Hundreds of police departments use camera company accused of breaking state law

Giannoulias alleges Flock Safety improperly shared data with federal border officials

CHICAGO — An automatic license plate reader company used by hundreds of police departments around Illinois broke state law by allowing federal border enforcement officers to access Illinois license plate camera data, according to Illinois Secretary of State Alexi Giannoulias.

The company, Flock Safety, was also allegedly used by out-of-state police earlier this year to look for a woman who recently had an abortion. That situation sparked the secretary of state’s office to audit Flock.

License plate readers are cameras which can automatically detect the license plate, make, model and other details of cars while they’re driving. These details are logged and entered into a database that can be searched and shared between law enforcement agencies, governments and private companies.

A 2023 state law, which was backed by Giannoulias, prohibits operators of license plate readers from sharing the data they collect for the purpose of enforcing immigration or abortion-related laws.

Giannoulias alleges that Flock gave U.S. Customs and Border Patrol access to Illinois data as part of a pilot program. Flock also didn’t have any safeguards to prevent other out-of-state police from violating Illinois’ license plate reader law, according to Giannoulias.

Giannoulias said the company’s actions “put them in direct violation of Illinois law” in a video statement Monday.

“We will not tolerate any violations to our data sharing and privacy laws,” Giannoulias said. “Moving forward, we encourage local law enforcement to closely examine their relationship with Flock and ensure that their use of this technology is compliant with the law.”

The law prohibiting this kind of data sharing does not contain any specific

penalties for violating it.

Giannoulias’ office told Capitol News Illinois it is “conducting an investigation” into the matter. The office has been in talks with the state’s attorney general, although it declined to describe specifics.

At least one city, Evanston, has deactivated its Flock cameras and begun the process of canceling its contract with the surveillance company. In a statement, the city called the situation “deeply troubling.”

A spokesperson for Flock, meanwhile, said that they were unaware of any ongoing investigation and that the company disagreed with the secretary of state’s legal assertions.

“We clearly communicated poorly,” Flock CEO Garrett Langley wrote in a blog post earlier this week. “We also didn’t create distinct permissions and protocols in the Flock system to ensure local compliance for federal agency users.”

In that statement, Langley said the company had paused all pilot programs with federal agencies. Langley also said he tasked the company’s top lawyer with overseeing the rollout of new compliance tools.

Flock cameras’ prevalence

Flock does not disclose its customers, but a database based on news reports and company statements assembled by the Electronic Frontier Foundation found about 90 police departments in Illinois that are confirmed to use Flock cameras.

Flock customers can elect to share information about their system through pages hosted by the company that disclose what types of information is collected, how many vehicles have been detected by their system and how long data is stored.

Police departments can disclose what other law enforcement agencies have access to the data collected by their cameras. In Illinois, at least 27 police departments disclose information in this way, including 14 which list the other agencies that have access to their data.

More than 461 police departments, prosecutors, dispatch agencies, state universities, transit agencies and rail-

roads in Illinois had access to Flock data, according to these disclosures. All of the transparency reports have been updated within the past week.

The attorney general’s office and Illinois State Police both have access to Flock data. ISP pays the company about $50,000 per year, according to state records. The agency can access Flock’s data for investigations but doesn’t operate any Flock cameras and doesn’t share its own data with Flock, according to an ISP spokesperson.

While license plate reader cameras are frequently associated with Chicagoland — in part due to a major state-backed program in the region — downstate municipalities use them too. Flock transparency reports indicate that the Champaign Police Department has 46 cameras. Normal has 51 license plate readers and other cameras, while Springfield has 135.

Out-of-state data sharing

The 14 agencies that disclose data sharing also share information with 551 agencies outside the state, including with law enforcement organizations in Texas, Oklahoma, Kentucky, Missouri, Indiana and more.

These out-of-state agencies that have access to Illinois license plate data include police departments, universities and state agencies. The list of organizations also includes the federal General Services Administration Office of the Inspector General, U.S. Postal Inspection Service and a U.S. Air Force base, according to Flock transparency reports.

State law requires that police departments and other license plate camera operators in Illinois obtain a written declaration from all out-of-state law enforcement agencies saying that they will not use license plate reader data to enforce abortion restrictions or immigration enforcement.

Landmarks Illinois evaluates the status of Rockford’s historic Elks Lodge

The Elks Lodge #64 has a long history in Rockford, and the structure has been used for many community activities. However, it has been vacant and deteriorating since 1990. It was built in 1912 and served many years as a lodge for the local Elks Club. Chicago-based architect Lawrence P. Buck designed the multi-story clubhouse made from red and brown brick with green tile. It has an exterior finish similar to that of the American Insurance Company across the street – making it an important part of the architectural aesthetic of this downtown area in Rockford.

Buck was influenced by the English Arts and Crafts movement and Chicago Prairie School philosophy, which are reflected in the building’s overall design. There is a second floor, a Classical-Revival ballroom and a bowling alley on the lower level.

The Elks Lodge was listed on the National Register of Historic Places in 2005. It is also West Downtown Rockford Historic District Rockford as of 2004. Its

location on the corner of Jefferson Street and Main Street makes it an important gateway to Rockford’s West Downtown commercial district. Many nearby buildings have been successfully renovated, including the Coronado Theatre. Rehabilitating the Elks Lodge building is needed to continue the revitalization and reinvestment efforts seen in the area.

It is the intention of local organizations like Friends of Ziock and the River District Association as well as the City of Rockford to promote and reinforce the historic district’s redevelopment opportunities. The Elks Lodge holds a linchpin corner to mark the gateway into this important downtown district.

A current court order calls for the immediate demolition of the historic former ElksLodge #64. Once a prominent community gathering space, the building has had a long history of sitting vacant and deteriorating. The Elks Club vacated the property in the 1990s, and it has since had several owners who never utilized the building. At one point, the building was donated to Goodwill Industries, which

made some needed improvements and sold it to the current owner a decade ago. Since then it has suffered deterioration due to a lack of maintenance and funding to make necessary repairs.

In August 2021,, a judge ordered the owner to demolish the building with January,2022 deadline. The owner, Argyll-McInnis, LLC is pursuing selling the property.

Despite its current negative presence due to neglect, the Elks Lodge’s location within the West Downtown Rockford Historic District does provide some benefits. For one, it opens up the possibility of a developer being able to use key financial incentives for the building’s rehabilitation.

The location makes the 20% federal historic preservation tax credit available with a qualified rehabilitation. Additionally, the Elks Lodge is in the State of Illinois’ River Edge Zone, which also provides use of the state’s 25% River Edge Historic Preservation Tax Credit. Rockford is one of five cities in Illinois with access to this additional financial

incentive for the rehabilitation of historic buildings.

Several other residential and commercial properties on the same block have been recently rehabilitated or have renovations underway, making the Elks Lodge rehabilitation a key part of downtown Rockford’s overall revitalization.

The restoration of our past mixed with new development opportunities have made this community thrive. The historical significant of the Elk’s Club building is paramount to the continuation of this mission. I, for one, cannot wait to see it back to the splendor of its past, ready for enjoyment of Rockfordians for generations to come.”

New trial ordered for 3 Memphis ex-officers in connection with the beating death of Tyre Nichols

MEMPHIS, Tenn. (AP) — A judge ordered a new trial Thursday for three former Memphis police officers who were convicted of federal charges in the fatal beating of Tyre Nichols, after defense lawyers argued that another judge who presided over their trial was biased in his belief that at least one of the men was in a gang.

U.S. District Judge Sheryl H. Lipman issued the order for a new trial for Tadarrius Bean, Demetrius Haley and Justin Smith, who were found guilty in October 2024 of obstruction of justice through witness tampering.

The ruling marks the latest setback for prosecutors in a case that shocked the country when videos were released showing officers violently kicking and punching Nichols during a traffic stop. The officers who have been granted a new trial in the federal case were acquitted of state murder charges in May. And last year federal prosecutors were unable to secure convictions on the most severe counts against Bean and Smith.

Two other officers charged, Emmitt Martin and Desmond Mills Jr., pleaded guilty before the federal trial.

Lipman took over the case in June after U.S. District Judge Mark S. Norris, who presided over the case and the trial, recused himself days before the sentencings for the five officers.

In a statement shared by his judicial office Thursday, Norris said, “Because of the code of judicial conduct, I cannot make a statement on this matter.”

New trial based on judge’s comments

In her order, Lipman cited a notice filed by the U.S. Attorney’s Office saying Norris expressed a theory that at least one of the officers was in a gang.

The notice discussed an incident in which Norris’ law clerk was shot during a car theft days after the trial ended. The clerk was staying at the home of another law clerk who had previously worked for Norris on the Nichols case, it said.

The notice also said police investigators believed some juveniles committed the shooting; that Norris wanted those responsible held accountable; and that he “evidenced reasonable frustration with the police investigation.”

Norris met with the U.S. Attorney’s Office and an FBI agent, who explained

why no federal charges would be brought in the clerk’s shooting.

Norris indicated that he believed at least one of the former officers was in a gang and that it was responsible for the shooting, the notice said. It also said the U.S. Attorney stated that Norris told those present that the clerk “had been seen by one or more of the Defendants during the trial.”

An assistant U.S. attorney who attended the May 30 meeting also said she remembered that Norris told her he could not meet with police to give a statement because the department was “infiltrated to the top with gang members,” the notice said.

Allegations of bias

Bean, Haley, and Smith filed motions seeking a new trial, arguing that Norris was biased and violated their rights to due process by presiding over the case.

Smith’s lawyer said there was no “suggestion or one hint in the federal discovery process or the federal trial that any defendant or any member of the Memphis Police Department was in any way affiliated with an illegal street gang either through membership or relationship.”

Haley’s lawyer wrote that “Judge Norris made the gang statements on at least two occasions, demonstrating that it is a firmly held belief, not an off-hand remark.”

Lipman also unsealed several filings made before and after Norris recused himself. In one of them, federal prosecutors argued that there was no evidence that he “harbored any bias before or during trial, let alone the type of extreme bias that would warrant the extraordinary remedy of a new trial.”

Lipman found that while a review showed Norris’ decisions throughout the trial were “sound, fair, and grounded firmly in the law,” a new trial is necessary “because the risk of bias here is too high to be constitutionally tolerable.”

A date for the retrial has not been set. Lipman ordered lawyers to submit positions on what charges they believe need to be tried.

Smith’s attorney, Martin Zummach, said Lipman “did the right thing.” Bean’s lawyer declined to comment, and Haley’s attorney did not immediately respond to a request. Memphis police also declined to comment.

Mixed verdict in 2024 trial

Bean, Haley and Smith were found guilty of trying to cover up the beating by failing to say that they or their colleagues punched and kicked Nichols and broke police department rules when they did not include complete and accurate statements about what type of force they used.

Bean and Smith were acquitted of more serious civil rights charges, however.

Haley was found guilty of violating Nichols’ civil rights by causing bodily injury and showing deliberate indifference to medical needs and also conspiracy to tamper with witnesses.

Bean, Haley and Smith were acquitted in May of all state charges, including second-degree murder. Haley is in federal custody, but Bean and Smith are on limited release.

Martin and Mills pleaded guilty in federal court last year to violating Nichols’ civil rights by causing death and conspiracy to witness tamper. They did not stand trial in federal court with their former colleagues.

Martin and Mills also avoided a state court trial after reaching agreements to plead guilty.

The officers were part of a crime suppression team called the Scorpion Unit that was disbanded weeks after Nichols died. The team targeted illegal drugs, guns and violent offenders, and it sometimes used force against unarmed people.

The Tyre Nichols case

On Jan. 7, 2023, officers yanked Nichols from his car and then pepper-sprayed and hit the 29-year-old Black man with a Taser. Nichols fled, and when the five officers, who also are Black, caught up with him, they punched, kicked and hit him with a police baton. Nichols called out for his mother during the beating, which took place steps from his home.

He died three days later.

Video of the beating captured by a police pole camera also showed the officers milling about, talking and laughing as Nichols struggled with his injuries.

It prompted intense scrutiny of police in Memphis, nationwide protests and renewed calls for police reform.

Norris is a former Republican state senator who was confirmed as a U.S. district judge in West Tennessee in October 2018 after being nominated by President Donald Trump.

Israel declares Gaza’s largest city a combat zone as death toll surpasses 63,000

GAZA CITY, Gaza Strip (AP) — Israel declared Gaza’s largest city a dangerous combat zone and recovered the remains of two hostages on Friday as the army launched the “initial stages” of a planned offensive that has drawn international condemnation.

As the military announced the resumption of fighting, health officials said the death toll in Gaza has risen to 63,025, with 59 new deaths reported by hospitals over the last 24 hours. Aid groups and a church sheltering people said they would stay in Gaza City, refusing to abandon the hungry and displaced who depend on them.

The shift comes weeks after Israel first announced plans to widen its offensive in the city, where hundreds of thousands are sheltering while enduring famine. The military has in recent days ramped up strikes in neighborhoods on the city’s outskirts.

Plumes of smoke and thunderous blasts could be seen and heard across the border in southern Israel on Friday morning.

Israel has called Gaza City a Hamas stronghold, alleging that a network of tunnels remain in use by militants after several previous large-scale raids on the area throughout nearly 23 months of war.

Prime Minister Benjamin Netanyahu has argued that crippling Hamas’ capabilities in the city is critical to shielding Israel from a repeat of the Oct. 7, 2023, attack that ignited the war.

While United Nations agencies and aid groups condemned the offensive’s announced start, people in Gaza City said it made little difference: Strikes already have been intensifying and the aid reaching them was insufficient.

City resident Mohamed Aboul Hadi said it made no difference. “The massacres never stopped, even during the humanitarian pauses,” he said in a text message sent from Gaza City.

More than 63,000 Palestinians have been killed since the war started, the Gaza Health Ministry said Friday. The ministry’s count — 63,025 — does not distinguish between fighters and civilians. It also said five people had died from malnutrition-related causes over the past 24 hours, raising the toll to 322, including 121 children, since the war began.

The ministry is part of the Hamasrun government and staffed by medical professionals. The U.N. and independent experts consider it the most reliable source on war casualties. Israel disputes its figures but has not provided its own.

Some refuse to leave as Gaza City assault begins

Facing international criticism, Israel instituted what it called “tactical pauses” in Gaza City and two other populated areas last month that it said were geared toward letting in more food and aid. The pauses included a daily halt in fighting from 10 a.m. to 8 p.m., though aid groups have said deliveries remained challenging due to blockade, looting and Israeli restrictions.

Midday Friday, the military said it had suspended pauses, marking the latest escalation after weeks of preparatory strikes in some of the city’s neighborhoods and calling up tens of thousands of reservists.

“We will intensify our strikes until we bring back all the kidnapped hostages and dismantle Hamas,” Israeli army spokesperson Avichay Adraee said.

Adraee, the Israeli military’s Arabiclanguage spokesperson, has for days urged Palestinians in Gaza City to flee south, calling evacuation “inevitable.”

Hundreds of residents began the journey south on Friday, piling their few remaining possessions onto pickup trucks or donkey carts. Many have been forced to leave their homes more than once.

“We cannot find any place in the west nor in the south. Conditions are difficult. Where are we going? We don’t know,” said Saddam Yazigi as he prepared to leave Gaza City.

The U.N. said Thursday that 23,000 people had evacuated over the past week, but many Palestinians in Gaza City question the effort when there is nowhere safe to go.

The Holy Family Church of Gaza City told The Associated Press on Friday that the roughly 440 people sheltering there would remain along with members of the clergy who would assist them.

Farid Jubran said the church had left the decision up to the people even though they had little recourse to insulate themselves from fighting.

“When we feel danger, people get closer to the walls or whatever, it’s more protected,” he said, noting the church had few specific defenses.

The UN’s humanitarian agency said its staff and NGOs also would remain on the ground.

Aid groups say they weren’t notified

As Israel suspended pauses on Friday in Gaza City, the military did not say whether they had notified residents or

aid groups of the impending declaration ahead of the 11:30 a.m. announcement.

Norwegian Refugee Council, which coordinates a coalition of aid groups active in Gaza, said it had not received notification that Israel’s “tactical pauses” would be suspended.

The U.N. said Thursday the besieged strip could lose half of its hospital bed capacity during an expanded assault on Gaza City.

“We cannot provide health services to 2 million people besieged in the south,” said Zaher al-Wahidi, a spokesperson for Gaza’s Health Ministry, noting a forcible evacuation of the strip’s largest city would be an environmental and health catastrophe.

The suspension of the pause also comes one week after the world’s leading food security authority declared Gaza City was being gripped by famine after months of warnings.

An Israeli military official said Israel intended to continue facilitating aid to Gaza City. But the official provided no details on how they would continue to get aid in amid a ramped-up offensive.

“This will have a horrific impact on people already exhausted, malnourished, bereaved, displaced, and deprived of basics needed for survival,” the UN’s humanitarian agency said in a statement.

“Forcing hundreds of thousands to move south is a recipe for further disaster.”

Remains of hostages recovered

Israel on Friday said its military had recovered the remains of two hostages

— Ilan Weiss and another left unnamed.

“The campaign to return the hostages continues continuously. We will not rest or be silent until we return all of our hostages home — both the living and the dead,” Netanyahu said in a statement.

Weiss, 55, was killed in the attack on Kibbutz Be’eri, one of the communities near Gaza that Hamas-led militants stormed on Oct. 7.

For the families of hostages, the return of their remains meets a central demand and brings some closure, but also is a reminder of hostages who remain in Gaza.

“At least they have closure,” said Rubi Chen, whose son was abducted during the Oct. 7 attack and is believed to be dead. “There are still 49 families waiting to have that closure.”

Of the 251 hostages taken by Hamasled militants, nearly 50 remain in Gaza including 20 that Israel believes to be alive.

Israel’s Hostages and Missing Families Forum, which has organized large-scale protests demanding a ceasefire to return the hostages, mourned the losses and said Israeli leaders should prioritize a deal to return both the living and the dead.

“We call on the Israeli government to enter negotiations and stay at the table until every last hostage comes home. Time is running out for the hostages,” it said in a statement.

Hamas-led militants abducted 251 people and killed around 1,200 people, mostly civilians, in the Oct. 7 attack. Most of the hostages have been released in ceasefires or other deals.

ly go into survival mode. Your tomato plants might stop setting new fruit or developing sunscald on existing ones. Don’t worry though – this is completely normal plant behavior during extreme heat. You’ve probably also noticed your green tomatoes seem to not ripen, refusing to turn red. This ripening slowdown happens because the natural enzymes that create those red pigments become less active in excessive heat. Your plants are simply conserving energy until conditions improve.

For heat stress, create afternoon shade using shade cloth and focus on deep, early morning watering. A thick layer of mulch around your plants will help regulate soil temperature and keep moisture

consistent.

Another frustration many of you are dealing with is blossom end rot – those unsightly dark, sunken spots on the bottom of tomatoes and peppers. You may be surprised to be encountering this late in the season and yet it’s a calcium deficiency problem caused by inconsistent watering. When we have sudden downpours following dry days, this symptom will show up. To tackle blossom end rot, the key is maintaining steady soil moisture through deep, less frequent watering. Avoid disturbing plant roots when weeding, and consider adding compost to improve your soil’s ability to hold both water and calcium.

Then there’s powdery mildew, that

white fuzzy coating that seems to appear overnight on stressed plants. This opportunistic fungus loves the combination of stressed plants and the humid conditions we’ve had after recent storms. For powdery mildew, air circulation by spacing plants properly and removing affected leaves immediately. Because this shows up very late in the season, chances are no action as needed as it may be nearly time to harvest your pumpkins.

With the fall weather we received last week, your plants will likely bounce back and you should still be able to enjoy your summer harvest into September and October.

Assaults on climate science continue

The key federal database tracking billion dollar weather disasters produced by the National Oceanic and Administration was formally ended this past May. It had been tallying the growing number of storms, droughts and wildfires that caused at least one billion dollars in damages. Ending the database was seen as another part of the broad assault on climate science by the current administration.

According to an article by Lauren Rosenthal appearing in the Newsletter ESG and investing in the data base will be produced by the nonprofit Climate Central this fall. The nonprofit organization has published studies how human caused climate change has influenced extreme weather events. Adam Smith, the former NOAA climatologist who led the disaster tracker program has been hired to continue tallying the billion dollar damaging storms, droughts and wildfires. He hopes to include disasters reaching as low as $100 million thresholds such as the growing hail storm damages in the US Midwest and Mountain West. In contrast to the databased tracking of storm costs is a report published in July of this year by the US Department of Energy. It is titled “A critical review of the impacts of greenhouse gas emissions

on the US climate.” It claims that C02 induced warming might be less damaging economically than commonly believed. The report could play a role in administration plan to rescind the endangerment finding supporting US climate policies.

The endangerment finding enacted to 2009 by the Obama administration states that six greenhouse gases contribute to the negative impacts of climate change and place the public in danger. There are six greenhouse gases that pose a threat to public health and welfare by contributing to climate change. They include carbon dioxide, methane, nitrous oxide, hydrofluorocarbon, perfluorocarbon and sulfur hexafluoride. The findings were a prerequisite for implementing emission standards on motor vehicles and other industries. The preceding was extracted from the EPA’s web site.

This portion of the article is based on some of the information contained in an article by H. Christopher Frey, a professor of Environmental Engineering at August 12, 2025. It points out that the Trump administration plan to rescind the endangerment finding could run afoul of four federal laws.

One law addresses the questions of whether the current Energy Department produced a credible report. The Information Quality Act passed by Congress in 2000 requires “ensuring the quality, objectivity and integrity of

information disseminated by Federal agencies.” The law requires a public review by scientific experts not affiliated with the depart that issued the report. The report does not appear to fulfil the law regarding outside experts.

The second concern is that agencies cannot cherry pick groups to give answers the agency wants. The Federal Advisory Committee Act of 1972 addressed concerns that “special interest groups” could promote their private concerns on matters of their vested interests.

The law requires a public process for appointing groups to advise government, appoint them in public view and take public comments. It also requires a fair balance of viewpoints within the group and a public nomination process with a public opportunity to comment on the candidates.

A third concern raised by the Administrative Procedure Act of 1946 requires Federal agencies to allow public participation in rule making processes and follow consistent procedures and practices when developing regulations. Agencies are expected to examine relevant data, follow applicable laws, follow established procedures and provide opportunity for public comment.

The fourth concern is raised by Environmental Research, Development and Demonstration Authorization Act of 1978. It requires the establishment of a

Science Advisory Board. It requires the Board to have all relevant and technical information on any proposed regulation. All previous members of the Advisory board were dismissed by the Trump Administration as of January 28, 2025 and no new members were listed as of Aug 11, 2025. If all procedures are followed in securing a new board the author doubts there is time to appoint a new board.

The four laws were passed to protect the public and prevent the federal government from being unduly influenced by narrow interests when gathering evidence that influences policy decisions. Science based agencies like the Energy Department and EPA have a legal requirement to follow the science.

The public has an opportunity to comment on the EPA’s proposal to rescind the 2009 endangerment finding and greenhouse gas vehicle standard until September 15, 2025. The EPA is accepting public comments on the report through September 2.

ORDINANCE NO. 25-04

AN ORDINANCE ESTABLISHING RULES, REGULATIONS, CHARGES AND FEES FOR THE USE AND SERVICES OF THE WATERWORKS SYSTEM OF THE NORTH PARK PUBLIC WATER DISTRICT, WINNEBAGO COUNTY, ILLINOIS

BE IT AND IT IS HEREBY OR-

DAINED by the Board of Trustees of the North Park Public Water District, Winnebago County, Illinois, as follows:

Section 1. That there shall be and there are hereby established Rules and Regulations for services supplied by the water works system of the North Park Public Water District, Winnebago County, Illinois, as follows:

A. PERFORMANCE BOND

Contractors/developers shall provide a performance bond in favor of the North Park Public Water District in an amount equal to the Engineer’s Cost Estimate shown in Schedule A of the IEPA Construction Permit Application. This bond shall guarantee completion of all proposed facilities shown on development plans and permit applications. The bond shall cover the period of 48 months as set forth in the IEPA Construction Permit. Should the proposed facilities not be completed within a 42-month period, the District reserves the right to complete the project and collect on contractor’s/developer’s bond.

Alternative bonding methods (i.e., other agency bonds covering water facilities, etc.) may be accepted at the discretion of the District. Every bond provided for in this Section shall have as security thereon one Surety Company qualified to do business in the State of Illinois and acceptable to the District.

B. MAINTENANCE BOND

Upon completion of proposed improvements, contractors/developers shall provide a maintenance bond in favor of the North Park Public Water District in an amount equal to ten (10) percent of the final contract price. This bond shall guarantee performance by the contractor/developer under Guarantee Warranty requirements detailed in the District’s Standard Specifications on file with the IEPA. This bond shall be furnished upon the District’s final acceptance and prior to submission of the IEPA Operating Permit Application and shall remain in effect for a period of one (1) year thereafter. Alternative bonding methods (i.e., other agency bonds covering water facilities, etc.) may be accepted at the discretion of the District. Every bond provided for in this Section shall have as security thereon one Surety Company qualified to do business in the State of Illinois and acceptable to the District.

C. DEVELOPMENT, CONTRACTS, AMENDMENTS REVIEW & PROCEEDINGS

Applicant/petitioner/contractor/developer shall be responsible for paying for the Professional Services Fee and costs incurred by the District as a part of each Professional Consultants’ performing their Development Review and participation in Development proceedings. No Development Review or Development Proceeding shall commence until the appropriate escrow account has been established and funded and a professional services fee agreement entered into.

D. ESCROW ACCOUNT AND PROFESSIONAL SERVICES FEE

AGREEMENT

1. In order to secure payment by the contractor/developer for any Professional Services Fee and costs incurred by the District, an escrow account (hereinafter referred to as “escrow account”) will be created and maintained

by the District. The applicant/ petitioner/contractor/developer shall deposit such amounts as in accordance with the schedule set forth in Section 2 and an overall cost estimate of the Professional Services Required for the project.

2. Applicant/petitioner/contractor/developer shall enter into a “Professional Services Fee Agreement (hereinafter referred to as the “Agreement”).

3. Notwithstanding anything to the contrary contained in this Section, the District General Manager shall have the right to adjust any escrow deposit amount or agreement, when warranted.

4. No construction work of any kind shall be performed on any proposed water main or other Water District improvement without an IEPA construction permit and the expressed permission of the District. The design shall be in accordance with the North Park Public Water District Standard Specifications, the Ten State Standards and the latest edition of the Standard Specification for Sewer and Water main Construction in Illinois.

5. Individual existing residential/homeowner properties on less than one acre in size, requesting to connect to the system and when it does not require any Professional Staff determination, the requirement of an Escrow Account can be waived by the General Manager.

E. PAYMENT OF FEES, BALANCE OF ACCOUNT

Upon submission of invoices for services by a Professional Consultant deemed necessary by the District, the District shall pay said invoice out of the specified escrow account. At such time as the balance of the specified escrow account reaches twenty-five percent (25%) of the original amount deposited, the District may require that an additional sum of money be deposited in the escrow account, inclusive of the present balance in the specified escrow account, which could equal or exceed the amount originally required by the District.

F. GOOD STANDING ACCOUNT STATUS

The District will conduct a monthly reconciliation of escrow account and forward its findings to applicant/petitioner. Should the account balance in escrow fall below the required amount, District shall notify the applicant/ petitioner/contractor/developer of the same and escrow account brought into good standing by applicant / petitioner / contractor / developer. Any deficiency shall be paid to the Water District prior to the issuance or release of an IEPA construction permit, NPPWD Connection Permit, or service connection to the water system.

G. REFUNDS

Upon a determination being made by the District that payment of all Professional Service Fees and costs associated with a particular project or request has been made, any balance remaining in the escrow account shall be returned to the applicant / petitioner / contractor / developer within ninety (90) days of such determination.

Section 2. That there shall be and there are hereby established charges and fees for the use of and for the service supplied by the waterworks system of the North Park Public Water District, Winnebago County, Illinois, as follows:

A. CONNECTION FEES

1. New Service Permit Deposit $350.00 each

Shall be assessed for all new water service installations to ensure the integrity of the water service line during the construction process. Once landscaping is complete and final inspection is passed, the District shall refund this deposit in its entirety, unless additional cost has been incurred by the District to address any

deficiencies*.

*Note: It is the District’s intent to have all new service installations completed and approved within six months of the substantial completion of the building. In the event the permittee fails to pass final inspection within this given time, or the property is sold prior to the six month periods completion, the District reserves the right to make any and all corrections and retain this deposit. Any costs for these corrections will be charged at Time and Material charges**, if costs beyond the deposit value are incurred, they will be billed to the owner of the property, payment will be required before the property can change hands.

2. Permit Fee: $225.00 each

The fee shall be payable upon issuance of the required Water Connection Permit and shall cover the initial installation inspection of the service connection. All connections shall remain open for inspection.

Failure to keep the connection open for inspection may result in the District requiring re-excavation of the service connection at the plumber’s expense. Permittee must give notice that the property is plumbed and ready for a meter to be installed, and said notice must be given at least 10 business days prior to property changing hands.

New Service Permits shall expire after 365 days of issuance. If after 365 days from the date the permit was issued the service line to the permitted property has not been installed the permit will be considered void. The permit fee will be retained by the District, however the permit deposit will be returned to the permittee if said permit is void.

All services shall be, at a minimum, 1-inch. The System Development Charge for Apartments (served by a single meter), including modular (mobile) home developments and Commercial business/office, motel, manufacturing, or other commercial building (served by a single meter) shall be based upon the size of the water service or fire service, whichever is larger.

The System Developmental Charge shall be paid at the time of Water District approval of new water service construction permit applications (IEPA, if applicable) or new water service application (NPPWD).

4. Water Stub Fee (if applicable)

A. Single family residential service (plus meter charge): $3,631

B. Up to 1” commercial service (plus meter charge): $4,356

Over 1” commercial service (minimum $4,231): Time and Materials**

The “Connection Fees” do not include surface restoration costs to utility easements or right-of-way areas. These additional costs, if any, will be the responsibility of the subscriber. “Connection Fees” include a water service line installed to the nearest private property line and does not include the cost of the meter. “Connection Fees” include materials and labor for a maximum service distance of 75 feet. Any service footage greater than the maximum will be subject to time and material charges**. Time and material charges** will also apply for all service installations when the frost depth is greater than 12 inches.

5. Water Meter Charge

meter will be based upon the actual cost of the meter or materials and installation labor plus 10%**.

The Meter Charges shall be payable upon issuance of the required New Water Service Permit. Properties occupied without a North Park Public Water District meter installed will be in violation of this Ordinance and are subject to a minimum fine of $400. For any customers (both residential and commercial) wanting to upsize the meter after it has been installed, the full cost of the new meter will be owed prior to the upsized meter being installed.

In instances where a 5/8” or 3/4” meter was installed, a prorated discount for the cost of the 5/8” or 3/4” meter will be applied based on 10 years of useful life of the meter. In instances where a 1” or larger meter was installed, a prorated discount for the cost of the 1” or larger meter will be applied based on 10 years of useful life.

6. Recapture Fee (if applicable) Recapture fee will be dictated by the conditions of an intergovernmental agreement whereby a water stub had been installed and paid for by another government entity.

B. RESPONSIBILITY FOR MAIN CONNECTION AND SERVICE LINE ACTIVATION

In instances where a subscriber is responsible for tapping the District’s water main to establish a connection to a service line, the subscriber must ensure the tap is performed properly and in accordance with District standards. If the service line is installed but the associated development or structure is not connected and activated within a reasonable time as determined by the District, and a subsequent review or inspection reveals that the service line was improperly connected due to an unsuccessful or faulty main tap performed by the subscriber, all costs for repair, re-tapping, or corrective work shall be the sole responsibility of the subscriber. The District shall not be liable for any delays in water service or damages resulting from an improper tap made by or on behalf of the subscriber. Additionally, the District reserves the right to suspend or deny water service until the connection meets all requirements and associated fees for correction have been paid in full.

C. WATER MAIN INSPECTION FEES

For all new construction projects, developers shall be responsible to reimburse the District for inspection services during the construction of the water system being installed by themselves or their contractor. In addition, this fee shall also be applicable when contractors are working near the District’s water system and its appurtenances so as to require close inspection of the construction process in order to protect the District’s facilities. The inspection fee will be based upon actual time spent on the project multiplied by the published labor rates (regular time and overtime). The inspection fee will be payable upon completion of the project and prior to an IEPA Water Operating Permit being issued. Estimated Construction Observation costs will be included in the Professional Services Fee Agreement and the aforementioned escrow account.

D. HYDRANT METER RENTALS

1. Rental Agreement Requirements

Any individual or organization must complete a Hydrant Meter Rental Agreement and provide a photo ID (of the primary renter).

The approval process may take up to 1-2 business days to complete and is subject to the availability of a hydrant meter.

For all meters (both residential and commercial, size determined by Water District), the cost of the

assign a hydrant meter for pickup. A hydrant meter deposit is required prior to the meter being provided to the Customer.

2. Installation and Use

The Customer is responsible for supplying their own hose, and for complying with all Air Gap and Backflow Prevention Requirements when connecting to the public water supply (standard detail for air gaps and backflow prevention requirements will be provided with the application).

The hydrant meter is only permitted to be used at the locations noted in the permit. Identification of meter usage on hydrants other than those noted on the hydrant meter rental agreement will result in fines. Additionally, failure to comply with this requirement may result in rejection of any future hydrant meter rental.

3. Meter Reading and Reporting

The Customer is  required to contact North Park Water with monthly meter readings and for payment of the monthly billing statements.

Monthly service fees and usage will be billed each month during the rental period. Failure to pay may result in the removal of the hydrant meter and termination of the agreement. Customer must return all meter equipment no later than 30 days before the Hydrant Agreement expires.

4. Deposit, Rates, Fees and Penalties

Deposit - A deposit for the rental of a temporary hydrant meter is required prior to the hydrant meter being provided to the customer. The rental deposit will be calculated at the current cost to replace the meter and all components, labor, and a 10% administration fee.

Monthly Meter Charge - Customer shall pay to the District a monthly meter fee at double the current rate for monthly commercial meter rates.

Monthly Base and Consumption Charge - In addition, Customer shall pay for all water discharged through the temporary hydrant meter at double the current commercial usage rate as well as the monthly base charge currently in effect.

Replacement - Customer shall pay for the replacement of the meter if deemed lost as well as any damage which occurs to the meter during the rental period at the current rate for the replacement of the meter and or parts.

Any damage to the meter or its components must be reported to North Park Water immediately and returned for inspection and/ or replacement. Any misuse of the device, damage to the metering components, any other action that results in damage to the meter or obtaining water without use of the meter will result in fines & fees as provided in our Rules & Regulations.

5. Enforcement

North Park Water reserves the right to withdraw permission to use the hydrant meter in fire, weather, or water shortage emergencies or if the meter is being used in violation of this section or utilization is extended to others not specified in the application.

E. OTHER CHARGES

Labor Charges:

Labor – (1 hour minimum): $75.00 per hr.

Equipment Charges (1 hour minimum):

Backhoe: $91.69

per hr. Dump Truck (14 CY): $96.03 per hr.

Utility Trailer: $15.22 per hr.

Vac Trailer: $95.06 per hr.

Portable Equipment (pumps, saws, generator etc.): $20.00 per hr.

** Material or rented equipment charges are calculated at cost or rate plus 10%

Professional Service Fees:

Initial Plan Review: $500$7,500

Section 3. Additional Fines and Penalties: Any violation of this ordinance not otherwise provided for herein, shall be punished by a fine of not less than one-hundred dollars ($100.00) and not more than five- hundred dollars ($500.00); and in addition, thereto, the District shall not issue permits of any kind within its jurisdiction to the offending party until the said party has complied with the provisions of this ordinance.

Section 4. The District reserved the right to withhold New Service Permits if circumstances regarding other permits to a permittee warrant such withholding.

Section 5. Applicable legal fees for any required collection proceedings will be added to amounts due.

Section 6. All ordinances, resolutions or orders, or parts thereof, in conflict with the provisions of this ordinance are, to the extent of such conflict, hereby repealed.

Section 7. If any section, paragraph, clause or provision of this ordinance shall be held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this ordinance.

Section 8. This ordinance shall be published within 30 days after its adoption and shall become effective a minimum of 10 days after such publication as provided by law. Passed this August 27, 2025.

ORDINANCE NUMBER 25-05

AN ORDINANCE authorizing the NORTH PARK PUBLIC WATER DISTRICT of Machesney Park, Winnebago County, Illinois, to borrow funds from the Public Water Supply Loan Program

WHEREAS, the NORTH PARK PUBLIC WATER DISTRICT of Machesney Park, Winnebago County, Illinois, operates its public water supply system (“the System”) and in accordance with the provisions of the Public Water District 70 ILCS 370S/ and the Local Government Debt Reform Act, 30 ILCS 350/1 et seq. (collectively “the Act”); and

WHEREAS, the BOARD OF TRUSTEES of the NORTH PARK PUBLIC WATER DISTRICT (“the Corporate Authorities”) have determined that it is advisable, necessary, and in the best interest of the public health, safety, and welfare to improve the System, including the following: NPPWD project to modify wellhouse #4 and equipment, piping and transmission mains to transmit water to the treatment plant to remove PFAS contaminants together with any land or rights in land and all electrical, mechanical or other services necessary, useful or advisable to the construction and installation (“the Project”), all in accordance with the plans and specifications prepared by the consulting engineers of Stantec Consulting Services, Inc. and Engineering Enterprises, Inc., which Project has a useful life of thirty-seven (37) years, and WHEREAS, the estimated cost of construction and installation of the Project, including engineering, legal, financial and other related expenses is $8,000,000, and there are insufficient funds on hand and lawfully available to pay these costs; and

WHEREAS, the loan shall bear an interest rate as defined by 35 Ill. Adm. Code 662, which does not exceed the maximum rate authorized by the Bond Authorization Act, as amended, 30 ILCS 305/0.01 et seq., at the time of the issuance of the loan; and WHEREAS, the principal and interest payment shall be payable semi-annually, and the loan shall mature in 30 years, which is within the period of useful life of the Project; and WHEREAS, the costs are expected to be paid for with a loan to the NORTH PARK PUBLIC WATER DISTRICT from the Public Water Supply Loan Program through the Illinois Environmental Protection Agency, the loan to be repaid from revenues of the system and the loan is authorized to be accepted at this time pursuant to the Act; and WHEREAS, in accordance with the provisions of the Act, the NORTH PARK PUBLIC WATER DISTRICT is authorized to borrow funds from the Public Water Supply Loan Program in the aggregate principal amount of $8,000,000 to provide funds to pay the costs of the Project; and WHEREAS, the loan to the NORTH PARK PUBLIC WATER DISTRICT shall be made pursuant to a Loan Agreement, including certain terms and conditions between the NORTH PARK PUBLIC WATER DISTRICT and the Illinois Environmental Protection Agency; NOW THEREFORE, be it ordained by the Corporate Authorities of the NORTH PARK PUBLIC WATER DISTRICT of Machesney Park, Winnebago County, Illinois, as follows:

SECTION 1. INCORPORATION OF PREAMBLES

The Corporate Authorities hereby find that the recitals contained in the preambles are true and correct and incorporate them into this Ordinance by this reference.

SECTION 2. DETERMINATION TO BORROW FUNDS

It is necessary and in the best interests of the NORTH PARK PUBLIC WATER DISTRICT to construct the Project for the public health, safety, and welfare, in accordance with the plans and specifications, as described; that the System continues to be operated in accordance with the provisions of the Illinois Environmental Protection Act, 415 ILCS 5/1 et seq.; and that for the purpose of constructing the Project, it is hereby authorized that funds be borrowed by the NORTH PARK PUBLIC WATER DISTRICT in the aggregate principal amount (which can include construction period interest financed over the

term of the loan) not to exceed $8,000,000.

SECTION 3. ADDITIONAL

ORDINANCES

The Corporate Authorities may adopt additional ordinances or proceedings supplementing or amending this Ordinance, providing for entering into the Loan Agreement with the Illinois Environmental Protection Agency, prescribing all the details of the Loan Agreement, and providing for the collection, segregation and distribution of the revenues of the System, so long as the maximum amount of the Loan Agreement as set forth in this Ordinance is not exceeded and there is no material change in the project or purposes described herein. Any additional ordinances or proceedings shall in all instances become effective in accordance with the Act or other applicable laws. This Ordinance, together with such additional ordinances or proceedings, shall constitute complete authority for entering into the Loan Agreement under applicable law.

However, notwithstanding the above, the NORTH PARK PUBLIC WATER DISTRICT may not adopt additional ordinances or amendments which provide for any substantive or material change in the scope and intent of this Ordinance, including but not limited to interest rate, preference or priority of any other ordinance with this Ordinance, parity of any other ordinance with this Ordinance, or otherwise alter or impair the obligation of the NORTH PARK PUBLIC WATER DISTRICT to pay the principal and interest due to the Public Water Supply Loan Program without the written consent of the Illinois Environmental Protection Agency.

SECTION 4. LOAN NOT INDEBTEDNESS OF NORTH PARK PUBLIC WATER DISTRICT Repayment of the loan to the Illinois Environmental Protection Agency by the NORTH PARK PUBLIC WATER DISTRICT pursuant to this Ordinance is to be solely from the revenue derived from the revenues of the System, and the loan does not constitute an indebtedness of the NORTH PARK PUBLIC WATER DISTRICT within the meaning of any constitutional or statutory limitation.

SECTION 5. APPLICATION FOR LOAN

The Chief Executive Officer is hereby authorized to make application to the Illinois Environmental Protection Agency for a loan through the Public Water Supply Loan Program, in accordance with the loan requirements set out in 35 Ill. Adm. Code 662.

SECTION 6. ACCEPTANCE OF LOAN AGREEMENT

The Corporate Authorities hereby authorize acceptance of the offer of a loan through the Public Water Supply Loan Program, including all terms and conditions of the Loan Agreement as well as all special conditions contained therein and made a part thereof by reference. The Corporate Authorities further agree that the loan funds awarded shall be used solely for the purposes of the project as approved by the Illinois Environmental Protection Agency in accordance with the terms and conditions of the Loan Agreement.

SECTION 7. OUTSTANDING BONDS

The NORTH PARK PUBLIC WATER DISTRICT has no outstanding bonds that are payable from revenues of the system.

SECTION 8. AUTHORIZATION OF CHIEF EXECUTIVE OFFICER TO EXECUTE LOAN AGREEMENT

The Chief Executive Officer is hereby authorized and directed to execute the Loan Agreement with the Illinois Environmental Protection Agency. The Corporate Authorities may authorize by resolution a person other than the Chief Executive Officer for the

sole purpose of authorizing or executing any documents associated with payment requests or reimbursements from the Illinois Environmental Protection Agency in connection with this loan.

SECTION 9. SEVERABILITY

If any section, paragraph, clause or provision of this Ordinance is held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this Ordinance.

SECTION 10. REPEALER

All ordinances, resolutions, orders, or parts thereof, which conflict with the provisions of this Ordinance, to the extent of such conflict, are hereby repealed.

Chicago to Rockford Intercity Passenger Rail Program

Governor JB Pritzker and the Illinois Department of Transportation (IDOT) have partnered with Union Pacific Railroad and Metra to reintroduce intercity passenger rail service from Chicago to Rockford, with intermediate stops planned in Elgin, Huntley and Belvidere. This service will provide an efficient, safe and reliable transportation option connecting Illinois communities in Cook, Kane, McHenry, Boone and Winnebago Counties. Design, survey, environmental review and stakeholder coordination are underway to support rail improvements.

IDOT will be hosting a series of public information meetings in Elgin, Rockford, Huntley and Belvidere to discuss the Chicago to Rockford Intercity Passenger Rail Program. The purpose of the meetings is to provide attendees with program updates, and an opportunity to speak with members of the project team.

All four public information meetings will be an open-house format with a continuous presentation and exhibition boards available to view. Attendees will have an opportunity to engage and discuss any questions with the IDOT project team. Please note, the same information will be presented at all four meetings.

The Roscoe Lions Club invites the community to the annual Roscoe Fall Festival. The event promises food, drinks, carnival rides, games, and live music throughout the weekend. Saturday is kids’ day on the midway with $30 wristbands for four hours of rides. On Sunday morning from 7 - 9:45 a.m., guests can enjoy a pancake breakfast then watch the festival parade which steps off at 11 a.m. on the corner of Bridge and Main Street in Roscoe. With free admission, it’s a perfect kick off to the start of fall.

Rockford’s 9th annual Latino celebration will feature an exciting Lowrider Show and Hop Contest, high-energy lucha libre action, and lively contests including a pinup showcase. Guests can enjoy live performances with Ballet Folklorico and Aztec dancers, along with art, local vendors, and refreshing cold drinks.
