Plaintiffs, Efren Villanueva, Peter Villanueva, Alejo Villanueva, Cirilo Villanueva, Felix Villanueva, Tiburcio Villanueva, Diana V. However, after obtaining their respective signatures, they were never given any copy thereof nor were they asked to appear before notary public to have it notarized; ATTY. VLADIMIR BERLA S. DARAL 8. 13. Plaintiffs however are no longer certain that the copy given them is a faithful reproduction of the same document they signed in 1996 when they received the initial down payment from the defendant. As far as their recollection is concerned, the provisions written in the unnotarized “Contract To Sell” does not express the correct conditions they agreed upon when they were asked to sign a document; 14. Sometime in 2016, some of the plaintiffs went to visit the subject properties but were not allowed entry by the security guards posted by the defendant. Plaintiffs filed a complaint before the Barangay to compel the guards to leave the area. As of date however, it appears that defendant has already vacated the properties pursuant to the Certificate of Non- Tenancy, copy of which is hereto attached as ANNEX ‘G”, forming an integral part hereof; 15. Subsequently, sometime on January 2018, some of the plaintiffs once again visited the defendant at his office in Makati City, but like before, defendant did not face them but instead sent a certain Mr. Robert Bolodo who informed them that defendant wanted a return of the amount previously paid plaintiffs in 1996 or after over twenty-one (21) years with interests; 16. For over twenty-one (21) years therefore, defendant never exerted any effort to comply with the terms imposed in the Contract To Sell he asked the plaintiffs to sign. Neither did he make any additional offer to pay the remaining balance of the original purchase price agreed upon with the plaintiffs; 17. On March 18, 2018 counsel for the plaintiffs sent a demand letter (via registered mail with return card) to the defendant notifying him of their intent to cancel the Contract To Sell they entered with the latter and to cause the cancellation of the adverse claim it caused to be annotated in the Tax Declarations of the properties. Said demand letter was initially sent to the address provided by the defendant in the Affidavit of Adverse Claim he executed, i.e., Unit 803, Orient Mansion, Tordesillas St., Salcedo Village, Makati City. However, no return card was ever received back by counsel. Copy of the demand letter with the post office receipt are hereto attached and marked as ANNEXES “H” to “H-1”, forming integral parts hereof; 18. Impatient with the delay, counsel sent his messenger Preny Dador to personally serve the demand letter to the defendant but much to his surprise, a foreigner is now occupying as the latter’s residence at Unit 803, Orient Mansions, Tordesillas St., Salcedo Village, Makati, the same address defendant indicated Affidavit of Adverse Claim. Upon query, the foreigner claimed that he has been occupying the unit as his residence; 19. After research however, another demand letter dated March 13, 2018, was sent to the respondent at the 5th Flr. Crown Center, 158 Jupiter cor. N. Garcia, Makati City. Said demand letter was received by a certain Cindy Flores. To date however nothing has been heard from the defendant. Copy of the 2nd demand letter is hereto attached and marked as ANNEX “I”, forming an integral part hereof; 20. On account of tax mapping conducted by the Office of the Municipal Assessor of Sto. Tomas, Batangas, new tax declarations were issued by the said office increasing the size of the two properties and issuing new tax declarations but containing the same adverse claim filed by the defendant as follows: ARP No. 008-00438 ARP No. 008-00439

Copies of the new Tax Declarations are hereto attached and marked as ANNEXES “J” to “J-1”, all forming integral parts hereof.

CAUSE OF ACTION 21. Clearly, more than twenty one (21) years have elapsed for the defendant to exercise his rights under the “Contract To Sell” he asked the plaintiffs to sign. This is a clear manifestation that he is no longer interested in pursuing the purchase of the properties from the plaintiffs; 22. Under Article 1144 of the New Civil Code an action based upon a contract must be filed within ten (10) years from the time the right of action accrues. Defendant’s right of action to recover based on the “Contract to Sell” he asked the plaintiff’s to sign is now barred by prescription; 23. Plaintiffs are therefore now entitled to cancel the intended sale with the defendant, and be considered relieved of their obligations thereto and may now freely convey, transfer or encumber said properties without any legal obstacle; 24. Plaintiffs likewise should now be entitled to cause the cancellation of the Adverse Claim annotated in the ARP Nos. 008-00438 and 008-00439, derivatives of ARP Nos. 2006-008-02002 and 2006008-01998, duly recorded at the Office of the Municipal Assessor of the Municipality of Sto. Tomas, Batangas under the name of Cirilo Villanueva and Andrea Manzanilla Villanueva; 25. By reason of the inaction of the herein defendant, plaintiffs are unlawfully being deprived of the enjoyment and use of their property and prospective buyers are behooved from buying the property in view of the annotation of adverse claim made by the defendant on the tax declaration of the properties; 26. By reason of the malicious refusal of the defendant to address the demands made by the plaintiffs, the latter were constrained to engage the services of counsel to whom they are obligated to pay the amount of Seventy Thousand Pesos (P70,000.00) by way of acceptance fees and Seven Thousand Pesos (P7,000.00) by way of appearance fees for every appearance; 27. By reason of the malicious failure of the defendant to comply with what was incumbent upon him under his contract with the plaintiffs, the latter were unreasonably deprived of the use and enjoyment of their property for over twenty-one (21) years, the defendant must be made to pay the plaintiff by way of liquidated damages in the amount of P500,000.00. 28. The real property taxes due on the properties subject matter hereof are all duly paid. Copies of the official receipt of real property payments are hereto attached and marked as ANNEX “K”, forming an integral part hereof; 29. The properties are not subject of any levy or attachment by the government or any private entity for any obligation whatsoever.

PRAYER

PREMISES CONSIDERED, it is most respectfully prayed that, after due notice and hearing, judgment be rendered:

1. Declaring the Contract to Sell executed by the parties as CANCELLED by reason of the failure of the defendant to comply with what is incumbent upon him under the said contract; 2. Declaring the plaintiffs relieved from their obligation under the Contract to Sell they signed; 3. Ordering the cancellation of Adverse Claim annotated in the ARP Nos. 2006-008-02002 and 2006-008-01998, formerly ARP Nos. 008-0043 and 008-00439, respectively; 4. Ordering the defendant to pay attorney’s fees in the amount of P70,000.00 and reasonable appearance fees in the amount of P7, 000.00 per appearance; 5. Ordering the defendant to pay the plaintiff’s the amount of P500, 000.00 by way of liquidated damages;

Other relief just and equitable under the circumstances.

‘BoC greets 2019 with reshuffle’

AGPATIBAY kamakailan si Bureau of Customs (BoC) Commissioner Rey Guerrero ng isang high-level reshuffle o pagbabalasa nang sa kanyang paniwala’y makakabuti ito sa pamamalakad ng organisasyon at para na rin mapagaan ang kanyang trabaho na makamit ang Collection Target sa kasulukuyang taong 2019.

Alinsunod sa isang Customs Personnel Order na kanyang nilagdaan nakaraang Enero 4, iniutos ni Guerrero LOUIE LOGARTA ang reassignment ng ilang matataas na opisyal sa Aduana, base na rin sa kani-kanilang performance. Si Collector Dina Austria (na diumano’y inaanak sa kasal ni Pangulong Duterte) ay ginawang acting district collector ng Manila International Container Port (MICP), mula sa kanyang dating kinalalagyan sa Compliance Monitoring Unit (CMU) ng Office of the Commissioner. Commissioner Guerrero (PHOTO BY: MELVIN TOLEDO) Si Atty. Rhea Gregorio naman ay na-promoted bilang acting district collector ng Port of Manila (PoM), mula sa dati niyang puwestong district collector ng Port of Subic. Si Maritess Martin ay itinalagang acting district collector ng Port of Subic, mula sa pagiging acting district collector ng Port of Manila. OFWs na may HIV, suportado ng bagong AIDS Law

TINITIYAK ngayon ang mas maayos na suporta sa mga Overseas Filipino workers (OFWs) na may human immunodeficiency virus o HIV sa ilalim ng bagong AIDS Prevention and Control Law. Epektibo simula Enero 25 ngayong taon ang bagong Republic Act 11166 na nagkakaloob ng mandato sa Overseas Workers Welfare Administration (OWWA) upang magbigay ng suporta at pangangalaga sa mga migranteng manggagawa na mayroong HIV, ayon kay ACTSOFW Rep. Aniceto Bertiz III.

“Under Section 37 of the new law, the OWWA, together with other agencies, is dutybound to develop a program to provide a stigma-free comprehensive reintegration, care, and support program, including economic, social, and medical support for OFWs with HIV, regardless of employment status and stage in the migration process,” ani Bertiz. The activity gathered more than 700 dog and cat owners giving them better access to animal services, such as spaying and neutering, as well as opportunities to adopt pets. It also seeks to strengthen public safety and security through free rabies vaccination and dry grooming. According to Charisse Abalos-Vargas, Mandaluyong City Councilor and founder of the project, a codified ordinance on responsible pet ownership is now underway in their local government. With initiatives like “Pet Ko Luv Ko,” the council has gathered insights on the needs and capabilities of Mandalenyos as pet owners. “I have always loved dogs and, it hurts me whenever I see so many of them tied up or caged the whole day. I also get stories about abandoned animals that cause problems in the community. The data on animal bites have not decreased as much, leading to more animals, dogs, in particular, being harmed and abandoned,” added Vargas. “I’m glad that every year more and more people are showing their interest and intent of participating in making the change happen.” As a way of supporting the project, Ganador, a brand committed to strengthening the bond among dogs and their owners, provided free products, as well as information dissemination on responsible pet ownership during the event.

MISS INTERCONTINENTAL 2019

HE 47th Miss Intercontinental Pageant is now being held in Manila. It was my first time on Thursday to witness an international pageant event, thanks to spouses Ram and Marilyn de Mesa who invited me to the media presentation. Ram is a key figure in the pageant, particularly in the evening gown competition, formally dubbed as the Philippine Designers Filipiniana Fashion Show, to be held on January 17, 6:00 p.m. at the Okada Grand Ballroom. On Coronation Night on January 26, Marilyn will be one of the judges. She is a fraternity sis and in the many years that I have known her, I have seen how hard she has worked her way up in the corporate ladder, but always with her feet kept on the ground. She is sensible and calm, and very humble, compassionate, and fun. She oversees top multinational accounts of Seasons Travel and Tours, where she is founder and general manager, living up to its name as one of the most efficient, innovative, and trustworthy travel consultancy firms in the country for over 21 years now. She is also one of the founders and owners and currently vice president of Medcare Tour Manila, Inc., which is one of only four medical tourism facilitation

companies in the country that have been accredited by the Department of Tourism to promote the Philippines as a major choice of destination for medical treatment of patients from all over the world. It is not as if Marilyn is one of the candidates to the Miss Intercontinental Pageant (lol), but I would just like to recognize one of the best people in her field who is “confidently beautiful with a heart,” to borrow the competition motto of the Miss Universe Organization (MUO), to which the Miss Intercontinental

Pageant belongs. The MUO has five other international competitions aside from Miss Intercontinental. These are Miss Universe, Miss International, Miss Supranational, Miss Grand International, and Miss Globe. The Philippines has yet to win the Miss Intercontinental title. Eighty-seven candidates were presented to the media on Thursday at the Mindanao Ballroom of the Sofitel Philippine Plaza. Our country’s representative, 26-year old, 5’5 1/2 tall Filipino-Australian Karen Gallman, won two special awards during the media presentation—H&H Standout Beauty and Media Favorite. She was an operations analyst in London before joining the Binibining Pilipinas Pageant in 2012 at the early age of 19. I am glad I’m not in Marilyn’s shoes. With all the beauties I’ve seen last Thursday, the hardest job on Coronation Night would be that of Marilyn and her fellow judges.

Confronting this court is a petition filed by Jose Aristotle C. Despite diligent efforts to locate it, Mr. Estolloso could no longer found it. For all intents and purposes, the Owner’s Duplicate Certificate of TCT No. T-25646 was considered irretrievably lost; 4. After having exerted all efforts to find the lost Owner’s Duplicate Certificate of TCT No. T-25646 and having been convinced that the same is lost beyond recovery, Mr. Estolloso executed an Affidavit of Loss and caused the annotation of the same in the original copy TCT25646 on file with the Registry of Deeds for Las Pinas City; 5. The absence of Owner’s Duplicate Certificate of TCT No. T-25646 is not attributable to any sale, transfer or conveyance to any person by way of assignment, mortgage or otherwise; nor was it presented to the Registry of Deeds for transfer or registration. Mahusay rin kasi ang kanyang performance nang pamunuan niya ang BI Davao field office. DAR targets zero backlog of legal cases

Award mula sa Office of the Ombudsman dahil sa organisadong frontline services, at ang excellent rating na nakuha mula sa Civil Service Commission dahil sa pagiging compliant sa Anti-Red Tape Act. Noong Disyembre 2018, ang lungsod ng Taguig ay nabigyan ng parangal sa pag-rank nito ng second place sa 2017 Bureau of Local Government Finance Collection Target for Business Tax na kumikilala sa local collection efficiency ng bawat local government units sa buong Metro Manila. Ang Taguig City, sa kabila ng pagiging isa sa pinaka-batang syudad sa bansa, ay kinilala noong Agosto 2017 ng National Competitiveness Council of the Philippines bilang Most Improved Local Government Units sa kategoryang Highly Urbanized Cities. “We are always thinking of ways to improve our services for our taxpayers. We wanted to stay true to our commitment that the City of Taguig is indeed a business-friendly city, and these achievements already speak for themselves. The Department of Agrarian Reform (DAR) is on track this 2019 to achieve a zero backlog on Agrarian Legal Implementation (ALI) cases. This following the resolution of most of its cancellation cases last year. According to its Bureau of Agrarian Legal Assistance, the DAR in 2018 resolved 84.80% of its cancellation cases or 1,529 of 1,803 caseloads. The agency has also evaluated 3,241 out of the 3,601 caseloads concerning cancellation without ALI cases. These are now en route to their respective regional offices for final disposition, segregation and transfer into individual Certificates of Land Ownership Awards (CLOA). “These cancellation cases go as far back as 2012. Agrarian Reform Secretary John R. Castriciones has ordered us to step up our game in our bid to attain a zero backlog of agrarian cases,” DAR Legal Affairs Undersecretary Luis Meinrado Pangulayan said. Pangulayan said the decided cancellation cases mostly involved collective CLOAs. “We are fast-tracking these cases in response to President Rodrigo Duterte’s preference to turn collective CLOAs into individual CLOAs,” Pangulayan said. “Individual CLOAs are better because they enable farmer-beneficiaries to have a clear and defined ownership of parcels of land. This is unlike collective CLOAs where a group of farmers owns the land,” he added. Early last year, Castriciones directed the legal sector of DAR to simplify and shorten legal proceedings by doing away with unnecessary steps that only contribute to the delay in the resolution of cases.

Sa ating palagay, kung anuman ang “issues” tungkol sa mga sangkot ay hindi dapat sinasabotahe ang operasyon sa airport.

He also believes na dapat bigyang respeto ang senior officers na kanyang dinatnan sa POD. Being a personal choice of DOJ Secretary Menardo Guevarra and Commissioner Morente, his expertise in handling a big number of employees noong nasa personnel section pa siya ang isang armas niya para gawing solid ang samahan ng buong dibisyon. Pagdating sa operations ng POD, nariyan pa rin ang mga dating tao na iniluklok ni soon-to-be Muntinlupa City Mayor Marc Red Mariñas. Alam naman ng lahat na bago bumaba sa puwesto si Mariñas ay siniguro muna niya na iiwanan niya sa mabubuting kamay ang POD.
