Nautilus Triumphs Over Skeleton Coast Trawling in Landmark Ruling

Educational Facilities in Dire Need of Millions

· The Namibian High Court has delivered a decisive verdict dismissing an appeal brought by SCT against Nautilus. Eileen van der Schyff

The Supreme Court of Namibia firmly dismissed Skeleton Coast Trawling's (SCT) appeal against Nautilus on Wednesday this week, reinforcing the sanctity of arbitration outcomes. The court's rigorous scrutiny and resolute stance set a significant precedent for the enforcement of arbitral awards, highlighting the importance of due process, and honouring contractual agreements. The court dismissed the appeal as frivolous, vexatious, and lacking in any prospect of success. The case cantered on Nautilus's application to enforce an arbitral award in its favour

against Skeleton Coast Trawling, invoking the High Court's discretion under the Arbitration Act. The parties to this dispute are entities engaged in Namibia's fishing Industry. Nauti-

lus had been allocated fishing rights by the Ministry of Fisheries and Marine Resources. Skeleton Coast Trawling is a subsidiary of Nova Nam Limited, part of a multinational fishing conglomerate

which operates in Namibia. The parties went into a joint venture agreement in May 2007. A dispute arose between them concerning Skeleton Coast Trawling's duty to account to Nautilus for the profits of the joint venture. The joint venture agreement provi-

ded that disputes are to be referred to arbitration. Protracted arbitration proceedings followed which were presided over a by a senior member of the Society of Advocates of Namibia. At the conclusion, the arbitrator found in a detailed award that Skeleton

Coast Trawling was liable to Nautilus in the sum of N$ 14 705 062 together with interest at the prescribed rate from 22 August 2016 to date of payment as well as costs of the arbitration proceedings. Nautilus's legal practitioners addressed Skeleton Coast Trawling's

Swakopmund Mayoral Office Vows to Work Towards Poverty Eradication Sharlien Tjambari During the first Ordinary Council Meeting of the year, the Mayor of Swakopmund, Dina Namubes said there are pertinent issues that affect the Swakopmund community, such as the high strides of poverty which the council cannot turn a blind eye to. Therefore, the Office of the Mayor's goal for the year 2024 is to work towards poverty eradication and ensure that there is zero hunger in Swakopmund. These goals are in line with the Sustainable Development Goals. In her

statement, Namubes said, “the high strides of poverty in our town are indeed worrisome and we need to take a collective stance to fight poverty. As we look around our beautiful city, it's easy to see the vibrant energy,

the diversity, and the resilience that define us. However, we must acknowledge the challenges faced by some of our fellow residents who find themselves grappling with the harsh reality of Continues on page 2

Namibia's Fishing The signing marks a significant stage in preparing for the Namibia Ocean Cluster to becoming a legal registered non-profit organisation in Namibia to minimise waste and maximise socio-economic value of the fish harvested from the Namibian fisheries sector. The Namibia Ocean Cluster, a collaborative forum for the Namibian seafood sector and allied stakeholders to work towards maximising the utilisation of all seafood post-harvest is supported by the World Economic Forum's Ocean Action Agenda. The Cluster's goal is to promote innovation, research, and markets for fisheries byproducts, whilst enhancing socio-economic benefit. The Cluster, a multi-stakeholder organisation, is set to collaborate with the global Ocean Action Agenda, an initiative by the World Economic Forum, to explore ways to optimise the utilisation of post-harvest seafood losses and maximise socioeconomic benefits. The Namibia Ocean Cluster's efforts align with the global 100% Fish Movement, which seeks to inspire seafood stakeholders to increase the use and value of each fish, create new business opportunities, boost employment, and reduce waste. The Namibia Ocean Cluster, supported by the World Economic Forum's Ocean Action Agenda, has been created to bring together the seafood sector and allied stakeholders, with a mission of maximising the utilisation of all seafood harvested. While the Cluster is currently driven by the hake industry, it is open to all fisheries in Namibia, and it is hoped that more companies representing a variety of seafood will join to collaborate on future by-product utilisation projects. Associate Members who can bring relevant expertise to enable full utilisation are also welcomed to join the Cluster. Pierre le Roux, Chairman of the Namibia Ocean Cluster said that as cluster members they look forward to other Associate Members joining. “Having in mind organisations such as in the cosmetics and pharmaceutical sectors, we

Continued from page 1 discover additional properties of fish that we were not aware of before.” Le Roux explained that utilising what was previously waste, through innovative research they have encouraged companies to produce products such as: fish skin bandages which have incredible medicinal healing qualities; cod liver oil tablets; collagen products from fish skins for human consumption; fish enzyme pharmaceutical products; fish heads for human consumption; pet foods; and leather products from fish skins to name some of them. Matti Amukwa, Chairman of the Confederation of Namibian Fishing Associations said that the Namibia Ocean Cluster is filling a very important gap. It brings together companies in areas of joint commercial interest, in what is otherwise a very confidential and competitive industry. “It is in the pre-competitive stage of developing seafood products.” Amukwa added that it is good to see such large companies as Embwinda, Hangana, Merlus, NovaNam, Pereira, and Seawork joining this initiative. “Working together I can see that they can achieve what they could not on their own, and this really opens the opportunity to start developing a totally new industry as a sideline to the Namibian fishing industry.” Amukwa explained that they have never really considered the medicinal and cosmetic elements of seafood, or the nutritionally valuable trace elements of fish parts that are currently not utilised. “By working together, and networking, both locally and internationally, this is opening a whole new side to the fishing industry that up till now we have not had the collective capacity to consider. I am very happy to see the Namibia fishing industry embarking on this new direction and encourage all sectors of the fishing industry to consider joining,” Amukwa said. Additionally, the six founding industry Members are all signing commitments to financially support the formation and ongoing activities of the Namibia Ocean Cluster, with the Associate Members also committing their support.

Shell Unveils Significant Oil Discovery in Orange Basin Eileen van der Schyff Plans 3D Seismic Exploration

Shell has uncovered a substantial reserve of at least 500 million barrels of recoverable oil in Namibia's Orange Basin, as reported by Energy Voice's Oil Journalist, Ed Reed, in articles dated January 23 and 25. Quoting Namibia's petroleum commissioner, Maggy Shino, Reed highlights the magnitude of the find. "Shell has discovered at least 500 million barrels of recoverable oil in Namibia's Orange Basin," said Shino. Shell is now propelling its exploration efforts forward by planning to conduct 3D seismic exploration on its acreage in Namibia's Orange Basin. The company aims to acquire 3D streamer seismic, coupled with ocean bottom node (OBN) data, which promises cleaner and more precise information compared to traditional seismic methods. The focus of Shell's exploration endeaours lies in Namibia's PEL 39, where the company has made multiple discoveries over the past two years. Despite facing an expired environmental clearance certificate (ECC) for 3D acquisition on part of the license, Shell remains undeterred. The company has filed documentation for the amendment and renewal of the license. Reed quotes Shell, stating, "the seismic would be helpful to support the identification of the most optimal drilling locations." Shell intends to achieve more detailed coverage

through smaller streamer spacing for its 3D work. Having drilled seven wells on the expansive 12,299 square km PEL 39, ranging from depths of 800 to 2,500 meters, Shell is keen on furthering its exploration initiatives. The environmental assessment is being managed by SLR Environmental Consulting (Namibia), serving as Shell's independent environmental assessment practitioner. While the documents do not disclose the exact timeline for the seismic acquisition, Shell plans to engage stakeholders in February, with a ministry review and decision expected in March. In a related development, Shell confirms the release of its Deepsea Bollsta rig in June, with plans to conduct an appraisal on the Jonker discovery and drill at least one more exploration well.

Educational Facilities in Dire Need of Millions Sharlien Tjambari

School infrastructure in the Erongo region needs to be maintained because of the impact the region's harsh weather has on infrastructure. However, the Erongo region's Ministry of Education is faced with financial challenges, hindering hostel and school infrastructure renovations. Erongo region's Director of Education, Erenfriede Stephanus stated the funds her office receives from the ministry's Head Office typically address the needs of the classrooms. Stephanus said a few years back with the Covid Fund, a total of three hostels were renovated, one in Omaruru, one in Swakopmund, and one in Okombahe. “It was not full renovations because these funds were also meant to build classrooms to address the issue of overcrowded classrooms,” Stephanus said. Two years ago, the Haus Romi Hostel (Namib High School Girl's Hostel) was water-damaged in the rainy season which made it impossible to keep the learners at the hostel. Arrangements were made to move the girls to Huis Namib Hostel at Swakopmund Secondary School. Stephanus reiterated the urgent need for funds to renovate the hostels fully and properly. Stephanus calls private companies to come on board and assist in the renovations of the schools and hostels at the coast. To assist in bringing improvements to school facilities in the country, Swakop Uranium, under the Invest in Education campaign of the Swakop Uranium Foundation, donated a cheque of N$500 000 to Namib High School for the renovation of the Haus Romi hostel and N$100 000 to Swakopmund Secondary School (SSS) for the renovation of the school's science and computer laboratories. The

handover took place on Tuesday this week. According to the chairperson of the Swakop Uranium Foundation, Percy McCallum, the Invest in Education Campaign aims to bring improvements to the school facilities to create a conducive learning environment for future leaders. It is also a call to action to ensure that the Namibian child is not left behind as the world reaches new heights in education and technology daily. McCallum said, through these initial pledges, the company hopes that other corporates will come onboard in their various capacities to assist in bettering the school facilities nationwide. While highlighting the history of the Hostel, the Principal of Namib High School, Rosemarie September said, approaching its 48th birthday, the hostel urgently needs upgrades to survive another 48 years and more. “While there is still much to be done, we would like to express our gratitude to Swakop Uranium Foundation for the generous donation towards the renovation of the girl's hostel. We hope that additional stakeholders will be inspired by this enormous gift and help us bring Ernst Rumf and Haus Romi back to its former glory. Renovated the hostels will also bring much relief to SSS' hostel, Huis Namib.” SSS principle, Sinvula Sibanga explained the challenges his school faces, stating the main challenge lies at the science and computer laboratories which are where the funds received will be deposited. The situation in the laboratories is life-threatening because the roof is leaking. The school also has very severe cracks in the walls which might be catastrophic should they collapse. The Governor of the Erongo region, Neville André Itope said the renovation of the school hostels and laboratories will undoubtedly enhance the living conditions of the learners, fostering an environment conducive to learning and personal growth. Itope extended a heartfelt appreciation to Swakop Uranium for their unwavering support. “Your donation not only improves the infrastructure of our education facilities but also reflects the tower of collaboration between the private sector and the Namibian government. Moreover, this donation will help individuals to have access to quality education and ultimately contribute to long-term social economic growth,” Itope concluded.

Stefnie Strauss, last seen alive at 01:00 purchasing items at a local tuckshop, met an unfortunate fate as her shack became engulfed in flames while her neighbours slept. Despite the valiant efforts of a neighbour who noticed the fire and

MVA Fund Urges Caution After Alarming Week of Road Incidents Eileen van der Schyff

The Namibian Motor Vehicle Accident (MVA) Fund expressed deep concern over the recent surge in road traffic incidents, revealing that Namibia lost 16 lives with 89 people injured in the past week alone. The MVA Fund, responsible for managing road accident compensation in Namibia, released year-to-date statistics (1 - 28 January 2024) indicating a total of 158 crashes, 335 injuries, and 29 fatalities. This alarming trend has prompted the fund to issue a stern call for increased vigilance and responsible behaviour on the roads. Having just emerged from the

festive season, traditionally associated with heightened travel and road activities, the MVA Fund underscores the importance of continued caution. The Fund urges drivers to maintain safe practices, exercise vigilance, and prioritise the safety of all road users. Emphasising the devastating consequences of road crashes on families, communities, and the nation, the MVA Fund stressed the preventability of many accidents through conscientious driving. Strict adherence to road traffic rules and regulations, along with careful planning for long journeys, is emphasised as key measures to avert such calamities. Of particular concern is

driving at night, where limited visibility on the road significantly increases the risk of accidents. The MVA Fund advises against nighttime driving and urges the public to be mindful of these risks when planning their journeys. The MVA Fund also encourages the public to play an active role in road safety by reporting crashes promptly. The toll-free accident response number, 9682, is provided as a crucial resource to report incidents swiftly. The Fund emphasises that timely reporting can contribute to faster response times and potentially save lives in critical situations.
