Market Commentary

Our optimism in spring was somewhat unfounded as a bright start did not translate into hugely improved market conditions in early summer.

It has taken a reduction in the Bank of England base rates and the confirmation of a change in Government in the UK to spark the market and we have experienced a much greater sense of urgency from buyers on both the Open and Local Markets as we head towards the end of 2024. We expect this trend to continue, and perhaps grow as the Labour Governments’ tax plans unfold, and interest rates look set to ease.

WELCOME TO GUERNSEY

In advance of Rachel Reeves’s Autumn Budget, Guernsey has become an increasingly popular yet discerning jurisdiction of choice for those leaving the UK or considering leaving the UK.

With its safe and secure Island lifestyle, coupled with its “Open Market” residential property market where any British or Irish passport holder may purchase and occupy a property, the entry requirement is more straightforward than in certain other jurisdictions.

In terms of becoming tax resident in Guernsey, this is possible by simply spending a minimum of 91 nights on the Island in a calendar year. Guernsey’s tax year is a calendar year. If you spend between 91 and 182 nights on Guernsey in a calendar year (and at least 91 in a second single jurisdiction) you are a “part time tax resident”. As such you may elect to pay the standard annual tax charge of £40,000 for the year, in place of filing a full tax return disclosing worldwide income. The standard charge tax payment covers all foreign income, including Guernsey bank interest, and the first £200,000 of Guernsey source income and is available under tax law. Typically, Guernsey residents who utilise the “part time tax resident” standard charge, often will have a home (or homes) in other jurisdictions where they also enjoy spending time.

Guernsey has always been welcoming to new residents, irrespective of whether part time or permanent tax residents. The tax system offers statutory tax capping, and other incentives, to new tax residents, making the Island an attractive place to live.

The Tax caps are:

> Open Market Cap of £60,000. Available for the first four years of Guernsey residence. Requires the purchase and occupation of an open market property within 12 months of residence. The purchase must generate minimum document duty (or anti-avoidance duty) of £50,000 (property cost of £1.4m).

> Foreign income tax cap of £160,000. This is for non-Guernsey source income only. Guernsey source income remains subject to 20% tax. Guernsey bank interest is not considered Guernsey source.

> Annual tax cap of £320,000. A global cap utilised by individuals with substantial Guernsey source income.

As well as the headline tax caps available, other significant tax incentives for a new resident that should not be overlooked may include:

> Ability to claim double tax relief in Guernsey for UK corporation tax paid, where shareholder control of the UK company is in Guernsey on a UK company distribution.

> Ability to receive certain UK dividends exempt from both UK and Guernsey taxation.

> Ability to receive UK pension income, potentially including a lifetime flexible drawdown solely taxable in Guernsey.

> Ability to mitigate UK capital gains tax on gains made upon the disposal of certain UK assets.
