A

s we approach the end of the year, I want to take a moment to update you on significant legislative developments in Washington that directly affect our industry. Congress is actively working on two major pieces of legislation—the National Defense Authorization Act (NDAA) and the Coast Guard Authorization Act—both of which carry implications for the American Salvage Association (ASA) and its members.

While the NDAA continues to support the Navy’s acquisition of Navajo Class salvage tugs, it is the Coast Guard Authorization Act that contains the most relevant provisions for our community. These changes reflect both regulatory shifts and emerging opportunities for those engaged in salvage and offshore response operations.

WHAT’S CHANGING AND WHY IT MATTERS 1. Credentialing Relief for Salvors and Divers The bill extends a two-year exemption from Coast Guard credentialing requirements for non-operating individuals such as salvors and divers aboard U.S.flagged vessels. This is a critical win that the ASA helped achieve for operational flexibility during emergency response. Hats off to the past and present

members of the Regulatory Committee for keeping focus on this initiative.

2. Expanding the Mariner Workforce Changes to citizenship and sea time requirements aim to broaden the pool of credentialed merchant mariners. This will help address staffing challenges and support the offshore response capacity ASA members rely on.

3. Abandoned Vessel Reforms The Act expands current law to include all vessel types, not just barges, under abandonment regulations. It clarifies Coast Guard responsibilities, assigns financial liability for removal, and introduces penalties for non-compliance. Importantly, it mandates the creation of a public database of abandoned vessels, which could present new business opportunities for ASA members.

4. Enhanced Oversight of Salvage and Marine Firefighting (SMFF) The Coast Guard will be authorized to implement a robust oversight framework, including: •P eriodic inspections of vessels and equipment

hora que nos acercamos al final del año, quiero dedicar un momento a informarles sobre los importantes avances legislativos en Washington que afectan directamente a nuestro sector. El Congreso está trabajando activamente en dos importantes proyectos de ley: la Ley de Autorización de Defensa Nacional (NDAA) y la Ley de Autorización de la Guardia Costera, ambas con implicaciones para la Asociación Americana de Salvamento (ASA) y sus miembros.

Si bien la NDAA sigue apoyando la adquisición por parte de la Marina de remolcadores de salvamento de la clase Navajo, es la Ley de Autorización de la Guardia Costera la que contiene las disposiciones más relevantes para nuestra comunidad. 5. Additional Provisions of Note • Litigation Shielding: Federal On-Scene Coordinators’ decisions will be protected from litigation until oil removal is complete.

These provisions represent a mix of regulatory relief, new compliance obligations, and potential business opportunities. As always, ASA will continue to monitor these developments closely and advocate for the interests of our members.

I encourage all ASA members to stay informed and engaged. The maritime industry is evolving, and our collective voice and expertise are more important than ever.

s summer draws to a close and kids return to school, we all settle into the last push for the calendar year. This is an opportunity to refine our schedules and action plans to meet our year end goals so many of us set for ourselves in January every year. December will be here sooner than we think.

I encourage everyone, as you look ahead, to lock the ASA Annual General Meeting (AGM) date of 02 December into your calendars. Our AGM in New Orleans this year offers an excellent opportunity to network with member companies, engage our government partners, hear the latest lessons learned and best practices in the salvage industry and reconnect with your peers just ahead of the International Workboat Show and Underwater Intervention. Our AGM Agenda will be published, and registration will open next month. Early registration helps the staff make the final preparations and is greatly appreciated. On 01 December, the ASA will hold its first golf outing at the beautiful TPC Louisiana Golf Course.

We have several golfers registered to play, so if you are a golfer, take advantage of the Louisiana weather in December to get out and play with other members. Sign up here if you’re interested.

In addition to blocking the date on your calendars, consider participating by sharing your successes and lessons learned with your fellow members and as you think about lessons learned, consider how those lessons translate into best practices. In my experience, lessons that are not incorporated into documented best practices are too often, not learned at all, and we will, more often than not, repeat the same actions or inactions that brought about the undesired outcome that we failed to learn from. Why not share those best practices with your peers in a short presentation at this year’s AGM? There are still slots on the morning agenda which you can fill with your presentation.

It was a statement about the Association’s evolving leadership in a sector that demands precision, agility, and coordination.

Nearly a decade later, the award remains a meaningful milestone. It validates not only the ASA’s operational readiness and strategic influence, but also its capacity to set industry-wide standards for professional response, environmental stewardship, and collaboration.

THE AWARD The Lloyd’s List North American Maritime Awards are considered among the highest accolades in the maritime industry. They recognize excellence across a wide range of categories, from innovation to safety, and from port operations to regulatory leadership. Each winner is selected by an independent panel of judges with deep expertise in the maritime sector.

In 2015, ASA was awarded for Marine Casualty Response, a category that highlights outstanding response to marine incidents involving wreck removal, fire, pollution control, cargo salvage, and vessel recovery. This is not a theoretical distinction; it’s a real-world acknowledgment that the ASA and its members had made a measurable difference in some of the most challenging environments in modern salvage history.

WHY IT MATTERED IN 2015 To understand the weight of this award, it’s essential to recall what ASA and its members achieved by 2015.

Hurricane Response ASA member companies were central to marine casualty operations following Hurricanes Katrina, Rita, and Ike, where ports, terminals, and vessels faced severe damage. Their efforts in refloating vessels, wreck removal, and debris clearance helped accelerate port reopenings and restore critical supply chains.

International Crisis Support When a catastrophic earthquake struck Port-au-Prince, Haiti, ASA members supported the United States Navy and other humanitarian missions by helping clear the harbor of debris and ensuring that vessels carrying aid could safely enter port.

Training and Advocacy The ASA wasn’t just responding to emergencies; it was also building capacity. By 2015, the Association had become a consistent voice in U.S. and international regulatory discussions. It collaborated with the U.S. Coast Guard, supported the implementation of the

In short, the 2015 award recognized more than just “a job well done.” It honored a decade and a half of operational excellence, regulatory influence, and strategic leadership.

THE AMERICAN SALVAGE ASSOCIATION: MORE THAN A TRADE GROUP Founded in 2000, the ASA was established to unify the voices of professional salvors across North, Central, and South America. At the time, there was no single organization dedicated solely to the interests, professionalism, and advocacy of the salvage industry in the Western Hemisphere.

In its first fifteen years, the ASA evolved from a small collective into a trusted liaison between salvors, regulators, insurers, and vessel owners. The Association routinely advised U.S. federal agencies, served as a subject matter expert in maritime law circles, and advocated for environmental and operational best practices.

Its success hinged on two things: member expertise and strategic partnerships. ASA’s membership roster

The 2015 Lloyd’s award validated this approach as it acknowledged that the ASA’s cooperative model worked, and that it delivered real-world outcomes in moments of crisis.

3. Public Awareness The recognition provided an opportunity to demystify the role of the salvor. Through media interviews, conference presentations, and publications, ASA helped convey the critical function that salvors perform in protecting both commerce and the environment.

MARINE CASUALTY RESPONSE: A CATEGORY OF CONSEQUENCE Winning in the Marine Casualty Response category isn't about flashy innovation or marketing. It's about real-life situations: sunken hulls, ruptured fuel tanks, burning cargo, lives at risk, and ecosystems in danger.

It’s about assembling teams, deploying equipment, and executing under pressure, often in remote or chaotic conditions.

The judges at Lloyd’s List recognized that the ASA’s structure, which allows multiple salvage firms to work in cooperation while maintaining high standards, enabled rapid, coordinated, and expert responses to such incidents. This was especially important in an era where maritime trade was becoming more complex and risk prone.

LASTING IMPACT AND CONTINUED RELEVANCE Today, that award still resonates. It helped solidify ASA’s status as a standard-bearer for salvage operations throughout the Americas. More importantly, it served as a catalyst for continued growth in several key areas: 1. Training & Workforce Development Following the award, ASA doubled down on its support for training programs, including partnerships with maritime academies and simulation-based salvage exercises. The Association recognized that the future of effective salvage lies in education, mentorship, and professional development.

2. Regulatory Engagement The award bolstered ASA’s reputation as a trusted in-

4. Environmental Response In the years since receiving the award, the ASA has placed an even stronger emphasis on pollution prevention and environmental accountability. Its members have responded to oil spills, cargo losses, and reef-grounding incidents with increasing technical and ecological sophistication.

A MODEL WORTH REPLICATING The ASA’s model has shown that salvors don’t need to operate in silos or compete to the detriment of safety.

Instead, by collaborating, they can increase both responsiveness and resilience.

That’s a message worth revisiting in 2025. As the shipping industry navigates the challenges of today, including but not limited to, megaships, cyber threats, and geopolitical instability, the need for capable, coordinated, and credible salvage response is greater than ever.

hen the Oil Pollution Act of 1990 (OPA 90) was passed in the aftermath of the Exxon Valdez spill, few could have predicted how profoundly it would reshape the U.S. maritime landscape. The law placed accountability squarely on vessel owners and operators for pollution response and preparedness, demanding they maintain robust contingency plans. Yet while OPA 90 created an unprecedented framework for oil spill prevention and response, it left open the question of how salvage and marine firefighting (SMFF) capabilities would be codified and integrated. That gap would become the focal point for the American Salvage Association (ASA). Since its

OPA 90 AND THE SEEDS OF SMFF REGULATION OPA 90 was the most sweeping U.S. maritime environmental law of its time, requiring vessel response plans (VRPs), financial responsibility, and dedicated resources for pollution control. For salvage professionals, though, one issue remained unresolved: while oil spill contractors and equipment providers were clearly addressed, there was no comparable clarity on the requirements for salvors and marine firefighters.

Salvage and firefighting capabilities had always been essential in preventing spills, not merely cleaning them up. Yet OPA 90’s early framework didn’t spell out how such services would be ensured. As a result, throughout the 1990s, the U.S. Coast Guard began consulting with industry stakeholders, trying to craft enforceable rules that would eventually mandate the inclusion of salvage and firefighting providers in vessel response plans.

This was the regulatory vacuum into which the American Salvage Association was born.

THE BIRTH OF ASA: A COLLECTIVE VOICE The ASA was formally established in 2000 by a group of leading U.S. salvage companies who recognized that their industry needed a unified voice. Individually, salvors had always worked directly with shipowners, insurers, or regulators, but OPA 90 created a new regulatory frontier. The Coast Guard’s planned SMFF regulations would dictate who could be contracted, what resources had to be available, and how quickly those resources could be deployed.

Final Rule. For nearly a decade, ASA members participated in workshops, submitted comments, and testified in hearings.

Key issues included: • Response timeframes: ASA argued for practical standards that accounted for weather, geography, and equipment mobilization.

• Capability requirements: ASA helped define feasible levels of firefighting, dewatering, lightering, and emergency towing services.

The salvors understood that without their input, the rules risked being unrealistic, demanding capabilities that were technologically or logistically impractical. The founding of ASA therefore gave the industry a seat at the table. From the start, one of ASA’s top priorities was influencing OPA 90 rulemaking, particularly as it applied to salvage and firefighting.

• Contracting and verification: ASA advocated for transparent vetting to prevent 'paper compliance' by companies lacking real capacity.

ASA AND THE COAST GUARD: RULEMAKING IN ACTION In the early 2000s, the Coast Guard began drafting what would become the Salvage and Marine Firefighting

For ASA, this was both a victory and a responsibility.

The association had ensured that the rule was workable, balancing regulatory intent with operational reality. But it also meant that ASA members now carried a formal mandate. They were no longer just emergency responder; now they were an integrated, regulated part of national spill prevention and response infrastructure.

• Training: ASA emphasized that compliance required skilled personnel, not just equipment.

IMPLEMENTATION AND GROWING PAINS The years following the Final Rule’s adoption were marked by a steep learning curve. Vessel owners scrambled to secure compliant contracts, while the Coast Guard reviewed hundreds of VRPs. ASA members were at the center of this process.

• Contracting: ASA worked closely with shipowners and insurers to clarify service scope.

ASA also educated regulators and the maritime community, explaining how SMFF compliance fit into safety systems.

OPA 90 IN ACTION: REAL-WORLD SALVAGE CASES OPA 90’s SMFF requirements were tested in major incidents: • Deepwater Horizon (2010): Resolve Marine provided contracted vessels and expertise.

• Costa Concordia (2012): Though outside U.S. waters, ASA members’ capabilities showcased what OPA 90 regulations aimed to ensure.

• Hurricanes Katrina, Sandy, Harvey, Irma, Maria: ASA salvors cleared ports and waterways.

• Golden Ray (2019–2021): The capsizing highlighted the value of OPA 90-embedded salvage capacity.

In each case, vetted salvors under OPA 90 helped protect the environment and commerce.

CONTINUING ADVOCACY AND ADAPTATION As it enters its twenty-fifth year, the ASA views OPA 90 not just as a regulation but part of its organizational DNA. The law gave salvors a defined role in the nation’s maritime safety net, and ASA has embraced that responsibility.

The ASA’s history with OPA 90 is a story of mutual evolution. The law created a framework; ASA provided expertise to make it functional. Today, ASA is a pillar of readiness, ensuring that when the next maritime emergency strikes, U.S. ports and coastlines are safeguarded by both regulation and a network of skilled salvors.

Simultaneously, T&T is managing daily diving, heavy lift, pollution response and hydrographic survey operations, including helping restore the historic Battleship TEXAS, recovering marine debris in an offshore National Marine Sanctuary, conducting emergency subsea surveys in response to exploding commercial rockets in South Texas, and beginning our decommissioning season in the Gulf of America.

Transiting Lake Superior

When a containership ran aground at Cedar Cove, Newfoundland, Canada on the morning of February 15, 2025, T&T Salvage was appointed as the salvor and arrived the next day to commence emergency fuel lightering and container offload operations. Battling severe weather and access challenges, to date, T&T Salvage has offloaded the majority of the ship’s 1250 m³ of heavy fuel oil and nearly half of the 472 containers, including safely removing dangerous cargo carried above deck. The vessel remains aground in Cedar Cove with operations anticipated to continue for the next several months.

On June 9, 2025, a container ship suffered multiple explosions with fires erupting throughout the vessel, forcing crew members to abandon ship. T&T Salvage

was selected as the salvor, and spent several weeks overcoming demanding offshore logistics, heavy weather and myriad fires and hazardous materials, to successfully establish positive control of the drifting ship. extinguish the fire, dewater and stabilize the vessel, and prepare the ship for transit. Pyrocool, a one hundred percent biodegradable foam, was used to extinguish the fire and cool the metal. Pyrocool is T&T’s proprietary product and is manufactured at its own manufacturing facility in Houston, Texas.

On June 8th, 2025, a Great Lakes Carrier, loaded with about 30,000 tons of limestone, ran aground near Sault Ste Marie, Michigan, on Lake Superior, damaging fuel and ballast tanks. As the vessel owner’s designated OPA 90 Salvage and Marine Firefighting Service Provider,

Last month, Talleres Industriales successfully completed a challenging structural repair on a 35-ton jib crane aboard a Panamax bulk carrier at the Balboa anchorage.

The damaged section was cropped, and a template was taken to fabricate new replacement parts. Once fabricated, the new section underwent structural integrity checks, including bend-point testing.

esolve Academy, a leading Florida-based provider of maritime training, hosted its 19th annual Damage Control Olympics on April 29. The competition of shipboard firefighting and vessel flooding exercises was designed for officers and crews from U.S. Navy and U.S Coast Guard visiting Port Everglades during Fleet Week Fort Lauderdale. Crews from the USS New Hampshire, USS New York, USCGC Tampa and USS Cole participated.

Resolve Marine and its training arm, Resolve Academy, created the Damage Control Olympics as a gesture of appreciation to the brave service men and women who defend the United States at sea. The event is an annual tradition, anticipated by service members who see it as an opportunity to demonstrate their skills, learn from their peers, and bond with their fellow crewmates.

The Damage Control Olympics took place at Resolve Academy’s training facility inside Port Everglades, aboard the T/V Resolve Vision, a 150-foot LOA mock training vessel. The state-of-the-art firefighting and damage control simulators feature confined spaces, low visibility, live fire, real heat and water ingress. Teams put their skills to the test in timed, practical, hands-on training exercises and shipboard emergency response scenarios that included navigating live fire smoke-filled environments, a search and rescue operation and a flooded ship chamber. The day provided participants with valuable training in a fast-paced, competitive environment with the opportunity to showcase their emergency response expertise.

In 2025, the USS New York emerged as the 2025 Damage Control Olympics winner and was recognized with medals and a pennant at a closing ceremony.

From August 5-7, 2025, the course took place at the NOAA Disaster Response Center in Mobile, AL. The informative training was presented to a classroom of 30 people, with the purpose of familiarizing the group with an in-depth overview of key topics and challenges faced when responding to marine casualties. The course content included making responders aware of rapidly emerging technologies and the need to ensure relevance and partnerships with industry professionals while aligning with ever-changing qualification criteria for the National Strike Force.

Bulk Carrier Ship Suffers Explosion at Site of Major Allision

nvestigators were working to determine the cause of an explosion that occurred aboard a coal-laden cargo ship as it departed Baltimore’s harbor en route to East Africa on August 18th.

Authorities reported that no injuries were sustained in the blast, which triggered a mayday call near the area where the Francis Scott Key Bridge collapsed last year.

Footage of the incident captured flames shooting into the air, followed by thick, dark smoke rising over the Patapsco River.

The Port of Baltimore’s main shipping channel was temporarily closed on Tuesday as crews searched for a hatch that had blown off the vessel and fallen into the water during the explosion. Officials confirmed that the channel had reopened by late afternoon.

According to marine tracking websites, the 751-foot (229-meter) merchant ship W-Sapphire was headed from Baltimore to East Africa and was expected to arrive at the Port of Mauritius in about a month.

The United States Coast Guard is investigating the cause of the explosion and T&T Salvage is on the scene as the contracted Salvage and Marine Firefighter.

aptain John Bauer relieved Captain Sal Suarez as the US Navy’s Commander, Supervisor of Diving and Salvage, Director of Ocean Engineering (SUPSALV) for the Naval Sea Systems Command. The ASA congratulates Captain Suarez on his leadership during his tenure in this national level position. Highlighting Captain Suarez’s tour, he led the successful removal of the MV Dali from the Francis Scott Key bridge and the clearing of Baltimore’s federal channel which led to the re-opening of the Port of Baltimore.

Captain Bauer assumes command after having a long and distinguished career serving first as a member of the Seabees’ Underwater Construction Teams, then an Explosive Ordnance Disposal (EOD) diver, and finally transitioning to an Engineering Duty Officer diver. He served in SUPSALV previously as an Underwater Ships Husbandry (UWSH) Project Manager. Most recently, he served meritoriously as the Commanding Officer of Southwest Regional Maintenance Center (SWRMC).
