RENT REVIEW PROGRAM
In response to the rising cost of rent, the Fremont City Council adopted the Rent Review Ordinance (RRO), which took effect on January 1, 2018. All residential rental units in Fremont are covered under the ordinance, with some exceptions. The ordinance provides a neutral setting to resolve rent increase disputes through a 3-step conflict resolution process: Consultation, Mediation, and Rent Review Board Hearing. Renters and landlords have the right to request a rent review for any amount of rent increase, regardless of the length of tenancy. The Rent Review Board is a public, impartial body of Fremont residents that evaluates the reasonableness of proposed rent increases at the request of either the renter or landlord, and can make non-binding recommendations. Requests for a Rent Review Board Hearing may be made if a proposed rent increase is over 5%, and if no agreement was made during consultation and/or mediation. The City also has a Source of Income Discrimination Ordinance, prohibiting landlords from discriminating against tenants based on source of income, which now includes rental assistance like Section 8. Landlords are no longer able to advertise their vacant rental units and list that they do not accept Section 8.
