2024 Legislative Recap: On the Right Track

This year brought some interesting challenges to the convenience store industry on local, state, and federal levels. Here’s a reminder of how your continued support and dues investments helped NYACS advocate on your behalf throughout 2024.

Local Tobacco Bills

Proposed county-level tobacco licensing is emerging across the state as a result of antitobacco advocates’ inability to pass legislation at the state level. NYACS has been working to educate both the Albany County and Oneida County Legislatures on the unintended consequences of their proposed regulations.

In Oneida, County Executive Anthony Picente proposed legislation that would have established an excessive county license fee for a Smoking Paraphernalia Retail License. It also would have restricted young adults under the age of 21 from working in businesses that sell smoking paraphernalia including rolling papers and e-cigarettes. The law also would have prohibited paraphernalia sales within 1,000 feet of various types of properties. NYACS mobilized our members in Oneida County and was ultimately successful in convincing Picente to remove all items in the proposed legislation that put convenience stores at an unfair disadvantage.

The Albany County Legislature proposed tobacco retail license legislation in September which aims to ultimately reduce the number of licenses in the county over time and would give preference for new licenses to 21+ stores. NYACS, along with local retail member representatives, have meet with various leaders in Albany County and have participated in public comment opportunities in efforts to

caution about the consequences the legislation will have for law-abiding retailers and the unfair playing field it creates. As of print time, the issue has been tabled at committee meetings since its proposal and has failed to get a vote for advancement.

Bottle Bill Expansion

Back in May, a bill to expand the state’s bottle bill was introduced which would have required all dealers and redemption centers to, “provide consumers with the ability to recycle any containers deemed unredeemable.” This change, and the legislation’s failure to address

issues with unreliable third-party collectors, would have put stores in an impossible position. NYACS responded with a Memorandum of Concern to the bill’s sponsors reasserting the fact that c-stores are not garbage bins for the state and suggesting the DEC work to fix the bottle bill before expanding it with legislation.

The bill did not advance in the 2024 session but we expect similar challenges in 2025. NYACS has built relationships with redemption centers, environmental groups, and others to further the message that bottle bill reform, not expansion, is the answer.

Federal Menthol Ban

On the federal level, NYACS is locked in with our colleagues at the National Association of Convenience Stores (NACS). The Biden Administration had hinted at a federal menthol ban but push back from the industry, as well as political pressure, were able to hold off the advancement of the ban in 2024. It’s unclear if the incoming administration will take up the ban, but it’s possible New York State might take the step to outlaw menthol in 2025.

New in 2025:

Retail Worker Safety Act

The New York Retail Worker Safety Act was signed into law on September 5, 2024, and aims to improve the safety and security of retail employees. To prevent workplace violence, the law requires employers with at least 10 employees to develop and implement written violence prevention policies, assessments, and training. The New York State Department of Labor will issue model policy and training templates to help employers comply with the law. Employers will be required to provide employees with a written notice of their workplace violence prevention policy and training in English and their primary language.

The law also requires employers with 500 or more employees to install panic buttons throughout the workplace, or provide wearable or mobile phone-based panic buttons to all employees. Mobile phone-based panic buttons are required to be installed on employer-provided equipment, and they cannot be used to track employees except when activated.

In response to feedback from NYACS and other groups representing the retail industry, the legislature is considering an amendment to the act that would reduce the frequency of workplace violence training for employers with fewer than fifty employees and replace the term “Panic Button” with “Retail Worker Requests for Assistance.” The amendment is anticipated to be voted on in January 2025, and would move the effective date of the act to June 2, 2025.

NYACS will assist our retail members in accessing resources to comply with the New York Retail Worker Safety Act starting in the new year.

NYACS 2025 Legislative Priorities

As we approach the finish line of 2024, the NYACS is actively engaged in tackling critical issues affecting convenience stores across the state. From the CLCPA to new regulatory proposals, NYACS works tirelessly to ensure that our members’ voices are heard. As we look ahead to 2025, several key legislative and regulatory concerns will continue to be at the forefront of our advocacy efforts.

Menthol Cigarette Ban and Its Impact on Retailers

Governor Kathy Hochul’s proposal to ban menthol cigarettes has raised concerns regarding its potential effects on both public health and the retail sector. While the ban is aimed at reducing smoking rates, especially among specific demographics, it could lead to unintended consequences, such as an increase in illegal sales of menthol products. This has been the case in other regions where similar bans have been implemented.

In response to recent reports that New York is unlikely to meet these objectives, NYACS joined a collective effort led by the Business Council of New York and sent a letter to the state legislature urging a reevaluation of the law’s ambitious goals due to the practical and economic challenges of meeting its targets. We will continue to advocate for a more realistic and flexible approach to the CLCPA’s goals, recognizing the significant barriers in renewable energy deployment, regulatory compliance, and the overall cost burden on businesses.

In 2025, NYACS will continue to advocate for a more balanced approach. We will push for stronger enforcement mechanisms to prevent illegal distribution and highlight the financial impact the ban could have on convenience stores, many of which rely heavily on menthol cigarette sales. Additionally, we will highlight potential shifts in consumer behavior, including the possibility of consumers turning to out-of-state or illegal sources for menthol products.

Impact of the Climate Leadership and Community Protection Act

(CLCPA)

The CLCPA has set ambitious goals for New York to reduce greenhouse gas emissions and transition to renewable energy. While NYACS supports the state’s commitment to combating climate change, the ambitious timelines and targets have raised concerns about their feasibility, especially given ongoing challenges like supply chain disruptions and labor shortages.

Another element of CLCPA, the state’s “cap and invest” program, could create compliance challenges for businesses, forcing them to scale back operations or face penalties for exceeding emission limits. The DEC has yet to determine the emissions threshold to start the program.

In 2025, NYACS will continue to advocate for a more realistic approach to the CLCPA’s goals. We believe the state should reassess the proposed timelines and ensure that the required investments in renewable energy and infrastructure are achievable without putting undue strain on businesses. As part of this effort, we will also focus on helping our members navigate the regulatory uncertainty surrounding the CLCPA and prepare for the changes it will bring.

Supporting Retailers Amid Shifting Lottery and Gaming Regulations

The ongoing push for online lottery systems presents a significant challenge for convenience stores that rely on inperson sales. NYACS will continue to oppose online lottery initiatives, which

could divert customers away from physical stores and harm small businesses. We will also advocate for improvements in the handling of lost or stolen tickets and continue to seek a 1% increase in commission rates for lottery retailers, ensuring that these businesses continue to receive a fair share of revenue.

Combating the Rise of Illegal Vape Sales

A growing concern for convenience store operators is the rise in illegal vape sales. These activities not only undermine public health efforts but also create unfair competition for lawabiding businesses. In 2025, NYACS will focus on strengthening enforcement against illegal vape sales by advocating for enhanced inspections and penalties for violators. Additionally, we will push for the establishment of a confidential reporting system that allows retailers to anonymously report illegal sales, helping to curb these unlawful practices. Another priority will be tightening age verification measures for vape products to prevent underage access. We will continue to address the disproportionate impact that illegal sales have on compliant retailers, ensuring that those who follow the law are supported and protected.

Hydrofluorocarbon (HFC)

Phasedown

The Hochul administration’s plan to phase down hydrofluorocarbons (HFCs) as part of New York’s climate goals is causing concern among businesses, particularly in the grocery, HVAC, and refrigeration sectors. While the regulations aim to reduce potent greenhouse gases, they are more aggressive than federal standards and require faster implementation, potentially forcing costly overhauls by 2035. Many small and family-owned businesses, including convenience stores, warn that the high costs, combined with rising expenses and labor shortages, could lead to closures or relocations. Industry leaders including NYACS have urged the

state to align with federal timelines and provide more incentives to support the transition, instead of imposing stringent mandates without sufficient assistance.

At NYACS, we are actively engaging with lawmakers and the Department of Environmental Conservation (DEC) to urge a more reasonable approach that balances environmental goals with the economic realities facing New York businesses. The DEC should consider the long-term viability of businesses and align its regulations with federal standards to avoid unnecessary burdens on the state’s economy.

Reforming the Bottle Bill

The proposed expansion of the Bottle Bill in May, which would have mandated that retailers manage unredeemable bottles, would have placed an additional burden on convenience stores. NYACS is actively working to push back against an expanded program, arguing that it imposes undue pressure on retailers, particularly those in food service. We will continue to advocate for better collection services, including more frequent pickups and dedicated collection vehicles, to ensure that the Bottle Bill remains functional without overburdening store owners.

Looking Ahead to 2025

As we head into 2025, NYACS remains committed to addressing the challenges facing convenience stores. We will continue to focus on combating illegal sales, advocating for fair regulations, and pushing for more realistic environmental and energy policies. Our goal is to ensure that convenience store owners can thrive in a rapidly changing regulatory landscape, while maintaining a strong voice in the legislative process.

Stewart’s Shops Corp. has acquired the convenience store, wholesale dealer, and residential heating oil businesses of Jolley Associates LLC and S.B. Collins Inc., which operate 45 convenience stores and supply fuel across Vermont, New Hampshire, and New York. Founded in the early 1920s, S.B. Collins is a familyowned petroleum distributor that expanded over the decades, including the formation of Jolley Associates in 1976 to operate convenience stores under the Short Stop brand.

Ultimate Sales appointed Brad Heetland as its new president where he will oversee marketing, sales, and strategic initiatives while working alongside COO Tyler Coates. Heetland, with 30 years of industry experience, previously held leadership roles at Kraft Foods, Borden Dairy, Core-Mark Atlanta, and Advantage Solutions, and has served on the NACS supplier board and board of directors.

United Refining/Kwik Fill secured a spot on Forbes’ Best Employers By State list for 2024. Forbes partnered with Statista to survey over 160,000 employees from companies with at least 500 U.S. employees, evaluating their likelihood to recommend their employer and past employers. Statista combined responses into a scoring system, prioritizing recent data and current employees, with the top-scoring companies in each state making the 2024 list of 1,294 organizations.

QuickChek has partnered with NFL player Kayvon Thibodeaux in a two-year ambassadorship, marking the convenience store chain’s first collaboration with a professional athlete. Thibodeaux will promote QuickChek’s fresh convenience, delivery options,

and quality offerings while aligning with the company’s philanthropic values through his Jream Foundation, which empowers underserved youth.

Swisher has rebranded its smokeless tobacco portfolio under the historic Helme Tobacco Co. name, which dates back to the 1880s and was once the world’s largest snuff maker. Previously marketed under Fat Lip Brands, the portfolio includes 24 brands such as Kayak moist snuff, Starr loose leaf chew, and Navy dry snuff. Swisher, headquartered in Jacksonville, FL, highlights this rebrand as a celebration of its 100 years in Jacksonville, while the Helme division continues operations in Wheeling, WV.

Accelerating into 2025

This quarter has seen tremendous growth among NYACS retal member companies!

• In addition to acquiring Jolley Associates, Stewart’s Shops opened rebuilt stores in Worcester, Catskill, and Pine Plains, NY. The company also unveiled its newest location, a 4,500-square-foot shop located in Marcellus, NY, despite preliminary opposition from the town. Push back from residents helped the deal go through and also resulted in the election og a new village mayor.

• QuickChek plans to build its first Albany region store near Albany International Airport, pending approval from the Colonie Planning Board. The proposed 6,730-square-foot store would include 16 gas pumps and be located on a 2.3-acre parcel owned by developer Tom Burke, near a newly constructed intersection at Exit 3 of Interstate 87.

• The Jamal family, with over 40 years in the retail and fuel business in New York, has continued their legacy with the grand re-opening of Chestnut Market on the Hutchinson River Parkway in April. Brothers Faheem and Farris Jamal led a unique remodel of the White Plains location.

• Byrne Dairy opened its new store at the intersection of Routes 5 & 20 and 414 in Seneca Falls in October and plans to demolish an old store in Skaneateles and replace it with a new, larger and a more modern building.

A Season of Giving

EG America donated over $645,000 to the American Cancer Society following a nationwide in-store fundraiser in July at its various convenience store brands. Customers could donate to the cause, with EG America matching funds raised by the top stores to boost the total donation. The American Cancer Society expressed gratitude for the partnership, noting that the funds will support its advocacy, research, and patient services.

Mirabito Convenience Stores’ October Round Up campaign raised $90,000 for the American Cancer Society, with customer contributions and a significant donation from Mirabito itself. The funds will support breast cancer research, treatment programs, and patient resources, as well as promote early detection and prevention. The campaign was part of Mirabito Cares’ commitment to community service, and the company’s employees participated by wearing pink shirts and attending Making Strides Against Breast Cancer walks.

CITGO’s Lemont refinery raised a recordbreaking $904,075 at its 28th annual Driving for a Cure Golf Outing, benefiting the Muscular Dystrophy Association (MDA). With the support of 130 companies and 416 golfers, the event has raised over $9.2 million since its inception, funding critical research and innovative treatments for neuromuscular diseases.
