WASTE CARRIER, BROKER, AND DEALER SYSTEM REFORM Introduction
In October 2023, the Department for Environment, Food and Rural Affairs (DEFRA) announced that in future, the transportation of waste (currently dealt with via waste carriers/brokers/ dealers) will be replaced by a permitting system. The terms “waste carrier” and “waste broker” will be replaced with the terms “waste transporter” and “waste controller” respectively, and three permits will be put in place dependent on the type & scale of activity carried out:
Waste controller-transporters: Businesses that organise waste collection, or its classification, transportation, end destination or arrange the recovery or disposal of waste on behalf of others, those who buy or sell waste and collect and transport it (for example, waste sites with their own transporter, skip companies, waste collection companies). When the new system goes live, businesses with existing upper tier licences for transporting waste will need to apply for a permit when their registration is due for renewal. Those with lower tier registrations will need to apply for a permit or exemption within 12 months of the system going live. These will last three years before needing to be renewed.
Waste Transporters: Businesses instructed by a controller to move waste between locations without input on the end destination and classification (for example, hauliers, contractors, delivery drivers). Waste controllers: Businesses that organise waste collection, or its classification, transportation, end destination (for example, brokers, dealers, waste sites), or arrange the recovery or disposal of waste on behalf of others, and those who buy or sell waste.
