2024 NYACS Legislative Agenda In 2023, NYACS proved we are not an organization to be taken lightly. Whether its tobacco or retail theft, state alcohol laws and labor issues, NYACS is both an advocate for small business and a resource for state policy leaders. In 2024 we will continue the hard work that led to much success last year. LEGALIZE THE SALE OF READYTO-DRINK COCKTAILS IN A CAN The rise of RDTs in the marketplace offers consumers more options but due to New York State’s archaic Alcoholic Beverage Control Laws, consumers are often puzzled as to what kind of RDTs they can purchase and where. Currently, consumers have the ability to purchase malt-based RDTs at c-stores but are only allowed to purchase spirit-based RDTs at liquor stores. Malt-based RDTs and spirit-based RDTs are nearly identical to consumers in their packaging, alcohol by volume percentage, and branding. The only difference in these two products is the method of production of the alcohol that is used in the cocktail; whether it is a malt alcohol production or a spirit production. Consumers deserve comparable access to comparable products.
END COVID LEAVE In March 2020, New York implemented a COVID sick leave mandate during the pandemic. COVID sick leave was intended to
be temporary and expire when orders of isolation or quarantine from public health officials ended. However, now New York State allows employees to self-attest to periods of isolation or quarantine. Employers have shouldered the burden of providing COVID sick leave for three years and are looking for certainty and guidance as to when this law will expire. Covid sick leave needs to expire as most businesses provide state mandated paid sick leave.
DEFEAT TOBACCO PROHIBITION LEGISLATION AND ENFORCE E-VAPE LAWS Even with New York’s adult and youth smoking rates at an all-time low, activists are pushing to ban flavored tobacco products at all levels of government. These are misguided proposals that would have no health benefit but would cost the state and localities billions in tax revenue

and thousands of jobs. Additionally, despite being illegal in the state since 2020, flavored disposable vapes continue to be sold by illicit retailers. We will build on the success of the past year to ensure common sense tobacco control laws are implemented.
INCREASE LOTTERY COMMISSIONS Convenience store operators are proud to support education through the licensed sale of New York Lottery tickets. Through dedication and hard work, they helped build the New York Lottery into a $9 billion-dollar-a-year enterprise. Yet their agent commission rate is stuck at 6 cents on the dollar – the same as it was in 1967. We will work with our lottery retail partners to bring the commission rate into the 21st century.
MAKE THE BOTTLE BILL “BETTER” BEFORE “BIGGER.” To avoid bigger piles of redeemed bottles and cans compromising sanitation in small food stores with limited space, support a store-size exemption from the Bottle Bill and expansion of regional redemption centers.
Other Legislative Issues •
Resist new taxes, fees, or cost mandates impacting convenience stores, their suppliers, or their customers.

Amend the anti-price gouging law to assign responsibility for publicly declaring “abnormal market disruptions” that trigger price controls.
•
Since all required price information is now electronically displayed to consumers by today’s gas dispensers, lift the redundant, antiquated “pump topper” sign mandate.
•
To ensure proper age verification and support neighborhood retailers, prohibit online sales of New York State lottery tickets.
•
Pursuant to U.S. Supreme Court rulings and existing state law, collect
excise and sales taxes on cigarettes and motor fuel sold by Native American enterprises to non-Native customers.

Wenzel’s Farm celebrated its 75th anniversary in epic fashion on Aug. 19 in Marshfield, Wisconsin. In addition to food, games, bounce houses, a dunk tank, mini-golf, a karaoke competition, and a free concert, the manufacturer of 14 tasty snack stick varieties, and five varieties of jerky, officially set a new Guinness World Record for longest meat snack stick, with a single and continuous Wenzel’s Farm Snack Stick that measured 314 feet long. After the record was set, the entire naturally smoked snack stick was shared with those in attendance, so the entire community could play a role in the record setting event. QuickChek Corporation was named as the official sub sandwich of the New York Giants in a multi-year partnership centered around season-long fan engagement opportunities and beginning with the launch of “Giants inspired subs” on the foodservice menu at all stores in the New York metro area starting Aug. 28. Combining the loyal, dedicated fan bases of both QuickChek and the Giants, the designation was accompanied by a season-long sweepstakes where
customers could win Giants gameday experiences, merchandise and more. All 160 QuickChek stores are within the New York Giant’s core territory. McLane Company Inc. unveiled McLane Fresh during its national trade show, McLane Engage, in Dallas. The expanded foodservice-at-retail program is designed for convenience stores and is intended to elevate the dining experience in c-stores. During the McLane Engage event, 1,100 attendees, including McLane customers and suppliers, had the opportunity to experience a taste of McLane Fresh with new products on display at the McLane booth. Menu innovation for the program will be led by accomplished corporate culinary chef Farley Kaiser, who recently joined the company as senior director of culinary innovation. Stewart’s Shops, for the second consecutive year, has the best milk in New York State as judged by the Cornell University Department of Food Science. Cornell’s College of Agriculture and Life Sciences partners with the New York State Department of Agriculture and Markets to assess the quality, safety and sensory taste of New York’s innovative dairy products. The chain’s flavored milk and ice cream also earned top honors at the New York State Fair in Syracuse on Dairy Day, Aug. 31. Stewart’s chocolate ice

cream won Best Chocolate Ice Cream and, in the Best Open Class Ice Cream category, Mint Cookie Crumble won first while Peanut Butter Pandemonium (which is actually the best ice cream ever) was a close second. Marathon Petroleum Corporation received the Spirit of Olene Walker — Outstanding Corporation Award from the Salt Lake Education Foundation (SLEF) for its ongoing grants and volunteer work toward enhancing student engagement and overall academic outcomes in the Salt Lake City School District. Their financial support has focused on advancing STEM education and other initiatives including the creation of a fullyear engineering program to prepare students for success at the university level and the renovation of the Rose Park Community Learning Center, which offers educational and life skills enrichment for families and students in a neighborhood near the company’s Salt Lake City refinery.

Retail Members Give Back United Refining/Kwik Fill hosted Operation Give Thanks from Nov. 11 to 30 to support local military families. Through the customer-supported fundraising campaign, Kwik Fill donates a portion of every gallon of gasoline and diesel purchased to support activeduty service members, veterans and their families. On Veterans Day, members of the military receive a free large coffee at Kwik Fill stores. Cliff’s Local Market, through the sale of Autism Awareness puzzle pieces at their stores, donated over $36,000 for Kelberman, a leading provider of autism services for children, adults and families in the Mohawk Valley and Central New York. This was the fourth consecutive campaign Cliff’s has run and it generated the highest gift ever. Mirabito Convenience Store’s Binghamton location served as a designated donation location for the Salvation Army’s Red Kettle campaign on November 17th. Staff members were “ringing the bell” and collecting donations from 7 a.m. to 7 p.m. in support of crucial programs and services, such as shelter and housing assistance, food distribution, utility bill support and various educational and community initiatives. And, on November 24th, the Vestal location hosted a toy drive in support of Broome County Toys for Tots. Stewart’s Shops announced the launch of its annual holiday match program, which runs from Thanksgiving Day until Christmas Day. Through the program, the company matches all donations, dollar for dollar, that come through its stores to support local nonprofit organizations benefiting children. In 2022, the program raised over $2 million for 1,939 local organizations and has raised over $36 million for local charities since its inception in 1986.
