From the President TIM MIKKELSEN GREETINGS FROM THE KAPITI COAST As we come to the end of a brilliant summer, I hope your businesses benefited from a flurry of activity the fine weather bestowed upon us. I anticipate another productive year and am pleased to provide you with an update of key events and initiatives being undertaken by the Association. This year the Hire Industry Association of New Zealand celebrates its 40th anniversary. What better way to mark this significant milestone than by holding a reunion to reconnect past and present members at this year’s 2018 conference. It will give us all the opportunity to meet up with some founding members and associates that have been part of the hire industry over the past 40 years. Conference is shaping up to be a wonderful event. Guest speakers include Gilbert Enoka (All Blacks Manager) and Sir Graham Henry – no introduction needed there. We have invited members from the Global Rental Alliance, and along with our loyal Australian supporters we are confident of a respectable international contingent. Supplier interest is very strong this year with trade display booths almost fully booked. We have a dedicated website for conference 2018 which can be accessed through the HIANZ website. Here you will find all the information you need to complete your registration and book accommodation. Check it out – www.hireconference.nz The HIANZ board have invested an enormous amount of time and energy into the strategic direction of the Association. Amongst other initiatives we are constantly looking at ways to increase membership, member benefits and grow a financially robust portfolio.

Now in our 40th year it is equally important to reflect and appreciate the commitment and hard work of those who have contributed to the success of the Association, and subsequently the Hire Industry as a whole. That is why as part of conference 2018 we are encouraging past members of HIANZ to register for all or part of the conference. Past members and delegates are invited to register for a reunion luncheon being held on July 4 at Conference. This will be an occasion for those involved to catch up with old friends, acknowledge the past and look to the future of our industry. If you are interested in attending the luncheon or are still in contact with past members who would like to attend, please go to the conference website and register. Membership diversity and growth is always a focus of the board. We have recently worked alongside the NZFIA (New Zealand Forklift Industry Association) to forge an alliance so we can better represent and support the businesses within this industry sector. The involvement of the NZFIA will increase the collective voice of the industry, further standardise industry best practices and bring efficiencies to both organisations in respect of HR and administrative resources. Other key initiatives We are currently undertaking a planned upgrade to the HIANZ website, development of “Instruction for Use library” and intentions to lobby for change to the Personal Properties Securities Act to replicate what was achieved recently in Australia. We look forward to updating members with progress. A presentation highlighting our work will also be made at the AGM. I am looking forward to catching up with as many of you as possible in July. Kind Regards,

COVER STORY

YOUNGMAN RICHARDSON AND GENIE APPOINTED PRINCIPAL HIANZ SPONSORS HIANZ has appointed Youngman Richardson & Co Ltd in conjunction with Genie Industries as its principal sponsors for the next three years. “YOUNGMAN RICHARDSON has a long history with the association spanning four decades and Genie Industries have been regular participants in association activities. Now, with the additional support from Genie Industries it is great to welcome them both as major supporters,” says HIANZ Chief Executive Phil Tindle. “Given the fact we will be celebrating 40 years as an association in 2018 it is entirely appropriate that as a founding member Youngman Richardson along with Genie Industries will be at the forefront of many of the activities planned over the next 12 months.”

“Youngman Richardson & Co Ltd and Genie Industries are equally delighted to remain involved with HIANZ,” says General Manager, Ed Richardson. “It is particularly important for Youngman Richardson & Co Ltd because being Principal Sponsor of the association has assisted us for many years in maintaining a high profile with the membership,” says Ed.

According to Phil Tindle, the highlight of the year is the Annual Conference which brings members together and involves an extensive programme of workshops, trade shows, presentations and networking opportunities. This will culminate in a well-attended Youngman Richardson and Genie Industries sponsored Hire Excellence Awards Black Tie Dinner on the final evening. “It has been a real privilege to work with the Youngman Richardson team over the past 12 years,” says Phil Tindle. “Youngman Richardson & Co Limited has grown considerably during that time, as has the Hire Industry. The mutual successes are the result of the way we all work together and now with the additional support from Genie Industries will help to stimulate, grow and enhance this dynamic industry sector even further,” he said. ◘

ITH THE NEW AGE of technology and increased demand on businesses to be compliant and fulfil the duties related to the supply of plant and equipment, there has been an increased demand for a national association to represent and advocate for the wider forklift industry within New Zealand. “We are very excited to announce the establishment of the New Zealand Forklift Industry Association (NZFIA), a peak industry body for the forklift sector”, says Association President Rhys Walter.

The NZFIA held an open industry meeting at the Sudima Auckland Airport on the 10th April, with the express intention of presenting a new

T

HE 1970’S REPRESENTED a period of change in world history and it was against this backdrop that the Hire Industry Association of New Zealand (HIANZ) was born. Forty years ago, a group of interested parties, which included independent hire owners and suppliers, gathered in New Plymouth to form what is now one of the more influential trade groups within New Zealand. Conference 2018 will take place in Rotorua, 3-5th July 2018. Looking back over the past 40 years there are some fundamentals that have been vital to the success of businesses within the industry. Our people, relationships with customers and communications are some of these. The focus this year, is to reflect on the importance of such key aspects and project how industry will need to adjust in order to successfully retain them. Industry

opportunities consistent with Industry Conferences. This year also celebrates the Associations 40th birthday and a special reunion function is being held to reconnect past and present members. We look forward to welcoming both new and existing members alongside those who have

Delegates will learn from the best in the country and enjoy excellent company and entertainment as we celebrate our 40th year in style! Networking opportunities are, by far, one of the most significant benefits! When you attend an industry conference, you get the opportunity to connect with your industry peers, initiate discussions, ask questions, compare key areas of your business with others, learn of business trends, industry issues, great ideas and the list goes on. The trade show is an integral component of the conference, where industry suppliers use this time to promote their products and services to hire companies. Hire companies use this time to check out new equipment options, new product lines, enhancements to existing products and services on offer that will compliment or grow their business. This annual event has always been well supported by Hire Companies and Industry Suppliers, held in an environment where members can openly communicate between each other and to the association. Open dialogue is encouraged to ensure the Hire Industry Association supports and protects the interests of all members. The level of participation and enthusiasm certainly makes the conference a very enjoyable and worthwhile event. The event annually continues to attract a greater attendance, and this year we are very pleased to welcome Continued

Attendee Feedback Here’s what some delegates had to say about last year’s Conference... “I have been attending the HIANZ conference and trade show for thirty years and I believe I learn something new every year. Furthermore, the contacts made are invaluable. I am sure that the event is of particular value to owner operated businesses.” “We are in a small town and can sometimes be a bit isolated. Getting out and meeting other people and hearing how they do things is very valuable.” “As we were new to the conference I was unsure what to expect. The benefit to attending was the opportunity to strengthen relationships with existing suppliers and meet with possible new suppliers. In addition, the opportunity to mix with other hire company owners was a great opportunity at the conference.” “As a supplier it is all about visibility and ensuring the members are aware of the product offering that they have access to throughout the year” “A great opportunity to “chew the fat” with other operators in our industry. Invaluable!”

HIANZ HISTORY 1978-2018

BLAST FROM THE PAST

Our first conference programme

HOPPT TO IT! THERE’S A NEW KID IN TOWN New Zealand’s construction equipment market may be small compared to many overseas economies, but it is no less competitive. And things just got hotter.

N

EW ZEALAND EQUIPMENT GROUP (NZEG), a Hunter Powell Investments company, have won the HOPPT brand of light construction equipment.

Group CEO, Paula Evans says, “The HOPPT brand is synonymous with quality and meets our vision of suppling globally proven equipment to New Zealand’s construction and contracting industry”. NZEG will supply the full range of HOPPT construction equipment, which is synergistic with their existing Takeuchi construction machinery brand, and comprises reversal plate compacters and vibration rollers, terrain loaders, trowel machines and concrete vibrators, and submersible pumps and lighting towers.

Australian Managing Director, Peter Evans, says, “We are delighted to have successfully concluded negotiations with the New Zealand Equipment Group and it is our intention to provide them with the full resources of HOPPT Australia, backed up by the HOPPT worldwide network spanning some 90 countries, to ensure Kiwi customers are well supported”. “The HOPPT range of ground engaging products works well with Takeuchi excavators and Tracked Load Carriers and we anticipate New Zealand customers to request PAGE 16

bundled orders, like a 6-ton excavator together with plate compactors and concrete products, as they do in Australia”, say Evans. Since its acquisition of New Zealand Equipment Group in October last year, Hunter Powell Investments have moved quickly to reposition the business by re-establishing their national service and support network and introducing a range of new internal systems. “The Takeuchi brand is synonymous with quality and is beloved by New Zealand contractors “, says Group Chairman, Tenby Powell. “It was therefore important that brand extensions are of a high manufactured quality and, at this stage, synergistic with Takeuchi products. We identified HOPPT as exactly that and we look forward to growing a cadre of specialist staff around this brand”. “Competition is a healthy thing and New Zealanders like choice”, says Powell. “We look forward to offering them alternatives in product and service, both at a high level of quality” ◘

INSURANCE

BUSINESS RISKS – TOP 5 INSURABLE BUSINESS RISKS FACING HIRE INDUSTRY Each year a number of international companies undertake surveys of various businesses across a number of industry sectors to answer the question of “what risks are impacting your business/sector?”, however we are yet to source a report focused solely on the Hire & Rental Industry.

W

E HAVE THEREFORE looked at this in an alternative way firstly showing you the top risks facing New Zealand businesses and then the insurable business risks ICB have identified based on our +20years experience of working with HIANZ members, let’s call it ICIB’s top risks facing HIANZ members. When looking at New Zealand in totality the world economic forum report found the top five perceived risks by local respondents were: • • • • •

Natural catastrophe Extreme weather events Large cyber attacks Assets bubbles Urban planning

If we were then to focus on HIANZ members and the insurable business

PAGE 22

- HIANZ HIRE & RENTAL 2018

risks we have observed they would be as follows: • Liability for damage to other people’s property from your products • Health & safety regulation compliance, especially when access equipment is involved • Natural disaster/extreme weather events • Talent attraction and retention • Cyber risk fraud Whilst the two lists differ in a couple of areas there are risks which will impact HIANZ members equally as much as those conducting business in NZ irrespective for the sector. Interestingly in 1995, when ICIB established the HIANZ insurance facility, we recognised that the hire industry was not well served, with limited coverage

suited to its business risks. We identified then the following risks: • Exposures once outside hire operator’s premises. • Replacement insurance for hire plant • Inclement perils for marquees and structures • And from there the following coverage was established within the HIANZ insurance facility: • Cover anywhere in New Zealand. • Replacement value for all nonmobile plant regardless of age. • Cover for Inclement perils for marquees and structures • Cover for cross hire amongst the members of HIANZ Inc. These covers remain available today and we have improved it recently with the introduction of replacement value of motor vehicles and mobile plant up to a certain age. ICIB’s HIANZ Insurance facility is the only insurance policy in the NZ market that has consistently provided this level of comprehensive cover since 1996, because we understand your business risks. ◘

HEALTH & SAFETY

MANAGING ASBESTOS IN THE WORKPLACE Approximately 170 people in New Zealand die each year from asbestos-related diseases, according to Worksafe.

T

IS THE BIGGEST CAUSE OF DEATH from work-related disease. To reduce the risk of exposure to workers the Health & Safety at Work (Asbestos) Regulations were introduced in 2016. Kathryn Roderick from OSHbox says “Intentionally or not, we are putting worker’s Health and Safety at risk by not correctly identifying asbestos in our workplaces. When occupying or carrying out work in a building which is likely to contain asbestos, information needs to be communicated to all parties involved.” If you are in control of, or manage a building, structure or plant constructed prior to 1st January 2000 you must ensure the risks caused by asbestos are minimised by identifying the presence and location of identified or assumed asbestos or ACM (Asbestos Containing Materials) in the workplace.

PAGE 24

- HIANZ HIRE & RENTAL 2018

This includes building owners, landlords and tenants. So, how do you know if there’s asbestos in your workplace? The first step is to identify any asbestos. You can employ a surveyor to assess your building and produce an Asbestos Management Plan or you could assume that asbestos is present everywhere in your building or workplace and write your own plan accordingly. An Asbestos Management Plan details where any identified asbestos or asbestos containing materials are and how they will be managed. From April 2018 failure to complete an Asbestos Management Plan or

AN ASBESTOS MANAGEMENT PLAN MUST INCLUDE • Information about where your identified asbestos is located - e.g. In which wall, window etc. • How you plan to manage the asbestos risks- e.g. remove it, encapsulate it with a false wall, paint, leave it alone as it is in good condition etc. • What procedures you will follow when work is to be undertaken that may disturb the asbestos or asbestos containing material • How you will record incidents or emergencies involving asbestos • A timetable for managing asbestos exposure risks- e.g. priorities and dates for removal, reviews, circumstances and activities that could affect the timing of action. This should be reviewed in six months, or after an incident or emergency • Procedures, including a timetable for reviewing and (if necessary) revising the asbestos management plan. Note, at a minimum this must be every 5 years

keep it up to date could result in a fine of $50,000 for a company and $10,000 for an individual. If you haven’t already got a plan in place, now’s the time! ◘

PRODUCT FOCUS

Ditch Witch Gets It Right Ron Maddern of Huntly Hire is not one to mince his words. So, when he says Ditch Witch has got it dead right with their trenchers and mini skid steers you can understand why his customers come back time and time again requesting the product.

O

VER TWO YEARS AGO Ron and his wife Shelley who own Huntly Hire purchased their first Ditch Witch, an RT30. “He needed a dedicated trencher and that’s what he got,” says ELB General Manager, John Grant. “They now own two RT30 Trenchers, one SK755 and a

SK600 Mini Skid Steer. This puts them at the forefront of hire companies in New Zealand who hire Ditch Witch equipment.” “Feedback from our customers suggest that Ditch Witch equipment is very user friendly, is easy to drive, safe and meets all their expectations,” says Ron. “Honestly if they weren’t performing we wouldn’t have them in our fleet. Another thing that ticks all the boxes is the fact that they fit our trailers which we purpose build. We know that the RT30 trencher is regularly in use and can go to work on projects anywhere from Hawkes Bay to Warkworth.” Ditch Witch are the pioneers when it comes to trenching equipment so it goes without saying that the Ditch Witch RT30 is one of the best around. This compact trencher combines manoeuvrability, low cost and minimal maintenance with a comfortable operators station, outstanding performance and easy to use controls. This is what you would expect from a larger machine but simply put it represents tremendous value for money. The Ditch Witch SK600 and SK755 are powerful mini excavators which are built to perform on any jobsite

providing greater lift capacity, faster ground speed and more comfort for the operator. In particular there two things that really stand out about these Ditch Witch mini skid steers. Firstly, there’s the innovative track system that provides superior ground clearance which is a real feature of both the Ditch Witch SK600 and SK755 mini skid steers. As well the wide track roller gives greater stability, longer track life and easier maintenance. Secondly, the auxiliary hydraulics with quick-connect attachment fittings gives the operator the benefit of doing multiple tasks on the same jobsite. The optimized hydraulics deliver more power and a smoother ride which ultimately leads to greater productivity. “Ditch Witch are an excellent machine that is backed with great staff, an excellent warranty and outstanding service,” says Ron Maddern. “Shelley and I may not be ELB’s biggest customer, but they certainly treat us as if we are. If there are any issues they deal with them immediately, we couldn’t ask for anything more. They are big on service and are excellent on communication. All and all a great bunch of guys to deal with.” ◘ Ditch Witch is distributed throughout New Zealand by ELB Equipment. For further information call 09 570 8841

ONDA POWER EQUIPMENT New Zealand have recently gone to market with an Approved Honda Engine Manufacturer sticker which will be attached to all Honda New

Through strict engine match testing from Honda Power Equipment in New Zealand these Approved Honda Engine Manufacturer stickers will be issued to all Honda New Zealand Original Engine Manufacturers (OEMs) to apply to their products. The concept to market is to provide added peace of mind for consumers when purchasing a Honda Powered product knowing the New Zealand manufactured goods are authentic and hold an extensive Honda New Zealand warranty.

There have been reports of counterfeit and parallel imported engines arriving into New Zealand by other sources, which are being dealt with accordingly, so it definitely pays to check with your dealer or salesperson about the origins of the Honda powered New Zealand manufactured product you are about to buy. If in doubt just look for the red sticker on the fuel cap. ◘ For any queries on Honda New Zealand Engines and OEM products, contact Bruce Wooding, Honda New Zealand OEM Manager at bruce.wooding@hpenz.co.nz

BRUCE WALLACE as the Secretary of Zone 3 for 15 years, which I relinquished in 2000 following the establishment of a national body for the association. How did you get involved in the hire industry? “After leaving University I started my career in the transport industry firstly working for Freightways on the Marsden Point Development. I then took over the management of an associate company called Hire Towers who hired out access equipment. Following a successful stint with them I then left to take up a senior position with Trestle Plank and Ladder (TPL) before deciding to purchase the general hire portion of a business in Glen Innes.

I renamed the business Glenn Innes Hire (1995) Ltd and set about updating the stock to make it more trade focused. The business was not well located or easily accessible so I took up an offer 5 years later to relocate to a userfriendlier site.”

What has been your involvement with HIANZ? “Suggesting membership to HIANZ when employed by Hire Towers, we belonged during the days of weeklong conferences and big zone meetings. I served

“That’s easy. The people, variety of work and the culture that surrounds the Hire Association. Members and suppliers are so happy to share ideas and information especially during hire events, which is unique to the industry. My business has been helped through networking and I have made it a point to attend as many conferences both here and in Australia as possible.”

How do you define your success? “Success for me has always been about making a good living and being able to retire comfortably which I did in 2015 when I sold my business to Kennards Hire. I have always taken a customer first approach to business and my passion for the industry has served me well over the years. This was helped, particularly in the early days, by the great support we have had from our suppliers. My only regret is that I should have spent more time reviewing and raising my hire rates. At the time it never seemed to be a priority.”

COMPANY FOCUS

R

BLACK JACK IS THE TALK OF WANAKA

ECENTLY PURCHASED by Central Machine Hire through Manitou’s New Zealand distributor AB Equipment the company requested that a condition of sale be that they wanted it painted black. That achieved and with the graphics added the Manitou MLT X741 telehandler is now a stand out amongst other working construction equipment at the new Three Parks subdivision being developed by Wanaka development company, Willowridge. Two years ago, Central Machine Hire identified the need to add a telehandler to their fleet. “It was acknowledged that telehandlers are pretty adaptable and that this type of machine would certainly add tremendous value to our operations,” says Central Machine Hire Director, Allan Dippie. “Our first experience of owning a competitor’s telehandler did not go well so we were forced to return it. Undeterred we did some more research and following a recommendation from our contacts

at Calder Stewart we went and had a talk with AB Equipment,” says Allan. “Safe to say that we were very impressed with the Manitou MLT X741 and were fortunate enough to find they had one in stock. Having a service centre close by in Cromwell also helped. Along the way the machine turned from red to black and got itself a nickname. And so, the ‘Black Jack’ legend was born.” Designed principally for agricultural applications the Manitou MLT X741 is a great work horse. Quality tyres, 4-wheel drive and 3 steering modes makes getting around on all sorts of off road terrain simple. Easy to use manual gearbox and Manitou’s exclusive JSM boom control allows the operator to move the machine back and forth whilst undertaking multiple tasks in unison. “It’s an easy, intuitive machine to operate and doesn’t need a dedicated driver,” says Allan Dippie. “In our case it will be used by multiple operators for a variety of tasks utilising different attachments. One moment it will be loading top soil and the next minute be doing forklift work.

Given that the turnaround is very time sensitive the 7-metre reach comes in really handy when loading and unloading trucks.” The cab is comfortable and spacious and is well insulated to reduce engine noise which is important for heavy duty use. The driving seat is adjustable in height and depth to accommodate all shapes and sizes and all related functions are grouped together for a logical common-sense operation. Central Machine Hire is a standalone business but is part of collection of companies that make up the Nichols Group. Operating out of Wanaka the company is known for its civil and rural contracting work with its current projects being the multiuse Three Parks along with several residential subdivisions in and around Wanaka . This involves establishing a mix of commercial, retail, schools, sports facilities and residential housing and is expected to be rolled out over the next 20 years. The Manitou MLT X741 known as ‘Black Jack’ is expected to play an essential part in this development. Central Machine Hire have become very attached to the machine which has already attracted a lot of attention since arriving in Wanaka. According to Allan Dippie now that they’ve got a Manitou it’s hard to know what they would do without it. For further information on the Manitou Rough Terrain Telehandlers or the location of your nearest Manitou dealer, contact Rob Fuller on 021 653 956

As if Wanaka hasn’t got enough attractions, they now have a Manitou MLT X741 Telehandler that goes by the name of ‘Black Jack.’

BUSINESS INSIGHTS

ANATOMY OF A BUSINESS By Stewart Kearney Partner - Good for Business ANATOMY, noun “The scientific study of the body and how its parts are arranged” Cambridge Dictionary

N

OW I KNOW you are not reading this article to improve your understanding of the human anatomy, but if we change body to business then we have a discussion you may be interested in reading, Business anatomy, still a noun! “The study of the business and how its parts are arranged” In this article my aim is to describe the similarities between your body and your business. Alas financial professionals tend to regard a business as a set of numbers that we run a quick health check over. Debt to Equity, Earnings per Share, Net Tangible Assets, etc. Your goal after reading this article is to see your business as an active entity that has a personality (mission statement), financial strength (balance sheet), financial appetite (Earning before Tax & Interest, EBIT) and Circulation (cash flow)

Business Personality... Is your business high growth, technology, customer focused, staff centric etc., what does your business believe it stands for, also what do your customers think your business stands for?

Financial Strength... Your balance sheet holds the assets of your business, if you have a strong balance sheet then you can negotiate from a position of strength. A strong balance with cash reserves also gives you time to reposition in times of change.

PAGE 36

- HIANZ HIRE & RENTAL 2018

Financial Appetite... To be a healthy business you must feed your business EBIT (earnings before interest & tax), EBIT is the fuel that a business operates on or stores as cash reserves, the better the EBIT, the greater opportunity a business has to grow.

Circulation... In business terms cash flow is like blood, all businesses run on cash, if you have an inefficient system that is slow in turning sales into cash, it does not matter how much you feed the balance sheet with EBIT, your business will wither and die without cash. To emphasise this point we will look at International Trouble Limited. ITL sells product into an international market, unfortunately ITL does not realise that this market expects extended payment terms. Are extended payment terms important if the Gross Margin is 80% & EBIT is 50%? ITL has stunning profitability, great balance sheet with strong net assets position (due to a high debtors). Unfortunately, after 6 months they are still trying to get paid. They have run out of cash! Finally, what you have been waiting for, key insights into Borrowing from a financial institution. QUESTION 1

Why do you need a loan? Answer has to be growth or cost reduction. (increasing debtors because of increasing sales, more staff to handle growth, new equipment for growth or to reduce costs) QUESTION 2

Can you afford to repay the loan and the interest? Understand Return on investment ROI on capital investment

QUESTION 3

What do your business vital signs show? Don’t wait for the financier to tell your stock or debtors are too high, understand industry bench marks. a) Net Tangible Assets – financial strength b) Debt to Equity – risk c) Quick ration – cash flow d) Gross Margin – opportunity from growth e) Interest Cover - risk QUESTION 4

Do you have accurate financial records? When you go to financier, go prepared, have a full report, answer questions, don’t be like so many people on Dragons Den, embarrassed by their lack of knowledge of the financial position of their business. a) Current Balance Sheet with prior year comparatives b) Current Profit & Loss, Year to Date (YTD) and prior period comparatives c) Forecast, what does your balance sheet, profit & loss and cash flow look like before and after the funding? d) Full picture of personal and company income and earnings. QUESTION 5

Do you have a good banking history & relationship with your bank & creditors? QUESTION 6

Time in the business, are you a newbie to the industry or are you a solid performer who is looking at growth?

EVENT ADVICE

FIVE EASY STEPS TO SET UP A BEAUTIFUL, RUSTIC EVENT DISPLAY We all know that the rustic look is in, in, in, for weddings and corporate events. How then do hire companies best capitalise on this trend? pink bows! The theme can be created with a combination of wooden and your classic party hire chairs such as our Bella Evolution (see pictured).

W

ELL, IT ALL STARTS with capturing the customer’s imagination. The good news is that with minimal effort and cost you can set up a beautiful display that will inspire customers and get those event hire bookings flowing. Step 1. Haul out that rustic wooden hire stock. If your current stock’s not up to scratch Alloyfold’s rustic bentwood chairs and rustic wooden folding tables work a treat for this genre. Keep the furniture neutral and natural - ditch the

Step 2. Source some elegant white plates and cloth napkins. Tie with a hessian ribbon or accessorise with a sprig of fresh eucalyptus. Step 3. The accessories are important. Get a palette or theme going. Eucalyptus leaves, vintage doilies, hessian, lace, copper, dusky pink, lanterns, bulbs, bunting. There are so many things you can do but the trick is to keep it simple, clean and fresh. Step 4. Copper cutlery. Go the extra mile and source some ultra trendy copper or black cutlery to give your customers a feeling of aspiration when

they look over your display. Pair classic wine glasses with vintage crystal water tumblers or even retro golden tumblers. Step 5. Fresh green table runners are essential to pulling off this aesthetic. They add colour and bring in that earthy connection to the outdoors. Ivy or eucalyptus works perfectly for this and should run through the middle of the table without taking up too much space. In summary, don’t make it complicated, make it beautiful. So beautiful that your customers walk in with ideas and out with a confirmed theme and handbag full of hire receipts. ◘ Good luck! LEGAL

THE PERSONAL PROPERTY SECURITIES ACT STRIKES AGAIN By Geoff Hardy of Auckland law firm Martelli McKegg

S

OME OF YOU MAY HAVE seen or read a news article in November 2017 about a car leasing company that leased a car to a customer, and then lost the car to a finance company that had lent money to the customer in the mistaken but understandable belief that he owned the car. Those of you who regularly read these articles or attend the HIANZ Conferences won’t have been surprised by this outcome. But the car leasing company, the other hire companies who are yet to learn of this law, the journalists, and the general public would have been astonished. To help you make sense of it, this is an explanation of how it all came about. First, the facts. The car leasing company was called Green Cars Ltd, managed by Mr. David Phan. They hired a Toyota Prius to a Mr. Vicente Lopez for a 6 month term, followed by a 12 month term. Immediately prior to that hire, Mr. Lopez fraudulently managed to transfer the car into his own name. Some 10 months later, while in possession of the car, he used it as collateral for a loan from Personal Finance Ltd. Two months later, he defaulted on the hire agreement (which still had 6 months to run), and another two months later Green Cars Ltd repossessed the Prius and reregistered the car in their own name. Some 8 months later Personal Finance found out that Lopez no longer had the car, and 7 months after that they identified it at Green Cars’ yard. When Green Cars wouldn’t hand the car over to Personal Finance, the finance company went to court to enforce its rights. Green Cars naturally protested that it owned the car, and surely its ownership trumped the rights of a financier who had been

PAGE 40

- HIANZ HIRE & RENTAL 2018

persuaded to take security over the car by a fraudulent hirer. But Green Cars learned a harsh lesson about the Personal Property Securities Act (“PPSA”). Personal Finance had registered its security interest on the Personal Property Securities Register (“PPSR”) at the time Lopez had offered the car as collateral. Green Cars had never registered its own security interest (the right to take back the car after the long-term hire had expired) until a year and a half later when Personal Finance tracked it down to their yard. Personal Finance had prior rights.

Why is it that you have to register your ownership of your own assets on the PPSR, to stop other people taking your stuff? How can that be? Why is it that you have to register your ownership of your own assets on the PPSR, to stop other people taking your stuff? Well the answer is, normally you don’t. You are only at risk in very rare situations. And those situations include where you lease or hire your assets to someone for more than one year. Usually leases of that duration are hire-purchase, conditional sales, or finance leases, not genuine operating leases. The asset is on the way to becoming the lessee’s, and the lease is just a way of protecting the seller until he is paid in full. Lessees who are permitted to hold onto an asset for that long can easily persuade a

financier that they already own it. It is particularly easy when there is no register of ownership that the financier can check, as there is with land or motor vehicles. And even if there is such a register, the lessee can forge a transfer into his own name, as he did here. To stop financiers getting conned in this way, the Government decided (as they did in every other country with a PPSA) to transfer the risk to the hire company or true owner, rather than the financier. But they came up with a simple solution. All the hire company or true owner had to do was go on-line when the long-term hire agreement was first entered into, and register its interest on the PPSR. Then it would be protected. Of course that assumes that the hire company or true owner knows about the PPSA and the PPSR, and is familiar with the registration process. A lot still aren’t, almost 20 years after the Act came into force. As with a lot of new laws that can catch out the unwary, the Government should have identified every hire company and every hire equipment supplier operating in New Zealand, and passed on the message. As it is, that job has been left to organisations such as HIANZ, and commentators like me. In effect, a hire agreement for more than one year is treated as if it was a security agreement, and as if the hirer was the owner. Even without forging a change of ownership form, a hirer can give collateral over the equipment to another security holder such as a financier. Then it becomes a competition between the hire company and the financier, which is generally won by the hire company if it registers its interest promptly,

LEGAL

because its interest has priority over the financier’s. Even though Green Cars did eventually register its interest, it was far too late to beat Personal Finance. Green Cars are not the only hire company to be caught out, they are simply the latest in a list of companies of which Portacom New Zealand Ltd was the first. Australia brought in its own PPSA about 10 years after us, and sure enough, it wasn’t long before a hirer of earthmoving equipment lost some equipment to the secured creditors of their insolvent customer, under the equivalent provision. Australia has since pushed the one year period out to two years and relaxed the rule a little as a result of intense lobbying by the hire industry, but the basic provision still remains. In this country there doesn’t seem to be much appetite for a similar relaxation of the rule, so we still have the one year test.

A hire agreement for more than one year is treated as if it was a security agreement, and as if the hirer was the owner The hire industry will gradually become more alert to this risk, and more adept at registering when longterm hires are entered into. It is also important to learn the definition of “lease for a term of more than one year”, because it catches a wider variety of arrangements than you would expect. Hopefully we will see less and less of these controversial court cases over time. ◘

NEW PRODUCT FOCUS

NIFTY RELEASE THE NEW NIFTY HEIGHTRIDER 21 HYBRID MK2 Niftylift was the first manufacture of elevating work platforms to produce a true hybrid product, starting with the Nifty HeightRider 21 hybrid in 2007, Nifty Hybrid technology is now available on 80% of the HeightRider products.

D

URING 2016 OUR MISSION was to revisit the design of our Hybrid system and increase its performance and efficiency to provide an improved product to our customers. The first machine to be installed with the 2nd generation Hybrid system is the redesigned Niftylift HeightRider 21 MK2. Release in Europe in January 2017 and New Zealand January 2018.

THE HYBRID HAS THREE POWER MODES: Electric Mode: The machine can operate on DC power zero emission, we now have AGM maintenance free batteries, giving us a total of 25-27 Hird cycles, which is around a day and a half work time. Hybrid Mode: The diesel engine (Kubota 902, Tier 4, 18kW) is running operating the machine function and drive, if all the power is not being used it will regenerating the batteries, so we have no waste of power, if the machine requires more power the hybrid power plant will go into Boost mode, the electric motor will now come into assist the diesel engine, which gives a combined power of 26 Kw. If the engine is just

PAGE 42

- HIANZ HIRE & RENTAL 2018

idling it will be regenerating 40 amp of power back to the batteries, at a minimal fuel consumption of 1.08Lts an hour. Diesel Only Mode: This is an involuntary state of the machine where the batteries are below 10% of charge and Boost is disabled but drive and boom functions will still operate. All surplus power from the engine is being used to Regen the batteries. The HeightRider 21 MK2 control system is now digital using PLC and CAN BUS communication, In the past, all electronic components needed to be hard-wired to the electrical system to be connected. Over time, these connectors would be susceptible to rust, vibration, or even moisture damage, with so many wires, locating the problem in the electronic wiring harnesses could be difficult when trying to repair a machine. CAN BUS uses a total of five wires, PLC control also gives us the ability to fault find on the machine, this feature is built in to the control panel, so no need for hand held diagnosing tools. The control screen at both base and cage gives the operator visual information on the hybrid power plant functionality, weight in the cage, fuel

load and fault code information and ability to log overload evidence and to reset. The machine will be available with telematics, at present that will show you on your phone or mobile device, information such as location of the machine, weather the machine is working and how many hours it has done, also it will show when the batteries were last charged and the voltage on the machine, this is only just the beginning to telematics. Other new feature on the machine include 250 Kgs SWL, increase drive speed to 6kph, better gradeability at 45%, we have still retained the outstanding outreach of 13m with an overall machine weight of 6640Kgs We are very excited about the new Nifty HeightRider 21 Hybrid MK2 this has already been launched in the European market, The results have been fantastic and we are struggling to keep up with the demand. We had a lot of success with the MK1, but this is a leap forward again in technology. â—˜ For further information contact Nifty on +61 2 4964 9765 or visit our website www.nifty.com.au

Kinshofer Acquire Doherty Kinshofer GmbH from Germany and New Zealand based Doherty Group have signed a definite agreement to merge. Under the terms of the agreement Kinshofer has acquired 100% of the Doherty Group.

F

OR OVER 45 YEARS, Kinshofer has been a leading manufacturer of attachments for truck mounted cranes, excavators and skid steer loaders, consistently developing its product range in both, the crane and excavator markets to become a competent partner for OEM’s and OED’s. Previous acquisitions of Liftall Inc. (Canada), Demarec B.V. (Holland), RF System AB (Sweden), Auger Torque Group (U.K./ Australia/ China) and Solesbee´s LLC (U.S.A.) were other important milestones of this development. The acquisition of Doherty is significant for Kinshofer in two ways; first it adds additional product segments, such as Quick Couplers, Buckets and other excavator products to Kinshofer’s already very comprehensive offering. And secondly, it improves Kinshofer’s distribution channel in New Zealand and Australia. But not only that, Kinshofer has now enhanced local manufacturing, with its Tauranga (NZ) and Brisbane (AUS) based facilities, customers will be served much quicker and with a much larger product range. With this move, Kinshofer further demonstrates its commitment to being the global leader in attachments to the crane and excavator industry. Doherty, a 2001 established family business, puts its focus on the development and marketing of tools and equipment which make carriers such as excavators more effective and versatile, particularly important for small and mid-size contracting businesses seeking high utilization of their machinery. With an extremely committed and well-educated workforce, Doherty will continue to

develop and sell its products globally. In order to meet the current market requirements, Doherty and Kinshofer will recruit more staff to ensure a swift and professional market launch of the companies’ products within either sales organization. Thomas Friedrich, President & CEO of Kinshofer Group, said: “Kinshofer continues its strategy to provide the industry with a “One-Stop-Shop” solution of outstandingly engineered products to increase efficiency and, more importantly, profitability of its customers. The acquisition of the Doherty Group was the next step in our approach to be a local manufacturer in NZ and Australia”. Jeremy Doherty, co-owner and

Managing Director of the Doherty Group, commented: “The concentration of knowledge and competence will form a powerful centre for future developments customers can only benefit from. In particular the combination of both product ranges will create more ground-breaking innovations for the industry. The whole Doherty management team, which will stay on in its entirety, is very excited to be part of this mutual future.” Kinshofer’s and Doherty´s employees are working on the rapid integration to provide customers worldwide with their comprehensive range of products and services. Kinshofer is very pleased Jeremy Doherty will remain with the company as its Managing Director. ◘

INTERNATIONAL FOCUS

On a visit to upstate New York one of our members filed this report on the state of the hire industry in that part of the world...

DOING BUSINESS IN A WINTER WONDERLAND

Despite the November winter snow, business is still brisk at LeBerge & Curtis Rental Centre, located in Upstate New York, and just 25km south of the Canadian border.

L

IKE MANY EQUIPMENT RENTAL and sales businesses throughout the USA, most of the larger equipment is displayed outside, enticing the customer to call in and spend some money. Having driven passed the front gate too many times while visiting my daughter at nearby St Lawrence University, it was finally time to call in for a chat. “We were started by the Curtis family in 2010, who own the local dealership for John Deere, Bobcat and Stihl, just south of Canton” explains Store Manager Stuart Marquart. “They kept on getting inquiries for hiring tractors and agricultural equipment, so we became a natural extension of their retail business. The family owned a piece of land here on the highway, so built a large showroom, workshop and yard, plus three multi-unit storage units”. The rental business, located on Highway 11 between the towns of Canton and Potsdam, has three full time employees and has been growing steadily since it opened. It offers a wide range of equipment not too dissimilar from your average New Zealand hire company. “Our largest moving items are our excavators (up to 3.3 MT), Bobcat skid steers, Boom lifts and indoor and outdoor scissor lifters” said Stuart. Loading weights doesn’t seem to be

an issue here, with most customers arriving in hefty pickup trucks with ample towing capacity. “We also deliver our heavier equipment anywhere in the St Lawrence county area” notes Stuart. The showroom is packed with immaculately prepared equipment, much of it spending more time in the showroom due to the cold weather. “It’s a seasonal business, and we’re kept very busy in summer. It certainly quietens down in winter” says Stuart. Popular smaller items at LeBerge & Curtis include trenchers (LeBerge & Curtis offer trenchers and attachments in three different sizes), power brooms, concrete breakers, compactors and concrete saws. “Concrete equipment is always popular, regardless of the season” says Stuart. “And our storage business just keeps growing, with good consistent occupancy. We’re lucky that we service four local universities in the county; the students are always looking for storage space, particularly over summer. A quick comparison soon identifies many similarities between the Canton operation and our hire business back home. There is one notable difference: “Our yard boss, or cultivating tillers are really busy in spring” says Stuart. This Stihl-powered device rotates a horizontal drum with rubber pads.

“Customers hire them to remove the stones and road grit from their front lawns once all the snow has thawed, and sweep it onto the road”. LeBerge & Curtis operate only 5 ½ days per week. “We offer equipment on daily, weekly or monthly rates” said Stuart. “However, we’re flexible; if the customer brings back the equipment after only a few hours, we will normally charge only half a day. We have to be flexible and offer the best customer service, especially with so much intense local competition”. Scott White, who also handles a lot of the rental sales would probably agree, but discussions with Scott were hindered by some urgent customer requests. “You’ve got to look after the customer” says Stuart, as Scott’s pizza goes cold. LeBerge & Curtis certainly face some strong competition from a large National equipment rental company on the other side of Canton, and from a branch of nation-wide UHAUL Trailer & Trailer rentals, virtually across the road. “We don’t compete head-on with UHAUL but we do offer a range of trailers that UHAUL don’t usually offer, such as tipper trailers and they’re consistently busy.” And the passion is the same; “It’s a great business to be in” says Stuart. “I really enjoy it”. ◘ HIANZ HIRE & RENTAL 2018 -

Existing Genie Material Lift customers can be assured that we will have a significant parts inventory Christchurch locations,” says Ed Richardson. “The company’s technical staff are already very familiar with the Genie product and will undergo further training to become acquainted with the specific service and maintenance requirements of the Material Lift range.” Specifically used for lifting and placing small pallets and objects Genie Material Lifts provide a versatile solution for worksites, warehouse, manufacturing, maintenance and utility applications. Using a Genie Material Lift decreases the need for workers to manually lift materials, thereby reducing the risk of workplace injuries. All the Genie models are able to pass through a standard doorway for ease and access to the worksite and can be loaded by one person on to a truck or ute. The Genie Materials Lift line up, to be exclusively distributed through Youngman Richardson & Co Ltd, will include two GH Super Hoists which are powered by CO2 or compressed air and can lift its one-piece platform to heights of 3.80 and 5.6 metres respectively. Three Superlift Contractor (SLC) models come with a strong, lightweight aluminium telescoping mast which provides maximum lifting heights of

3.94, 5.64 and 7.32 metres depending on the requirement. Likewise, the heavy-duty design of the Superlift Advantage (SLA) has a variety of models that will suit a range of working heights and load capacities. The Genie AWP Super Series is an industry favourite due to their ease of use, convenience and flexibility. With a lightweight and durable design these models are great for light construction, schools, churches and other interior work. ◘ HIANZ HIRE & RENTAL 2018 -

THE TORO HIRE RANGE TAKES IT TO A HIGHER LEVEL Your days consist of guiding customers towards the correct piece of equipment to get the job done. What is the project? How big is the scale? How long is the equipment required for? What is the level of expertise of the operator?

T

HE LAST THING YOU WANT to be thinking about is “Will this unit work once it’s on site?”

Toro builds its heavy duty hire contractor range with the user in mind. From experience, we know there are a few things that are critically important to getting the job done once on site. These are: suitability of the product for the job; reliability; ease of use and service back-up. Firstly, is the piece of equipment suitable for the requirements of the customers job? The last thing you need is a machine with an engine too small for the load it’s bearing or overkilling the power requirements of the site with a unit that is too big. The important thing here is: range. Toro appreciates that one size does not necessarily fit all, and so offers both a range of products to suit different purposes, and a range of options within many of its hire units. For example, the Toro

Stump Grinders come with a range of horsepower options, either 26 (Toro STX – 26) or 38 (Toro STX-38). The Toro Mini-Digger TX1000 comes with a range of attachments (post-hole borer, trencher, 4-in-1 bucket and more), giving it multi-functional purpose all in the one hire. Toro understands that product reliability is absolutely paramount. Particularly for the hire and rental

industry where equipment is pushed to its limits, rigorous design, manufacture and product testing takes place at the Toro manufacturing facility to ensure optimum work site performance. Because rental services cross a range of industries – from golf courses, to residential and commercial building projects to utilities infrastructure, equipment needs to be easily operated by anyone. Being designed for simple maneuverability and handling with operator-friendly controls means users get the job done faster with minimum fuss. Variable groundspeeds on many of the units allow users to spend less time transporting, and more time getting the job done. Let’s face it, occasionally things don’t go to plan. You need reliable and efficient service back-up. Our technicians are Toro factory-trained professionals, who specialise in providing technical support for any Toro product; from a consumer lawn mower through our commercial units. They can provide on-site service no matter where you are. Toro has taken the time to understand your customers and their requirements, taking the hassle out of the features that are most important to keeping giving your customers an excellent hire experience. ◘ HIANZ HIRE & RENTAL 2018 -

Takeuchi Delivers First Excavators To Huntly Hire Ron Maddern has been in and around diggers from an early age and with his wife and business partner, Shelley purchased Huntly Hire in 2005. Since then they have invested wisely in good quality equipment to ensure that their customers will keep coming back. “WE’D BEEN IN THE MARKET for a new 1.8 tonne excavator and approached Steve Hale, North Island Manager with the New Zealand Equipment Group,” says Ron Maddern. “Steve is a straight shooter and a professional operator, so Shelley and I knew that he would give us an honest assessment of the Takeuchi product. We trust Steve and his feedback of the new Takechi models was invaluable.” “On his advice we initially purchased a 1.7 tonne Takeuchi TB216 excavator, then another and now we are about to take delivery of our third machine. We now have three TB216 excavators kitted out identically,” says Ron. Maintaining fleet consistency will be a cost benefit to Huntly Hire who will find general servicing and parts inventory management easier to administer. These machines are well spec’d, are extremely good value for money and have great residual value on the second-hand market. They also have a 3,000-hour, 3-year warranty. Ron and Shelley’s customers have remarked on how simple the Takeuchi are to operate, their remarkable reach and outstanding digging depths, something that you would normally expect from a larger machine. PAGE 52

- HIANZ HIRE & RENTAL 2018

“What our customer sees are what they get with Takeuchi machines right down to the accessories,” says Ron. “The standard fit out includes; A 900mm wide tilt bucket, a 200 and 300mm wide spade, normal digging buckets and a ridder for removing concrete and tree stumps,” says Ron.

“The Takeuchi is really suited to our customer base and to date we’ve had nothing but positive feedback and no complaints whatsoever.”

“However, It’s the little things that have impressed us most,” says Ron. “Such as the overload lifting mode which goes off when the load exceeds its capacity, the anti-drop valves, enclosed piping, the numerous safety features and the easy engine access. With my big hands this is a real bonus for me.”

“On top of that Takeuchi has had a long association with Hirepool. They’ve been using them for decades so if it’s good enough for Hirepool its good enough for us.” ◘

“Takeuchi looks to have been another wise decision and dealing with the New Zealand Equipment Group has been very easy,” says Ron.
