Section 3. Authorized Gaming Structure/Activity a.

The establishment and operation of authorized Gaming Structure/Activity shall include the following but not limited to: i. PAGCOR eGames Station (PeGS) otherwise known as Internet Casino Game Parlors; ii. Bingo including cBB; iii. Casino; iv. Lottery or Lotto; v. Offshore Gaming; and vi. Other authorized gaming activities, which may be determined by the SBLUZ.

b.

The maximum number of establishments that will be authorized to operate a Gaming Structure/ Activity in the City, or support services related thereto, shall be limited to the following:

SBLUZ-2016-001 IMPLEMENTING RULES AND REGULATIONS OF THE MAKATI CITY ZONING ORDINANCE FOR GAMING STRUCTURE AND ACTIVITY WHEREAS, Section 45 of the City Ordinance No. 2012-102 or the Makati City Zoning Ordinance authorizes the City Government of Makati to allow gaming activity/facility in the City subject to different conditions.

WHEREAS, Section 68 of the same Ordinance tasked the Special Body on Land Use and Zoning (SBLUZ) to act and approve applications for Gaming Activity/Facility, and prepare an IRR that shall prescribe other appropriate conditions for the establishment of the gaming activity/facility.

NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED BY THE SPECIAL, BODY ON LAND USE AND ZONING (SBLUZ) BY VIRTUE OF THE POWERS VESTED IN IT BY THE CITY ORDINANCE NO. 2012-102 OR THE MAKATI CITY ZONING ORDINANCE, IN SESSION ASSEMBLED, hereby adopted, as follows: RULE I - GENERAL PROVISIONS

Section 1. Legal Basis This IRR is hereby adopted based on the City Ordinance No. 2012-102 otherwise known as the New Zoning Ordinance of the City of Makati. By virtue of Executive Order No. 013, S. 2016 of the City Government of Makati, the Special Body on Land Use and Zoning (SBLUZ) hereby adopts the implementing Rules and Regulations for Gaming Structure and Activity pursuant to Section 68 of the City Ordinance No. 2012-102, otherwise known as the “New Zoning Ordinance of the City of Makati”. Section 2. Definition of Terms a. Bingo is a game of change played with cards having numbered squares corresponding to numbered balls drawn at random and won by covering such squares in a row depending on the pattern. b. Casino is structure either built near or combined with hotels, restaurants, retail shopping, cruise ships or other tourist attactions which houses and accommodates certain types of gambling such as roulette or blackjack, baccarant, chemin de fer, among others. c. Churches/Place of Religious Worship is an institutional facility that is designed and particularly adapted for the primary use of conducting, on a regular basis, formal religious services by a religious congregation. Ministries such as those located in buildings conducting once or twice weekly services and/or bible studies shall not be considered in the distance restriction. d. EGGAR refers to the Engineering, Geological and Geohazard Assessment Report. e. EIA refers to the Environmental Impact Assessment. f. Gaming Activity refers to legal gambling practices or involvement. g. Gaming Structure refers to any facility or portion thereof used for games of change, which are conducted in a properly regulated environment, and may include bingo hall, commercial casino, lottery station, slot machines, video games, etc. h. Lotto refers to a gaming activity typically with an accumulating jackpot, in which participants play numbers of their choice in a random drawing. i. MCZRC refers to Makati City Zoning Review Committee. j. Offshore Gaming refers to the offering by a license of PAGCOR authorized online games of chance via the inernet using a network and software program, exclusively to offshore authorized players excluding Philippine citizens residing abroad, who have registered and established an online gaming account with the licensee. Offshore gaming shall have three (3) components, namely: i. Prize consisting of money or something else of value which can be won under the rules of the game; ii. A player who: 1. Being located outside of the Philippines and not a Philippine citizen, enteres the game remotely or takes step in the game by means of a communication device, such as the internet; and 2. Gives or undertakes to give, a monetary payment or other valuable consideration to enter in the course of, or for, the game; and iii. The winning of a prize is decided by chance. k. Pagcor eGames Station (PeGS) refers to Internet Casino Game Parlors that are offered to players within the Philippines and/or receive bets within the Philippines. l. Philippine Offshore Gaming Operators (POGO) refers to entities that provide and participate in offshore gaming services, i.e., provides the game to players, takes bets and pays players’ winning. m. POGO Licensee refers to a POGO duly licensed and authorized by PAGCOR to provide offshore gaming services. It does not include POGO Gaming Agents, POGO Service Providers and/or POGO Gaming Support Providers who provide only a particular or specific component of the offshore gaming activities to the POGO. n. POGO Gaming Agents refers to the representatives in the Philippines of offshore based licenses duly registered with PAGCOR. o. POGO Service Providers refer to the entities duly registered with PAGCOR who provide components of offshore online gaming operations: i. Gaming Software/Platform Provider — for gaming systems and games sports book, pool betting, etc. ii. Business Process Outsourcing Provider — for call centers, IT support, data streaming/content services. The data streaming/content refers to the real time online games produced from a live dealer studio set-up, streamed via the internet to the website of the POGO Licensees. The service of POGO Service Providers excludes the taking of actual bets. p. POGO Gaming Support Provider refers to a business entity duly registered with PAGCOR that produces proprietary products and services that may or may not be found in the gaming system of the POGO Licensee, but is an important part of the online gaming set-up, e.g., payment solutions, player registration. q. Schools/Learning Institutions. Any educational institutions duly registered with the Department of Education (DepEd) or the Commission on Higher Education (CHED). Other schools/learning institutions not registered with these agencies shall not be considered in the distance restriction. r. TIA refers to Traffic Impact Assessment. s. UDD refers to the Urban Development Department of the City Government of Makati. t. UIA refers to Utilities Impact Assessment.

In the event that the number of establishments for a particular gaming structure/activity indicated above has been reached, the Board can adjust the limits as the circumstances may warrant, or it may, subject to its evaluation of the substantive and documentary requirements provided herein, recommend to the City Council the approval of the application to operate the gaming structure/activity. Should the City Council adopt the recommendation of the Board, it shall issue a Resolution for such purpose. RULE II – REQUIREMENTS

Section 4. a.

Substantive Requirements Offshore Gaming and PeGS i.

The establishment, maintenance, and operation of any Offshore Gaming (POGO Licensee, POGO Gaming Agents, POGO Service Providers and POGO Support Services) or PeGS shall be allowed in hotels/resorts, malls, arcades, and commercial buildings located in C2, C3, C4 and SMU zones; ii. The operation of Offshore Gaming or PeGS will not be detrimental to the general welfare of the community; iii. The use and enjoyment of the surrounding property shall not be substantially impaired. iv. The operation of Offshore Gambling or PeGS shall not create or contribute to traffic congestion; v. The streets providing access to such use shall be adequate to handle the traffic to be generated; vi. Offshore Gaming or PeGS shall be located at least 200 meters away from any school/learning institution and church/Place of Religious Worship; vii. Offshore Gaming or PeGS shall have a distance of at least one (1) kilometer away from any existing gaming structure duly licensed by the City Government of Makati. If the Offshore Gaming or PeGS is located inside the shopping mall, hotel or resort, or commercial building in a tourist or Entertainment/Amusement Center, the 1-kilometer distance will not be required; and viii. The entity that intends to undertake Offshore Gaming or PeGS within the City must submit a license or certificate of registration, as the case may be, duly issued by PAGCOR within 20 days from receipt by the applicant of a copy of the Resolution of No Objection approved and issued by the SBLUZ; and ix. Such other appropriate conditions and safeguards that maybe required by the Special Body from the Proponent in order to minimize adverse effects on the character of the surrounding area. Bingo i.

The establishment, maintenance, and operation of Bingo Terminal and the like shall be allowed only in C2, C3, C4 and SMU zones; ii. The operation of Bingo will not be detrimental to the general welfare of the community; iii. The use and enjoyment of the surrounding property will not be substantially impaired; iv. Its operation shall not create or contribute to traffic congestion; v. The streets providing access to such use will be adequate to handle the traffic to be generated; vi. Bingo proposed site shall be located more than 200 lineal meters away from school and Churches/Place of Worship; vii. The terminal shall have a distance of at least I kilometer away from any existing bingo venue/s and at least one (1) kilometer away from any existing gaming structure/ activity approved by PAGCOR. If the terminal is located at the shopping mall, hotel or resort, or commercial building in a tourist or Entertainment/Amusement Center, the 1-kilometer distance will not be required; and viii. Such other appropriate conditions and safeguards that maybe required by the Special Body from the Proponent in order to minimize adverse effects on the character of the surrounding area. Casino i. The establishment, maintenance, and operation of the Casino and like gaming activities shall be allowed only in C2, C3, C4 and SMU zones; ii. Its operation will not be detrimental to the general welfare of the community; iii. The use and enjoyment of the surrounding property will not be substantially impaired;
