APIVAC Realizes Training in Legal Prevention

The course, titled Legal Prevention in Real Estate Operations, consisted of three presentations given by specialists in the field.

The Asociación de Profesionales Inmobiliarios de Vallarta, A.C. (APIVAC) (Association of Real Estate Professionals of Vallarta, A.C.) afforded training to about 60 agents and real estate administrators at the Hotel Marriott CasaMagna in Marina Vallarta. The course, titled Prevención Legal en Operaciones Inmobiliarias (Legal Prevention in Real Estate Operations), consisted of three presentations given by specialists in the field.

Jorge Carbonell, principal operator of Keller Williams Bienes Raíces in Mexico, began the day by presenting some approaches from the book El Agente Millonario de Bienes Raíces (Millionaire Real Estate Agent), written by the founder of the company, in which the best practices of some of the 100 most successful entrepreneurs in the sector are explained. Then, Reynaldo Álvarez, from the law firm Álvarez y Asociados, explained how real estate professionals can protect and properly use their clients’ personal data. He spoke about the nature and implications of the privacy notice and the possible legal sanctions in this matter.

Lastly, law professor Felipe de Jesús González Romero presented Aspectos Legales en el Arrendamiento de Inmuebles y Administración de Rentas (Legal Aspects of Leasing Properties and Administration of Rentals). During his talk, he explained the components and clauses of a lease agreement, presented some examples of frequent conflicts and offered recommendations to protect both owners and tenants.

La Asociación de Profesionales Inmobiliarios de Vallarta, A.C. (APIVAC), impartió una capacitación a cerca de 60 agentes y administradores de bienes raíces dentro del Hotel Marriott CasaMagna en Marina Vallarta. El curso se tituló Prevención Legal en Operaciones Inmobiliarias, el cual estuvo conformado por tres ponencias impartidas por especialistas en el rubro.

Jorge Carbonell, operador principal de Keller Williams Bienes Raíces en México, inició la jornada con una charla en la que abordó algunos planteamientos del libro El agente millonario de bienes raíces (escrito por el fundador de la empresa a la que representa) y en el que se explican las mejores prácticas de algunos de los 100 emprendedores del sector más exitoso del mundo.

Enseguida, Reynaldo Álvarez del despacho de abogados Álvarez y Asociados, ofreció una charla en la que explicó la manera en que los profesionales inmobiliarios pueden proteger y usar adecuadamente los datos personales de sus clientes. Habló sobre la naturaleza e implicaciones del aviso de privacidad y las posibles sanciones legales en esta materia.

Por último, el maestro en derecho Felipe de Jesús González Romero impartió la ponencia Aspectos Legales en el Arrendamiento de Inmuebles y Administración de Rentas. Durante su participación, explicó los componentes y cláusulas de un contrato de arrendamiento, expuso algunos ejemplos de conflictos frecuentes y ofreció recomendaciones para proteger tanto a los propietarios como a los arrendatarios que conforman la cartera de clientes de los asistentes.

Domus Fine Real Estate Announces New Development

Punta Cala, a project composed of 63 residences, will be located within The El Tigre Golf & Country Club.

The El Tigre Golf & Country Club, one of Nuevo Vallarta’s main residential and recreational complexes, will have a new addition to its real estate inventory: Punta Cala, a development composed of 63 residences that are already being marketed by real estate agency Domus Fine Real Estate.

The project has a modern and contemporary design, with minimalist finishes that combine materials such as wood, natural stone and concrete. There are six types of facades and more than 10 plans to choose from for each residence. The properties will have three bedrooms, three baths, a study, living room, kitchen, laundry area, terrace, grill and garage for two vehicles.

Depending on the model, some will also have a utility room, pool, hallway and side windows.

Owners will be able to enjoy common areas such as a terrace, swimming pool, children’s area with wading pool and fountains, as well as green areas for recreational activities. In addition, the development will have 24-hour security and controlled access.

El proyecto tiene un diseño moderno y contemporáneo, con acabados minimalistas que combinan materiales como madera, piedras naturales y concreto. Existen seis tipos de fachadas y más de una decena de planos a elegir para cada residencia. Sales Center in Pacifica Bucerías Opens

Pacifica Bucerías will house one- and two-bedroom units with two full baths and two and a half baths.

Timothy Real Estate Group has opened a sales center where Pacifica Bucerías will be located, this latest project currently in the pre-sale phase. Once completed, it will house one- and two-bedroom units with two full baths and two and a half baths.

Located in an inclined area within the zone known as Bucerías’s Zona Dorada (Golden Zone), just two blocks from the beach and close to restaurants, cafes, galleries and boutiques; the complex’s contemporary Mexican design is inspired by the Pacific coast and will be composed of three modular buildings of different heights offering views of the sea and town.

Amenities that residents will enjoy include two lobbies, fully equipped gym, storage space for bicycles and sports equipment, golf cart for getting around Bucerías, underground parking, rooftop lounge with barbecue area and rooftop pool with bar and social area.

The company handling construction is Mesa Moral, developers of condominiums such as The Park, Oceana and Pacifica Vallarta.

La propietaria de Paradise Properties habla sobre su singular trayectoria, así como de los desafíos y satisfacciones de estar al frente de una agencia boutique.

With more than 40 years of experience, 20 as the head of Paradise Properties, the story of this broker, originally from Seattle, is unique. Mother of two children born and raised in Puerto Vallarta and with an extraordinary career in all imaginable areas of the real estate industry, Kelsey Magness’ vision is far from the big leagues, her passion and personal attention to her family reflected in her work.

An assiduous traveler and lover of Mexico, during a sabbatical in 1994 she met Guillermo, who would become her husband. It did not take long for the couple to decide to settle in our city. Magness came from the USA with an impressive career, with experience as a banker, mortgage broker, real estate developer and owner of her construction company, something that has given her global vision and knowledge of the industry.

Her first jobs in Puerto Vallarta were with McFadden Group Real Estate and later with Mark Venegas Real Estate. A novelty she remembers from this time is working at The Pancake House. “I knew the owner, and he asked me to help him. I did not do it for money, since I was working as an agent at the time, but it was a great opportunity to make contacts and meet people. My children were embarrassed, but they were two very interesting years,” she recalls with humor.

Paradise Properties: A Family Project With proven experience and an entrepreneurial spirit, but more because of the need to work close to her family (since she had to take care of her convalescent husband and children), in 1998 she decided to establish with a partner Paradise Properties (a small real estate agency with a boutique 14

Madre de dos hijos nacidos y criados en Puerto Vallarta y acreedora de un extraordinario currículum en el que ha ejercido en todas las áreas imaginables de la industria inmobiliaria, Kelsey Magness tiene una visión alejada de las grandes ligas, en la que su pasión y meticulosa atención personal a su familia se ve reflejada en su trabajo.

Asidua viajera y amante de México, fue durante un año sabático en 1994 cuando conoció a Guillermo, quien se convertiría en su esposo. No pasó mucho tiempo para que la pareja decidiera establecerse en nuestra ciudad. Kelsey llegó desde los Estados Unidos con una impresionante carrera, con experiencia como banquera, agente hipotecaria, desarrolladora inmobiliaria y propietaria de su compañía de construcción; algo que siempre le ha dado visión y conocimiento global de la industria.

Sus primeros trabajos en Puerto Vallarta fueron en McFadden Group Real Estate y después trabajó con Mark Venegas Real Estate. Una curiosidad que recuerda de esta época, es haber trabajado en The Pancake House. “Conocía al propietario y me pidió que le ayudara. No lo hacía por dinero, ya que estaba trabajando de agente en ese momento, pero era una gran oportunidad para establecer contactos y conocer gente. Mis hijos se avergonzaban, pero fueron dos años muy interesantes”, recuerda con humor.

“I never saw Paradise Properties as more than a means of sustenance. I see contemporary brokers like Carl Timothy, Wayne Franklin and Silvia Elias, whom I admire, with big companies, doing a great job; however, I had a family, and that was always my priority,” she says. “It was only recently, when my children grew up and went off to college, that I began to see my company differently, from a more entrepreneurial perspective,” she adds.

Fortunately for Magness, her children have shown interest in following in her footsteps.

“One of them has been working with me for months, and the other, who is still studying computer engineering, also wants to support us in the future. So, I said to myself, ‘Why not turn this project that started as a mere source of income into a family legacy?’ That is my plan.”

Growing Without Losing Perspective

Para suerte de Kelsey, sus hijos han mostrado interés en seguir sus pasos. “Uno de ellos lleva trabajando conmigo desde hace meses y el otro, que aún sigue estudiando ingeniería informática, también quiere apoyarnos en el futuro. Por tanto, me dije a mí misma: ‘¿Por qué no convertir este proyecto que inició como mera fuente de ingresos en un legado familiar?’.

Ese es mi plan”.

amenities, facilities and services of a city, but still has the charm of a small and quiet city. For example, a place like Zihuatanejo is good for vacationing, but it is too small to live in. At the end of the day, ‘You can take the girl out of the USA, but you cannot take the USA out of the girl,’” she jokes.

“The destination is no longer just a place for vacations; we are increasingly receiving more full-time residents. An indication is that you already see expats in neighborhoods where previously only locals resided. This is because Puerto Vallarta already has top-notch services and infrastructure. The Internet has allowed foreigners to work remotely, and thanks to frequent flights, we are just a few hours from our places of origin,” she adds.

Finally, Magness says she will be part of Paradise Properties forever. “I will never retire.

I do not see this as a job, but as a vocation, and I will continue to personally attend to all my clients. I am delighted with the company’s current situation, seeing how it has consolidated and the great family we all are together.”

El internet ha favorecido a los extranjeros para que puedan trabajar de manera remota y además, gracias a los vuelos frecuentes, nos encontramos a pocas horas de nuestros lugares de origen”, añade.

Finalmente, Kelsey Magness asegura que será parte de Paradise Properties por siempre.

“Nunca me retiraré. Yo no siento esto como un trabajo, sino como una vocación en la que continuaré atendiendo personalmente a todos mis clientes. Estoy encantada con la situación actual de la compañía, ver cómo se ha consolidado y la gran familia que conformamos entre todos”.

After almost 100 years intact, the landscape of our city was transformed with the emergence of functionalism and the emblematic and unique Vallarta style.

Después de casi cien años intacto, el paisaje de nuestra ciudad se transforma con la irrupción del funcionalismo y el emblemático y singular Estilo Vallarta.

Vallarta style respected the basic forms of serrana architecture, but added elements and materials such as unglazed, painted bricks; interior adobe walls, bottles in walls for illumination and polished cement in the form of mosaics, among others.

In Part I of this series reviewing the architectural history of Puerto Vallarta with architects and specialists Alfonso Baños and Óscar Morán, we almost covered its first 100 years, when serrana (highlands) architecture predominated, established when the first settlers from nearby municipalities brought their methods and customs, including rustic and traditional buildings with a colonial air. For decades, intersecting cobblestone streets and buildings with sloping tile roofs, adobe walls and narrow vertical windows would form its unique landscape: serrana architecture blending with the warmth of the sea and the exotic beauty of the jungle.

In this second part, we explore how the arrival of the first visitors and new trends began to transform this idyllic setting, bringing new styles and ways of building to the city, which adapted without losing its original essence.

En el capítulo anterior de esta serie que repasa la historia arquitectónica de Puerto Vallarta de la mano de los arquitectos y especialistas Alfonso Baños y Óscar Morán, hicimos un recorrido a través de los primeros (casi) cien años en los que predominó la arquitectura serrana, la cual se estableció desde que los primeros pobladores provenientes de municipios aledaños trajeron sus usos y costumbres, incluyendo la manera de construir que se caracterizaba por su aire rústico y tradicional con esencia colonial. Calles entrecruzadas y empedradas, así como edificios con techos inclinados de teja, muros de adobe y ventanas verticales y estrechas serían por varias décadas los elementos que conformarían un paisaje único que uniría la arquitectura montañesa con la calidez del mar y la exótica belleza de la selva.

With the First Visitors, Changes Arrive In the ‘40s, the arrival of the first visitors triggered a transformation for both the local economy (henceforth with a focus on tourism) and its urban landscape, giving rise to functionalism, the avant-garde style of the time. Baños notes that for the first time, “There was a break from serrana architecture, in order to adapt to the needs of the tourist industry, modifying the geometry and building technology and imposing simplicity of lines.” This architectural style, where “form follows function,” is characterized by flat roofs, elongated horizontal windows, full facade balconies and 45-degree corners. In addition, buildings of between three and five levels were built for the first time in the city, and modern materials were used, such as prefabricated shutters, concrete ceilings, ironwork and glass.

Llegan los Primeros Visitantes, Llegan los Cambios A partir de los años 40, la llegada de los primeros visitantes desencadena una transformación tanto para la economía local (en adelante con vocación turística) como para su paisaje urbano, dando lugar al funcionalismo, que era el estilo vanguardista de la época. Alfonso Baños indica que, por primera vez, “se presenta una ruptura respecto a la arquitectura serrana con el fin de adaptarse a las necesidades de la industria turística, modificando la geometría y tecnología edilicia e imponiéndose la simplicidad de líneas”.

The most representative example from this period is Hotel Rosita (1948), which was built with simple geometric lines and spaces designed to meet the modern needs of its guests, including amenities such as hot water and a swimming pool. Other large examples are the school buildings built on Zaragoza street during the 1950s, such as the Teresa Barba school, and the Agustín Flores Contreras auditorium.

Vallarta Style: Modernity and Tradition Baños notes that, during the 1950s, foreign residents began to build houses in town, adopting the serrana style that had made them fall in love with the destination as visitors (and had been displaced by functionalism). In this way, a new generation of builders came from other parts of Mexico, their main contribution “The recovery of the serrana architectural tradition, but incorporating contemporary materials and construction systems.”

Fernando “Freddy” Romero is considered the creator of this new “school.” His first projects were Las Campanas, a series of Mexican-style bungalows. He is also behind most of Gringo Gulch’s emblematic houses, where he respected the basic forms of serrana architecture, but added his own style with many original elements and materials: unglazed, painted bricks; interior adobe walls, bottles in walls for illumination, polished cement in the form of mosaics, windows with vegetation and ironwork. “In addition, he took advantage of the views with terraces, balconies and windows,” says Morán. On the corner between Matamoros and Mina streets, four Freddy Romero houses are still in excellent condition.

During that time, engineers Luis Favela and Guillermo Wulff were also of great importance, as well as architect José Díaz Escalera. “All of them had unique characteristics, but shared the vision of incorporating the construction and stylistic legacy that Romero initiated,” says Morán. “Romero used many traditional

Otros grandes ejemplares son los edificios escolares construidos sobre la calle Zaragoza durante la década de 1950, como la escuela Teresa Barba y el auditorio Agustín Flores Contreras.

El Estilo Vallarta: Modernidad y Tradición Alfonso Baños comenta que, durante la década de 1950, surge un interés por parte de los residentes extranjeros por construir sus casas dentro del poblado, adaptando sus nuevas residencias al estilo serrano que los enamoró como visitantes (que por aquel entonces había sido desplazado por el funcionalismo).

De esta manera, surgió una nueva generación de constructores que llegaron de otras partes de México, cuya principal aportación fue “la recuperación de la tradición arquitectónica serrana, pero incorporando materiales y sistemas constructivos contemporáneos”.

Fernando “Freddy” Romero es considerado como el creador de esta nueva “escuela”. Sus primeras construcciones fueron “Las Campanas” (una serie de bungalows construidos con un estilo mexicano). También es autor de muchas de las casas más emblemáticas del Gringo Gulch, donde respetó las formas básicas de la arquitectura serrana, pero aportó un estilo propio con numerosos elementos y materiales originales: ladrillos sin enjarrar, solo pintados; muros de adobe en interiores, botellas para iluminar, cemento pulido en forma de mosaicos, ventanas con vegetación y herrería. “Además, proporcionó el valor de las vistas a través de terrazas, balcones y ventanales”, comenta Morán.

Thanks to them, new construction elements were incorporated, such as domes, arches and exposed brick walls, among other elements that would henceforth be in high demand and would be part of the architectural heritage of Vallarta,” clarifies Baños.

An Eclectic but Harmonious Landscape Regarding functionalism and Vallarta style (predominating between the late 1940s and early ‘70s), Morán says that both belonged to the modern architecture that was popular globally, characterized by simplicity of shapes and absence of unnecessary ornamentation.

He says, “During these decades, there was a harmony in the city. The buildings and architects, both within the Vallarta style and independently, integrated aspects of modernism—like functionalism—with serrana architecture, creating an evolution and not so much a rupture.”

With the arrival of postmodernism in the ‘60s and especially the increasing projection of Puerto Vallarta as a tourist destination during the ‘70s, Vallarta style (still maintaining its roots) would begin to evolve in a free way to meet other stylistic functions and needs, which we will explore in the next part of this special.

Durante esa época, también fueron de gran importancia los ingenieros Luis Favela y Guillermo Wulff, así como el arquitecto José Díaz Escalera. “Todos ellos tienen características únicas, pero comparten la visión de integrar el legado constructivo y estilístico que inició Romero”, comenta el arquitecto Morán. “Romero utilizaba muchos materiales tradicionales en sus estructuras, pero Favela y Wulff empezaron a utilizar formas estructurales más modernas y materiales de ciudad, pero siempre revistiendo y accesorizando con materiales tradicionales”.

Gracias a ellos, “se incorporan nuevos elementos constructivos como cúpulas, arcos de medio punto y punto buscado, así como muros de ladrillo aparente, entre otros elementos que en adelante serían muy demandados y formarían parte del legado arquitectónico vallartense”, matiza Alfonso Baños.

Un Paisaje Ecléctico pero Armónico Sobre el funcionalismo y el Estilo Vallarta (que se sitúan entre finales de la década de 1940 y principios de los 70), Morán comenta que ambos pertenecían a las corrientes de arquitectura moderna que se estaban llevando a cabo de forma global, caracterizados por la simplicidad de formas y ausencia de ornamentos innecesarios. Añade que, “durante estas décadas, existió una armonía en la ciudad. Los edificios y arquitectos, tanto dentro del Estilo Vallarta como independientemente, integraron aspectos del modernismo —como el funcionalismo— con la arquitectura serrana, creando una evolución y no tanto una ruptura”.

Con la llegada del posmodernismo a partir de los 60 y sobre todo a la cada vez mayor proyección de Puerto Vallarta como destino turístico durante los 70, el Estilo Vallarta (aún manteniendo sus raíces), comenzaría a evolucionar de una forma más libre para atender otras funciones y necesidades estilísticas; algo que veremos en el próximo capítulo de este especial.
