阿根廷商標採先申請主義，商標如要使用於任何商品或服務，需登記註冊 以取得商標權。在案件進行正常的狀況（無異議），從申請到註冊約需 16～24 個月。 阿根廷採用尼斯分類，如涉及多個類別，須一類一案申請，不可跨類申請。 商標有效期間自註冊日起算 10 年，每 10 年繼續延展。 阿根廷並無強制要求已註冊商標須放上註冊標誌，實務上仍以加上註冊標 示為宜，因可警示他人商標之註冊地位，日後如有侵權行為，他人更無法聲稱 是無知無故侵犯。如要使用註冊標誌，可選擇®、MR 等符號。在阿根廷，法 律上並未明定®符號，但實務上承認其使用。 關於阿根廷商標之主要相關規定，以下逐項介紹：
一、國際締約與優先權 阿根廷係下列智慧財產權國際條約之締約國：(1)巴黎公約（Paris Convention） ； (2) 尼諾比條約（Nairobi Treaty）；(3) 尼斯協定（Nice Agreement）。 依據《巴黎公約》規定，該公約任何成員國國民或成員國內有住所或營業 所的非公約國國民，已在公約國內某一國家正式提出商標註冊申請者，於 6 個 月內，在其他國家就同一商標在相同商品上提出的申請享有優先權。如申請人 國籍是 WTO 的會員國，亦可主張母國商標註冊申請日之優先權。 阿根廷另簽署多個與智慧財產權相關的雙邊條約、多邊條約、及區域經濟 一體化條約（見本篇後附表）。
二、商標主要法源 包含：1933 年第 11.723 號法（關於智慧財產權法律制度，最新由 2009 年 第 26.570 號法修改）、2008 年第 26.355 號法（關於集體商標）等及 2011 年第 1141/2001 號法令（修改商標法實施法令）及相關實施細則等。

三、商標主管機關 商標及專利係由「產業產權局」（National Institute of Industrial Property, INPI）主管，著作權則由司法及人權部（Ministry of Justice and Human Rights） 轄下之「著作權署」（National Directorate of Copyright）負責。

五、不得註冊商標之種類 (一 ) 商標違反公序良俗。 (二 ) 一般性通用名詞。 (三 ) 國家、省份、區域、地區或國際組織之名稱、旗幟或標誌。 (四 ) 不具識別性商標，且無法取得後天識別性者。 (五 ) 其他法律所明定之絕對或相對事由。 地理標示與原產地在阿根廷受到特別法及法院判決之保護；葡萄酒、蒸餾 酒、食品、及農產品為地理標示保護之產品類別。
六、申請流程 商標業務代理：申請人若在阿根廷境內無住所或營業所，須提供阿根廷地 址以供文件送達，並須委任阿根廷當地之代理人。 申請時程：商標註冊申請案的審查，大約 16～24 個月，可長達 56 個月。 但處理時限自收文日起算，其通知補正、申復、答辯期間或因其他正當事由緩 辦之期間不計算在內。 商標檢索：審查過程中，審查員會利用 INPI 之商標資料庫檢索，與已註冊、 已審定或申請在先的商標加以比對，如有相同或近似，且指定商品、服務相同 或類似的情形存在時，審查員會依法駁回申請。故事前之商標檢索，確認有無 註冊障礙，實有其必要性。

申請應備文件（外國人或外國企業）： 1. 商標註冊申請書。 2. 代理授權委託書。 3. 商標圖樣。 4. 特殊證明及其他必要文件。 一般阿根廷商標申請到註冊約 16～24 個月期限。商標提交申請後會開始進 入形式審查，檢查申請表格文件是否有誤，如有需要修改，例如指定商品名稱 不符合官方要求，INPI 則會下發「補正通知」 ，通知申請人限期（一般是 10 個 工作天）提交補正 1。 商標經過形式審查後，就會進入為期一個月的公告期，可對商標提出異議； 此時大約是提交申請後第 45～60 天。公告後如無人異議，則進入實質審查階 段，實質審查通過即可核准註冊；案件一經核准後約 1～3 年後會收到商標註冊 證，有時會等待更久的時間。 如審查有不得註冊事項，例如商標不具有識別性、有近似商標存在等等， INPI 會通知申請人限期提交答辯。 另外，商標如被提出異議，須於一年內與異議方協商完畢，若未協商完畢， 申請人可向「聯邦人民及商業法院」（Federal Civil and Commercial Courts）提 起訴願（Appeal） 2。 阿根廷商標申請流程簡圖如下：

七、申請案審查內容 商標申請註冊之審查，可分為「形式審查」及「實質審查」兩部份。前者 係指申請提交之應備文件資料是否滿足法定要件的審查，如查核申請書內容填 寫是否充份、清晰；提交書證或有關手續是否完備，先以初步過濾決定是否受 理申請案。實質審查則係審查申請之商標是否具備法定之註冊條件，包含「絕 對理由」（是否受到法律之禁用）及「相對理由」（是否具備商標之構成要素、 有無在先衝突）。 審查內容一般包含：(1) 必要文件的形式審查；(2) 申請類別，確認所有的 商品或服務落在正確的類別；(3) 申請內容的描述是否清楚、可理解的；(4) 是 否有說明性；確認該商標的功能是否僅在提供其相關商品或服務的訊息；(5) 是否有識別性；(6) 是否有衝突的在先註冊、在先申請之商標存在等。 在審查過程中，可能會涉及之特殊問題： ※聲明不專用：阿根廷有聲明不專用的制度（對於其商標的某不具識別性 元素表達放棄其專用）。
八、異議 商標申請案在完成形式審查後，即予公告，進行異議階段；異議期自公告 日起 30 天。在先商標權人、及任何利害人均可提起異議。商標申請之異議理由， 包含以下事項： 1. 基於在先權利，例如相同或者近似的商標權。 2. 該商標包含了一般營業中用以顯現商品或服務之種類、品質、數量、意 圖目的、價值或其他特性之標示或指示。 3. 該商標不具識別性。 4. 該商標涉及誤導、欺騙、或詆毀。 5. 商標本身具功能性。

6. 該商標違反著作權。 7. 該商標違反《巴黎公約》第 6 條（著名商標、國家標誌之保護及以商標 所有權人之代理人或者其他代表人的名字註冊）規定；及第 8 條營業名 稱之保護。 8. 已註冊之外觀設計專利權。 9. 姓名權。 10. 通用性，該商標包含了已慣用於現行語言或現行交易行為中的標誌或指 示。 11. 商標違反公序良俗。 12. 商標包含原產地名稱。 13. 不具備原創性之標語。
九、註冊商標之權利 商標經註冊後，取得以下權利： 1. 取得該商標於阿根廷的專用權。 2. 可對在後之衝突商標提起異議或撤銷程序。 3. 可對第三方使用近似而有混淆之虞的商標提起侵權訴訟。 4. 可將商標授權第三人使用。 5. 有權請求海關當局查扣進口的偽造商品。 6. 獲得侵權損害賠償。 ※不可對抗性：阿根廷商標註冊後，其撤銷之訴須自註冊日起 10 年內提 出。但若干法院判例則主張對著名商標的撤銷訴訟沒有期限。
十、商標移轉 註冊申請中或已完成註冊商標皆可辦理移轉，但必須就其申請∕ 註冊之地

理範圍全部進行移轉。移轉之類別則可針對其申請∕ 註冊的全部或一部分。「商 譽」不須被包含在移轉的標的中。 移轉合約中須包含：轉讓人與受讓人的姓名、地址；移轉的商標細節；移 轉之商品∕ 服務類別；移轉生效日；雙方簽名；移轉之實際對價。 移轉文件須進行公認證。已註冊商標辦理移轉須經登記才生效力；須經登 記始得對抗第三人。
十一、商標授權 申請中或已註冊商標皆可對外授權；授權可以是部分區域或全區域性。授 權之商品∕ 服務類別可為申請∕ 註冊之全部或一部分；可以是專屬（也排除所 有權人）或非專屬；可以是獨家（包含所有權人）或非獨定。 如商標被使用於相關企業，必需取得授權。已註冊商標之授權，必須設定 期限，形式上不得永久授權。 授權文件需有：授權人與被授權人的姓名；授權商標的明細；授權之商品 ∕ 服務類別；授權起始日、授權期限；授權區域；品質控管條款；雙方簽字。 授權文件須公認證，但授權契約不以登記做為生效要件，但登記有助於證 明商標之使用。授權即便未登記仍屬有效，但特定之租稅優惠則無法適用。 商標延展前之授權，如原授權合約載明授權在延展後仍有效，則該授權在 商標延展後不須重新登記。
十二、商標使用證明 商標未使用可為撤銷商標理由，自註冊日起算，商標應於 5 年內使用，以 避免被撤銷。要滿足使用要求，商標應使用於阿根廷領域，使用數量必須達到 商業規模；單純象徵性的使用是不足夠的。 商標未使用，可能造成：(1) 如自註冊日起 5 年內未使用時，任何利害關係

人均可提起撤銷訴訟；(2) 如商標到期日前 5 年間，商標均未使用，該商標將無 法延展。 每次申請商標延展時，都必須提出宣誓使用聲明（但僅針對該註冊商標的 某一商品或服務即可）。使用聲明須於商標延展期限前 60 天內提交。 商標未使用如係因進口限制、或其他政府政策因素（不可抗力）所造成， 得免於被撤銷。 如實際使用的商標是以註冊商標調整修改後的形式呈現，只要兩者差異不 大，且修改並沒有明顯改變註冊商標的識別特點，是被允許的。但已註冊之商 標無法向官方申請修改，如有需要應重新申請。
十三、商標撤銷條件 對已註冊之商標如有下列情況，得提起撤銷訴訟： 1. 在先權利。 2. 商標包含了一般營業中用以顯現商品或服務之種類、品質、數量、意圖 目的、價值或其他特性之標示或指示。 3. 商標不具有識別性。 4. 該商標存有誤導、欺騙、詆毀等情事。 5. 商標本身具有功能性。 6. 違反著作權。 7. 該商標違反《巴黎公約》第 6 條之規定（著名商標；徽章、國旗或者其 他國家象徵；以商標所有權人之代理人或者其他代表人的名字註冊）。 8. 該商標違反《巴黎公約》第 8 條之規定（營業名稱）。 9. 已註冊外觀設計專利。 10. 通用性，該商標包含了已慣用於現行語言或現行交易行為中的標誌或指示。 11. 該商標違反公序良俗。 12. 商標包含原產地名稱。 13. 商標之申請或註冊存在惡意。

商標註冊後，如要提起撤銷，需自註冊日起 10 年內提出。但若干法院判例 則主張對著名商標的撤銷訴訟沒有期限。在先權利人或任何利害關人皆可提出 撤銷訴訟。
十四、海關邊境保護 《阿根廷海關法》第 46 條授權海關人員阻止實際或潛在侵犯智慧財產權的 商品出入境阿根廷。
