Dianne M. Clark, Executive Assistant & Professional Standards Administrator, celebrates one year of service with the Association this March. Dianne enjoys working as an Executive Assistant, planning functions and interacting with the membership. She also serves as the Professional Standards Administrator, learning the Code of Ethics and assisting members and consumers in resolving their issues. RASM is proud to recognize the workplace anniversaries of our professional staff! Jessica Montague, RASM Membership Coordinator, and Room Rental Coordinator, celebrates her two-year anniversary this month. She assists new members in joining the Association and helps them gain access to the MLS. She also supports current members with questions they may have, and she coordinates room rentals at both the RASM North and South office locations. We’re on a mission to make our community a better place to live, work and play with this year’s outreach partners. Your RASM Community Outreach Committee convened early this year to review over 25 proposal forms in response to a request from RASM to give back with volunteer support and/ or financial aid. This year, they paired down their 2017 projects to 12 deserving organizations by focusing on small local groups looking for volunteer support at their upcoming events and the strong need of collections within the community.

Sarasota Family YMCA, Inc. – Frank G. Berlin, Sr. Branch. March The mission of the Sarasota YMCA is to build strong kids, strong families, and strong communities. Since 1945, the Sarasota YMCA has touched over 50,000 lives annually through their programs. RASM Volunteers will be supporting the Sarasota YMCA Baltimore Orioles Spring Training days at the Ed Smith Stadium on Saturday, March 11, 2017. Proceeds raised will benefit the programs at the Frank G. Berlin, Sr. Branch. Fifteen volunteers will be placed at different parking lots and will either direct cars to designated parking areas or help collect money at the entrance of each lot. Volunteers will receive a hat and shirt and will be granted entrance to the game, once their three-hour shift is over.

Heroes Welcome Home April Heroes Welcome Home is a 501c3, whose primary mission is to provide down payment assistance to returning veterans, enabling them to achieve their dream of home ownership. The RASM Gives Back program has committed to donating $1,000 to Heroes Welcome Home and will also volunteer at their upcoming Annual Craft Beer & Music Festival on April 22, 2017 from 4 – 10 p.m. This fun event will feature craft beer tasting and live music, offering something for everyone. RASM Volunteers will support by assisting with set-up, 50/50 raffles and silent auctions.

The Tiny Hands Foundation August The core mission of The Tiny Hands Foundation is to improve the quality of life for impoverished children in our area. RASM volunteers will assist with the 2017 Back-to-School Backpack Brigade, scheduled for Saturday, August 5 or Saturday August 12, 2017, from 10 a.m. to 1 p.m. The goal is to fill 1,500+ backpacks with school supplies to give away to community school children in need.

Keep Sarasota County Beautiful September The mission of Keep Sarasota County Beautiful (KSCB) is to educate the public, and promote interest and participation in the overall improvement and beautification of the environment throughout Sarasota County. The RASM Gives Back program has pledged to assist KSCB with their International Coastal Cleanup day, on Saturday, September 16, 2017 from 8:00 am–12:00 noon. KSCB is seeking volunteers to help collect litter throughout the county, specifically area beaches, parks and along county roadways.

Special Olympics Florida – Manatee County October The mission of Special Olympics Florida – Manatee County (SOFMC) is to provide year around sports training and athletic competition in a variety of Olympics-type sports for persons eight years and older with physical and intellectual disabilities. The RASM Gives Back program has pledged volunteer hours at the 2017 Area 9 Bowling Tournament event on October 21, 2017 from 9 a.m. - 3:30 p.m. The organization is requesting enough volunteers to cover all the lanes and other positions needed to help the athletes.

Boys & Girls Clubs of Manatee County November The mission of the Boys & Girls Clubs of Manatee County (BGCMC) is to enable all young people, especially those who need us the most, to reach their full potential as productive, caring, responsible citizens. The BGCMC is planning a RASM adopt-a-day on Monday, November 27, 2017, as part of their 63rd Annual Christmas Tree Fundraising Event. The goal is to sell out of all Christmas trees and wreaths. All proceeds benefit their clubs and members. The shifts are 12 - 3 p.m., 3-6, and 6-8pm.

Boys & Girls Clubs of Sarasota County December The mission of the Boys & Girls Clubs of Sarasota County (BGCSC) is to enable all young people to reach their full potential, as productive and responsible citizens. The BGCSC serves approximately 5,000 children each year across Sarasota County, in five Club locations from Newtown to North Port. The RASM Give Back program has pledged to support the South Sarasota County Holiday Party, scheduled for December 14, 2017. For most of the children invited, the Holiday Party is the only chance to celebrate the season because of difficult circumstances. The RASM volunteers will assist with serving a holiday meal, manning the activity booths, and assisting with Santa photos.

The Blessing Bag Project Ongoing The Blessing Bag Project is a 501c3 organization of volunteers who collect hygiene and clothing items for the thousands of homeless and nearly homeless of Manatee and Sarasota counties. The RASM Gives Back program has pledged to provide donation drop off locations at both the RSAM north and south offices. Children’s Healthy Pantry Ongoing The mission of Children’s Healthy Pantry (CHP) is to ensure that highrisk children attending Title 1 Schools in Sarasota and Manatee counties, have enough to eat during the school day. CHP provides granola bars, crackers and water to over 6,000 students each month. RASM has committed to support CHP by collecting these donations.

Realtor Attorney Joint Committee ®

FR-BAR Contract – Here We Change Again! By David P. Clapp, GRI, SFR, CDPE

It is the goal of the contract revisions committee to update the FR-BAR Residential Contract For Sale And Purchase (Contract) roughly every two years. Because of the changes that were being implemented by the Consumer Financial Protection Bureau (CFPB) in 2015, the committee made some minor changes to the Contract to accommodate for those changes. Those changes were published in February 2016 as version 4x of the Contract. Having addressed the CFPB changes, the committee set out in 2016 to tackle additional changes that had been delayed because of the work on the CFBP changes. During 2016 the committee spent 100 plus hours working through new changes that needed to be made to make the Contract a better and more effective document, balanced and fair to all parties. The proposed changes from 2016 have now been approved and are being published as version 5 of the Contract on April 4, 2017. In 2016 the committee also worked on an extensive revision to the HOA Rider; those changes are still going through the approval process, so until it has been approved, the Comprehensive Rider will still be labeled as CR- 4. There are roughly 13 changes being made with this revision to the Contract. Many of them will not change the way you conduct your business. BUT - there is one the, Financing Clause, that will most definitely change the way you conduct your business. With the finance contingency under the current contract, if the Buyer fails to deliver written notice that they have received a Mortgage Commitment by the Mortgage Commitment Date the Buyer’s deposit money does not go “hard” until seven days prior to closing, with some exceptions. The remedy afforded now is that either Buyer or Seller can cancel the contract. Under the new version of the finance clause, the term “Mortgage Commitment” has been replaced with “Loan Approval.” In the new version, the Buyer’s deposit money will go “hard” if he/she fails to deliver notice of the receipt of Loan Approval, or their inability to get Loan Approval, or if he/she fails to obtain an extension of the Loan Approval Date. Additionally, if the Buyer fails to deliver notice by the Loan Approval Date, the Seller will have the opportunity for three days afterward to cancel the contract with a return of the deposit to the Buyer. If the Seller does not cancel, then the contract will continue to closing, and if the Buyer fails to close, their deposit will be paid to the Seller. This new version of the Finance Clause will require real estate agents to be much more diligent with their tracking of the Loan Approval Date. As a Selling Agent, your failure to keep track of the Loan Approval Date could cause your Buyer to forfeit their deposit monies. As a Listing Agent, your failure to keep track of the Loan Approval 12

Date could cause your Seller to lose their right to cancel within the three-day period afforded them. This could disadvantage them in that it might have been advantageous for the Seller to move on to other opportunities. This article is inadequate to fully explain all of the Contract changes and their implications, especially in regard to the changes that have been made to the finance clause. For that reason, we will be teaching a class with a detailed explanation on all of the changes to the new version of the Contract. You will want to make sure you register for one of the classes, either on Thursday, March 23 from 1:00 to 3:00 at the North RASM location or on Wednesday, March 29 from 9:00 to 11:00 at the South RASM office. Being a new member to YPN, I can tell you I’m thrilled to be a part of such a wonderful crowd. I’m looking forward to a year full of events and community outreach. So, let’s dig in, shall we? The first event of the year was kicked off at Oak & Stone, benefiting the All Faiths Food Bank. Everyone was asked to bring a jar or jars of peanut butter for their donation. The turnout was great! We collected 81 jars of spread, all while enjoying the atmosphere, great food and drinks and welcoming the New Year! On February 18th, we participated in Bridge a Life Superhero 5K & Kids Fun Run. I was just saying to myself how I wish there were some event going on that would allow me to break out my superhero costume. Timing on this was perfect, running through the Farmer’s Market for golden beets and imported olive oil while dressed as Bat Woman would not have gone over very well. Or maybe it would have? Anyhow, whether you volunteered, or you suited up and ran, a good time was had by all. Bridge a Life is an organization that brings foster care awareness to the surface. There’s always some way to help, some way to get involved and some child out there who could use your help. What an honor it was to contribute to something so wonderful! Lastly, an event that is cooking as we speak. YPN will be hosting the first Lip Sync Battle in May at McCurdy’s

Comedy Club. Yes, I said, “Lip Sync Battle”! I bet some of you are saying, “YES! Finally!” I know I was. Contestants will dress the part, bring in the props, and silently serenade the crowd. The details of this event are still in the works, but in the meantime mark your calendar for May 2nd. Proceeds from this event will benefit the “Heroes Welcome Home” charity. Ongoing Feeding Empty Little Tummies (F.E.L.T.) provides nutritious meals for Manatee County’s homeless children, particularly during non-school hours. Manatee County Habitat for Humanity Ongoing Since 1994, Manatee Habitat has provided 126 families with a stable, sustainable place to call home thanks to partner families, donors and volunteers. Manatee Habitat has completed three neighborhood communities – Washington Park and Village of the Palms in Palmetto, and Hope Landing, a neighborhood of attached villas in Ellenton, plus numerous single lot homes throughout Manatee. The RASM Gives Back program has pledged $5,000 as well as volunteer hours on upcoming build sites.

Habitat for Humanity Sarasota Ongoing Since 1984, Habitat Sarasota has provided safe, affordable homes to lowincome working families in Sarasota County. Since April 2010, 249 RASM members have contributed 1,899 volunteer hours on 20 different Habitat build sites. “Affordable housing in our area has become almost nonexistent. Season Off to Solid Start in Sarasota and Manatee

Recent data produced by Florida Realtors® for our two-county area indicates January 2017 to be off to a solid start to this season’s sales. Inventory has been increasing in the two-county area each month since September. The result of higher inventory is that we are very near the balance between a seller’s and a buyer’s market. January also saw an increase in both year over year and month over month in the number of properties that went under contract during the month. Inventory in the two-county area increased by 17.9 percent over January of last year. Sarasota condo inventory increased by 27.1 percent, while single family was up 20.8 percent. In Manatee County, condos were up by 11.4 percent and single family by 10.9 percent. New pending sales in the month increased. The combined county pending sales reflect an 8 percent increase from January of 2016. “The increased inventory is easing the supply and demand pressure and giving buyers more choices,” says Xena Vallone, 2017 RASM President. “The increase in pending sales is a good indication of future closed sales.” Median prices for Sarasota single family homes increased to $250,000, while Manatee single family increased to $279,000. With fewer homes available to purchase below $200,000, largely because of the decline of distressed properties available for purchase, we can expect median prices to continue to rise. Condo median sales prices rose to $239,900 in Sarasota and to $175,000 in Manatee. Closed sales in the two-county area are up by 11.6 percent from January 2016 for condos. Meanwhile, single family home sales in Sarasota and Manatee showed an 8.2 percent decrease. Collectively, distressed sales experienced a 51.8 percent decrease from last year, while traditional sales (non-distressed) experienced an increase of 3.5 percent, making a healthier market. The months’ supply of inventory indicates a more balanced market, with an increase across the board. Sarasota condos are at a 5.9-month supply, surpassing the threshold of a balanced market at 5.5 months, while single family homes are at a 5-month supply. Manatee County condos are at a 4.8-month supply and single family at a 4.5-month supply of condos. “A balanced market is driven by supply and demand and favors neither the seller nor the buyer,” says Vallone. “If the market is strong and balanced, buyers have more choices and sellers have a larger pool of buyers.” Editor’s Note: For comprehensive statistics dating back to 2005, visit www.MyRASM.com/statistics.

Commercial Investment Division Medical Marijuana

Amendment 2 has passed. Now what? So what does medical marijuana have to do with commercial real estate? Well, you would be surprised. There are probably two different facilities and zoning classifications that will be required, and even though government officials have known for some time that passage was inevitable, once it passed they hit the pause button and created a moratorium to Rico Boeras make sure that they got the zoning and other CID President regulations right. Last November, Amendment 2 passed by a very large margin and now that 28 states have passed similar laws, everyone knows this is not a fad. The implications of legalizing a new type of drug are huge, so government officials really want to get this right. Federal law continues to make the use of marijuana illegal, and so I would think it is just a matter of time before that changes. To date, there are eight states and Washington D.C. that have voted to legalize the recreational use of marijuana. However, not all of the states have gone through the steps to implement legalization. Right now, marijuana is legal in California, Oregon, Washington, Alaska, Colorado, Nevada, Maine, Massachusetts and Washington D.C. for recreational purposes. There are currently 28 states that have legalized medical marijuana. However, not all of them have implemented their laws. Florida’s Amendment 2 took effect January 3, 2017, however, they created a moratorium. Time is running out for them and for us as Realtors® to get a handle on the zoning and regulations that will take effect. “The state has six months to put the regulations into effect and nine months to start issuing cards to the caregivers,” said Dr. Brent Stewart, who is one of the three licensed physicians to order cannabis for patients in Alachua County. As a matter of fact, we can look to Alachua County to get an idea of some of the restrictions regarding zoning. They had two dispensaries and seemed to be the first or one of the first Florida counties to implement Amendment 2. One key zoning regulation that Alachua County requires is that the dispensary is not less than 750 feet from a school. We have similar requirements for alcohol where an establishment that sells alcohol has to be at least 500 feet from a church or other house of worship.

Now that Amendment 2 is in effect, the list of approved conditions for medical marijuana has expanded to: Cancer, Epilepsy, Glaucoma, HIV, AIDS, Post-Traumatic Stress Disorder (PTSD), Amyotrophic Lateral Sclerosis (ALS or Lou Gehrig’s disease), Crohn’s disease, Parkinson’s Disease and Multiple Sclerosis. This is going to be big business, too. It is expected to be a $1-billion-dollar business but getting the right regulations are going to be critical. So what do Realtors® need to know to be ready? We are in a holding pattern because of the moratorium. The zoning and regulations have not been finalized but keep on the lookout; it will be soon. We will need to research the zoning regulations and meet with county and city officials to find out firsthand what those zoning regulations will be. It is part of our job to stay on top of the ever-changing nuances of our industry.

Commercial Investment Division Installs 2017 Officers The RASM CID installed their 2017 officers and directors, including CID President Rico Boeras of Sarasota Commercial Realty, LLC. During his term, Boeras will focus on building participation in CID, increasing membership to 400 Realtors® and business partners and to improve the educational opportunities available to members. “Everyone in CID is involved for the betterment of our industry. Be the Best There is an increasing volume of statistics available on the extent of non-U.S. nationals’ activity in the real estate market in Florida and our Sarasota/Manatee area. Whatever the detail the over-riding message is that if you are active in the real estate market in Sarasota/Manatee sooner rather than later, you are going to be involved with a foreign national either on your side or the other side of the transaction. Beware When you are dealing every day with real estate transactions in Florida, it is easy to mistakenly assume that the parties you are dealing with have an understanding of the practices and steps involved in a transaction and that they understand the terminology you are using and appreciate what is required of them. This can be a terminal error to your chances of earning a commission from a transaction as well as being detrimental to your reputation for providing high-quality service to your clients, customers and your fellow professionals whether they are Realtors®, attorneys, accountants, bankers, etc. Be Prepared - You Should be Aware of: 1) The specific laws affecting foreign nationals living, working, visiting or investing in the US. 2) The cultural differences which may influence the behavior of a foreign national. 3) That the laws and practices of the real estate market are different in the foreign national’s home market. 4) The economic and financial factors which will influence the foreign national’s decisions on real estate in the US. 5) The foreign national may have a limited understanding of ‘American’ English, if any at all. Be Informed RASM’s Global Business Council’s mission is to help you develop and extend these understandings as well as providing an opportunity to interact with fellow Realtors® and other professionals involved in the Global Real Estate marketplace.
