Bill Description: This bill would raise the bottle deposit from 5 to 10 cents and increase the handling fees to redemption centers from 3 to 6 cents. It would expand the types of bottles that are eligible for redemption to include noncarbonated soft drinks, certain juices, coffee and tea beverages, and carbonated fruit drinks. Additionally, it mandates stricter pickup schedules from distributors.
NYACS Position: Opposed.
Result: The bill did not pass in either house this year. The bill finished in the Assembly Codes Committee and the Senate Environmental Conservation Committee.

Bill Description: This bill would ban the sale of flavored oral nicotine pouches. While New York State already bans flavored vape products, this proposal would expand that ban to include nicotine pouches.
NYACS Position: Opposed.
Result: The bill did not move this session. NYACS coordinated an effort to push back on the bill which was removed from an Assembly Health Committee agenda earlier this session, and was successful in making sure the bill did not move from the committee of origin in either House.
Bill Description: This bill mandates that prepackaged foods sold in stores include clear allergen labeling on all prepackaged items. NYACS has concerns with the added costs and operational burdens for retailers to now label every prepacked food item with an allergen warning label.
NYACS Position: Opposed.
Result: The bill passed both Houses at the end of session. NYACS will continue to engage with the Executive in the off-session.
Bill Description: This bill amends the General Business Law as it relates to false advertising to allow courts to consider additional factors when determining the claim of a false or misleading advertisement of food products. The bill gained traction this session after it was reassigned from the Agriculture Committee to the Consumer Protection Committee in the Assembly.
NYACS Position: Opposed.
Result: The bill passed the Senate, but did not move in the Assembly after the bill was reassigned to the Consumer Protection Committee. NYACS will continue to monitor the bill in the upcoming session year.

expand interactive gaming, including online lottery options, and modify how those games are taxed. NYACS expressed its concerns to the bill sponsor, urging changes to the proposed tax structure. NYACS worked with both Gaming Chairs to ensure traditional lottery sales agents would not be harmed if the bill were to become law.

Bill Description: This bill modifies how revenue from the 5-cent paper bag fee is distributed, without changing the fee amount. Result: The bill was scheduled for a vote by the Senate on the final day of session, but the NYACS team worked diligently and were able to get the bill removed from the agenda. Because of this, the bill did not move in either House.

Bill Description: This bill aimed to strengthen the enforcement of vapor products by imposing a 20% wholesale tax on vapor products and requiring distributors to obtain a license. The bill also would create a statewide directory of approved vapor products and grant enforcement powers to the Department of Tax and Finance to seize and destroy unauthorized or non-taxed products.
NYACS Position: Support.
Result: The bill advanced through the Senate Budget and Revenue Committee and advanced through the Senate Rules Committee on the final day of session but failed to make it to the Senate floor for a vote. The bill failed to advance out of the Assembly Ways and Means Committee during session.

Stewart’s Shops, for the first time in its 80year history, has named a president from outside the Dake family, promoting longtime executive Chad Kiesow to the role effective June 1. He now succeeds Gary Dake as president, with Dake transitioning to CEO while Bill Dake continues as chairman. The leadership transition, planned over the past three years, comes as the Dake family gradually sells shares to employees and increases annual charitable donations from $9 million to $12 million, while Stewart’s continues to grow its 400-store footprint across New York and New England.
Core-Mark’s Chris Hobson has been inducted into the Convenience Store News Hall of Fame as this year’s supplier honoree, recognizing his more than 25 years of leadership in the convenience retail industry. Since joining Core-Mark in 2000, he has held multiple executive roles before being named president and CEO in January 2024, where he now oversees company performance, growth, and key business functions. Beyond his corporate leadership, Hobson serves as a national trustee for the Boys & Girls Clubs of America and contributes to the 2025 Youth of the Year Committee.

JUUL has received FDA authorization to keep its e-cigarettes on the U.S. market, including its original vaporizer and tobacco- and mentholflavored refill cartridges. The FDA determined that the products’ benefits for adult smokers outweigh potential public health risks, including for youth. Juul CEO K.C. “EBITDA, EBITDA, EBITDA, what the heck is EBITDA” asked my 14-year-old as I ended a call discussing what has become one of the most ubiquitous terms in banking today. If you are considering borrowing money, it is a concept that you should be familiar with as your banker will ask about your business’ EBITDA.
Earnings Before Interest Taxes
Depreciation and Amortization (EBITDA) is shorthand for a business’ cash income from operations and is analogous to Net Operating Income (NOI) in the real estate world. Your banker will generally allow you to adjust or add back one-time, nonrecurring expenses and likewise require subtraction of one-time, non-recurring sources of income in determining Adjusted EBITDA. Despite bankers embrace of EBITDA, savvy operators should consider how they maximize their borrowing capacity.
Borrowing Capacity: Cash Flow (EBITDA-based) vs. Collateral (Value of your sites)

Lenders that are active in the C&G space will generally lend against the total value of the sites, as they understand the components of value.
Further, active lenders will quickly want to get behind your company’s EBITDA. This is your opportunity to tell your story. We believe one of the most important topics you can explain is the differing cash flows and levels of control you have given the particular classes of trade you operate. Take the time to walk through the key elements of site level demographics: how many stores you operate and classes of trade, size of sites and stores, age, number of dispensers, and age and construction of underground storage tanks. The aim here is to connect a description of your sites to future cash needs for expansion or renovation and provide a glimpse of the cash return such spending will generate. The NYACS Scholarship Foundation announced the recipients of the 2025 Emmy Seng Scholarship last month. This year, thanks to the generous support of NYACS members, we were able to recognize not just one, but four outstanding applicants following a tie for third place!

David Dyakiv, a standout student entering his junior year as an accounting major at Roberts Wesleyan University, has been awarded a $3,000 NYACS Scholarship. Maintaining a 4.0 GPA while working at Delta Sonic and serving as a Teaching Assistant in economics, David demonstrates both academic excellence and strong community involvement. Outside of school, he is actively involved in his church, where he teaches children’s Sunday school. He plans to complete the 150 credit hours needed to sit for the CPA exam and pursue a career in public accounting.
Nicole Spencer, a dedicated food service manager at Cliff’s Local Market, has been awarded a $2,000 NYACS Scholarship in recognition of her hard work, academic excellence, and professional growth. Starting her convenience store career during the height of the pandemic, she rose through the ranks while earning her ServSafe certification and now balances
full-time work with maintaining a 4.0 GPA as a medical administration student at Bryant & Stratton College. Nicole’s long-term goal is to build a fulfilling career in the medical field while continuing to pursue her passion for learning and self-sufficiency.
Emma Ferraro, a rising junior studying chemical engineering at Brown University, has been awarded a $1,000 NYACS Scholarship. Overcoming an academic gap in physics through determination and hard work, she now serves as a teaching assistant for the very course that once challenged her. Emma hopes to apply her engineering education to make a positive impact in fields like renewable energy, clean water access, or medical manufacturing. Emma’s father, Paul Ferraro, is a National Key Accounts Manager for National Tobacco.
Elysia Shannon, a Graphic Design major at SUNY New Paltz, has been awarded a $1,000 NYACS Scholarship for her academic achievement, campus leadership, and career ambition. She has consistently made the Dean’s List while holding leadership roles in Design Society and Alpha Phi Omega, and working multiple on-campus jobs, including as a peer advisor and student ambassador. Elysia plans to pursue a career in graphic design that aligns with meaningful causes, such as her recent internship with a company focused on global clean water access. Elysia’s father, Michael Shannon, works as a Corporate Auditor for Stewart’s Shops.
