Tablets are the best medicine

Everest walking challenge 2020 fundraising for Sarah Groves Foundation We have some beautiful scenery in Guernsey but not much in the way of mountains so to walk the 8850 metres of Mount Everest meant 115 times up Le Val des Terres hill! We did though and were proud to have raised money for the Sarah Groves Foundation.

Inspired by the ‘We All Matter, Eh?’ initiative #StayConnected to keep more isolated islanders connected during the Covid 19 outbreak, Cooper Brouard purchased 5 brand new tablet computers which they handed over to the charity to distribute to the groups or individuals that need them the most. Director, Matt Brouard has a particular affinity for the project said at the time “I have elderly parents in a care home, currently both getting over Covid 19 virus, and a mother in law in another home who we skype to keep in touch with, I know what a huge difference it can make being able to both see and talk to them. This is a fantastic idea from ‘We All Matter, Eh?’ and we’re are delighted to be able to support it. Karen Blanchford, Project Manager at ‘We All Matter, Eh?’ said of the donation, “This is another example of the amazing community spirit that we are seeing from individuals and businesses. So far our partners and team have been able to connect the majority of care homes, hospital wards and supported living accommodation. Our volunteers are working hard to connect more individual islanders during the pandemic. These five tablets from Cooper Brouard will enable another group of more vulnerable people to connect with their loved ones, which is so important for their mental health and wellbeing. Matt ended by saying, “Although staying safe is still the Island’s priority, staying in touch is equally as important particularly for those unable to go out at all. I’d encourage any individuals who have a device they are not using to donate it, and for businesses that are able to, to consider buying some new kit and handing it over to #StayConnected they are doing a wonderful job.”

Children at St Martin’s Primary School organised their own fundraiser, taking it in turns to cycle and row throughout the day in aid of young people in Australia. We were happy to sponsor the initiative and join in with the pedaling and pulling.

Cathy provides a coffee machine for staff and parents at Frossard Ward Scott and Cathy Gallienne spent time on Frossard Ward with their daughter Lily-Mae when she was only four and a half months old with meningitis and at six months with severe bronchitis. Soon after, they decided to set up the Friends of Frossard Children’s Ward as a way of thanking the nurses and doctors and to support other children and parents going through similar experiences. When Cathy heard the coffee machine had broken, she leapt into action and has another one with them in a matter of hours! GUERNSEY PROPERTY SPRING/SUMMER 2020

At present, in most countries, the percentage of electric cars on the road is very small, typically lower than 0.5%. China is relatively more advanced, with 1%; California benefits from sunshine and, perhaps, a ‘Tesla effect’, with 2%, while oil-rich Norway is an absolute outlier, with 10% plug-in electric vehicles already on the road, due to long-standing and powerful government incentives and subsidies. Meanwhile Guernsey is currently hosting 0.5% fully electric vehicles. So uptake on the island is in line with the global average but why isn’t it greater? The main barrier to faster take-up is ‘range anxiety’ - concerns about battery technology, which dictates the distance electric cars can go between charges. 200-300 kilometres is the current maximum, depending on how the car is driven. With Guernsey being only 78 square kilometres, ‘range anxiety’

certainly shouldn’t be a problem here and islanders have the opportunity to be world leaders in adoption.

The positive charge

Electric cars are pollution-free, so their environmental impact is really embedded elsewhere, in their cost of production (especially batteries) and how the electricity needed to recharge them is sourced. But they remain expensive because of still-low volumes, albeit governments often subsidise them. The running costs of electric vehicles are markedly lower than internal combustion engine vehicles. Maintenance and repairs will also be dramatically cheaper and less frequent. Up to half of car maintenance is attributable to the internal combustion engine, which contains hundreds of moving parts, whereas solid state systems and electric motors typically have fewer than ten.

The negative charge

What about the future of the car industry at large? Manufacturers are still wringing efficiencies out of the combustion engine, including better fuel use and lower emissions. Hybrids provide a best-of-both-worlds intermediate technology. But the real threat to manufacturers may lie with urbanisation. In congested cities fewer people may want cars; more pedestrian zones and fewer parking spots already make city ownership less practicable in Europe.


There is also the lack of a physical charging infrastructure outside of major cities. For this, governments must invest, possibly alongside the private sector. Guernsey has seen some development in this area with a £100,000 plan announced to introduce further charging stations.

Sustainability starts now

Even ten years ago the thought of an electric revolution for the transport industry would have been out of the question. Whereas today, the innovative work being done in the Formula E space is acting as a test bed for this technology. Competition drives innovation and brands like BMW are using the sport to not only spread the message about electric transport, but also to push technological boundaries to use this experience and learnings in the consumer space. Open Market properties Looking forwards to a brighter future We are certainly planning on a dynamic new start after the sudden lockdown that changed operations so dramatically and which will remain in our memories for many years to come. This edition sees a fresh look with a rebrand that we hope reflects our energy and enthusiasm to continue where we left off, on the assent. In fact, my underlying observation for this auspicious launch is that, of all the unexpected outcomes from recent events, the least likely of all may have been for business to resume so smoothly! We have been enjoying remarkably similar market conditions to pre-lockdown weeks and months, sales for May have been robust, enquires remain very steady and prices constant, all of which has shaken off doubts moving forward.

One might even conclude that many people have spent the lockdown on the internet perusing the property market or that the change in routine has led to a reassessment of housing requirements? We have much to be grateful for and a good deal to thank our political leaders for and once again the level of consultation with business community was key if the last month was anything to go by, in which we have received great acclaim for the decisive handling of the Covid-19 procedures and the subsequent success that it brought. Now we must navigate the economic challenges and do everything possible to maintain these encouraging early gains. Clearly, Guernsey has come to prominence on the national and international stage for all of the right reasons and

must do everything in our power to welcome those who share our values and for whom it appears, more than ever may wish to consider as a future home to live. For all concerned, safety remains paramount but we have risen to every challenge that the virus has raised so far and when the business community can confidently invite new applicants back to our shores it will be a further boost to our wider economic aspirations. Not many will be rushing to make sales predictions or economic forecasts at this time but what we do know is that many sales agreed before the crisis have been concluded successfully following the lifting of restrictions and confidence has been carried with us on this journey into the new normal.

Living in Guernsey Perhaps a common misconception about Island life is that the Guernsey tax system is straightforward. Although the fundamentals are simple, there are opportunities for many new residents moving to the Island, as well as pitfalls for the unwary. I am aware that Guernsey has a 20% income tax rate and no capital taxes, so I assume it is straightforward. It is correct that Guernsey has a flat 20% rate of income tax and we use the calendar year as a tax year. A married couple are also presently subject to Guernsey income tax jointly. The Guernsey tax system provides personal allowances and mortgage interest relief in certain circumstances. Furthermore, there is no capital gains, inheritance or value added tax in Guernsey.

Why every Guernsey property owner should make a will Over the last twelve years significant changes have been made to Guernsey’s law of succession, the effects of which may have been overlooked by some homeowners. Prior to 2008 if a homeowner was married with ‘legitimate’ children (children born during marriage) and died without having made a will then their house and land, what is known as ‘realty’, would have passed automatically to their legitimate children. In those circumstances their house could not, by law, pass to any ‘illegitimate’ children. Also, back then, wills of realty had to be signed before Jurats in the contracts court and some found that inconvenient. In 2008 a change in the law meant that children born to unmarried parents would have the same inheritance rights as children born to married parents. This led to problems for the heirs of someone who died without having made a will – that is to say someone dying ‘intestate’. The problem was that prospective purchasers of property inherited on an intestacy could not be sure that the deceased had no other children. If there were other children the heirs selling the property would not be able to give good title to the property. Why was that? If there was another child (who the sellers may not have even known about) the purchasers would not acquire all of the property; the other child would still own an interest in it after it has been sold. In most cases it is difficult to prove that there are no ‘illegitimate’ children, so sales of a deceased’s property may be delayed until one of the heirs, or 74

an Advocate, have been appointed by the Royal Court as ‘Administrator’ of all of the real property of the deceased – a process known as obtaining an Administration Order. Upon the grant of an Administration Order all of the deceased’s real property is transferred into the ownership of the Administrator, who may then sell it with good title. The process of obtaining an Administration Order is rarely looked upon as a pleasant experience for the applicant who must swear an affidavit setting out the life history of the deceased. The affidavit is intended to show, as far as possible, that the deceased had no children other than the heirs who are trying to sell the property. The applicant must usually appear in Court at the time the application is made. The application itself is usually straightforward, but has cost implications and can delay a sale.

testamentary disposition, meaning a property owner could leave all of their property, including realty, to anyone they chose. The new law did nothing to allay the fear of a prospective purchaser of realty from an heir on an intestacy, and Administration Orders are still often required in such circumstances. The simple solution is to make a will, and all homeowners are advised to do just that.

The change made in 2008 did not alter the fact that a person with a child could only leave their realty by will to a spouse or a descendant (or stepchild).

Also, it is no longer necessary to sign your will before the Court.

Your move to Guernsey… An increasing number of wealthy individuals, entrepreneurs and financial services principals have chosen to move to Guernsey with their families in recent years, with some also relocating their businesses to the Island. Here, Carey Olsen property partners Jason Morgan and Davey Le Marquand look at some of the practical issues to consider when contemplating a move to Guernsey. How does Guernsey’s residential property market operate? There are two designated classes of housing in Guernsey: Local Market and Open Market. The Local Market has significantly more properties on it and is available for occupation by people either born and brought up in Guernsey, or those qualified to live in such accommodation for other reasons, such as by virtue of their employment circumstances, or in some cases their potential economic contribution to the Island. The Open Market is therefore available to all those people who do not have the particular qualifications enabling them to live in Local Market accommodation. Which market would be available to me? The Open Market is usually the most obvious option for people coming to live in Guernsey who do not hold local residential qualifications. That said, recent changes to Guernsey’s population management regime, combined with 90

Guernsey’s entrepreneurial visa scheme, offer increased scope for people moving to the Island to live in Local Market properties. It is also worth noting that there are no financial criteria that need to be fulfilled to be able to live on the Open Market, making the process of moving to Guernsey easier than in some other jurisdictions. Ultimately, the right to occupy property on either market is controlled by domestic population management legislation, which also has a bearing on who can work in Guernsey. The Population Management (Guernsey) Law 2016 (“the Population Law”) came into force on 3 April 2017 and replaced the previous Housing (Control of Occupation) (Guernsey) Law 1994. The Population Law requires everybody aged 16 and over who lives and/or works in Guernsey to hold either a certificate or a permit relevant to their residence. Certificates are issued to lawful householders – people who then have a right to live and work anywhere in Guernsey. There are three types: 1. Open Market Certificates (Part A for private home, Part B for hotels, Part C for residential care or nursing homes and Part D for a house in multiple occupation); 2. Established Resident Certificates; and 3. Permanent Resident Certificates. In broad terms, anyone can live and work in Guernsey indefinitely if they live in a Part A, B, C or D house on the Open Market Housing Register and they are the lawful occupier of that house. Open Market Certificate holders can accommodate immediate family members, while Part A Certificate holders can also house extended family members.

A permit is issued to a person whose ability to live and/or work in Guernsey is conditional. This may include working in a specific job, living with a specific person or other appropriate conditions. When a permit holder completes eight years of continuous lawful residence on the Local Market, they can generally obtain an Established Resident Certificate. This gives the holder the right to live and work in Guernsey, provided the holder remains in Guernsey from this point until they have accumulated 14 years of continuous lawful residency. What is the choice of property like on the Open Market? Less than 10% of the current population lives on the Open Market, which has a stock of approximately 1,700 properties. As the properties are fewer in number and occupancy controls are less stringent, Open Market property prices tend to be higher than Local Market ones but the Open Market also includes many of the Island’s most desirable houses.
