Through a fideicomiso (trust), foreigners can purchase property on the coasts and borders of Mexico.

Currently considered as one of the most useful legal tools, the fideicomiso allows foreigners to easily and securely acquire property in coastal areas and at the borders. Its origin has to do with the history of Mexico, when large territories were lost. To prevent this from happening again, laws were modified that led to its creation. To learn in general what it involves, we approached Marco Ramírez, deputy notary attached to Notaría Pública 2, and Sarah Elengorn, director of Elengorn Realtors, who explained the basic process to us.

MexLaw Holds 2017 Real Estate Summit

This August 22, prestigious law firm MexLaw held Real Estate Summit 2017 in the Hilton Puerto Vallarta Resort’s Salon Vallarta. The event included a series of incisive and practical 30-minute presentations designed to provide useful information to both real estate professionals and individuals interested in acquiring real estate in the Puerto Vallarta and Riviera Nayarit area.

In the first presentation, Luis Mendoza, director of operations at Vallarta Lifestyles Media Group, explained communications strategy as applied to real estate marketing. Then, María del Carmen Macías, director of the MexLaw Puerto Vallarta and Riviera Nayarit office, spoke about the benefits of escrow services. José Luis Reyes, head notary at Notaría 31, explained the role of the fideicomiso in real estate transactions.

Audrey Royem, president of Ai Real Estate + Relocation, offered some essential factors that must be considered before acquiring a property in Riviera Nayarit. Charles Tibshirani, president and founder of MexLaw, detailed the process for foreigners to acquire real estate in Mexico using pension funds. And lastly, Antonio Trejo, regional manager of Guardian Insurance, spoke about the elements an insurance policy should include.

Almost 200 attended, notably including Harriet Murray, director of Cochran Real Estate and president of the Puerto Vallarta section of AMPI; Alfredo Casillas, leader of the Asociación de Profesionales Inmobiliarios de Puerto Vallarta (APIVAC); and Gerardo González, lawyer and senior partner of MexLaw. At the sponsors’ stands in the reception area, attendees could ask questions, collect information and meet the exhibitors. At the conclusion of the event, Tibshirani mentioned to the Vallarta Real Estate Guide Editorial team that he, together with the MexLaw team, plans to hold the Real Estate Summit every year.

Posteriormente, María del Carmen Macías, directora de la oficina de MexLaw en Puerto Vallarta y Riviera Nayarit, habló acerca de los beneficios del servicio escrow. José Luis Reyes, notario titular de la Notaría 31, explicó el papel del fideicomiso en las transacciones inmobiliarias.

El pasado 22 de agosto, la prestigiosa firma de abogados MexLaw, llevó a cabo el Real Estate Summit 2017 dentro del salón Vallarta del Hotel Hilton Puerto Vallarta Resort.

El evento estuvo comprendido por una serie de ágiles y prácticas conferencias en modalidad de 30 minutos que tuvieron como objetivo brindar información útil tanto a los profesionales inmobiliarios como a individuos interesados en adquirir bienes raíces en el área de Puerto Vallarta y Riviera Nayarit.

APIVAC Inaugurates Board of Directors

A few weeks ago, a ceremony was held to inaugurate APIVAC’s new board of directors, which will govern the Asociación de Profesionales Inmobiliarios de Puerto Vallarta for the 2017-2018 term. The event took place at the Sheraton Buganvilias Resort & Convention Center and was attended by professionals from the local real estate industry.

Leaving his position as vice president of the association, the new president is Alfredo Casillas, who replaces Rebeca Hernández, the 2016-2017 APIVAC president.

Julio Gil Bustillos, national president of COPIM, the Consejo de Profesionales Inmobiliarios de México (Council of Real Estate Professionals of Mexico), was one of the event’s special guests.

During his speech, he recognized the work done by the outgoing board of APIVAC, which is affiliated with COPIM, and also took the opportunity to call on Jalisco’s Congress to advance the establishment of a real estate law.

COPIM and the associations that compromise it have been promoting this initiative since last year, in addition to other projects, such as the creation of a national real estate MLS and the professionalization of consultants.

Hace algunas semanas, se llevó a cabo la ceremonia de toma de protesta de la nueva mesa directiva de la Asociación de Profesionales Inmobiliarios de Puerto Vallarta, la cual regirá el organismo durante el período 2017-2018. El evento tuvo lugar en el Hotel Sheraton Buganvilias Resort & Convention Center y contó con la presencia de profesionales de la industria local de bienes raíces.

El nuevo presidente es Alfredo Casillas, quien deja el cargo como vicepresidente de la asociación y ahora ocupará el lugar que deja Rebeca Hernández, presidenta de la APIVAC en el ciclo 2016-2017.

El presidente nacional del Consejo de Profesionales Inmobiliarios de México (COPIM), Julio Gil Bustillos, fue uno de los invitados especiales al evento y durante un discurso, reconoció el trabajo realizado por la mesa directiva saliente de APIVAC, la cual está afiliada a COPIM. Por otro lado, aprovechó la ocasión para hacer un llamado al Congreso de Jalisco para que se avance en el establecimiento de una ley inmobiliaria.

Desde el año pasado, COPIM y las asociaciones que lo integran trabajan para impulsar esta iniciativa, además de otros proyectos como la creación de una bolsa inmobiliaria nacional y la profesionalización de los asesores.

New Lighting System in El Centro

Citelum is the company in charge of the new lighting system in El Centro.

Puerto Vallarta Mayor Arturo Dávalos Peña inaugurated the first stage of the new lighting system in El Centro. About 50 lights with LED technology were placed along Juarez street, providing a warm ambiance to passers-by.

AMPI Announces National Congress Recently, AMPI announced the dates of its 46th national congress, which will take place from October 18 to 21, at the Villahermosa Convention Center, Tabasco. Origins Its creation has to do with the history of Mexico, when large territories were lost. “To prevent this from happening again, laws were developed so that no foreigner could buy real estate on the border or in front of the sea. With the economic growth and development of the country, foreign investors arrived, and the law had to be changed somewhat. Thus, the fideicomiso came into being,” says Elengorn.

Orígenes Su creación tiene que ver con la historia de México, cuando en los viejos tiempos se perdieron grandes territorios. “Para evitar que eso volviera a ocurrir, se desarrollaron leyes para que ningún extranjero pudiera comprar un bien inmueble en la frontera o frente al mar. Con el crecimiento y desarrollo económico del país, vinieron inversionistas extranjeros y de cierta forma, había que cambiar la ley. Como resultado, surgió el fideicomiso”, comenta Elengorn.

What is it?

“Legally, the fideicomiso is a contract in which a person (called the fideicomitente) transmits to an institution the ownership or title or rights of use for a licit and specific purpose in favor of another person (called a fideicomisario),” explains Ramírez.

Who can use a fideicomiso?

“Foreigners who intend to acquire real estate outside the restricted zone or obtain permits for the exploration and exploitation of mines and water in national territory must first submit a letter before the Secretaría de Relaciones Exteriores (Ministry of Foreign Affairs) to obtain the corresponding permit.

Therefore, the fideicomiso is a necessary vehicle for foreigners to acquire the rights to use and develop real estate,” says Ramírez.

“In fact, I have also worked with Mexican clients who have fideicomisos to protect their investments and to ensure that real estate is transferred to their heirs in the future in a more expeditious and secure manner,” Elengorn adds.

Who is involved in the process?

“The seller, as fideicomitente, the fiduciary institution (usually a bank), as a fiduciary, and the buyer, as fideicomisario, under the guidance of the notary and the advice of the real estate agent throughout the process,” says Ramírez.

How long does the process to establish a fideicomiso take?

“The process normally takes 30 to 45 business days, from the complete integration of the file to the delivery of the public instrument containing the fideicomiso—that is, the deed. It can range up to 90 days after closing,” says Ramírez.

“Now, if the seller is a foreigner and the buyer is another foreigner who wants to take over the rights to the existing deed, that can also be done, since the fideicomiso is valid for 50 years and renews automatically," adds Elengorn.

She also says: “For example, if the seller has had the property for three years, the buyer can acquire that same fideicomiso, but it will be for 47 years. That way, you avoid all the previously mentioned procedures. It is a relatively easy process.”

What is the role of the fiduciary institution?

“Although the deed is in the name of the bank, the foreign buyer is the first beneficiary.

This means that he has every right to sell, rent or use the property. Likewise, he has all the responsibilities. The fiduciary institution is not going to attend the condo meetings or pay the property tax—all that is specified in the deed. Basically, the bank puts it in its name so that the foreigner can acquire the property, receiving the same rights and benefits as Mexicans,” says Elengorn.

¿Qué es?

“Legalmente, el fideicomiso es un contrato en el que una persona —denominada fideicomitente— transmite a una institución la propiedad o titularidad de bienes o derechos para destinarlos a un fin lícito y específico a favor de otra persona llamada fideicomisario”, explica Ramírez. ¿Quiénes pueden utilizar un fideicomiso?

“Los extranjeros que pretendan adquirir bienes inmuebles fuera de la zona restringida u obtener concesiones para la exploración y explotación de minas y agua en el territorio nacional, deberán presentar previamente ante la Secretaría de Relaciones Exteriores un escrito para obtener el permiso correspondiente", asevera Ramírez.

También agrega: "Por tanto, el fideicomiso resulta ser un vehículo necesario para que los extranjeros adquieran los derechos de uso y aprovechamiento sobre bienes inmuebles”.

“De hecho, también me ha tocado colaborar con clientes mexicanos que tienen fideicomisos para proteger sus inversiones y en un futuro, asegurar que los bienes inmuebles sean traspasados a sus herederos de manera más ágil, fácil y segura”, agrega Elengorn. ¿Qué actores intervienen en el proceso?

“El vendedor como fideicomitente, la institución fiduciaria —regularmente es un banco— como fiduciario y el comprador como fideicomisario bajo la guía del notario público y el asesoramiento del agente de bienes raíces durante todo el proceso”, afirma Ramírez. ¿Cuánto tiempo dura el proceso para constituir un fideicomiso?

“El proceso normal se puede hacer entre 30 y 45 días hábiles desde la integración completa del expediente, hasta la entrega del testimonio del instrumento público que contiene el fideicomiso —o sea, la escritura—. Puede variar hasta 90 días posteriores al cierre”, indica Ramírez.

“Ahora bien, si es una cesión de fideicomiso, es decir, que el vendedor sea extranjero y el comprador sea otro extranjero que quiera tomar los derechos sobre la escritura existente, también se puede hacer, ya que el fideicomiso tiene una vigencia de 50 años y se renueva automáticamente. Por ejemplo, si el vendedor tiene tres años con su propiedad, el comprador puede adquirir ese mismo fideicomiso, pero será por 47 años.

De esa manera, se ahorrará todo el trámite previo. Es un proceso relativamente fácil”, complementa Elengorn. ¿Cuál es el rol de la institución fiduciaria?

“Aunque la escritura queda a nombre del banco, el primer beneficiario es el comprador extranjero.

Esto significa que tiene todo el derecho de vender, rentar o usar la propiedad. Al mismo tiempo, adquiere todas las responsabilidades.

La institución no se va a presentar a las juntas condominales, ni pagar el predial —todo eso se especifica en la escritura—. Básicamente, el banco pone el nombre para que el extranjero

What are some of advantages?

“Fortunately, it is a standard process for all notaries and fiduciary institutions, so it is relatively simple from the client’s perspective, as the notaries diligently handle the process to completion,” says Ramírez.

“In addition to that, it can be willed. In the event of the death of the original owner, the beneficiaries can receive the property without having to go through the long judicial process,” adds Elengorn.

What is an essential point to keep in mind?

“That the names of the beneficiaries are written correctly. Often foreigners write something like Bob Smith instead of Robert Smith. Although it is elementary, it must be watched, since once the deed is drawn up, it is very difficult to change,” concludes Elengorn.

“In addition to that, the client must consider the time required for the process, as well as the cost. Each individual case is different, and the cost can range from about 3.5 to 5 percent, depending on the value of the property,” says Ramírez.

“Que los nombres de los beneficiarios estén escritos correctamente. En muchas ocasiones, los extranjeros suelen escribir Bob Smith en lugar de Robert Smith. Aunque es algo elemental, se debe tomar en cuenta, ya que una vez que esté la escritura, es muy difícil cambiarlo”, finaliza Elengorn.

“Además de eso, el cliente debe considerar el tiempo requerido para el proceso, así como los costos —cada caso es particular y puede oscilar aproximadamente de entre un 3.5 % a un 5 %, dependiendo del valor del inmueble—”, finaliza Ramírez.

ORTH CENTRAL ZONE: GROWTH EXPECTATIONS Zona Centro Norte: Expectativas de Crecimiento

Alfonso Dávalos, real estate agent at Tropicasa Realty, shares his outlook and the growth he envisions for Puerto Vallarta’s north central zone, which includes the 5 de Diciembre, El Cerro, El Centro, Caloso and Canoas neighborhoods.

Alfonso Dávalos, agente de bienes raíces de Tropicasa Realty, nos comparte sus expectativas y el panorama de crecimiento que vislumbra para la zona centro norte, la cual incluye las colonias 5 de Diciembre, El Cerro, El Centro, Caloso y Canoas.

From Monterrey, Nuevo León, Alfonso Dávalos (“Poncho” to those close to him) first came to Puerto Vallarta in 2008, to apply his degree in Tourism to the hospitality industry.

A year later, he took a job as concierge with the Luxury Beach team, a vacation rental agency managing the Península condominiums.

This began his organic path into real estate, as he became familiar with not only buildings and houses, but also the destination’s various residential areas. Eventually, he switched to vacation rentals with the same company.

Within a few months, familiar with how they worked and having the necessary contacts, he went out on his own for a time.

In 2012, Wayne Franklin and Jorge Guillén gave him the opportunity to work with Tropicasa Realty on the Artesanías project, a real estate development within the El Tigre Golf Club in Nuevo Vallarta. After a few months and showing good results, he began his career as a real estate agent.

“My area of expertise is the condominiums in Puerto Vallarta’s north and south central areas, as well as homes for sale in Gaviotas, Aralias and Independencia (in El Pitillal). Most of my work has been in those areas, and in that order,” he says.

When asked about the prospects he sees for this sector, as well as his expectations for growth, Dávalos says that although development in the central area will continue, 24

Proveniente de Monterrey, Nuevo León, Alfonso Dávalos (conocido como “Poncho” entre sus allegados), vino por primera vez a Puerto Vallarta en 2008 para ejercer su licenciatura en turismo y trabajar en la industria hospitalaria. Un año después, se unió como concierge al equipo de Luxury Beach, una agencia de rentas vacacionales que administraba los condominios del desarrollo Península.

A partir de ese momento, su incursión en los bienes raíces se fue dando de manera orgánica, pues comenzó a tener exposición tanto a los edificios y casas, como a las distintas zonas residenciales del destino.

Eventualmente, se cambiaría a las rentas vacacionales dentro de esa misma empresa.

Al conocer cómo funcionaban y teniendo los contactos necesarios, a los pocos meses se aventuró a hacerlas por propia su cuenta durante un tiempo.

En 2012, Wayne Franklin y Jorge Guillén le dieron la oportunidad de trabajar para Tropicasa Realty en el proyecto Artesanías, un desarrollo inmobiliario dentro del Club de Golf El Tigre en Nuevo Vallarta. Después de algunos meses y de mostrar resultados, comenzó en forma su carrera como agente de bienes raíces.

“Mi área de expertise son los condominios de la zona centro norte y sur de Puerto Vallarta, así como las casas en venta ubicadas en las colonias Gaviotas, Aralias e Independencia —en El Pitillal—. En esa parte y en ese orden, es donde mayormente se han llevado a cabo mis operaciones”, comenta.

Currently, the Romantic Zone is experiencing incredible growth and will continue to do so, but the proximity of these neighborhoods to the beach and the entertainment offered in this area lead me to foresee a considerable increase in housing construction in that part of the city,” he explains.

Regarding that growth, he predicts that development will include condominiums and small buildings ranging between about 3,300 and 4,400 square feet. “Personally, I have a special affection for 5 de Diciembre, because that was where I lived when I first arrived in Puerto Vallarta. However, beyond that, I see a lot of potential there. It is a perfect mix of modernity, proximity to the Malecón, sea, mountains and jungle and the destination’s ‘Mexican-ness.’ On the same block, you find a traditional house of yesteryear next to a contemporary house that costs $400,000

Actualmente, la Zona Romántica tiene un crecimiento increíble y así continuará, pero la cercanía de dichos vecindarios con la playa y el entretenimiento que se oferta en esta zona, me hace augurar un incremento considerable de construcciones habitacionales en esa parte de la ciudad”, explica.

En relación a eso, pronostica que “se desarrollarán condominios y edificios pequeños que oscilarán entre los 300 y 400 m². Personalmente, le tengo un cariño especial a la colonia 5 de Diciembre, porque fue donde viví cuando recién llegué a Puerto Vallarta. For the last quarter of this year, Dávalos expects a lot of work and activity, not only for his colleagues and real estate agencies, but also for the destination’s entire workforce.

Para el último trimestre de este año, Dávalos espera mucho trabajo y movimiento, no solo para sus colegas, agentes y agencias que integran la industria de bienes raíces local, sino también para toda la fuerza laboral del destino.

“Se viene un gran período laboral y es muy reconfortante ver gente caminando sobre el Malecón todo el año. Ya no hay temporada baja y alta, sino temporada de verano e invierno. Desde hace ocho años que no se veía y esperaba una época con tanto movimiento como la que estamos por experimentar en lo que queda de este 2017”, finaliza.

Although Puerto Vallarta is perceived as one of the safest cities in Mexico, there are situations owners must address to properly protect and monitor their businesses.

Aunque Puerto Vallarta es la ciudad con mayor percepción de seguridad en México, existen situaciones a las que los empresarios deben prestar atención para prevenir y vigilar apropiadamente sus negocios.

A business must have at least one alarm, preferably monitored by a security company, as well as closed-circuit video.

Puerto Vallarta is perceived as one of the safest cities in Mexico, as found by the Encuesta Nacional de Seguridad Pública Urbana (National Survey of Urban Public Security) prepared by the Instituto Nacional de Estadística y Geografía (INEGI) (National Institute of Statistics and Geography), whose results have placed Vallarta in first place for several consecutive months.

However, theft and vandalism, as well as dishonest acts by employees, are phenomena employers must address. “These are the most frequent crimes, but they can be prevented and monitored with security systems,” says Leonardo Villarreal, general director of Alarmas y Sistemas Tessla, a Vallarta company that provides professional security services for companies and individuals.

Puerto Vallarta es la ciudad con mayor percepción de seguridad en México, así lo confirma la Encuesta Nacional de Seguridad Pública Urbana que elabora el Instituto Nacional de Estadística y Geografía (INEGI), cuyos resultados han colocado a este destino, por varios meses consecutivos, en el primer lugar.

Sin embargo, los robos y daños por vandalismo, así como operaciones deshonestas por parte de los empleados, son un fenómeno al que los empresarios deben prestar atención. “Estos son los delitos más frecuentes, pero se pueden prevenir y vigilar mediante sistemas de seguridad”, asegura Leonardo Villarreal, director general de Alarmas y Sistemas Tessla, empresa vallartense que provee servicios profesionales de seguridad para empresas y particulares.

To avoid these problems, he recommends hiring a professional service that guarantees IT security, but he also emphasizes the importance of familiarizing all involved personnel with the tools and systems in use, so they are aware of the risks.

Today, there are systems that can be controlled remotely and/or with a smartphone.

En el caso de Puerto Vallarta, los mayores problemas que observa Ayón son el fraude, robo de identidad digital, pérdida de información por falta de respaldo, robo de información bancaria, de clientes y bases de datos; alteración de sistemas de vigilancia, infección de troyanos y ataques a sitios web, donde se altera y modifica maliciosamente tanto el contenido como los archivos de los mismos.

Para evitar este tipo de problemas, aconseja contratar un servicio profesional que garantice la seguridad informática, pero subraya la importancia de familiarizar a todo el personal involucrado con las herramientas y sistemas que se utilicen, para que sean conscientes de los peligros que existen. Algunos de los consejos básicos que Ayón ofrece, son los siguientes: dividir las redes públicas y administrativas, cambiar las configuraciones de fábrica de los módems, utilizar cifrados WPA2 en redes wifi, no utilizar usuarios administrativos en dispositivos, no utilizar software sin licencia, limitar la información pública y utilizar segundos factores de autenticación.

Además, recomienda que se cuente con cámaras de vigilancia con sensores de movimiento y sonido, un respaldo constante de la información (ya sea en la nube o en un equipo independiente), un firewall, un equipo que separe la red que se presta a clientes de la administrativa y un control de accesos a información sensible.

Al igual que Leonardo Villareal, Favian Ayón advierte que el peor error es pensar en cosas como “a mí no me va a pasar, no tengo ninguna información importante, con la contraseña basta, a mí quién va a querer hackearme”… Pensar de esta forma, es minimizar la cantidad de problemas que actualmente se viven en el ámbito de la información y las comunicaciones. Es importante recordar que en internet todo es vendible. Por estas razones, es necesario que conozcamos al menos de forma básica el funcionamiento de todos los dispositivos que utilizamos y a dónde va nuestra información.
