In a water-scarce environment, transitioning to xeriscaping offers a practical solution to conserve water. Ponderosa Cactus, a Tucson go-to for 36 years, is helping homeowners embrace this new trend, specializing in plants ideal for Tucson's dry climate.

Ponderosa Cactus, located at 3571 E. Esmeralda Carrasco, Chief Operating Officer of Ponderosa Cactus, finds deep professional fulfillment in educating and guiding customers as they transform their outdoor spaces. She recalls a particularly rewarding project with a family who had recently relocated from the East Coast. “They were accustomed to a lush, water-intensive English garden, and helping them reimagine their landscape into a breathtaking Mediterranean-inspired desert oasis was incredibly gratifying,” she said. “We incorporated stunning clusters of golden barrel cacti, elegant Yucca rostratas, towering Mexican Fence Posts, and vibrant aloes—creating a space that was not only sustainable but also a reflection of the natural beauty of the Southwest.” And the enthusiasm is spreading across the city.

STEP 7: MULCH

While mulch is important for many landscapes, it is not significant in an xeriscape. Gravel, decomposed granite, and organic mulch are components that will work more effectively.

STEP 8: MAINTENANCE AND CARE

For those looking for less work, xeriscaping is great. While xeriscaping still needs some maintenance like pruning, some watering, and weed control, it requires way less attention than a traditional landscape.

Protecting Your Assets

Planning Can Avoid Probate and Judgments

As a real estate and estate planning attorney and a real estate broker, I am constantly approached by people asking me what they should do to protect their real estate. This usually leads to great conversation, planning, and changes.

Most people think there is no hurry to move their non-owner-occupied property into an entity (like an LLC or Trust) to protect their personal liability or to execute a transfer-on-death type of deed to avoid probate. They do not think they will be hit by a bus anytime soon or that someone will secure a judgment against them that can attach to their home and other assets.  But the truth is, these things happen all the time. Without proper planning, sometimes it’s just too late to protect yourself.

Another common oversight is not thinking ahead about the consequences of how they take title to their property.  They may be buying a property with a friend or a significant other and don’t realize the consequences of taking title as joint tenants until they break up, and one wants to sell, and one wants to stay.

Or they don’t understand what community property means. Their marriage breaks up, and they do not know that all income is community property or understand the exceptions to community property: inherited assets, gifts, assets a person walked into the marriage with,

and assets a person bought with money that they inherited or had before they married. These assets are not community property and do not get split upon divorce (as long as they have not been comingled).

One of my favorite things to do is sit down with someone or with a couple and run through their list of assets together and discuss each one. I ask, what is your intention with this asset if you die? Do you have kids from a prior relationship or marriage (many of us do), and how do you want to distribute your assets between those kids and your current spouse so everyone is comfortable? We execute a Disclaimer Deed if the intention is for one spouse to own the property sole and separate.  With their primary residence, we discuss creating and moving it into a Trust to avoid probate. If they don’t want a Trust, we discuss a Beneficiary Deed to pass to their beneficiary upon the death of the second one, without probate. Suppose it’s an income or non-owner-occupied property (think rental or AirBnB). In that case, we look at the option of creating and moving the title into an entity, like an LLC, to keep possible judgments away from their personal assets. There are many ways to avoid probate and protect oneself from creditors.

None of this happens magically. When I am teaching my classes on estate planning, I ask my students, how come most of you (more than 75%) have nothing written down? Why do you have your rentals in your personal name? A Trust, a Will, Medical Directives, a Financial/Durable or Medical Power of Attorney can simply provide the needed protections.  The number one answer is: “There is no hurry, I’m not dying anytime soon”. They also say, “I figured I’d get around to it.” Or, “It’s too expensive” (PS – it’s not). Or, “I don’t think I have enough assets to worry about estate planning”. Most admit that they don’t like to think about their mortality.  The thing is, once you are incapacitated (dementia, coma, etc.), it’s too late.

A person must be “of sound mind” to execute a Will, Trust, Power of Attorney, etc. You cannot do it while you are on a morphine drip, controlled substances, or narcotic drugs for pain without opening yourself up to your mental capacity being attacked and your document possibly being thrown out. Certain medications cause cognitive impairment and will allow an attorney to attack a Will or power of attorney.  Medication can be a threat to your testamentary capacity.  Why go there?  The window of opportunity is now.

It’s not difficult to go one by one and decide how to hold title to avoid probate and to protect oneself from creditors. There are TOD/POD documents (transfer on death, payable on death) for most titled assets, there are Living Trusts, and there are Beneficiary Deeds. There is the option to own real estate with someone as Joint Tenants with the Right of Survivorship or with a spouse as Community Property with the Right of Survivorship. There is the option to move each investment property into an entity and assign your membership to your Trust or have your Trust be a member.  There is a structure available for everything that will allow your heirs and beneficiaries to avoid headaches if you become incapacitated or if you die, and will achieve the results you want, as opposed to leaving it up to the state. Don’t wait until someone can challenge your mental capacity and condition. The time to plan is now.

Savory and Sweet Eats from the Past

A CHEF… must think like a scientist, organize like an accountant, inspire and motivate like a warrior, move like a trickster, plate like an artist, and COOK like a Grandma!

As the wintery cold days give way to spring, a little comfort can go a long way. There’s nothing quite like the warmth of delicious home-style meals to set the tone.

HOMESTYLE CHICKEN NOODLE SOUP

Serves six

ingredients:

• Two tablespoons of butter

• One onion, diced

• Two carrots, peeled and diced

• Two stalks of celery, diced

• Three cloves of garlic, minced

• Eight cups of chicken broth

• Two bay leaves

• Salt and pepper

• Two and a half pounds of bone-in, skinless chicken breasts

• Two cups of wide egg noodles

• Two tablespoons of chopped fresh parsley

• Two tablespoons of chopped fresh dill

• One teaspoon of grated ginger

• One tablespoon of freshly squeezed lemon juice

instructions:

Melt the butter over medium heat. Add the onion, carrots, and celery and cook, stirring occasionally, until caramelized, (about four minutes).

Stir in garlic for about one minute. Add the chicken stock and bay leaves and season with salt and pepper.

Add the chicken and bring to the boil. Reduce the heat and simmer, covered, until the chicken is cooked through (about 30-40 minutes).

Remove the chicken and let it cool a little, then dice it into bite-size pieces.

Add the chicken and noodles to the pot and cook until tender (about seven minutes).

Remove from the heat, stir in chopped herbs and lemon juice. Adjust seasoning and serve.

CHICKEN POT PIE

Serves 10

ingredients:

• Four tablespoons of butter

• One-half cup of finely diced onion

• One-half cup of finely diced carrot

• One-half cup of finely diced celery

• Three cups of shredded cooked chicken

• One-quarter cup of flour

• Three cups of low-sodium chicken broth, plus more as needed

• A splash of white wine (optional)

• One-quarter teaspoon of turmeric

• Salt and pepper, to taste

• Chopped fresh thyme to taste

• One quarter cup half-and-half or cream

• Pot pie crust (recipe follows)

• One egg

instructions:

Preheat the oven to 375ºF.

In a large pot, melt the butter over medium-high heat. Add the onion, carrot, and celery and cook, stirring occasionally, until the onion turns translucent, about three minutes.

Stir in the chicken, sprinkle the flour over the top, and stir until the meat and vegetables are combined. Cook for one minute, then pour in the chicken broth (and wine, if using). Stir and let it cook and thicken.

Once it starts to thicken, add the turmeric, salt, pepper, and thyme. Add the half-and-half or cream, stir the mixture and let it bubble and thicken for about three minutes. Turn off the heat.

Pour the filling into a two-quart baking dish. Roll out the pie crust on a floured surface and lay it over the top of the dish. Press the dough so the edges stick to the outside of the pan. Use a knife to cut little vents here and there on the surface of the dough.

Mix the egg with two tablespoons of water and brush it all over the crust’s surface. Place the pie on a rimmed baking sheet and bake until the crust is deep golden brown and the filling is bubbly for 25 to 30 minutes.

POT PIE CRUST

ingredients:

• Three cups of flour

• Three-quarters of a teaspoon of salt

• Three-quarters of a cup of butter, cut into pieces

• Four and a half tablespoons of shortening cut into pieces

• Six tablespoons of water

instructions:

Combine flour, salt, butter, and shortening in a food processor and blend until the mixture resembles coarse breadcrumbs. Add four tablespoons of water and blend in, adding enough water by tablespoonfuls to form moist clumps.

Gather dough into a ball and flatten it into a disk. Wrap in plastic and refrigerate until cold (about one hour).

FOCACCIA BREAD

Makes two large loaves

ingredients:

• Four cups of flour

• One tablespoon of salt

• One tablespoon of yeast

• Two cups of lukewarm water

• One teaspoon of sugar

• One tablespoon of olive oil

• Rosemary

• Coarse salt.

instructions:

Place the sugar in one-half cup of lukewarm water. Sprinkle in the yeast and allow it to rise for 15 minutes or until doubled.

Mix the flour and salt and add the rest of the water. And one-half tablespoon oil and mix until the dough is smooth and homogeneous.

Cover with a damp cloth and let rise in a dry place for two hours.

Divide the dough in half and stretch it to a 1/2inch thick round. Cover again and allow to rest for 10-15 minutes.

Turn on your oven to 425F.

Use your hands to gently push the dough to the edges of the baking pan. Brush with the rest of the olive oil and sprinkle with rosemary and coarse salt. Cover and let rise for 20 minutes.

Bake for 15-20 minutes until the focaccia crust is medium brown and feels dry and firm on the surface. The baking time will vary according to the thickness of the bread.

Cut into wedges and serve warm.

CREMA DE MANGO

Serves three to four

This Filipino icebox dessert consists of layers of crushed graham crackers, sweetened whipped cream, and ripe mango!

ingredients:

• Two cups of heavy cream

• One 14-ounce can of sweet condensed milk

• One and a half cups of graham crackers

• Three ripe mangoes, diced.

instructions:

Combine the whipped cream and the sweet condensed milk in a bowl. Beat with a hand mixer until doubled in volume and is stiff.

Spread two cups of cream in an 8-inch square baking dish, followed by 1/2 cup graham crackers and a third of the mangoes. Continue alternating layers for a total of nine layers, ending with mango.

Chill overnight… and serve!

This annual family-friendly event celebrates Americana and Folk Music traditions and all the wonderful variations, including bluegrass, blues, country, jazz, Celtic, and various Latin and Mexican music styles!
