EDITORIAL

From the President Tim Mikkelsen - Greetings form the kapiti coast

Conference 2015

A

couple of months have passed since the annual conference and trade show. Another fantastic event with a great mix of owner operators, large company representation and suppliers. Thank you to all those who attended to make this a highly successful event. This is the second year now we have followed the Australian conference model in which EWPANZ have had their AGM during the HIANZ conference. From a logistical and marketing perspective this makes so much sense as it just brings another dynamic to the conference and trade show with the additional delegates attending. Along with several other HIANZ members I attended the EWPANZ break out meeting where Work Safe NZ gave a very topical and engaging presentation on working from heights and in particular the use of log books in EWP’s. The gala dinner this year was very special as it was a great honour to award Bruce Wallace with an honorary membership to our association. Bruce’s involvement with the industry spans some 29 years when he commenced work at Hire Towers. In 1995 Bruce and his wife Dianne bought Glenn Innes Hire which they sold in June of this year. Both he and his wife have been loyal supporters of the Hire Association continuously creating lifelong friendships, and extending the hand of the Association to our overseas guests. Both Bruce and Dianne most certainly have been our very own goodwill ambassadors and we all thank you very much. The Hire Excellence Awards this year received a record number of entries. A total of seven companies entered which was so pleasing to see after only receiving two entries in 2014. Congratulations to all the entrants. What better way to acknowledge and celebrate excellence with in our industry than by recognising the following companies:

Bronze Award for Excellence Telelift New Zealand Ltd

It was a special occasion for the Ward family from Continental Event Hire. Not only did they celebrate 50 years in business this year, David and Joan Ward (founders of Continental) celebrated their 50th wedding anniversary. With membership on the rise, conference is the place where new members can attend workshops, receive industry updates, network and learn from industry veterans. The transfer of knowledge is crucial to ensure new members feel included and part of the association. We must continue to foster and nurture our new members to ensure the longevity of this organisation. Conference 2016 is already in the planning stages and I look forward to seeing you in Rotorua next August. The Saturday after conference I was in Wanganui to attend Harrison Hire Master’s gala dinner as they celebrated 40 years in business. The four hundred strong guest list included a myriad of friends, family and business acquaintances. An extremely well run event with plenty of hire memorabilia and founding hire association members to help celebrate this milestone. This is a solid family business that has transitioned to second generation ownership and has now been taken to the next level. Health and Safety at Work Act The Reform Bill has now passed in Parliament and the new law is called the Health and Safety at Work Act. This new law has a commencement date of the 4th of April 2016. As you will be aware HIANZ has partnered with OSH Box to deliver an industry specific H S system available for purchase. The key here

is the partnership between the two organisations. OSHBox do not see any value in selling a Health and Safety system without the back up and support to make it effective and workable in the work place and quite frankly neither do I. Angie William’s presentation at conference was informative, easy to understand and presented in a language we could all understand. Feedback from previous membership surveys and in my travels visiting Hire Companies around New Zealand, indicates an apparent lack of understanding and compliance around health and safety. There was also just a sense of “where do we start with all this.” The huge take up on the OSHBox system indicates to me that it was not a case of “we are not bothered about compliance” more of “where and how do we start the process.” The partnership with OSHBox means the association now has a health and safety resource available to the membership. I am pleased to inform you that OSHBoxes are now making their way to companies that purchased the system. Site Visits Waikato and Bay of Plenty In the 3rd week of August I set aside 2 days and along with Phil Tindle visited a number of hire companies in the Waikato and BOP. It was really good to get out amongst the member companies and take a look at how you do things and what works for your business. There are certainly some common themes / concerns around health and safety. However it is very encouraging to see the yellow pouches and log books in use on EWP’s, a sign to me that compliance in this area is been taken seriously. I know for some of the smaller operators it is hard to get to zone meetings and conference and you can feel somewhat isolated at times nevertheless I trust our visit bridged the gap somewhat. With winter behind us and busier times ahead for us all as we move on into spring I wish you all the best for the remainder of the year. Regards, Tim Mikkelsen.

LEGAL

New Health & Safety Laws Geoff Hardy - Auckland based Commercial Lawyer

My perspective

Y

ou should all be aware by now that the new Health and Safety at Work Act (the HSW Act”) has been passed by Parliament, and will come into force on 4 April 2016. The impetus for change came from the Christchurch earthquakes and the Pike River mining disaster, and the tragic loss of life, serious injuries and emotional trauma they resulted in. These and the official enquiries that followed them, persuaded the Government to adopt a brand new health and safety law modelled on the Australian legislation. Obviously this is not the first time we have had health and safety laws – we have had them for more than 100 years – but in the past people have not taken them seriously enough and they have not been enforced effectively. The HSW Act differs from the current Health and Safety in Employment Act 1992 (the “HSE Act”) in two important respects. First, the penalties will be significantly increased (to a maximum of 5 years imprisonment and a $600,000 fine for individuals, and a maximum $3m fine for companies). Secondly, much greater liability will be imposed on the directors and senior employees of the businesses concerned. Under the existing HSE Act and its Regulations, a business proprietor such as a hire company owner has a large number of specific health and safety duties. If you are an employer you have by far the most duties, but you also have a few duties if you are in charge of a workplace or work equipment, or if you sell or hire out work equipment, or you hire contractors, or you are selfemployed, or you are an employee. You do have to get to know your specific obligations, although in most cases they boil down to taking all practicable steps to ensure no-one is harmed by your work. Under the HSW Act the approach is much the same but the terminology is slightly different. There are roughly 16 separate duties you have to comply with, and these are imposed mostly on a “person conducting a business or undertaking” (a “PCBU”). All hire companies running their own business are covered by these rules, but

PAGE 6

- HIANZ HIRE & RENTAL OCTOBER 2015

employees and individual contractors are not, although they have their own set of requirements to comply with. The new duties (which are summarised below) are not significantly different from the existing ones, and most of them are capable of applying to a hire business. In general you only have to do what is “reasonably practicable”, but you cannot insure against your potential liability, and you cannot delegate or contract out of your duties, so there is no escaping them. Most importantly, all directors, partners, trading trustees, and senior managers of the business must exercise “due diligence” to ensure their business complies with its duties, and they will face heavy penalties if they don’t. What does due diligence involve? Well it includes taking reasonable steps to become (and remain) informed about health and safety issues, and to fully understand your own operations, hazards and risks. You have to ensure the business has (and uses) appropriate resources and processes to eliminate or minimise those risks, that it gathers information about incidents, hazards and risks, and that it acts on that information promptly. Finally, you have to ensure that your business has (and implements) processes for complying with its duties and obligations, and you have to verify your business does all the above things. The duties imposed on all PCBUs comprise the following: • Ensure the health and safety of all affected workers. • No-one else is put at risk from your work. • You have a risk-free work environment. • Your plant and structures are safe. • You have safe systems of work. • The safe use, handling & storage of plant, etc. • There are adequate facilities for the welfare of workers. • All necessary information, training, instruction or supervision is provided to protect from risks. • Worker health and conditions are monitored. • If you have management or control of a workplace, ensure it is largely risk-free. • If you have management or control of

fixtures, fittings, or plant, ensure they are largely risk-free. • If you design plant, substances or structures, ensure they are largely risk-free. • If you manufacture plant, substances or structures, ensure they are largely risk-free. • If you import plant, substances or structures, ensure they are largely risk-free. • If you supply plant, substances or structures, ensure they are largely risk-free. • If you install, construct or commission plant or structures, ensure they are largely risk-free. I wrote a textbook on OSH Law in 1998, when the HSE Act was relatively new. In the course of doing that I researched every case that had been decided on the Act since its introduction. What those cases demonstrated is that it is impossible for anyone in business to anticipate and avoid every risk, particularly when humans cut corners, as they typically do. So when a work-related accident or illness occurs, liability generally follows the event, because the very occurrence of the accident or illness pretty much demonstrates that a practicable step wasn’t taken. In fact, in approximately 75% of those cases the business owner pleaded guilty to the charge, even if the victim had gone to extraordinary lengths to get around all the safety precautions that had been put in place. After pleading guilty, the business owner then advanced reasons why a lower sentence was appropriate. But that is no reason to be defeatist. One of the major factors that does result in a lower sentence is the fact that you have been diligent about trying to manage the hazards in your workplace. And there are plenty of good-value consultants around to help you do that, including HIANZ’s preferred supplier Angie Williams of OSHbox. Just remember that despite all the hype, OSH law isn’t changing much, so it’s no reason to give up the hire business. 2015 CONFERENCE

Hire Conference delegates converge in Christchurch The 2015 Hire Industry Conference held 16/17 July attracted over 250 attendees. The event was held in Christchurch this year in an effort to help the conference & event market as the city is rebuilt.

H

osted by Kubota NZ, a preconference city tour attracted over 80 people with staff from CERA on board as guides. The tour also featured on site visits to a group of Christchurch hire companies before concluding with dinner at the all-new Continental Events complex in Rangiora. A wonderful start to conference! The conference is an industry event that is growing each year. The aim is to provide hire company delegates with good educational material and an overview of the Association’s current and future initiatives. A focus this year was on Health and Safety with guest speakers and related workshops to ensure that the delegates went away with a good understanding of what

PAGE 8

- HIANZ HIRE & RENTAL OCTOBER 2015

changes the new legislation will have on their businesses. GUEST SPEAKERS Opening guest speaker, Sam Johnson - one of NZ’s most inspiring young citizens. Farm boy turned disaster recovery guru, New Zealander of Year, Communicator of the Year, and a Sir Peter Blake Leadership Award recipient. Sam overviewed how positive change that can occur if technology at our fingertips is harnessed to build stronger community relationships. Many will recall, Sam initiated the team of young people who organised the 11,000 strong Student Volunteer Army following each of the major earthquakes in Christchurch. Very inspiring indeed! Closing speaker Billy Graham – a man

who grew up on the wrong side of the tracks and learned from a young age to have his dreams and fight for them. Billy’s presentation was inspiring and very enjoyable. Informative workshops were held during conference including – Westpac economic updates, focusing on how to Energize and Empower your team, Health & Safety in Hire, Legal & HR updates, and meetings for Party & Events and the EWP sector. Many thanks to James Oxenham (HRIA), Vadim Spice (Worksafe) and Nathan Maxwell (owner of CS Roofing Canterbury) for their presentations during the EWPA event/ workshops. Special thanks to the Association partner services group for your attendance & support. INDUSTRY AWARDS Industry Awards are always a highlight of the conference. The first award came during the association AGM when Tim Mikkelsen presented an appreciation award to retiring board member Andrew Messent of Hirepool, recognizing his commitment and input over the 6 years on the board. An appreciation award was also presented to Dave Single (EWP technical guru) for his assistance to the

EWPA New Zealand. The award was presented by Paul Robinson (EWPA Director) and received by James Oxenham in Dave’s absence. Seven companies entered the Hire Excellence Awards in 2015. This is the highest number of entries since the awards began back in 2008. The awards are a great way to recognise and showcase hire company outlets and teams who demonstrate excellence in various aspects of their business. Congratulations to award recipients; Continental Events Hire, Access

Solutions, Pacific Linen, Tauranga Hire, Telelift NZ, Stella Hire Invercargill and Kennard’s Albany. Highlight of the evening was the Honorary Membership bestowed on Bruce Wallace. Bruce recently sold his hire shop in Glenn Innes, ending a 29-year career in the industry and was totally surprised to receive the award. The criteria for this award - an individual who has made a contribution to the Association or the Hire Industry that in the opinion of the Board is significant. The board unanimously supported Bruce’s nomination. “Both Bruce and his wife Diane have been our very own goodwill ambassadors over the years, and we thank you very much for that,” stated Tim Mikkelsen who presented the award. OUR SPONSORS We are very grateful for the continued support of Youngman Richardson & Co Ltd as Principal Sponsors of the Association. The important partnership with sponsors also enables the

Association to move forward with important issues that face the industry, in particular earlier this year when the new EWP operator-training package was released. Conference Sponsors are an integrual ingredient, again special thanks to YRCO Ltd, to Gold Sponsors Skyjack for a great welcome function, ICIB & NZI for the guest speakers, Pacific Linen for the superb themeing at the Annual Awards Dinner and Kubota NZ for the pre-conference tour. Special thanks also to the many long serving and new suppliers to the hire industry that attended. This year’s event featured a trade show and outdoor equipment display supported by over 40 suppliers to the hire industry. Well supported by hire companies, and an excellent opportunity to update on new product & get hands on with equipment. HIGHLIGHTS & FEEDBACK Conference is the place to network & learn of what is happening with the industry! The participation and enthusiasm of members certainly made the Conference a very enjoyable and worthwhile event. Check out the highlights of Conference 2015 webpage – http://hianz.net.nz/page-1862129 and read about awards, download the workshop material, view photos, and hear what attendee’s had to say! NEXT YEAR We all look forward to August 2016, where you can expect a few surprises and loads of fun back in Rotorua. The HIANZ membership continues to experience growth and the Association strives to support all key segments of the industry. If you are interested in joining the Hire Industry Association of New Zealand, please refer to our website – www.hianz.net.nz or contact Phil Tindle on 07 575 2563. MAKINEX provides materials handling with some backbone Workplace injuries is an ongoing concern for a great number of companies where lifting is a core element of their operation.

TTHE BAR

he Makinex PHT-140 is a safer and easier alternative to loading with a forklift or tailgate loader and can be used just about anywhere including workshops, warehouses, distribution centres, factories and hire and rental outlets. Operated safely by one person the Makinex Powered Hand Truck is able to pick up most equipment

weighing under 140kg and can load them into vehicles such as vans, pick up trucks and SUV’s or to place gear and small loads on to bench tops. The unique design of the Makinex PHT-140 features a battery powered lift that makes it very easy to operate. The user who can lift or lower the handles and arm height by way of a

simple thumb switch that controls the lifting arm reach. This eliminates the awkward and potentially dangerous one and two person lifts and reduces the incidence of back and shoulder injuries. Without attachments the Makinex PHT-140 weighs 40kg and is 2000mm

in length, 740mm wide and 1930mm high. A major benefit is that it can be folded completely flat for easy transport and storage. The Makinex can be used with either a hook or fork attachment with maximum lifts heights of 1.9m and 1.55m respectively. The power for the lift is provided via a 12V 25Amp linear actuator that

after only a 3 hour recharge gives approx. 50 lift cycles per charge. Introduced in late 2013 the Makinex PHT-140 has quickly gained market acceptance and last year received the Best New Products Award by the Australian Hire and

Rental industry. More importantly companies using the PHT-140 are reporting a 50% reduction in lost time injuries. “Makinex are always looking to make improvements and have already added a strap frame and glass sucker attachment to the original PHT-140 design so that it can broaden its utilisation across a wider range of applications.” says Youngman Richardson Sales and Marketing Director, Ed Richardson. “Makinex has a reputation for innovation and has other safety inspired products including a Jackhammer Trolley and Dual Pressure washer in its range. Makinex are committed to new innovations that help people do their job, faster, safer and easier,” says Ed.

JLG technicians are also well equipped in the field, travelling in a growing fleet of specialised JLG Service Vehicles featuring advanced wireless In-Van-Technology which gives them real-time access to equipment service records and job status, parts ordering, and up-to-date service histories that help optimise service efficiencies. As Rob Branch, JLG’s Director of Ground Support Australia & NZ, explained, expansion into regional Australia to provide better coverage and support for customers has been a key JLG initiative. “Ground Support is all about JLG being responsive to customer needs, wherever our customers may be, so we have been focusing on infrastructure to ensure we are where our customers need us to be, when they need us, with the quality service, parts and support they require.”

Technology is also playing a large part in JLG’s commitment to bringing superior service and support to customers, complementing the Ground Support field initiatives and increased workshop capabilities JLG has been introducing. One example is Online Express, JLG’s convenient online parts ordering system which offers a range of features to benefit customers and make parts ordering much faster and easier. By registering with Online Express and downloading the Online Express app to smart phones and tablets, or logging in on their computer, customers can view interactive parts manuals and machine specifications 24/7, look at parts availability and pricing and conveniently order the parts they need for prompt delivery anywhere in Australia and New Zealand. Another clear advantage of choosing JLG access equipment is JLG’s ClearSky™

system which allows customers to monitor the location, status and service requirements of equipment in the field. Designed to maximise equipment returns while minimising downtime and expenses, ClearSky combines GPS technology with data reporting via the mobile phone network in an easily accessible web-based management system that provides real-time equipment position and operational reporting. This includes fault reporting alerts via email that allow online diagnosis and the dispatch of service personnel with the right parts to get the machine back to work quickly. With apps to suit Apple, Blackberry and Android smartphones and devices, ClearSky lets customers access critical information on-the-move and also offers preventative maintenance alerts, geofencing and the ability to map assets locally, regionally or nationally. In addition to these many Ground Support solutions, JLG also offers outstanding back-up through its National Technical Support Centre which delivers expert technical information and advice to customers and service technicians across Australia and New Zealand. Customers can use JLG technical support for a range of purposes, from simple enquiries regarding machine specifications or characteristics to in-depth fault finding step-by-step over the phone. Harrison’s Hiremaster celebrates 40 years The official celebrations may be over but the party continues for Harrison’s Hiremaster in Wanganui.

T

he family owned business recently marked its 40 years of operation with a weekend of festivities which included a staff function, an open day and a formal black tie dinner.

and DIY enthusiasts alike. And, we will continue to invest in good product to ensure that our customers have access to the best and safest gear possible,” says Grant Harrison.

Whilst the official celebrations are now well and truly over Harrison Hiremaster’s loyal customers have continued to benefit with an ongoing campaign of special promotions and prizes thanks to the generosity of company’s many suppliers.

Harrison’s Hiremaster has always enjoyed a close relationship with the local community and through sponsorships and donations support a variety of sports teams, the building, plumbing and associated industries, Hospice and the Cancer Society. Harrison’s Hiremaster continues to have a strong family focus and with Grant and Karine’s children Renee, Rebecca and Blair anything is possible.

Prior to getting into the hire business the Harrison family owned a number of grocery stores in the area. However Bruce and Ann Harrison, who managed the Aromoho one decided in 1975 that they needed a new challenge. It came about when they were renovating the old family villa in Castlecliff. Bruce suddenly realised that he needed a concrete mixer and a skill saw. “All the things I didn’t own,” remembers Bruce. “I said to Ann that I reckoned there was an opening for a hire centre in Wanganui.” And so it began. It was a gamble that paid off with three generations of the Harrison clan having worked in the business. Bruce and Ann’s son, Grant who is the current owner of the business along with his wife Karine says that Harrison’s Hiremaster has stood the test of time by simply maintaining a high level of customer service.

itch Witch is renowned worldwide as the ‘go to’ brand for rugged and reliable underground construction equipment. Backed by heritage and technical innovation in equal measure, Ditch Witch manufactures a world-leading range of directional drills, trenchless, trencher, electronic and compact utility equipment solutions. And here in New Zealand, Ditch Witch caters to the hire industry with a popular and expanding range of tools and machinery. “We’ve been supporting the local hire industry for some time now,” says Ditch Witch New Zealand general manager, John Grant. “As the Ditch Witch range offering has grown, so too has the need for us to ensure our hire customers have the ability to secure the right tools for an ever-wider audience. “Our versatile, heavy-duty RT12, RT16, RT20 and RT24 walk-behind trenchers and our compact, userfriendly RT30 ride-on trencher have proven popular with hire companies. But the options for hire entities to ‘go orange’ don’t end here.” As seen in the Ditch Witch New Zealand display area at the recent HIANZ conference and trade show in Christchurch, there is a wide array of machines and tools available to help hire company customers achieve their project goals. Ditch Witch SK755 mini skidsteers add a huge amount of practicality to a hire yard within a compact

footprint, thanks to the diverse array of attachments these great machine can handle. Similarly the Ditch Witch RT45 mini tractor offers 42.2hp and robust attachments such as a vibratory plow, back hoe, saw and multiple trencher options. Ditch Witch’s range of accurate electronic utility and cable locator equipment for civil works teams, electricians, plumbers and other contractors offer ‘next level’ specialist ability; true world-class technology that helps hire

customers eliminate risk when digging underground. And once the contractor has an accurate view of what’s beneath the surface, Ditch Witch New Zealand provides the industry with Hammerhead trenchless products for pipe bursting, pipe ramming and piercing tools for new service installation. These trusted, hardwearing products provide long life for hire operators and will work consistently for customers in even the most challenging sub-surface conditions. John says that with the increase in

options from within the Ditch Witch range of underground construction equipment, the opportunity for hire operators to diversify their product offering has never been better. By bundling together an accurate Ditch Witch Utiliguard utilities locator with a Ditch Witch RT20 walk-behind trencher, for example, the hire company has the ability to provide their customers with ‘one stop shop’ assuredness for the task ahead. Elsewhere, local councils and other stakeholders are increasingly looking for ground works in urban areas to be completed in both a timely and tidy manner. For the fast and efficient exposing of utility lines, posthole digging and other sub-surface tasks, the innovative trailer-mounted Ditch Witch FX20 vacuum excavator provides quick and clean excavation for civil customers engaging in smaller scale commercial and residential ground works; minimal mess and maximum efficiency is guaranteed. Ditch Witch New Zealand has a range of hardware for hire entities of all sizes. And with the ability to offer detailed technical support anywhere in the country, customers are never too far away from expert assistance if it’s needed. “Ditch Witch New Zealand boasts a comprehensive after-sales service programme for all hire customers; from our extended warranty offering through to customised build and installation options, we have the hire industry covered,” concludes John Grant. “Our interest in an entity’s requirements doesn’t end when a customer invests in Ditch Witch equipment; it’s actually the beginning of our partnership with the hire operator. And we’re committed to ensuring they get the best from that partnership with us.” HIANZ HIRE & RENTAL OCTOBER 2015 -

HIANZ EVOLUTION

The evolution of the NZ Hire Association and the friendly bunch of characters who made it happen. I write this as I suffer mildly from “hire overdose” as I have just attended the 40th year celebrations of the Harrison family Hiremaster Hire Centre in Wanganui.

A

mong the 420 odd guests were some dozen or so who had started hire centres from around 1968 onwards. Before that period there were only a few hire centres around NZ and two larger companies such as the Cable Price owned Air Hire Centre based in Auckland and Hire Pool based in Wellington. Each had a few branches or franchisees at that time. Two other guests at the Harrison function were Bob Youngman and Tim Richardson who before this period were already supplying hire centres from a company in Wellington but had left that employ and started Youngman Richardson based in Auckland. Among the great speakers at the Harrison function were the now retired Bruce Harrison who started the company with his wife Ann in 1975, and Bob Youngman. Both spoke about the great friendships that were formed in those early days among those early operators and how these friendships have lasted until today. My own start in this industry was in 1970. I had returned to NZ with my Irish wife and no employment so was looking for something other than working on cars which was all that I knew at that time. Starting in New Plymouth in the late 1950’s I spent seven years in a Ford franchise before setting out for England in early 1965 with five other lads about

PAGE 24

- HIANZ HIRE & RENTAL OCTOBER 2015

my own age at the time (21). Shortly after arrival I started work for Jack Brabham building his production F3 racing cars before leaving and travelling around Europe as a racing mechanic with two drivers in 1965 and 1966 before a year in Formula 2 as Brabham’s mechanic in 1967. That was followed in 1968 and ’69 as mechanic to Jackie Stewart helping him to win the World F1 championship in 1969 before returning to NZ. (If interested you can read all about that period, and the rest of my life, in my autobiography Paddock to Podium). On arrival it was suggested by a brother and a friend that I start a hire centre and as I knew nothing of the industry I took a tour around the North Island with my wife talking to and learning from operators in Rotorua, Auckland, Palmerston North and Wellington. At that time there was no hire centre in New Plymouth so I had a lot to learn but all the people I spoke to were helpful and gave me hire price lists and supplier contact names. A couple were a little reluctant at first but soon warmed to the job of helping me when they realised I would be in another city, so therefore no opposition to them. Actually that was the very aspect that quickly became the trademark of the hire industry in NZ. Helping each other get ‘up to speed.’

When I started New Plymouth Hire Centre in mid 1970, along with two silent partners, we saw steady growth until 1975 when the Muldoon Government announced their ‘Think Big’ projects which saw several large oil and gas related projects developed in Taranaki to use the gas from the large fields that had been found on and off-shore in the province. This meant a very large upswing in business for machinery hire and as we were the only hire centre between Te Kuiti and Wanganui we had to gear up very quickly. Three new shareholders were added and each was a working shareholder. They were Gordon Dale from the quarrying and concrete industry along with Russell Miscall and Ray ‘Baldy’ Christiansen who were motor mechanics like myself. I guess it was rather unique to have four working shareholders in the same company but it worked well and we grew rapidly to have 25 staff in the machinery hire division along with a further 35 in four other companies we added to our portfolio in New Plymouth supplying such things as wire rope, chain and canvas products in the area. Around 1975 the hire company became an agent for Air Hire Centre which meant we could call on the vast fleet of gear they owned to supplement our own. We also received great help form Colin Crooks who was the CEO of Air Hire Centre at the time. The Think Big projects took around six years to develop and they kept us extremely busy but we still found time to work on other projects as well. One that Gordon Dale had in mind was to organise the formation of a national body formed from delegates from the forty or more hire centres that were by that time operating around NZ. He had travelled to Brisbane with Colin Crooks

of AHC and Noel Weeks of Hire Pool to a national conference of Australian hire companies. They all agreed that the time was ripe for a NZ association and that Gordon should be the one to do all the work! Colin and Noel both felt that if they were seen to be leading in the formation with their big companies the small companies would not be interested in joining. So Gordon wrote to and phoned all the hire centres and invited them to a meeting in New Plymouth during the winter of 1977. The response to Gordon was overwhelming, including those big companies. A large group of people arrived along with various trade people as well that Gordon had invited as it was felt they had a major part to play in the solid and structured growth of the industry in the years to follow. They set up displays of their products in the grounds of the hotel and that format was to set the stage for the typical annual conferences which followed. The first annual general meeting of the new association was held in Rotorua a year later and the association was incorporated that year as well. It was especially fortunate for me that the trade people had been invited to attend that inaugural meeting. Having done all the hard work in getting all the delegates to New Plymouth Gordon Dale then had the misfortune to be admitted to hospital just two days before the event. I then became the mug who tried to chair the meeting and quite frankly I was way out of my depth at the head table in front of about 120 keen and eager to learn attendees. I very quickly found myself over my depth when tricky questions were raised but seemingly divine intervention happened in the form of a booming voice from the back of the hall. In a very polite way Bob Youngman stood and asked me - the chairman - if I would accept some help from him in chairing the meeting? My answer was something like “how quickly can you get up here to the head table?” Bob saved the day and I have been grateful to him ever since. The association was duly formed and the country divided up into three zones which I believe remain in place today. South Island was one and the North Island split in two across from above Gisborne to above New Plymouth but below Taupo. The zones had their own meetings which were every three months in our Zone two. Our meetings became very productive with various guest speakers and motivational experts along with displays and demonstrations of new equipment suitable for the industry. I must tell a story at this point about one meeting when one of the speakers gave us a motivational talk about how

to increase our cash flow. (I must admit I used to call them ‘wind up merchants’) This particular speaker asked for questions after his one hour presentation when a certain member who shall remain nameless, (he operated in Palmerston North) stood and said, “If I do everything that you have suggested to improve my cash flow, I am going to have to get a water cooled cash register!” The comment from the speaker was not recorded. Although almost all of the operators in Zone two at that time have since retired we have nearly all remained close friends and get together from time to time to have a drink and reminisce. We talk fondly about the great times we had growing our businesses and learning from each other during those great first few years from the early 1970’s. During the latter 1970’s there was rapid growth in ‘Party Hire’ and these new operations were sometimes standalone but usually started as a division of the machinery hire centres although a couple of large operators had started earlier than even some machinery companies in their respective city’s. Colin Taylor in Wellington was a case in point as they had been in business from the late 1960’s I believe. Colin became a motivational leader in his own right and introduced the rest of us learners into such hire items as marquees and also the sale of party requirements such as paper plates and helium balloons. He even showed us how to promote that type of item along with being the leader in setting up what was to be the Hiremaster franchise which is still operating in some centres today. Through combining our resources and funds we were able to promote ourselves on Television which independently would not have been possible. Gordon Dale was instrumental in

starting staff training programs and these became very successful after some early hick-ups were ironed out. Likewise some of the trade suppliers set up training in such things as safe erection of large marques and this became helpful when the “OSH” of the time began to question things and some local bodies wanted permits issued before marquees could be erected. In Gordon’s own words - “Some of the Hire Centres were very lax in showing customers the safe use and care of equipment. We got together with the Labour Department, Insurers and Suppliers and introduced safety pamphlets on the safe use of equipment.” There were always safety issues but sometimes they were funny! I recall one event when I erected a large marque on a tar seal yard and a tornado came through and flattened it over the top of several new cars that were on display. One of the centre poles fell straight across the bonnet of a brand new Police Patrol car! The recent event in Wanganui enabled several of us to renew our friendships and many promises ‘to remain in touch’ were exchanged. Many of us old-timers already meet in various locations about every 18 months although some of us are showing our age when it comes to travel. As mentioned, some of the early operators have been fortunate in being able to bring in the next generation of their families like the Harrisons have. That wasn’t the case with me but then our hire centre was not a family business. However I have recently found a relatively new hire centre that has opened in New Plymouth and have been able to help them with some of the tips that we learned way back in the depths of history - the 1970’s - they were great years. A

nother step in the rebuild of Christchurch: the temporary production kitchen marquee at College House at Canterbury University has come down having been in place three and a half years longer than originally anticipated. Continental Event Hire was approached mid-March 2011 to supply a marquee for the large boarding facility after building inspectors red stickered the existing

building following the Canterbury earthquakes. Hires manager Andy Youngman recalls the meeting was on a Tuesday and they needed the operating kitchen completed fitted out by the following Monday: “It was pretty crazy but we did it.” It was estimated the University would need the marquee for around 12 months. “Prior to the earthquakes a hire of four weeks was considered ‘long term’

so we were pretty impressed! But the eventual actual hire of four years and five months might be something of a record.” Once the 12 x 20m Alispan marquee is dismantled the whole set-up including the kitchen equipment is going to Invercargill for similar use. JLG launches the world’s first four wheel drive hybrid boom JLG Industries launches in the Australasian region at HIRE 15 in Adelaide the world’s first true four wheel electric drive hybrid boom, the H340AJ.

C

ombing diesel- and electricpowered system, the H340AJ provides the power and durability of a diesel-powered machine with the flexibility to work indoors or out. Electric power is stored in eight 12V 100AH AGM batteries, each requiring less recharging time than lead acid batteries. It relies on an environmentally friendly, Tier 4 dieselpowered generator for recharging. The JLG H340AJ has four independent

electric brushless AC-drive motors that provide unprecedented rough terrain performance. This four-wheel drive hybrid boom can operate in harsh environments, including muddy and rugged terrain. The variable-speed motors operate smoothly and quietly, and feature proportional control. HEALTH & SAFETY

HIANZ announces health & safety legislation partnership F

eedback from HIANZ members indicated an apparent lack of understanding around health and safety. There was also a hint of “where do we start with all this”. With this in mind, HIANZ cast the net to ascertain what options might be available to potentially develop a basic H&S system that all members access and build upon depending on the specifics of their businesses. No longer will the responsibility for Safety in the workplace, just fall on the ‘Employer’. The new legislation shares various duties on Persons Conducting a Business or Undertaking (PCBU), Officers, Workers, and Others (including Contractors and Volunteers). In essence, this means no one can ‘opt out’ of Health and Safety, put their hands in the air and say “it’s not my problem”. Safety is everyone’s responsibility. The primary duty to ensure Health and Safety sits with the PCBU – as the person or business in the best position to control risks in the workplace. The PCBU is responsible for the Health and Safety of anyone working for them (including Contractors, Volunteer Workers and Employees) as well as those within the vicinity of the work they are carrying out or by using the products and services they provide (including Customers and Visitors). Earlier this year, following market research, OSHbox Health and Safety consultants and HIANZ joined forces to develop a hire industry-specific Health and Safety system exclusively for HIANZ members. We had to ensure the system was specific to the Hire Industry, easily customised to each business, cost-effective and easy to implement and manage. The system was released to members at the national Conference, held in Christchurch in July. The uptake was overwhelming with 50% of hire centres in attendance signing up during or immediately following the event. Hire Industry Association President, Tim Mikkelsen says “The huge take

New Zealand businesses have known for some time now of the pending changes to H&S here in New Zealand. up on the OSHBox system indicates to me that it was not a case of “we are not bothered about compliance” but more like “where and how do we start the process”. The OSHBox Health & Safety presentation at our National conference was informative, easy to understand and presented in a language we could all understand.” The Reform Bill has now passed in Parliament and the new law is called the Health and Safety at Work Act. This new law will come into force on the 4th of April 2016.

OSHbox has committed to providing HIANZ and their members with ongoing updates, information, guidance and support via roadshows and seminars, to ensure the members are well informed and have the tools they need to make their workplace safe and consequently ensure the industry is recognised in the future, for its commitment to Health and Safety. For more information on changes to the NZ Health and Safety legislation visit our website – www.hianz.net.nz

PARTNER PROFILES

HIANZ Partner Services To be an effective association it is essential that we are able to call upon people outside our core business to provide essential services that will not only strengthen our operation but can also assist individual members with theirs.

H

IANZ is no different to anyone else and in this respect we have developed partnerships with a number of professionals who are now providing us with additional experience and skills to ensure we continue to be a strong voice for the hire industry. In this issue we profile four companies that are currently supplying partner services to HIANZ and who can be contacted directly by individual members who might like to take advantage in their expertise. MADISON HARDY- SOLICITORS How our company became involved in the hire industry and partnering the HIANZ. Geoff Hardy formed Madison Hardy in 1998. Prior to that Geoff had spent 20 years in very large firms, the last 10 years of which were as a commercial law partner at Simpson Grierson. He left that firm at the end of 1994 and for the next two years he studied for an MBA at Auckland University. He set up Madison Hardy from a standing start with absolutely no clients, and has steadily grown the practice since then. This year the firm is a finalist in the New Zealand Law Awards in three of the 22 categories. Mark Sinclair is an old friend of Geoff’s, and while Mark was CEO of HIANZ, he commissioned Geoff to write the Association’s constitution. Geoff has remained the Association’s solicitor ever since, and has developed a special interest in hire law. He now has three lawyers working for him and they specialise in looking after the needs of businesses across all industry sectors.

What we provide to members: Madison Hardy helps HIANZ out on tricky legal issues from time to time. In addition to that, the firm provides a free legal helpline service to all HIANZ members, from Kaitaia to Bluff. You can get advice on any business-related legal issue, any time during working hours, provided it can be done within 20 minutes and doesn’t involve reviewing documents or providing written advice. Although most members already have their own lawyers, it’s sometimes helpful to get a second opinion, especially if it relates to a specialist area that might be outside your regular lawyer’s expertise.

How you can get in touch? Madison Hardy has four lawyers available to take your calls, and these are the numbers you can reach them on: Geoff Hardy 09 379 0700 Simona Krsteva 09 969 5963 Meika McHardy 09 970 9568 Sarah Anderson 09 970 9567 ICIB INSURANCE BROKERS How our company became involved in the hire industry and partnering the HIANZ. In 1995, the insurance industry was very averse to providing insurances to the hire industry and to a certain extent still does today. Insurance was not available once the hire plant left the hire centre and there were no replacement cover for hire plant. It was extremely difficult to buy insurance to cover marquee damage from inclement weather. At that time the insurance industry perception of

the risk on the hire industry was very much based on anecdotal information rather than statistical information. ICIB believed that with the right statistical information, the insurance industry would be more receptive in insuring the hire industry. In conjunction with the HIANZ, a feasibility study was put in place and this involved collating information from those hire companies prepared to participate. It is interesting to note some of those companies who participated in that study are still around today with their insurance programme arranged by ICIB. Today ICIB manages the insurance programme of more than 50 hire companies. In fact with the passage of time, and for some, we are now dealing with the second generation who have taken over their family business. I am still in contact with some who had retired and continue to look after their insurance needs long after their retirement. What we provide to members: As a result of 1995 feasibility study and the combined efforts of HIANZ and ICIB we are now able to offer a hire industry insurance policy that covers: • Non Mobile Hire Plant for replacement Value. • Mobile Plant and Motor Vehicle for Replacement Value less than 12 months old. • Covers whilst out on hire including burglary and theft. • Covers theft by the hirer subjected to adequate ID obtained from time of hire. • Covers marquee damage from inclement weather.

ICIB supports HIANZ by dealing exclusively with members and encourages non-member hire companies to join the association. This partnership has yielded immense benefits for both parties over the years. How you can get in touch? Enquiries to David Chow Mobile 0274 826832 Email: davidc@icib.co.nz Web: www.icib.co.nz

OSHBOX-HEALTH & SAFETY CONSULTANTS How our company became involved in the hire industry and partnering the HIANZ. Early in 2015, OSHbox Health and Safety consultants approached HIANZ in regards to a gap in the industry that they had noticed around Health and Safety systems. In 2014, OSHbox had worked with two small Hire Centres writing customised Health and Safety systems for their businesses and realised that many of the small to medium businesses in the Hire Industry needed the tools to comply – an area that HIANZ had already started investigating. By mid-2015, a partnership between OSHbox and HIANZ had formed and an industry-specific Health and Safety system was developed exclusively for HIANZ members. Both OSHbox and HIANZ were determined to ensure the system was specific to the Hire Industry, easily customised to each business, cost-effective and easy to implement and management. The HIANZ-OSHbox has provided all that and more. At the 2015 HIANZ conference, OSHbox ran a workshop on the new Health and Safety legislation and released the HIANZ-OSHbox system to members. The feedback from delegates was overwhelming, the turnout to the workshop huge and the feedback ‘fantastic’! The uptake

during and following conference was close to 50% of the hire centres who attended, and the enquiries are continuing to flood in. The first round of HIANZ-OSHbox systems have been rolled out and the OSHbox team are busy talking members through the implementation. What we provide to members: For both OSHbox and HIANZ, implementation is not where the support ends. OSHbox has committed to providing HIANZ and their members with ongoing updates, information, guidance and support with roadshows and seminars to ensure the HIANZ members are well informed and have the tools they need to make their workplace safe and consequently ensure the industry is recognised in the future, for its commitment to Health and Safety.

Employment Lawyers is a boutique

law firm specialising exclusively in employment and human resources law as well as acting for employment clients throughout New Zealand. Having successfully operated a national employment helpline for another member based association since 2008 we were approached to provide a similar service to HIANZ members. Employment Lawyers has put this into place and have operating the employment helpline for HIANZ members since October 2014.

What we provide to members: HIANZ members can contact directly either Danny Jacobson or Trudy Marshall, partners of Employment Lawyers about any employment issue of query. The helpline allows for up to a 15-minute phone call to receive advice verbally. This service does not include reviewing documents or providing advice in writing but members are welcome to engage Employment Lawyers directly for more detailed assistance.
