any additional offer to pay the remaining balance of the original purchase price agreed upon with the plaintiffs; 17. On March 18, 2018 counsel for the plaintiffs sent a demand letter (via registered mail with return card) to the defendant notifying him of their intent to cancel the Contract To Sell they entered with the latter and to cause the cancellation of the adverse claim it caused to be annotated in the Tax Declarations of the properties. Said demand letter was initially sent to the address provided by the defendant in the Affidavit of Adverse Claim he executed, i.e., Unit 803, Orient Mansion, Tordesillas St., Salcedo Village, Makati City. However, no return card was ever received back by counsel. Copy of the demand letter with the post office receipt are hereto attached and marked as ANNEXES “H” to “H-1”, forming integral parts hereof; 18. Impatient with the delay, counsel sent his messenger Preny Dador to personally serve the demand letter to the defendant but much to his surprise, a foreigner is now occupying as the latter’s residence at Unit 803, Orient Mansions, Tordesillas St., Salcedo Village, Makati, the same address defendant indicated Affidavit of Adverse Claim. Upon query, the foreigner claimed that he has been occupying the unit as his residence; 19. After research however, another demand letter dated March 13, 2018, was sent to the respondent at the 5th Flr. Crown Center, 158 Jupiter cor. N. Garcia, Makati City. Said demand letter was received by a certain Cindy Flores. To date however nothing has been heard from the defendant. Copy of the 2nd demand letter is hereto attached and marked as ANNEX “I”, forming an integral part hereof; 20. On account of tax mapping conducted by the Office of the Municipal Assessor of Sto. Tomas, Batangas, new tax declarations were issued by the said office increasing the size of the two properties and issuing new tax declarations but containing the same adverse claim filed by the defendant as follows: ARP No. 008-00438 ARP No. 008-00439

to to

ARP No. 2006-008-02002 ARP No. 2006-008-01998

Copies of the new Tax Declarations are hereto attached and marked as ANNEXES “J” to “J-1”, all forming integral parts hereof.

CAUSE OF ACTION 21. Clearly, more than twenty one (21) years have elapsed for the defendant to exercise his rights under the “Contract To Sell” he asked the plaintiffs to sign. This is a clear manifestation that he is no longer interested in pursuing the purchase of the properties from the plaintiffs; 22. Under Article 1144 of the New Civil Code an action based upon a contract must be filed within ten (10) years from the time the right of action accrues. Defendant’s right of action to recover based on the “Contract to Sell” he asked the plaintiff’s to sign is now barred by prescription; 23. Plaintiffs are therefore now entitled to cancel the intended sale with the defendant, and be considered relieved of their obligations thereto and may now freely convey, transfer or encumber said properties without any legal obstacle; 24. Plaintiffs likewise should now be entitled to cause the cancellation of the Adverse Claim annotated in the ARP Nos. 008-00438 and 008-00439, derivatives of ARP Nos. 2006-008-02002 and 2006008-01998, duly recorded at the Office of the Municipal Assessor of the Municipality of Sto. Tomas, Batangas under the name of Cirilo Villanueva and Andrea Manzanilla Villanueva; 25. By reason of the inaction of the herein defendant, plaintiffs are unlawfully being deprived of the enjoyment and use of their property and prospective buyers are behooved from buying the property in view of the annotation of adverse claim made by the defendant on the tax declaration of the properties; 26. By reason of the malicious refusal of the defendant to address the demands made by the plaintiffs, the latter were constrained to engage the services of counsel to whom they are obligated to pay the amount of Seventy Thousand Pesos (P70,000.00) by way of acceptance fees and Seven Thousand Pesos (P7,000.00) by way of appearance fees for every appearance; 27. By reason of the malicious failure of the defendant to comply with what was incumbent upon him under his contract with the plaintiffs, the latter were unreasonably deprived of the use and enjoyment of their property for over twenty-one (21) years, the defendant must be made to pay the plaintiff by way of liquidated damages in the amount of P500,000.00. 28. The real property taxes due on the properties subject matter hereof are all duly paid. Copies of the official receipt of real property payments are hereto attached and marked as ANNEX “K”, forming an integral part hereof; 29. The properties are not subject of any levy or attachment by the government or any private entity for any obligation whatsoever.

PRAYER

PREMISES CONSIDERED, it is most respectfully prayed that, after due notice and hearing, judgment be rendered:

1. Declaring the Contract to Sell executed by the parties as CANCELLED by reason of the failure of the defendant to comply with what is incumbent upon him under the said contract; 2. Declaring the plaintiffs relieved from their obligation under the Contract to Sell they signed; 3. Ordering the cancellation of Adverse Claim annotated in the ARP Nos. 2006-008-02002 and 2006-008-01998, formerly ARP Nos. 008-0043 and 008-00439, respectively; 4. Ordering the defendant to pay attorney’s fees in the amount of P70,000.00 and reasonable appearance fees in the amount of P7, 000.00 per appearance; 5. Ordering the defendant to pay the plaintiff’s the amount of P500, 000.00 by way of liquidated damages;

Other relief just and equitable under the circumstances.
