Conference 2017 GREETINGS FROM THE KAPITI COAST

ZONE MEETINGS

It is hard to believe we are already in to May. From all accounts and reports, member companies have had an extremely busy start to the year and are reporting good sales for the first quarter. With the Christmas holidays a distant memory we are all looking forward to making the most of this year and the positive economic outlook.

I am pleased to report the zone meetings were well attended in May. The dedicated Event and Party Hire meeting in Rotorua is gathering momentum which is great to see. I am looking forward to some positive outcomes here regarding the Marquee Best Practice Guide.

BOARD ACTIVITIES The association has had a busy start to the new year. Phil Tindle and Rob Stewart represented the association at the ARA annual conference and GRA (Global Rental Alliance) meeting this year held in Orlando, Florida. The meeting was chaired by the ARA’s new CE, Tony Conant who spoke about the need for the GRA to be more focused on common goal projects and the achievement of tangible outcomes. The current focus for the board at present includes the Careers in Hire project we intend on releasing to members in July, and the negotiation of templates for industry specific terms and conditions. The board are also undertaking due diligence and consideration of a support program that will provide industry with generic “Instruction for Use” sheets. Financial planning is always front of mind, and given the sizable fund currently on term, plans are afoot relating to how the revenue generated from this investment will fund training and other HR activities – all of course having direct and tangible benefits for the membership. MEMBERSHIP Membership continues to increase. At this point in time membership is at its highest in the past decade. The Association has welcomed another nine (9) new members since January 2017. Membership renewals were invoiced on 1 April to 129 full members, and 80 associates.

We plan to have another round of meetings in October. CONFERENCE 2017 - JULY 24-26 Another great event planned for you this year. What better place to take a few days out of your busy professional lives than New Zealand’s wine capital. We have plenty to offer in Blenheim including a partner’s day, pre-conference charter trip in the Malborough Sounds, networking functions, a dedicated party and event luncheon, great workshops and a fantastic trade show. This all culminates on the Wednesday night at the Gala Dinner and Hire Excellence Awards to be held at Omaka Aviation Heritage Centre. This will be an event not to be missed! JLG ‘CUSTOMER CARE’ As one of Australia’s leading materials handling companies, JLG realised many years ago that having a leading range of access equipment was not enough – customers were looking for a more holistic solution to their needs.

T PROMPTED JLG to take a very close look at how to better support its clients beyond just supply machines, and this lead them along the path to establishing the industry’s pre-eminent aftersales support services, encompassing a range of market-leading offerings that competitors couldn’t - and still can’t - match. Simply known as JLG ‘Customer Care’, the name says it all, and allows customers to choose from a range of services designed to make ownership of JLG equipment efficient and hassle-free. JLG’s service vehicles are also at the forefront of innovation, using wireless InVan-Technology to provide technicians with real-time access to equipment service records and job status, parts ordering, and up-to-date service histories that help optimise service efficiencies. The service vehicles operate in a virtually paper-free environment. These services add to JLG’s broader Customer Service offerings including generous equipment warranties and inspection services. And for customer wanting absolute peace of mind with their JLG equipment, the company

offers a Comprehensive Preventative Maintenance Program (CPMP). CPMP is ideal for clients who don’t employ maintenance divisions, or who would prefer to concentrate on their core areas of business and leave their fleet maintenance needs in the hands of the experts at JLG. CAREERS IN HIRE PROJECT RELEASED HIANZ has a new and exciting project currently underway that will result in a valuable communication tool for future promotions around careers in our industry.

C

AREERS IN HIRE will be launched in July 2017, consisting of a sharp & attractive dedicated website promoting careers in the hire industry. The highlight of the website is a series of engaging video interviews that promote different pathways that exist in this great industry and how young and mature entrants can find their way through different entry and destination points. The web content will highlight a tapestry of experiences that would have appeal to new people considering joining the industry. From trade activities, through to management pathways, there will be something for everyone. Getting people interested in joining the Hire Industry is the key objective, all business are looking to attract good people who are keen to develop themselves, contribute to the business, and help create the next generation of leaders. According to HIANZ CEO, Phil Tindle, the Hire industry is one where there is a large amount of people who have been around for some time and the average age of those involved is probably higher than other areas of occupation. It is also heavily male dominated, notwithstanding family husband and wife businesses. “The Careers in Hire project would look to feature 5 individuals making their way and setting examples for others, particularly those beginning their working lives,” says Phil. “This would allow students and young people to see what is possible in this diverse industry and to spend some time with some of the industries up and coming leaders of the future. The project would also feature a good gender balance to introduce more women into the industry.” “People still see aspects of the industry as transient and not a good long term career option. EY REPRESENTATIVES of the Hire Industry Association of New Zealand, including HIANZ CEO, Phil Tindle and HIANZ Board Director, Robert Stewart, attended the Global Rental Alliance Meeting, held on 2nd March during The Rental Show 2017 in Orlando, Florida. The purpose of the Global Rental Alliance (GRA) is to increase the profile of equipment rental worldwide and to build global understanding of the industry. It is a partnership of rental associations from around the world that meets twice a year to share information on member initiatives throughout the year. The Japan Construction Rental Association (JCRA) officially joined the GRA, as of 2nd March 2017, with representatives attending the meeting along with those from the Canadian Rental Association (CRA); European Rental Association (ERA), Belgium; Hire Association Europe (HAE), United Kingdom; Hire Industry Association of New Zealand (HIANZ); Hire and Rental Industry Association Ltd. (HRIA), Australia and American Rental Association (ARA). “The GRA continues to be a valuable forum for industry and association representatives from around the world

to engage on key issues that impact on the hire sector. The addition of the JCRA brings the third largest country from a global rental perspective to the Alliance. The GRA welcomes Mr. Kadoguchi and the JCRA to the GRA, as we are always looking to add global members that are interested in advancing the hire industry, says HIANZ CEO, Phil Tindle” High on the meeting agenda was a review of the global survey initiated by the GRA, which revealed a combined hire and rental revenue figure for 2015, among the GRA associations of US $91.5 billion, as calculated by IHS Markit™ on behalf of the group. This combined hire and rental revenue figure includes Japan’s figures for the first time. A discussion was held among the associations on the economic forecast for their countries throughout 2017. All of the GRA associations demonstrated their commitment to increasing the use of hire equipment behalf of their membership through their respective initiatives. Other topics on the agenda during the meeting included focusing on advancing the business success for members of the individual associations and promoting the image of the

hire industry across the globe. The priorities and member initiatives of each individual associations were shared for the benefit of the group, along with any trends and industry developments. Amongst the topics discussed were global technology trends, success and challenges with their individual association conventions and workplace issues including creating hire industry awareness and promoting the hire sector as a viable career option. The GRA International Rental Business Leadership Program, which is administered by the ARA Foundation, was also reviewed and future program participants were discussed. Initiatives regarding young professionals in each association were reviewed. The group discussed their objectives for 2017/2018, as well as conference dates and schedules for their respective associations. These dates are available on the GRA website, GlobalRentalAlliance.com. A midyear webinar meeting for GRA will be held and is planned for August 2017. The next annual meeting will be held at The Rental Show 2018 in New Orleans, Louisiana. ◘

AUSTRALIA EASES THE RULES FOR THE HIRE INDUSTRY Geoff Hardy Auckland Based Commercial Lawyer

M

OST HIRE COMPANIES by now will be aware of the Personal Property Securities Act 1999 (“PPSA”). In particular they should be aware that they risk losing their hire equipment if they hire it long-term to a customer who then goes bust, and they have not registered their ownership on the Personal Property Securities Register (“PPSR”). The 2004 New Zealand High Court case of Graham v Portacom New Zealand Ltd first made it clear that a secured creditor such as a bank who holds security over all the customer’s present and after-acquired property, will have prior rights to the hired equipment unless the hire company has registered its security interest in time. This only applies to a “lease for a term of more than one year”. But that not only includes leases (and hires, bailments) with a fixed term of greater than 12 months, but also a lease for an indefinite period (even if it can be terminated earlier than one year by either party), a lease for one year or less that is either automatically renewable or renewable by one party beyond one year, and a lease for one year or less where the customer remains in possession for more than one year with the lessor’s consent. So it is easy to fall into the trap without knowing it.

However it is not a big a risk as you might think. Long-term hires aren’t that common, and when the customer does hire the equipment for a long time, only a very small proportion IVE TRANSPORT MINING

of them ever go bust or try to sell or mortgage the hire equipment to someone else. Nevertheless in the short time the PPSA has been in force in New Zealand, not only did Portacom lose five portable buildings because of a failure to register on the PPSA, but a stallion owner lost its horse, the owner of three mobile units lost the units, and the owner of some construction equipment including two substantial on-site hoists lost them as well. Our 1999 PPSA was based on Canadian and American laws, which had similar long-term lease provisions. Ten years later Australia adopted its own PPSA which came into force on 30 January 2012. They have much the same definition of long-term lease as we do, but the lessons we learned in the ten years previously weren’t picked up across the Tasman. Sure enough, within a year, the owner of some Caterpillar excavators and loaders (Queensland Excavation) who had hired them to a construction company (Maiden Civil) for more than one year, lost them to a financier who had registered its security. Another contractor suffered a similar fate a year later. The Australian Hire and Rental Industry Association (“HRIA”) were always a lot more agitated about this rule than we were, and our friends from HRIA who regularly attend the HIANZ Conferences were adamant they were going to get the law reversed. They pointed out that it was common for smaller hire companies to hire equipment out to a customer for no fixed term, and then receive the equipment back a few weeks later. They maintained that it was unrealistic to expect those companies to go to the trouble of registering or to switch

to fixed term hires, even if they were aware of the law. The Australian PPSA was required to be reviewed within three years, so a lawyer called Bruce Whittaker was appointed to lead that review and after public consultation he produced a final report on 31 July 2014. He noted that PPS Leases generated more submissions than any other topic.

Our friends from HRIA who regularly attend the HIANZ Conferences were adamant they were going to get the law reversed. So much so that even before that review was completed the Australian Government passed an amendment which narrowed down the definition of PPS Leases. Whittaker’s report dismissed the suggestion that the short-term hiring industry should be exempted from the PPSA altogether, but he did recommend some tweaks to the one year rule. The Federal Parliament responded to that report by introducing the Personal Property Securities Amendment (PPS Leases) Bill 2017 on 1 March of this year, which went further than Whittaker had recommended. If that Bill is passed, it will extend the minimum duration of PPS leases from more than one year, to more than two years. Leases of an indefinite term will not be deemed to be PPS leases unless and until they run for a period of more than two years. That will reduce the number of continued over HIANZ HIRE & RENTAL 2017 -

AUSTRALIA EASES THE RULES FOR THE HIRE INDUSTRY instances where a PPS lease needs to be registered, because there will be less leases that meet the criteria in the first place, and you won’t need to register an indefinite or rolled-over lease unless and until it approaches the two year mark. However you will still need to programme your computer to prompt you to register when the two year deadline is getting close, and there are going to be plenty of hire companies that forget, so there are still going to be some hard luck stories. Will the Australian hire industry chalk this up as a significant victory? I suspect not, mainly because they wanted hire agreements to be exempted from the PPSA regime altogether. I can’t help thinking that the increase from one to two years was a bit of a sop to appease the industry without

abandoning the core principles of the PPSA. But at least in Australia if these changes go ahead there are going to be less hard luck stories in the future than there are now. Interestingly, in New Zealand the PPSA didn’t generate the same outcry from the hire industry as it did in Australia, so I doubt whether we will see similar reforms here any time soon. In fact, in a 2015 seminar paper Mike Gedye, one of our leading academics on the PPSA, expressed the view that “in New Zealand the leasing industry does now generally accept the PPSA concepts”. As with all things though, political pressure to change the law only comes about as a result of saturation media coverage of some sensationalised incident or some vocal lobby group. So it will probably take

the loss of ownership of a sentimental New Zealand icon such as a famous racehorse, a McCahon painting, or a treasured Maori artefact, to thrust this issue into the spotlight and create pressure for change. ◘

HONDA SUCCESSFULLY HOSTS NETWORKING FUNCTION Honda Power Equipment recently hosted HIANZ members at the Northern Industry function held in April. This was the first of three regular regional meetings put on by the association to help foster networking amongst suppliers and fellow hire companies. The other two were held in Rotorua and Christchurch in the same month.

HE NORTHERN EVENT sponsored by Honda was well attended and proved to be very successful with those representing both the independent hire centres, the larger chains and all associated suppliers. Those who were there were equally impressed with the extensive facilities at the Power & Marine Headquarters and with the Honda motorbikes, power products and outboards on display. The evening consisted of a brief presentation from Power & Marine General Manager Ian Biddick followed by a guest speaker John O’Rourke from Law firm, MunterEllisRuddWatt. John provided members with an insightful presentation on the latest regulations on Health and Safety matters relative to the hire industry.The presentation was followed by a brief walk through of the impressive building and warehouse at Power & Marines distribution centre in New Zealand, with the Honda team laying on a great spread and light refreshments. Without question all attending now look at Honda in a different light in that they had no idea of the size and scale of the business. HIANZ CEO, Phil Tindle, was grateful to Honda for allowing HIANZ delegates the opportunity to use the Honda site to conduct their

New Waterblasters from AES The new H&S rules, requirements and penalties have been well published. “But how many Hire managers & Directors or directors of companys are confident their waterblasting equipment is up to scratch,” asks AES Director Alan Bisley?

HE AS/NZS4233.3 STANDARDS ON Safe Operation & Maintenance of High pressure water jetting systems which covers virtually all water blasters will make sobering reading for some. AES Waterblasters (founded in 1981) have always taken customers safety seriously. Typical safety features fitted to an AES Waterblaster include: an unloader valve, a pressure gauge and safety valve or burst disc (a rupture disc in USA) plus a thermo protector valve to help prevent pump over heating.

Most waterblaster pumps are of the positive displacement category which means when the crankshaft is turning, the pump is pressurising the water inside. The Wash jet (or nozzle) determines the operation pressure of the system. The unloader valve is a crucial component. It controls the operating pressure of the system and it unloads the water flow to by-pass when the gun trigger is released. The pressure gauge confirms the operating pressure of the system plus is a valuable indicator of damage or wear and tear in the unloader valve. The safety valve (or burst disc) is preset at a slightly higher pressure and is a back-up to the unloader valve and will release excess pressure in a controlled manner.

BASIC INSPECTION PROCEDURE FOR A MACHINE RETURNED FROM HIRE

Both the unloader valve and the safety valve should be set by a competent technician and should not be adjusted or interfered with by the hirer. ◘

When it comes to posting content it’s a case of quality over quantity – a customer would respond more to a well written post or an eye catching video, rather than a flood of posts that had little to no information that was relevant to them. Posting once a day on each channel and making sure that this is useful and engaging would drive positive results.

WHAT IS A GOOD STARTING POINT FOR SME’S WHO WANT TO DRIVE THEIR BUSINESS THROUGH SOCIAL CHANNELS? For starters, identifying clear goals around what you want to achieve on a digital platform is vital.
