Judge asked to order many immigrants released from detention to electronic monitoring

CHICAGO — U.S. Customs and Border Patrol Commander Gregory Bovino, who has spent the last 5 ½ weeks running the Trump administration’s “Operation Midway Blitz” immigration enforcement campaign in the Chicago area, has been ordered to testify in federal court Tuesday after allegations he threw tear gas into a crowd Thursday with neither warning nor justification.
Following news of federal agents deploying tear gas again on Friday, U.S. District Judge Sara Ellis set an Oct. 28 hearing in an ongoing case over the Department of Homeland Security’s use of crowd control tactics on protesters. The judge also ordered lawyers for the Trump administration to “produce Defendant Gregory Bovino, in person, for this hearing.”
Ellis had already ordered Bovino be deposed in the case during an Oct. 20 hearing in which the judge expressed concern that DHS officials and immigration agents alike weren’t following her Oct. 9 temporary restraining order restricting the use of “riot control” weapons, including tear gas, on protesters.
The judge questioned a pair of officials from CBP and U.S. Immigration and Customs Enforcement about recent clashes between federal agents and members of the public, whose spontaneous protests unfolding against immigration arrests in their neighborhoods ended in tear gas deployment.
CBP Deputy Incident Commander Kyle Harvick told Ellis that his agents’ use of tear gas in two incidents earlier this month was warranted, as protesters were impeding on their ability to perform their mission, in addition to endangering agents. The judge’s order prohibits agents from using “less-lethal” weapons like tear gas, pepper balls, rubber bullets, flashbang grenades and tasers on protesters who don’t pose an immediate threat.
But agents can issue a crowd dispersal order “when three or more persons are committing acts of disorderly conduct that are likely to cause substantial harm,” according to the order. In that case, the
use of riot control weapons is permitted if protesters are given at least two separate warnings loud enough for the crowd to hear and allowing for “reasonable time and opportunity for individuals to voluntarily comply.”
In a 12-minute video submitted to Ellis on Thursday, Bovino cannot be heard giving such warnings before tossing a canister of tear gas into a crowd of protesters hours earlier in Chicago’s Little Village neighborhood, which is heavily populated by Mexican immigrants.
Immigration agents deployed tear gas again Friday after protesters surrounded the feds’ rental cars in Chicago’s wealthy Lake View neighborhood. And on Saturday, agents deployed tear gas in Chicago’s Irving Park and Avondale neighborhoods.
The Trump administration has claimed the only way to protect immigration agents from protesters that DHS officials have called “violent” and “rioters” is by deploying the National Guard. But a federal judge has blocked troops’ activation in Illinois — at least until the U.S. Supreme Court weighs in.
Bovino has been the face of Operation Midway Blitz since his mid-September arrival in the Chicago area fresh from running a similar campaign in Los Angeles. He has made numerous media appearances defending the Trump administration’s tactics in addition to using his own social media channels to promote CBP’s capture of undocumented immigrants with long criminal histories.
But in another Chicago federal courtroom Friday, U.S. District Judge Jeffrey Cummings heard arguments that the majority of the roughly 3,000 arrests CBP and ICE have made in Chicago and its suburbs in the last four months don’t have criminal backgrounds. Immigration and civil rights attorneys told the judge that as many as 2,000 of those are not subject to mandatory detention and should be released to electronic monitoring.
The judge questioned Department of Justice attorney William Weiland on the conditions in which those who’ve been arrested have been held, including in the ICE processing facility in the Chicago suburb of Broadview — the scene of many protests in recent weeks. After Weiland balked that the question of treatment is “beyond the scope” of the consent decree,
Cummings pointed out that the DOJ had included it in its own filing not long ago.
“Can you certify to me that potential class members who are being detained are being held in safe and sanitary conditions?” the judge asked. “Can you certify that as an officer of the court?”
“No, I cannot,” Weiland said before offering to retract that statement for the record.
Asked whether detainees had “sufficient access to counsel,” Weiland said he’d have to “have a conversation with my client about that.”
Cummings already ruled earlier this month that ICE had violated a 2022 consent decree that limits immigration agents’ authority to make warrantless arrests unless they have probable cause to believe a person is in the country illegally and he or she is a flight risk. Though it was scheduled to expire in May, plaintiffs’ attorneys had asked for an extension, which was supposed to have left it in place while the judge weighed the arguments.
But on June 11, a top ICE lawyer emailed all agency employees advising the consent decree was dead and officially rescinding the corresponding agency policy restricting warrantless arrests.
As a result, Cummings extended the consent decree until February. In his ruling earlier this month, the judge wrote that agents’ practice of carrying blank warrant forms and filling them out at the scene of an arrest was “explicitly designed” to get around the requirement that agents have probable cause before arresting an undocumented immigrant.
On Friday, Cummings agreed that the consent decree also applies to CBP, as DHS describes Operation Midway Blitz as an “ICE operation.”
“CBP is working with ICE,” he said. “So any arrests as part of this operation I view as arrests working with ICE.”
Between June 11 — the date Cummings determined ICE had officially violated the consent decree — and Oct. 7 when Cummings issued his order extending the consent decree, ICE made nearly 1,900 arrests. Continued on next page

And on Friday, Weiland told Cummings CBP has arrested “right around 1,200” people as part of Operation Midway Blitz.
Before a September 5 decision from the U.S. Board of Immigration Appeals, the vast majority of undocumented immigrants who were arrested would be released on bond after an immigration judge determined a person didn’t have a disqualifying criminal record and was not a danger to the community or a flight risk. But less than two weeks since Operation Midway Blitz began last month, the Trump administration’s BIA reversed decades of precedent and ruled that detention would be mandatory for any undocumented immigrant who entered the U.S. without being “admitted” by an immigration officer.
A few days later, U.S. Supreme Court Justice Brett Kavanaugh wrote in a Sept. 8 concurring opinion that although “apparent ethnicity alone cannot furnish reasonable suspicion” for immigration enforcement actions, it can be a “relevant factor.” Based on reasonable suspicion, Kavanaugh wrote that “immigration officers may briefly stop the individual
and inquire about immigration status.”
Those two decisions, combined with ICE’s unilateral decision that the consent decree was dead, have resulted in far more arrests and detentions than there otherwise would be under previous policies and precedents. It’s also meant that those who’ve been swept up in Operation Midway Blitz have included undocumented immigrants who’ve been in the U.S. for years or even decades, and who are now being expedited for deportation.
Attorneys for immigrant and civil rights argued to Cummings on Friday that the Sept. 5 BIA decision represented a sea change that was unforeseeable at the time they and the DOJ agreed to the 2022 consent decree. Despite pushback from the DOJ’s Weiland, the judge seemed to agree, saying the consent decree would be essentially useless if “everyone who was arrested and subject to detention proceedings would be detained as a mandatory matter.”
“What good would this agreement be?” Cummings asked. “Why would they agree to do something that had no effect?”
The judge also pointed out more than
100 of his colleagues across the country have rejected DHS’ arguments on mandatory detention since the agency began testing the new legal theory in July.
Plaintiffs attorneys argued that because the Trump administration had committed “repeat material violations” of the consent decree and because last month’s BIA decision altered the playing field, Cummings had the authority to order the release of many detainees to electronic monitoring.
DOJ attorneys accused opposing counsel of painting with too broad a brush and the judge said he wasn’t comfortable with issuing a blanket ruling, as “it could be that some of these individuals should not be released and are properly subject to mandatory detention.”
But Cummings did order DHS to file briefs on the feasibility of handing over the names, arrest dates, country of origin and “A numbers” for all detainees. That information will help determine who among the 3,000 would be eligible for release on bond under DHS’ long-running
policies — at least those who haven’t yet been deported.
Mark Fleming of the Chicago-based National Immigrant Justice Center told Cummings that time is not on the side of detainees, as many have been pressured to sign voluntarily deportation agreements or have otherwise had their removal proceedings fast-tracked. He cited the case of an undocumented immigrant arrested in Elgin as part of a pre-dawn raid that kicked off Operation Midway Blitz last month. The man had previously suffered a massive stroke that left his communication abilities impaired.
“He cannot speak but apparently can consent to voluntary departure to Mexico,” Fleming said. “We had to scramble to make sure there was someone to care for him.”

companies’ requests, but still recommends increasing bills

Customers across Illinois could face increased natural gas rates next year, based on proposed decisions in two proceedings before the Illinois Commerce Commission.



The regulatory agency, which oversees gas utilities, is considering two requests from Nicor Gas and Ameren Illinois. A five-member panel of commissioners, appointed by Gov. JB Pritzker, will make the final decision in the cases in November.
But administrative judges overseeing the cases have released proposed decisions which suggest cutting Nicor and Ameren’s requests by about one third.
Nicor, which delivers natural gas to 2.3 million customers in northern and western Illinois, asked for a $314 million rate increase in January — equivalent to about $91.50 per year or a 9.21% increase for residential customers, according to the company.
Ameren, which has 800,000 customers throughout downstate Illinois, asked for a $129 million increase in January, or about $100 per year, or about a 13% increase for residential customers, according to the Citizens Utility Board, a consumer watchdog group.
The proposed decisions cut Nicor’s request by $109.8 million and Ameren’s by about $43.7 million, according to CUB. Ameren officials said the cuts bring the increase down to $5.80 per month, or about $70 per year for the typical customer. Nicor officials said the increase under the order would be about 5% to 6%.
“Even with the proposed increase, our distribution rates remain among the lowest of any major natural gas utility in Illinois and the total bill for an average residential customer under proposed rates continues to remain in line with the Consumer Price Index,” Nicor spokesperson Jennifer Golz said in a statement.


Brad Kloeppel, Ameren’s senior director of gas operations, defended his company’s request for higher rates by saying the majority of the increased revenue will go toward safety upgrades and compliance with federally required safety testing.
“Fifty percent of the pipes on our system are over 50 years old,” Kloeppel said. “We have to design, operate, maintain our system to provide gas service on the coldest hour of the coldest day.”
Ameren’s rate case also includes pilot programs that could swap gas service in
some areas for electric service, and for an incentive program for “renewable natural gas” — a method of capturing methane from landfills and other sources that would otherwise be released as a pollutant.
Despite proponents’ claims that it can help reduce greenhouse gas emissions, some environmentalists criticize that technology for still releasing some pollutants.
The gas cases have attracted significant attention from consumer advocacy groups, who say the requests go too far and represent a trend of increasingly frequent rate hikes.
“This is part of a troubling trend being repeated, where large rate hikes are becoming the norm, and consumers simply cannot keep paying the price,” Jeff Scott, AARP’s senior associate state director, said in a statement.
The most frequent target of utility criticism from consumer groups in cases like these is the “return on equity” — a way of calculating the profits returned to shareholders.
Nicor asked regulators for a bump from about 9.51% to 10.35%. Ameren’s ask was similar, 9.44% to 10.7%. Most of the reductions recommended by the administrative law judges stemmed from lowering both companies’ return on equity figures to 9.93%.

to things like post-employment benefits.
“The companies always claim this is about maintenance, but at the same time they’re asking for an outrageous profit rate to their shareholders,” CUB spokesperson Jim Chilsen said. “That exposes their true motivation for their rate hike requests.”
Abe Scarr, director of the consumer advocacy group Illinois PIRG, said there “really is a lot more work for the commission to do” beyond the cuts to profit rates. He said that the commission’s decision is tied up into the uncertain future of gas utilities in the state.
“Regardless of the future and exactly the pathway, there are going to be fewer customers on the gas system using less gas,” Scarr said. “If the utilities keep spending the way they’re doing, it’s going to make rates even more unaffordable for more people.”
The ICC is weighing that question in a yearslong “Future of Gas” proceeding in which advocates, utilities and businesses are advising regulators what the natural gas industry will look like as the state approaches its deadlines for reducing greenhouse gas emissions.
In the meantime, the deadline for the commission to act is Nov. 24 in the Nicor case and Dec. 1 in the Ameren case.

BUDAPEST, Hungary (AP) — Israel will not allow Turkish troops to take part in an international force the United States has proposed to oversee the ceasefire agreement in the Israel-Hamas war in Gaza, Israel’s top diplomat said Monday.
The 20-point deal brokered by U.S. President Donald Trump earlier this month calls for a force to monitor the ceasefire but does not mention which countries would provide troops.
It says the U.S. would “work with Arab and international partners to develop a temporary International Stabilization Force” to deploy in Gaza. The force would train and provide support to “vetted Palestinian police forces” and will “consult with Jordan and Egypt who have extensive experience in this field.”
The ceasefire agreement calls for Israeli troops to gradually withdraw from more areas of Gaza as the international force “establishes control and stability” and as Hamas militants disarm.
Questions about the force
Countries that are considering taking part also want more clarity on the force’s
mandate. Officials from some Arab and Muslim nations have said the focus must be on peacekeeping in Gaza, not acting as an enforcer of peace between Israel and Hamas.
“What is the mandate of security forces inside of Gaza? And we hope that it is peacekeeping, because if it’s peace enforcing, nobody will want to touch that,” King Abdullah II of Jordan said in an interview with the BBC.
Speaking to journalists during a visit to Hungary, Israeli Foreign Minister Gideon Saar said Israel opposes the participation of Turkish troops in Gaza because of President Recep Tayyip Erdogan ‘s longstanding hostility to Israel. Saar said Israel has communicated its stance to U.S. officials.
“Countries that want or are ready to send armed forces should be at least fair to Israel,” Saar said. He did not elaborate. U.S. officials have said there would be no American boots on the ground in Gaza. Around 200 U.S. troops are now in Israel working alongside its military and other countries’ delegations at a coordination center, planning Gaza’s stabilization and reconstruction.
During visits to Israel last week, U.S.
Vice President JD Vance and Secretary of State Marco Rubio said multiple countries would be interested in joining the international force for Gaza.
The U.S. was working to secure a U.N. mandate or other international authorization for it, Rubio said.
At a summit in Egypt two weeks ago, Erdogan was one of four leaders to sign a document outlining Trump’s vision for Gaza and regional peace. The others were Trump, Qatari Emir Tamim bin Hamad Al Thani and Egyptian President Abdel Fattah el-Sissi.
Erdogan last week said Turkey was “ready to provide all kinds of support to Gaza.” Officials from Turkey’s Defense Ministry, speaking on condition of anonymity in line with regulations, said the country was preparing for whatever role it might be asked to play, whether it’s peacekeeping or humanitarian assistance.
Turkey also has close ties with Hamas. Turkey once had strong diplomatic relations with Israel, though they have been at an all-time low over the war in Gaza, sparked by the Oct. 7, 2023, Hamas-led
attack on Israel.
Erdogan has criticized Israel, and particularly Prime Minister Benjamin Netanyahu, since the start of the war, which has killed tens of thousands of Palestinians. He has accused Israel of genocide — which Israel strongly denies — and has compared Netanyahu to Adolf Hitler.
Hamas political officials regularly visit Turkey, and Israel previously accused Turkey of allowing Hamas to plan attacks from its territory, which Turkey has denied, as well as carry out recruitment and fundraising. Turkey doesn’t consider Hamas to be a terror organization and frames its relations with the group as part of its broader support for the Palestinians.
“Israel will determine which forces are unacceptable to us,” Netanyahu said Sunday during a government meeting. “This is, of course, acceptable to the United States as well, as its most senior representatives have expressed in recent days.”

PARIS (AP) — Two suspects were arrested in connection with the theft of crown jewels from Paris’ Louvre museum, justice and police officials said Sunday, a week after the heist that stunned the world and sparked a massive manhunt.
The Paris prosecutor said that investigators made arrests Saturday evening, adding that one of the men taken into custody was preparing to leave the country from Paris Charles de Gaulle Airport.
French media BFM TV and Le Parisien newspaper earlier reported that two suspects had been arrested and taken into custody. Paris prosecutor Laure Beccuau did not confirm the number of arrests and did not say whether any jewels had been recovered.
A police official, who was not authorized to speak publicly about the ongoing case, told The Associated Press that two men in their 30s, both known to police,
were taken into custody. He said one suspect was arrested as he attempted to board a plane bound for Algeria. The official added that one of the suspects was identified through DNA traces. Beccuau said earlier this week that forensics experts were analyzing 150 samples at the scene.
The suspects can be held in police custody up to 96 hours.
Thieves took less than eight minutes last Sunday morning to steal jewels valued at 88 million euros ($102 million) from the world’s most-visited museum. French officials described how the intruders used a basket lift to scale the Louvre’s façade, forced open a window, smashed display cases and fled. The museum’s director called the incident a “terrible failure.”
Beccuau said investigators from a special police unit in charge of armed robberies, serious burglaries and art thefts made the arrests. In her statement,
she rued the premature leak of information, saying it could hinder the work of over 100 investigators “mobilized to recover the stolen jewels and apprehend all of the perpetrators.” Beccuau said further details will be unveiled after the suspects’ custody period ends.
French Interior Minister Laurent Nunez praised “the investigators who have worked tirelessly, just as I asked them to, and who have always had my full confidence.”
The Louvre reopened earlier this week after one of the highest-profile museum thefts of the century stunned the world with its audacity and scale.
The thieves slipped in and out, making off with some of France’s crown jewels — a cultural wound that some compared to the burning of Notre Dame Cathedral in 2019.
The thieves escaped with a total of eight objects, including a sapphire diadem, necklace and single earring from a set linked to 19th-century queens Marie-
Amélie and Hortense.
They also took an emerald necklace and earrings tied to Empress Marie-Louise, Napoleon Bonaparte’s second wife, as well as a reliquary brooch. Empress Eugénie’s diamond diadem and her large corsage-bow brooch — an imperial ensemble of rare craftsmanship — were also part of the loot.
One piece — Eugénie’s emerald-set imperial crown with more than 1,300 diamonds — was later found outside the museum, damaged but repairable.
News of the arrests was met with relief by Louvre visitors and passersby on Sunday.
“It’s important for our heritage. A week later, it does feel a bit late, we wonder how this could even happen — but it was important that the guys were caught,” said Freddy Jacquemet.
“I think the main thing now is whether they can recover the jewels,” added Diana Ramirez. “That’s what really matters.”

One of the most common questions we get at the Illinois Extension office each fall is: What can I still do in my vegetable garden before winter? After the recent rain and frost, many gardeners are focused on wrapping up the season and finishing the last of the harvest. The good news is that with mild weather in the forecast next week, some plants may recover from the cold snap and continue producing a bit longer.
Horseradish is one crop that can still be harvested. It’s best to dig it before the ground freezes, ideally after a hard frost
when air temperatures dip near 28°F. Unlike rhubarb or asparagus, horseradish is harvested by removing the entire plant. Start by cutting back the leaves to the soil surface, then use a shovel or garden fork to lift the plant, keeping the large main roots and leaving behind the smaller pencilsized ones to regrow. Store the roots unwashed in a cool place or refrigerator until you’re ready to use them.
This is also the ideal time to plant garlic for next year’s harvest, which typically comes at the end of June. Each clove you plant now will form a full bulb next summer. Plant cloves about twice as deep as their height, spacing them six
inches apart in rows 12–36 inches apart. Hardneck varieties tend to perform best in northern Illinois. Once planted, cover the bed with 4–6 inches of straw mulch. If you’re not ready to mulch right away, waiting a couple of weeks is fine. Consider locating your garlic bed near a water source—regular watering last summer noticeably increased clove size in my garden, so I’ve moved my new garlic bed closer to the hose.
With the warm September and October weather this year, some gardeners may still have crops actively growing. While most summer vegetables have finished, cool-season crops like Brussels
sprouts can continue to mature well into November. To help existing produce ripen, remove flowers so the plant can focus its energy on the developing crop. For pumpkins, consider cutting back the vine to just beyond the unripe fruit to direct nutrients where they’re needed most.
As the season winds down, there’s still plenty to do in the garden – whether harvesting, planting for next year, or helping late crops finish strong. Taking a little time now can set the stage for a productive and rewarding start next spring.

The growth in the global economy is heavily influenced by the decisions of the existing financial and military elites in the hierarchy controlling the system. Historically environmental and citizen well-being are seldom the dominant factors impacting such decisions. Economic growth has been the dominant concern and it relies on existing resources and materials available from the biosphere. As the resources supporting the global economy become less available and human populations continue to increase questions arise of how to respond to the growing challenges. Given the massive size of the global economy there are concerns over the damage being inflicted on the health of the planet.
The existing economy relies on oil and less oil is being found and what is being found is more costly to process and refine into useful products. Currently
the existing economy consumes about 100 billion barrels per day. Projections of oil availability in 25 years indicate it could fall to 16 million barrels/day. The availability of natural gas is also projected to decline. As a result there is an ongoing effort to find suitable energy sources to replace them.
There is also an effort underway to reduce the reliance on fossil fuels to curb the growing threat of climate change.
The International Energy Agency Global Energy Review 2025 reported that solar PV, wind power, nuclear power, electric cars and heat pumps were effectively cutting global carbon emissions. Since that report the current administration in the United States has curbed investment in the clean energy transition while increasing support for fossil fuels and nuclear power.
Given the massive size and projected growth of the global economy has lead scientists to document the threats it poses to the health of the planet. It refers to how
well the planet sustains the conditions necessary for life on earth, including humans. Heathy refers to maintaining stable conditions, being able to recover from disruptions and support essential processes for life.
The latest scientific Planet Health Report indicates that human economic activity now exceeds seven of the nine planetary boundaries. As the boundaries are exceeded the favorable climate in which the humans have built the massive global economy is expected to change in ways far less favorable to humans and the existing economy. The areas that exceed the boundaries include climate change, the loss of biosphere integrity, land system changes, freshwater changes, modification of biogeochemical flows, ocean acidification, and the introduction of novel entities.
While the degree of risk for each of the seven areas vary, there are interactions between the areas that intensify the risk to the earth system. Over the past 150
years the earth system maintained its capacity for self-regulation of conditions which were favorable to civilization. Over that time roughly half of greenhouse gas emissions from human consumption of fossil fuels were absorbed in the land and ocean carbon sinks. The carbon sinks on land are saturated while ocean absorption of carbon continues and global warming appears to be accelerating.
Climate change is interacting with other areas exceeding planetary boundaries increasing the intensity of the loss of biodiversity and increasing the degradation from severe droughts and heat waves. If the pressures from exceeding planetary boundaries intensify the report suggests that the planetary system could destabilize and lead to the collapse of a major ice sheet or the disruption of an ocean current.
The conclusion of the Planetary Health Report is that there is time to return to a safe operating space for planetary health but it is closing fast.

For Rehabilitation of the Roscoe Road Bridge over the Rock River (SN 101-3016) and Improvement of Roscoe Road from Old River Road to the Rock River
The Winnebago County Highway Department (WCHD) announced today that an Open House Public Hearing has been scheduled from 5:00 P.M. to 7:00 P.M. on November 5, 2025 at Roscoe Village Hall, 10631 Main St., Roscoe, Illinois 61073, for the purpose of discussing two separate projects:
• Rehabilitation of the Roscoe Road bridge over the Rock River (IL Special Bridge funding)
• Improvements to Roscoe Road from Old River Road to the Rock River (HSIP/Safety funding)
The bridge project will consist of repairing the existing steel beams, replacing the expansion joints, bearings, bridge rail, bridge deck and guard rails. The road project will consist of pavement widening and paving shoulders, resurfacing, installation of shoulder and centerline rumble strips, high visibility pavement markings, extension of existing box culverts, new pipe culverts and improvements at the intersection with Gleasman Road to provide a westbound left turn lane.
Engineering drawings, maps and aerial photography, will be available for inspection and viewing during the entire time the WCHD representatives are present. This same material currently is available for review and inspection at the WCHD office.
WCHD is in the process of preparing environmental reports for the bridge and roadway projects in accordance with the National Environmental Policy Act of 1969 and IDOT’s Public Involvement Process.
All persons interested in these projects are invited to attend the hearing to express their views and comment on the project(s). This meeting will also serve to involve and obtain the views of the public about potential project impacts to the adjacent properties. The bridge rehabilitation will require closing Roscoe Road for approximately 5 months which may be an effect to local businesses and adverse travel.
The meeting will be conducted on an informal basis with projects displays and other information available for viewing. WCHD rep-
resentatives and IMEG (consultant for the bridge project), will present an overview of both projects at 5:15 pm and again at 6:00 pm and will be available to answer individual questions and record comments offered by those in attendance. An opportunity will be made available for participants to comment on the project and these verbatim comments will be made part of the public record.
