New York State Budget Update New York’s Fiscal Year 2025 Budget continues to be negotiated. As of today, we are waiting for the Senate and Assembly to release their “One-House” Budget resolutions, which identify the priorities for each house. In the meantime, there are a handful of proposals the Governor made which are fully supported by NYACS. These include:
RETAIL THEFT PACKAGE
During the COVID pandemic, our employees went to work every day putting their health and lives at risk and they did so in order to provide for their community. Now these same employees put their health and lives at risk because that same community cannot protect them. Per data compiled by the National Association of Convenience Stores (NACS), since January 2020, monthly per store losses due to theft in the convenience industry have more than doubled to an average of $1,953 per month. This has a huge impact on businesses that survive on margins of less than 2.5 percent. Retail theft, however, is more than an economic crime. As theft has increased, the nature of the crimes has become more violent. In fact, one of our stores reported a criminal throwing a pot of coffee at the face of an employee.

FREQUENCY OF PAY
Under Labor Law §191, employers are required to pay “manual” workers on a weekly basis; however, most employers are unaware of this little-known statute. Many employers pay on a bi-monthly basis, which does not diminish an employee’s overall pay. There is also confusion about what the term “manual” means. The New York State Department of Labor interprets “manual” broadly to include “individuals who spend more than 25% of working time engaged in ‘physical labor’.” These outdated and poorly defined terms have left many employers confused about who qualifies as a manual worker, and thus, the frequency of pay requirements. Multiple courts cases have led to further confusion.
This is an entirely untenable situation, and something must be done to rectify it before more stores close or workers are harmed. The Governor has included language in her Executive Budget to clarify this confusion. While SUPPORT: Establishment of the Commercial some may argue that the Governor’s proposed Security Tax Credit. language is unnecessary due to the Grant case,

this decision will undoubtedly be challenged, which means any pending litigation and future litigation will remain ongoing. These damaging lawsuits are overly punitive and unreasonable and must come to an end if the state is serious about creating a robust and thriving economy. SUPPORT: Clarifying Frequency of Pay Statute
COVID-19 LEAVE EXPIRATION
Four years after the COVID pandemic began and almost one year after the CDC declared it over, New York continues to maintain a law that mandates an additional minimum of five days of paid sick leave per quarantine period (up to 14 paid sick leave days per quarantine period for large employers) specifically for COVID. With readily accessible vaccines and treatments available and laws requiring general paid sick leave, NYACS believes it is time to eliminate COVID paid leave requirements. Additionally, the state’s required paid leave policies for COVID vaccinations expired at the end of 2023. SUPPORT: Sunsetting the State’s COVID-19 Sick Leave Law on July 31, 2024.
A few of the non-budget bills we are engaged on are:
Legalization of igaming/ilottery S.8185-A, Addabbo
This bill would legalize online interactive casino gaming and the online sale of lottery tickets. This bill would negatively impact retail stores by directly removing a source of revenue at a time when the cost of doing business – labor, energy, taxes – has skyrocketed. At the same time, the state’s appreciation for the lottery retailers has been waning – in fact it has been hostile. In 2021, the Gaming Commission shortened a

retailer’s payment cycle for scratch-off tickets. Instead of having 45 days to pay for a book of tickets, now agents only have 28 days, which has squeezed cash flow significantly. In addition to pre-paying for tickets in this short timeframe, retailers are no longer reimbursed for tickets that have been stolen and reported. In effect, the state has told NYACS members that theft and crime is their problem to address – not the state’s – in a budget year where the Governor has made retail theft and the safety of retail workers a top priority.
Bottle Bill Expansion
While there are multiple bills introduced that expand the types of bottles that are included and increase both the deposit and handling fees, there is not currently a threat that this will be included in the budget. NYACS has made it clear we oppose any expansion until the infrastructure of the current system is fixed.
Retail Worker Safety Act - A.8947 (Reyes)/S.8358 (Ramos)
This misguided bill would put the onus on retailers to combat retail theft by themselves without support from law enforcement or the state. NYACS opposes this bill without reservation. We are also monitoring labor-related issues that: • Require paid Breaks for Breast Milk Expression in the Workplace. • Establish Paid Prenatal Leave Purpose. • Increase Short-Term Disability Leave Benefits.

Cliff’s Local Market successfully raised $36,447 in its fourth consecutive Autism Awareness Campaign, marking the highest amount ever generated through the sale of puzzle pieces at Cliff’s stores. The funds will significantly contribute to ensuring ongoing high-quality services for individuals affected by autism and their families in the communities served by Cliff’s. Kelberman, a leading provider of autism services, expressed gratitude for the community support and emphasized the importance of such partnerships in sustaining their programs. Philip Morris International (PMI) appointed Travis Parman as the Vice President and Chief Communications Officer for its U.S. business. In this role, Parman will lead communications as PMI strives to achieve its goal of a smoke-free future for adults who currently smoke. The pizza company will also be an associate sponsor for Ryan Blaney’s No. 12 Ford Mustang throughout the 2024 season. This collaboration marks Hunt Brothers Pizza’s 17th season

As part of the partnership, the company will provide free branded Joey Logano signage to its store partners and aims to engage fans while offering marketing value for convenience store partners in the coming years. Marathon Petroleum Corporation has separated its CEO and president roles, appointing Maryann Mannen (pictured) as the new company president, effective January 1. CEO Michael Hennigan will continue in his role, while Mannen, who was previously Marathon’s executive vice president and chief financial officer, will now oversee the refining business and commercial performance. John Quaid, the former CFO of Marathon’s MPLX division, succeeds Mannen as CFO and will also serve on MPLX’s board of directors. Marathon follows a trend among major companies, including 7-Eleven and Wawa, in dividing the president and CEO roles. Reynolds has been recognized as a Top Employer for the second consecutive year by the Top Employers Institute in the United States for 2024. Reynolds is one of 44 organizations nationwide to receive this distinction, based on the results of the Human Resources (HR) Best Practices Survey covering various HR domains. EG America has collaborated with local health authorities to introduce NaloxBoxes in some of its stores, providing opioid rescue and emergency kits. The clear boxes contain four doses of naloxone, designed to reverse opioid effects in case of an overdose. The initiative aims to address the opioid epidemic, particularly fentanyl overdoses, which is a leading cause of opioid-related deaths. EG America has installed NaloxBoxes in over 30 Fastrac and Cumberland Farms locations in communities struggling with the opioid crisis, with a focus on areas with specific needs. Anheuser-Busch InBev (AB InBev) has become the first official beer sponsor at the Worldwide Olympic Partner level for three Olympic Games, starting with Paris 2024. AB InBev’s alcohol-free Corona Cero has been named the official beer for the Games, emphasizing a commitment to responsible consumption. The sponsorship covers the Paris 2024 Summer Olympics, the 2026 Winter Olympics in Milan, and the 2028 Summer Olympics in Los Angeles. This move marks the first global beer sponsorship for the Olympics, with AB InBev focusing on promoting Corona Cero to align with the growing trend towards non-alcoholic propositions and responsible drinking.

Global Partners has completed the acquisition of 25 Liquid Energy Terminals from Motiva Enterprises for $305.8 million. The acquisition nearly doubles Global Partners’ operating footprint, extending from Maine to Florida and into the Gulf Coast. With a 25year take-or-pay throughput agreement with Motiva, Global now owns or leases 49 liquid energy terminals in the U.S., totaling about 18.3 million barrels in shell capacity. The new assets provide access to marine loading facilities and major refined product pipelines, enhancing Global’s integrated supply, storage, and retail network. Stewart’s Shops, Shops through its Holiday Match program, has raised an impressive $570,000, and with the company’s match, the total will exceed $1.1 million. The funds will exclusively benefit local organizations supporting children in Stewart’s communities. One such beneficiary is the Ronald McDonald House’s Comfort Cart in the Bernard & Millie Duker Children’s Hospital at Albany Med, providing families with snacks, coffee, toiletries, and games. Stewart’s Holiday Match matches individual donations penny for penny, with 100% of the funds going to local, non-profit children’s organizations without any administrative costs.

Marathon Petroleum, Petroleum in collaboration with Truckers Against Trafficking (TAT), has initiated a training program to educate its employees, including transport drivers and company leaders, on identifying and combating human trafficking. The training, which is voluntary, aims to certify as many employees as possible to play an active role in recognizing and reporting suspicious activities related to human trafficking. With over 1,000 truck drivers nationwide, Marathon Petroleum has trained nearly 500 employees through the TAT program. The initiative has garnered interest, with transport drivers expressing gratitude for the opportunity to contribute to combating human trafficking by recognizing and responding to red flags.
