New York State Executive Impact on Convenience Stores

As New York State lawmakers deliberate the Fiscal Year 2025 Budget, NYACS is diligently reviewing Governor Hochul’s Executive Budget to assess its potential impact on convenience stores and small businesses. The proposed budget outlines various fiscal policies and regulatory measures that could shape the economic landscape for retailers across the state. As operating costs rise and consumer behavior shifts toward digital and cashless transactions, convenience store owners must adapt to these changes.

LABOR & EMPLOYMENT

Payroll Requirements

Current labor laws mandate that “manual” workers be paid weekly, a rule that has caused confusion and led to costly lawsuits for businesses, including convenience stores. The Governor’s budget proposes clarifying these regulations to protect employers from unnecessary litigation.

Department of Labor’s authority by allowing the agency to seize employer assets when collecting unpaid wages. While addressing wage theft is important, this change could create unintended hardships for small businesses trying to navigate compliance.

Oppose: Expanding enforcement measures could unfairly penalize small retailers.

Cap and Invest

Governor Hochul has paused the implementation of the “cap and invest” program, a market-based initiative designed to cap emissions and require businesses to buy allowances for excess pollution that is mandated by the Climate Leadership and Community Protection Act (CLCPA). Instead, state agencies have been directed to develop emissions reporting requirements. The delay reflects concerns over consumer costs and political consequences but has drawn criticism from environmental advocates.

Monitor: NYACS continues to push for clear and supportive policies.

Non-Budget Bills NYACS is Watching

Bottle Bill Reform

A renewed push to modernize New York’s Bottle Bill could lead to increased handling fees, which would directly impact convenience stores. The proposed changes include expanding the bill to cover additional beverage containers and raising deposit amounts.

While these efforts aim to improve recycling rates, the financial burden of higher handling fees would fall on retailers, adding to their operational costs.

Monitor: Potential cost increases for convenience stores due to changes in bottle deposit requirements.

Credit Card Swipe Fees

Although not included in the Governor’s budget, NYACS is advocating for reform of credit card swipe fees, a significant financial strain on convenience stores. Currently, credit card companies charge businesses a percentage-based fee on the total transaction amount—including sales taxes and gratuities—which increases costs for both retailers and consumers.

A proposed bill (A.4017 - McDonald) would ensure that swipe fees are only applied to the actual cost of goods sold, not the taxes collected on behalf of the state. This change would alleviate financial pressure on businesses operating with razor-thin margins and could ultimately lead to lower prices for customers.

gratuities, reducing excessive financial burdens on small businesses.

Strengthening Enforcement Against Illegal Flavored Vapes

A new bill (A.4619 - Solages) proposes stronger enforcement measures against the sale of illegal flavored vapes, which continue to undermine law-abiding retailers.

This legislation would empower the Department of Taxation and Finance to seize illicit products and impose stricter penalties on violators. While NYACS is not actively lobbying for this measure, we recognize its potential benefits in creating a fairer market by cracking down on illegal sales.

Support in Background: Increased enforcement against illicit vape sales to protect compliant retailers.

As New York considers these policy changes, and individual house budgets once released, it is crucial to balance consumer protections, environmental goals, and business sustainability. Ongoing advocacy efforts remain essential to ensure that convenience stores can operate fairly and competitively while complying with evolving regulations. NYACS will continue to monitor, support, and oppose policies as needed to protect its members and the communities they serve.

EG America’s vice president of corporate affairs, Matthew Durand, left the company on Dec. 20 to join the National Association of Convenience Stores (NACS). Durand spent 12 years with the company, beginning in 2013 at Cumberland Farms. He later took on various government affairs roles before transitioning to EG America after its acquisition of Cumberland Farms in 2020. He is now serving as deputy general counsel at NACS as of January.

Mirabito Philanthropy’s 33rd Annual Golf Classic, held for the first time at Turning Stone Resort and Casino on June 4-5, 2024, raised $150,000 to support various charities. The event brought together business partners, employees, and community members to support organizations focused on medical research, family support, and community well-being, including the Cystic Fibrosis Foundation, Make-A-Wish, and Roswell Park Cancer Center. Mirabito remains committed to philanthropy and looks forward to continuing this tradition at its 34th Annual Golf Classic on June 11-12, 2025.

Flowers Foods Inc. has agreed to acquire Simple Mills for $795 million in cash, expanding its presence in the betterfor-you snacking market. Simple Mills, a natural brand known for its crackers, cookies, snack bars, and baking mixes, saw an estimated 14% sales growth in 2024, reaching $240 million. Flowers Foods plans to leverage its resources to grow Simple Mills’ distribution, innovation, and brand awareness while maintaining its commitment to integrity and sustainability.

Chestnut Market has been recognized for Family Business Success in the 2025 Business Hall of Fame Awards by the Business Council of Westchester. Since its rebrand in 2020, Chestnut Market has focused on transforming its locations into top-tier destinations with an emphasis on service, cleanliness, and safety. The company will be honored at an awards dinner on April 29 at the Glen Island Harbour Club in New Rochelle. The company’s revamped store, “The Hutch,”

located at North Street and Hutchinson River Parkway, was recently recognized by CStore Decisions, for its upscale design with a glass-front exterior, high ceilings, and a blend of historic charm and modern technology.

Stewart’s Shops’ 2024 Holiday Match program raised over $1.75 million for local children’s charities. Customers donated more than $880,000 between Thanksgiving and Christmas, which the company then doubled. Since its inception in 1986, the program has contributed over $39 million to nonprofit organizations supporting children, with applications for funding open until January 31. Meanwhile, Stewart’s Shops is in the process of selling five convenience stores to comply with Federal Trade Commission (FTC) conditions following its December acquisition of Jolley Associates, which included 45 convenience stores across Vermont, New York, and New Hampshire.

Anheuser-Busch is entering the energy drink market through a partnership with 1st Phorm, a sports nutrition company. Their first product set to launch by summer 2025. The collaboration, which includes sports and entertainment mogul Dana White, aims to leverage AnheuserBusch’s beverage expertise and 1st Phorm’s deep ties in the fitness industry. This move follows a wave of innovation in the energy drink sector, with brands like Celsius, Zoa Energy, and Red Bull introducing new flavors and products in early 2025.

Krispy Krunchy Chicken has launched new chicken nuggets, marketed as “big flavor in bite-sized form,” made with whole-muscle white chicken breast and a special “krunchy” breading. The nuggets, available in 6-piece and 10-piece orders, are designed to deliver exceptional taste and crunch, with a range of dipping sauces such as honey mustard, BBQ, and ranch. The product is expected to drive customer interest and sales, particularly through third-party delivery services like DoorDash and UberEats, following successful market testing.

Each year, the NYACS Scholarship Foundation awards the NYACS Emmy Seng Scholarship to a qualified student who is a goal-oriented and best demonstrates academic achievement, community involvement, financial need, and qualities of spirit and success identified within the convenience store industry. This year, prizes will be awarded to the top three applicants. Marathon Petroleum has expanded its partnership with Truckers Against Trafficking (TAT) by training nearly 800 employees, including 700 fleet drivers, to identify and report human trafficking on the road.
