s we are amid summer, the marine salvage industry has already geared up for another busy season. The marine salvage industry faces the dual challenge of bracing for nature's fury while navigating the evolving landscape of government regulations. In this summer issue, we focus on hurricane preparedness, providing vital strategies for safeguarding assets and minimizing damage in the face of unpredictable storms.

Additionally, we examine the latest regulatory changes, offering guidance on compliance and insights into how these new rules impact salvage operations. In an industry where unpredictability is the norm, readiness is not just a strategy—it's a necessity. The ability to think ahead, foresee potential challenges, and prepare accordingly is what sets the top marine salvage operators apart. ASA members know that being ready means having the right tools, teams, and tactics in place long before a crisis hits. This proactive approach ensures that when disaster strikes, whether it's a sudden hurricane or an unexpected regulatory shift, our members can respond swiftly and effectively.

n pleno verano, la industria del salvamento marítimo ya se ha preparado para otra temporada alta.. La industria del salvamento marítimo se enfrenta al doble reto de prepararse para la furia de la naturaleza y navegar por el cambiante panorama de las normativas gubernamentales. En este número de verano, nos centramos en la preparación para los huracanes, proporcionando estrategias vitales para salvaguardar los activos y minimizar los daños frente a tormentas impredecibles.

aving completed development of our 2024 Member Pulse Survey, I hope every member will take a few minutes from your busy schedules to complete your survey. Your responses inform us of actions your Association needs to take to provide you with the most value for your membership. The survey provides each member with the opportunity to identify yourself or remain anonymous, should you wish.

Your candid responses provide real direction in where the Association moves forward.

The ASA Staff and Leadership have been busy developing plans for our Annual Meeting to be held in New Orleans in November. This year’s meeting will showcase the important role our members play in Keeping Maritime Commerce Flowing. The ability to safely, effectively, and efficiently move goods and commodities via maritime transportation is essential to the economic stability of any maritime nation. Any significant disruption in the flow of maritime commerce not only harms financial markets and employment opportunities, but it also threatens national defense. Members of the ASA provide vital capability and capacity to quickly respond to maritime incidents that threaten economic stability and national security. Through the ASA network of companies and the cooperation the Association promotes, our members continually support the flow of maritime commerce by:

• Protecting ships, cargo, and mariners from fires & flooding • Protecting the environment from oil and HAZMAT that could threaten safe passage on critical waterways.

• Clearing obstacles and hazards to navigation.

• Harbor clearance to permit ready ship terminal access.

• Developing strong relationships that result in rapid response to maritime disasters.

The presentations and ensuing discussion, coupled with the networking opportunities throughout the day, make this an opportunity you will not want to miss. Outlook on the 2024 Hurricane Season & What It Means for Local Salvors Payton Burge and Dustin Clark / Couvillion Group

long the Gulf and East Coast our summers are filled with fun in the sun, including fishing, BBQs, water sports, beach trips, and unfortunately hurricanes. The 2024 Hurricane season is forecasting an 85% chance of an above ordinary season. As members of the American Salvage Association, we should enter this hurricane season ready to embrace our roles as first responders. Our mission is to restore functionality to the maritime and oil and gas industries along the Gulf Coast through effective hurricane preparedness plans, preventative maintenance of equipment, and business continuity plans. By implementing these measures, we can ensure that companies are equipped to resume operations moments after a hurricane has passed.

HISTORICAL & FUTURE HURRICANE DATA As each year passes, both the Gulf and East Coast face numerous tropical storms and hurricanes, each unique in its impact and intensity. Florida, Texas, and Louisiana lead the nation with experiencing the highest frequency of these storms. Since the 1980s, there have been over seventy hurricanes (categories 1-5) to make landfall in the US, and they have caused over 1.3 trillion dollars in damage. This period included some of the most notable hurricanes: Ida, Michael, Harvey, and Katrina. In 2005, Katrina made landfall in southeast Louisiana causing around two hundred billion dollars (adjusted cost) in damages and caused over 1800 fatalities across Louisiana, Mississippi, and Alabama. The impacts from hurricanes prove to be devastating and costly not only because of the destruction caused by high winds (used to categorize these storms), but these hurricanes can also cause storm surges, inland flooding, coastal flooding, and tornadoes that can be equally as destructive.

What makes the 2024 Hurricane Season different?

The National Oceanic and Atmospheric Administration (NOAA), a federal agency within the Department of Commerce, is forecasting an 85% chance of an above-normal season. NOAA’s forecasting predictions include 17 to 25 total named storms (winds higher than 39 mph), 8-13 hurricanes (winds of 74 mph or higher), and 4 to 7 major hurricanes (winds 111 mph or higher).

In comparison, from 1991-2020 the average number of named storms each year was 14.4.

Several key factors that are contributing to these above average predictions include near record high ocean temperatures in both the Atlantic and Caribbean Sea

and one of the strongest El Ninos ever recorded which means a rapid transformation into La Nina. La Nina creates favorable conditions for tropical systems due to less vertical wind shear.

The record high ocean surface temperatures that the Atlantic is experiencing allows tropical systems to develop later into the hurricane season towards the end of November; also, rapid intensification (increase of 35 mph in 24 hours or less) of storms greatly reduces the amount of time that citizens located within the proximity of a hurricane must complete their hurricane preparedness plans. Warmer atmospheric temperatures and less wind has helped contribute to the ocean surface temperatures increase of 2° Fahrenheit when compared to the previous three decades.

HOW TO PREPARE Key factors to keep in mind while preparing for an intensified hurricane season: keeping up with weather forecasts, preparing evacuation plans, and keeping/making a disaster survival kit. NOAA is introducing two new forecasting models to help the public become aware of new tropical developments: MOM6 (Hurricane Analysis and Forecast System) and SDCON (Probability of Tropical Cyclone Rapid Intensification). Preparing evacuation plans help identify how and where people will go in case of a hurricane or natural disaster. For example, New Orleans would need approximately 72 hours to evacuate the city if a hurricane made a direct impact. As the hurricane season develops and storms approach, stores will begin to run out of essential goods.

This is why it is important for all citizens that are subject to tropical or hurricane force storms to build a disas-

ter survival kit, with at a minimum, the following items: canned food, water, first aid kit, prescription medications, matches, emergency lighting, and batteries.

With Hurricane Beryl already making history as the earliest Category 5 hurricane on record in the Atlantic, Beryl was also the furthest east a hurricane has formed in June.

Hurricane Beryl underwent two rounds of rapid intensification and was able to gain ninety-five mph in less than two days due to unusually high ocean temperatures. NOAA’s forecasts indicated these record high temperatures as a key factor for predicting an above average hurricane season. With rapidly intensifying storms, salvors preparations now are key for a safe and timely response. To effectively prepare for hurricanes, salvors should focus on several key steps: communication with local and state officials, regularly check forecast models to anticipate storm developments, procure and maintain essential equipment and ensure adequate fuel supply for operations, develop and update emergency response plans to address various scenarios, and establish and test reliable communications to ensure coordination during emergencies.

IMPORTANCE OF SALVORS TO THE INDUSTRY What happens next? After the hurricane/storm passes, salvors are typically one of the first to arrive on location; they are required to begin working on saving both life and property while doing so to protect the environment.

With the marine economy responsible for two percent of the gross domestic product (GDP) with a 476-billion-dollar economic impact in 2022 and responsible for supplying over 2.4 million jobs; salvors must be prepared to answer the call whether it is construction efforts to repair ports to restore marine transportation or environmental cleanup efforts resulting from the oil and gas industry. Nearly 40% of the United States population lives in or near these coastal regions, all of which rely heavily on the marine industry: tourism, commercial trade, seafood production, and oil/gas production which in turn means they rely on salvors after a natural disaster to restore their way of life. It is of utmost importance that we, as members of the American Salvage Association, have our essential equipment and supplies safe, secure, and prepared for the rescue and restoration of our Gulf Coast regions.

ABOUT THE AUTHOR: Payton Burge is a Project Engineer/Assistant Project Manager at Couvillion Group for the past year. He is a project engineer and offshore rep on the highly successful, first of its kind subsea oil spill containment and collection system for the longest running oil spill in U.S. history at Mississippi Canyon Block 20 site in the Gulf of Mexico, and he was also a part of the Couvillion team that assisted with the 2023 Saltwater Intrusion, where saltwater from the Gulf of Mexico pushed up the Mississippi River and affected the drinking water supply for towns along the Mississippi River in Plaquemines Parish. Couvillon was responsible for delivering freshwater by barge to the water treatment facilities in Belle Chasse, Dalcour, East Point-a-laHache, and Port Sulphur. Payton Burge is a graduate of Mississippi State University earning his Bachelor of Science degree in Civil Engineering in 2023.

ABOUT THE AUTHOR: Dustin Clark has been a Senior Project Engineer at Couvillion Group for the past three years. He is the lead project engineer on the highly successful, first of its kind subsea oil spill containment and collection system for the longest running oil spill in U.S. history at the Mississippi Canyon Block 20 site in the Gulf of Mexico. Clark has overseen the collection, capture, and recycle of over 1.5 million gallons of crude oil that would have otherwise polluted the Gulf waters. His responsibilities on this historically significant project comprise the oversite of all aspects of the project, including but not limited to design, fabrication, installation, offshore operations, maintenance, decontamination/disposal of hazardous materials, permitting, data examination, report writing, project tracking, and cost analysis. his article discusses Sec. 401, “Vessel Response Plans”, in the proposed Coast Guard Authorization Act of 2024 (the Act) recently passed by the House of Representatives. This provision is of interest to those required to submit Vessel Response Plans (VRP) pursuant to OPA 90, as well as the Salvage Marine Firefighting (SMFF) resource providers and Oil Spill Removal Organizations (OSRO) who are contracted resource providers listed in those plans.

CONCERNS AND CONFLICTS EMERGE Most VRP holders and marine casualty response professionals understand that SMFF and OSRO capabilities require distinct contracting and operational expertise to provide effective services. This is recognized in the separate VRP regulations found at 33 CFR 155 Subparts D, J, and I. These regulations include that the VRP plan holder certifies, in writing, the availability of OSRO and SMFF resources via contract. In addition, the OSRO Classification and Preparedness Assessment Visit programs, managed by the Coast Guard National Strike Force Coordination Center, confirm resources are ready and capable to respond when requested. However, when the SMFF regulations were adopted, the Coast Guard disagreed that a classification system was needed at that time. Instead, those regulations provide a 15-point selection criteria plan holders will consider in the selection of a resource provider prior to entering into a contractual agreement. While most agree these programs can be improved, it is not clear if or how granting the Coast Guard authority to review private contracting would help as Sec. 401 proposes.

The proposed language confuses the verification and inspection of equipment, capabilities, and training, which, as noted above, already exist, with the Coast Guard’s new authority to “review contracts and relevant third-party agreements.” This proposed authority is substantial and concerning, as it vests a federal agency (the Coast Guard) with the authority to review, and perhaps require certain terms of or formats, for numerous private and complex contracts (something typically handled by the individual VRP holder, SMFF, or OSRO, and their attorneys). Obviously, the review and development of proper contract terms and format

is a legal matter, and something quite different from the inspection of operational capability, equipment, and training with which the Coast Guard has experience and is familiar.

In his testimony to Congress regarding SMFF resources, Coast Guard Rear Admiral Paul Thomas, former Chief of Prevention Policy, stated, salvage assets are not to be required on a firehouse standby. He testified further, if this were the case, it would have been reflected in the economic analysis and costs for the regulations would have been much, much higher. The same applies to OSRO resources, as well as the new proposed contract review authority being granted to the Coast Guard under the Act. Current regulatory language provides the Coast Guard rights and full opportunity to confirm the existence of valid response contracts, and verify equipment and capability, etc., but not review the individual private contract terms being utilized. Contract review (which implies approval or mandate of legal terms) appears contrary to OPA 90, under which the vessel operator has ultimate responsibility in the event of an oil spill.

The Coast Guard’s authority to review contracts will not, presumably, involve the Coast Guard ‘stepping into the shoes’ of the VRP holder, OSRO, or SMFF, assuming responsibility for performance, or making prudent business decisions, etc. The proposed language and new authority will only add confusion and increase the time and costs of compliance for the VRP holders, SMFFs, OSROs, and Coast Guard alike.

In addition, Sec. 401 “comingles” SMFF and OSRO functions as though they were identical. They are not.

While oil spill response and SMFF operations are critical for environmental protection and maritime safety, these operations are typically managed by separate entities with specialized resources and expertise.

Commingling resources can lead to conflicts when simultaneous oil spills and marine firefighting incidents occur. Shared resources may not be sufficient to address both emergencies effectively, potentially resulting in delayed responses and increased environmental damage. These two separate functions are regulated by the Coast Guard under separate regulatory regimes

Some have erroneously analyzed this legislation as merely codifying what is in current law (regulations), but it clearly goes much further and gives the Coast Guard unprecedented authority, beyond that intended by OPA 90. Background information suggests Sec. 401 was meant to address a perceived failure to activate SMFF services correctly under a particular VRP, although those facts are vague and need to be more precisely articulated. As currently understood, the purported vessel fire of concern seems to have been exacerbated by a local shoreside fire department taking over the firefighting from SMFF responders who were responding effectively as required by the VRP, not by some failure of the VRP or applicable contract terms between the VRP holder and SMFF. If this is the case, the language is misdirected, as the failure to activate SMFF services correctly under a particular VRP was not the problem in that case.

ONGOING CONFLICTING REGULATORY ACTIONS It is also worth pointing out that the USCG Office of Marine Environmental Response Policy (CG-MER) is currently engaged in an initiative called “Coast Guard’s National SMFF Taskforce” that is working on a variety of issues with the response community, SMFF providers, and senior USCG personnel. The Coast Guard and Congress should allow these processes to continue and wait for the benefit of input from the interested parties and experienced industry professionals on these important initiatives before adopting the new proposed legislation. OPA 90 compliance measures should be done in a deliberate fashion in cooperation with the industry with the aim of facilitating and ensuring capable response to oil spills and marine salvage incidents.

VRP holders, OSROs, and SMFFs cannot efficiently or effectively obtain the necessary approvals and ensure response capabilities when applicable requirements are changed before existing legislation and regulations have been fully understood and implemented. This too only causes additional confusion, and increased cost and time, something which must be avoided in the context of oil spill response. In addition, the current efforts to begin the implementation of the Western Alaska Oil Spill Response Planning Criteria are also just getting under way. Lots of moving parts and no need for an additional one without a sound foundation.

PROCEDURAL STATUS The Act passed the House earlier this year and pends before the Senate where it awaits action. A later attempt to incorporate the Act as an amendment to the House National Defense Authorization Act (NDAA) failed. This is significant because the NDAA is a “mustpass” bill for Congress, while the pending Act has a much lower priority. Congress may run out of time in the current session to complete the Coast Guard legislation. Presently, the Senate seems amenable to accepting the House's Sec. 401 language as originally proposed. The Senate has taken procedural steps to include a Coast Guard Authorization provision in the Senate’s version of the NDAA. As explained above, this would mean the requirements of OSRO and SMFF resource providers could be comingled; it could also vest the Coast Guard with new broad authority to “review response contracts and relevant third-party agreements.” Presumably, this would include contracts between VRP holders and the SMFFs and OSROs they utilize, as well as the various ‘downstream’ contracts used by OSROs and SMFFs to support the VRPs. The cost, extent, and practical implications of potential commingling and the Coast Guard review of these var-

CALL TO ACTION AND REMAINING QUESTIONS VRP holders, OSRO and SMFF providers, and their attorneys should consider the implications of this language and authority carefully. They should work on educating congressional staff that there is no need for the Coast Guard to “review” contracts or “relevant third-party agreements” given existing regulatory language, requirements, and processes. They should also ask the Coast Guard to provide examples of a pre-contracted response service provider being untimely or inadequate due to the terms or format of such a contract, as well as how the Coast Guard’s review/approval under the proposed language would improve the contracting situation and thus the response efforts. If some action is deemed necessary,

Congress should revise the language to confirm the Coast Guard’s authority to “verify contracts,” as it currently does for equipment and resources, rather than “review contracts,” which implies legal review and approval. Will Coast Guard attorneys with knowledge of contract law be involved in this review or will this be a collateral duty of operational duty officers? Will this review and approval process be different for OSRO and SMFF contracting, or will these functions be blurred?

OSROs and SMFFs have various types of ‘subcontracts’ which support their respective organizations and responsibilities. Will all these ‘subcontracts’ be subject to Coast Guard review and approval? What are the guidelines or criteria for approval? Will there be a formal rulemaking process to develop regulations for the review and approval process? What measures will the Coast Guard undertake to assure it is not imposing contract conditions that conflict or are unduly burdensome for the VRP holders and response contractors? What problem is the proposed grant of “contract review” authority attempting to fix, and how would it

CONCLUSION The development of appropriate federal law and supporting regulations is a dynamic and fluid process. VRP, SMFF, and ORSO stakeholders, and other interested parties, should keep a keen eye on the Act and provide thoughtful input before it becomes law. The ongoing regulatory initiatives to examine these issues should be allowed to conclude before changing the law. The importance of these matters cannot be understated. The proposed language and its effect upon the industry, and its ability to provide effective response to oil spills, should be given due and proper attention.

Winners will be notified before September 27, 2024, and will be announced in a variety of official marine industry publications via a press release and social media. Scholarship recipients will be invited to receive their award at NAMEPA’s Annual Conference & Awards Dinner in New York, NY on October 24, 2024. This is a unique opportunity for winners to interact and network with highly regarded marine industry representatives, potential employers, researchers, educators, and regulators.

The awards for both high school and undergraduate winners are five hundred dollars for first place, two hundred fifty dollars for second place and one hundred dollars for third place.

In this technology driven age many different methods exist to ensure proper communication. Cell phones, Microsoft Teams, email, satellite phones, text messages, WhatsApp, GroupMe, VHF and UHF are just the tip of the iceberg of potential technologies that can be used to communicate. When operating under ICS the comms plan should be followed but may need to be supplemented with internal company practices. One best practice that T&T Group utilizes for large responses is creating a group email and WhatsApp group taking the name of the response. These serve as a distribution group to relevant team members involved in the Response. By using this group email, we can ensure that personnel are not dropped off accidentally from the chain of emails.

Shared contact lists should be established of responders, critical contacts from agencies or contractors. For more advanced responses a document register, and file management system should be integrated to ensure collection of documents and ability to control distribution and editing of document versions.

Modern day responses require timely communications keeping all stakeholders informed. Timely updates keep stakeholders at ease, often reducing delays. Virtual meetings can help bridge the gap when in person meetings are not feasible. Microsoft Teams’ channels can be used to create a virtual command post. These meetings should be throttled in such a way as to not bog down various team members with meetings that do not have a clear intent or purpose. Agendas should be sent out ahead of meetings so that the attendees can be prepared and understand their role in the meeting. Another useful tool in remote locations or in situations where conventional Internet services may be limited is the use of satellite communications, such as Star Link. Having a responsive IT team to support the response and the needs of the team enables smooth integration.

There is no one size fits all communication strategy but the more that communication is prioritized the smoother a response will run. What we do not want is to hear the famous movie quote “What we've got here is failure to communicate” Instead we must channel Orwell and realize “Whoever controls the image and information of the past …. commands the future.”

He is responsible for managing worldwide marine salvage, firefighting, heavy lift, commercial diving, and emergency response operations while simultaneously managing multiple com-panies. With three decades of leadership experience in maritime operations, he has served as a senior Coast Guard Officer, Incident Commander, Salvage Master, Commercial Diver and Project Manager on salvage and oil spill response operations from the Equator to the Arctic.

Additionally, he has earned over 75 governmental and industry awards and medals, including selection into the Coast Guard’s Leadership Hall of Fame and the ADCI Commercial Diving Hall of Fame.

Jim is also a past President of the American Salvage Association.

Jim Butler is the Principal of Incident Response Group, LLC serving as Counsel &, External Affairs under contract to the Alaska Chadux Network.

At the request of the U.S. Coast Guard, Jim was part of the initial project team that first organized Alaska’s unique structure for combining risk reduction measures and marine casualty response capability for vessels operating in the remote regions of Western Alaska and the U.S. Arctic.

Jim remains active on several public and private sector incident management teams serving in various command and general staff functions on marine casualty incidents throughout Alaska and around the country. Most recently, Jim was the Liaison Officer supporting the Unified Command on the M/V Genius Star XI lithium-ion cargo fire incident from December through February 2024 in the Aleutian Islands.

n early March, TowBoatU.S. Ft. Lauderdale received a call regarding a 124’ yacht that had caught fire and sunk in Northern Bahamas. TowBoatU.S. Fort Lauderdale was awarded the job and quickly mobilized, deploying the ninety-six’ Salvage Vessel Richard L Becker and a fifty-five’ ANB Lady Katherine loaded with all necessary gear to patch, refloat, and tow the yacht back to the States.

Upon arrival, our team surveyed the vessel and began patching and plugging all through hull fittings and port lights. Lift bags ranging from 6,000 lbs. to 12,000 lbs. were then strategically rigged and attached to provide lift and stability. Once preparation was complete, the high-capacity compressor aboard Richard L. Becker was utilized to fill the lift bags while a combination of portable, high-volume pumps ran to dewater the vessel.

After successfully refloating the yacht, all the remaining fuel and lube oil was removed into totes on the deck of the Richard L Becker to be taken back and properly disposed of in the United States. Once a short weather window was identified, salvage crew and divers were stationed aboard the casualty to monitor bilge water levels while the casualty was towed nearly two hundred nautical miles for haul-out in Florida. Once on land, a large, protected shelter was constructed around the vessel preserving the vessel for inspections.

Panama Hub of Ship Repairs

P

anama is quickly establishing itself as the international ship repairs hub of the Americas. As Talleres Industriales has grown and diversified in many out-of-the-box solutions, Panama has also become more appealing as a location for major repairs.

One of the big reasons why Panama has framed itself as a ship repair hub is Talleres Industriales’ evolution, expertise, and certifications.

Aframax vessel came from Curacao to perform several repairs onboard to Cristobal. A Panamax bulk carrier came from Peru to perform a major structural repair to Balboa. Finally, a Japanese Panamax bulk carrier just arrived in Panama to perform a major underwater repair caused by a grounding in Colombia. Panama is an easy place to do business and now with more lay berth facilities on both sides of the canal, is the ideal place to come and perform repairs.

This month, Talleres Industriales is working on three vessels which’s damage occurred in other countries. An

owBoatU.S. Fort Lauderdale was recently called upon to refloat an eighty-foot Sunseeker that had struck a dredge marker in St. Augustine, Florida.

The allision resulted in a four foot by six-foot hole in the bottom of the vessel, causing it to sink stern-down with the bow breaching the surface in sixty feet of water.

Immediate actions were taken to mitigate environmental hazards. TowBoatU.S Ft. Lauderdale teams secured curtain containment boom around the casualty to contain any fuel or lubricant leaks, and a patrol boat was stationed to monitor the scene 24 hours a day during the 3-day operation, being vigilant for spills and ensuring the safety of other mariners navigating the area.

The TowBoatU.S. Ft. Lauderdale’s 96’ salvage tug Richard L. Becker was deployed with a wide variety of salvage equipment and an experienced salvage crew to safely refloat the vessel. Upon arrival, using absorbent materials, the crew removed the fuel and lubricants contained within the boom. A four-point moor was then established on the containment boom, providing ample space for the 450-ton crawler crane and barge that would be used to raise the casualty.

Using hard hat divers equipped with video feed and communications, all rigging including lifting straps and lines to prevent the straps from slipping during the lifting process were safely affixed. High-capacity lift bags were also rigged and inflated to keep the bow on the surface during the lift. Once complete, the wire from the crane was lowered and secured to the rigging.

With all preparations in place, the crane slowly began lifting the vessel. The casualty gradually ascended to the surface and leveled. Upon surfacing, multiple high volume dewatering pumps were employed to dewater the vessel, after which it was safely lifted and placed

Kerry Walsh is Retiring After 30 Years in the Marine Salvage Industry!

fter more than three decades in the maritime industry, Kerry Walsh has decided to retire, leaving behind a legacy of expertise in marine salvage. Kerry spent over fifteen years with Global Diving & Salvage, where his influence was felt far and wide, particularly as a key member of the ASA training committee. He fostered strong relationships with the U.S. Coast Guard and other Federal and State agencies, ensuring safe work practices were always at the forefront of response decision maker’s minds.

A big part of Kerry’s charm was his humor and knack for storytelling. Whether it was recounting his adventures onboard the SALVAGE CHIEF after his Coast Guard days, or sharing a good laugh with colleagues, Kerry's stories were always a highlight. Now, he and his wife, Janet, are looking forward to some well-deserved quiet time at their beautiful home near Seaside, Oregon.

As Kerry steps into retirement, J.J. Winston will be taking his place at Global Diving & Salvage. As a member of the ASA training committee, a 23-year veteran, and a retired Chief Warrant Officer from the U.S. Coast Guard, J.J. is no stranger to the marine salvage industry. Having worked with Kerry on numerous marine casualties over the past two decades, J.J. is well-equipped to navigate the challenges in this industry and carry on the high standards and practices that Kerry has established.

Incoming Chief Executive Officer, Port of Houston Authority, to Deliver the Keynote at CLEAN GULF 2024

W

e are thrilled to announce Charlie Jenkins, Incoming Chief Executive Officer for the Port of Houston Authority, as the Keynote speaker for CLEAN GULF 2024.

Charlie Jenkins was named Incoming Chief Executive Officer in April 2024.

In this role, he will oversee the advocacy and stewardship of the Houston Ship Channel, the nation's busiest waterway, working in partnership with the U.S. Army Corps of Engineers for Channel maintenance and improvements. More than two hundred public and private facilities conduct business alongside the Channel and together support $906 billion in annual economic value.

Mr. Jenkins also oversees the efficient and effective operations of Port Houston's public facilities, which handle a diverse range of imports and exports including container, general cargo, breakbulk, and bulk commodities and include the area's largest breakbulk facilities and two of the most efficient container terminals in the nation.

Mr. Jenkins has been with Port Houston for more than 32 years and has served in various capacities during his tenure. He started with the Port as the first intern the organization ever had. Throughout his Port Houston career, he has led several departments including container ops, strategic planning, environmental affairs, channel development, financial planning, Bayport Container and Cruise Terminal, and the grants department. Most recently, he was the Chief Channel Infrastructure Officer, overseeing channel development, the Port Houston Strategic Asset Management Program and GIS.

House Passes Coast Guard Authorization Act of 2024

egulatory Affairs (RA) continues to monitor H.R. 7659, the Coast Guard Authorization Act of 2024, which was passed by the House and sent to the Senate Commerce Committee. The bill still includes a provision to extend the moratorium on enforcement of the non-operating personnel provision to 2027.

RA drafted a notice for distribution to the ASA membership on H.R. 7659 outlining the bill’s major provisions, as of May. RA reviewed and provided draft comments to the Executive Committee on proposed legislation from the Senate Commerce Committee on TITLE IV-OIL POLLUTION LIABILITY SEC. 401. VESSEL RESPONSE PLANS. Finally, OSHA published a 608-page Notice of Proposed Rulemaking (NPRM) on firefighting, search and rescue, and emergency medical response. The primary concern is that it appears these proposed regulations will apply to commercial marine firefighters. This comprehensive NPRM bears close scrutiny. As of this writing, RA has completed draft comments which have been forwarded to the Executive Committee for review.

Christine Curran is currently the Client Services Manager at Resolve Marine, bringing with her 7 years of experience in Fleet Operations with the Marshall Islands Registry, as well as a solid background in various marketing roles. She holds a BA in Communications from Salisbury University and an MBA from the University of Maryland.

REGULATORY AFFAIRS COMMITTEE Regulatory Affairs (RA) continues to monitor H.R. 7659, the Coast Guard Authorization Act of 2024, which was passed by the House and sent to the Senate Commerce Committee. The bill still includes a provision to extend the moratorium on enforcement of the non-operating personnel provision to 2027. RA drafted a notice for distribution to the ASA membership on H.R. 7659 outlining the bill’s major provisions, as of May. RA reviewed and provided draft comments to the Executive Committee on proposed legislation from the Senate Commerce Committee on TITLE IV-OIL POLLUTION LIABILITY SEC. 401. VESSEL RESPONSE PLANS. Finally, OSHA published a 608-page Notice of Proposed Rulemaking (NPRM) on firefighting, search and rescue, and emergency medical response. The primary concern is that it appears these proposed regulations will apply to commercial marine firefighters. This comprehensive NPRM bears close scrutiny. As of this writing, RA has completed draft comments which have been forwarded to the Executive Committee for review.
