Down by the bay

Awealth of recent data about Chesapeake Bay and the delmarva Peninsula is giving agriculture and the nutrient management industry a lot to think about in terms of total maximum daily load (tmdl) targets – and it’s important to be educated about this key issue.

the american Farm Bureau Federation (aFBF) announced this past fall that it is appealing a district court decision upholding the u.S. environmental Protection agency’s tmdl limits imposed on nutrients entering the Chesapeake Bay area.

the aFBF had originally challenged the limits, set in 2010, on the amount of nitrogen, phosphorus and sediment that can enter the watershed, due to concerns the e Pa had been granted a wide frame of reference regarding local land use and development.

“this is a wrongly decided case that has dangerous implications for farmers and many others in the Chesapeake Bay area and nationwide,” said aFBF president Bob Stallman. “this case isn’t about whether or not to protect the Chesapeake Bay – we all share that goal. this case is about whether e Pa can dictate where farming will be allowed, where homes can be built, and where businesses can be established. By taking over decisions like that, e Pa has turned the whole concept of cooperative federalism out the barn door. meanwhile, the american Water resources association Journal themed its October 2013 issue around Chesapeake Bay Total Maximum Daily Load (TMDL) Development and Application according to publication officials, 10 papers plus an introduction were published in the journal, telling the story of the Chesapeake Bay tmdl from developing water quality standards through to establishing allocations – an issue they described as results of a recently published “an up-to-date picture of the result of 30 years of restoration effort.”

that restoration effort might take a bit longer than expected, given the results of a recently published u.S. geological Survey (u Sg S) study on the delmarva Peninsula. according to that research, it may take several decades for current water-quality management practices to achieve their goal due to lag response time, which is the time between implementing management actions and the resulting improvements.

the study, conducted by Ward Sanford, shows that the ages of groundwater in Chesapeake Bay and delmarva can range from less than a year to centuries, with the median age being between 20 and 40 years. these results indicate that groundwater age in the area is much older than was originally estimated. that estimation was based on the age of groundwater located west and north of Chesapeake Bay, which has a median age of 10 years.

“the u Sg S research found that in some areas of the delmarva, the groundwater currently discharging to streams is gradually transitioning to waters containing higher amounts of nitrate due to fertilizer used during the 1970s through the 1990s,” the report states. “Similarly, the total amount of nitrogen in the groundwater is continuing to rise as a result of the slow groundwater response times.”

according to Sanford’s model, a 12 percent increase in nitrogen loads from the delmarva to Chesapeake Bay is expected by 2050 if additional management practices are not put into place.

all of this information provides much to consider and raises many questions: What happens if the e Pa tmdl models are flawed? is the region shooting for targets that are unattainable? and, given the new information on lag response time, will anyone be able to meet the targets in the required time?

hopefully, the answers will emerge as this important appeal goes forward.

White Acres Farm,

a U.S. Poultry and Egg Association environmental winner, has found ways to make litter handling both sustainable and profitable

Garry Staples hasn’t always been a farmer, but the choice he made 12 years ago to get into poultry farming turned out to be a good one. this year, he and his family, who run White acres Farm, received the u.S. Poultry and egg association’s Family Farm environmental excellence award and he’s looking ahead to find new ways to improve upon farming and new uses for chicken litter.

Getting started

garry says when he decided to get into poultry farming it happened fast. he and his wife, denise, checked out a poultry farm in Steele, ala., on a Saturday.

“We bought it the next monday,” says garry with a laugh.

From that point on, it’s been “all about chickens” for the Staples family. garry’s passion for creating not only a profitable but also an environmentally healthy farm has been passed on to his children and grandchildren. in addition to garry and denise working White acres Farm, their son Jeremy and daughter-inlaw Becky also live on the farm and work it with them, along with their grandson Justin.

“my daughter tori and son-in-law ryan, also own their own poultry farm,” says garry.

Upgrades

When garry purchased the original farm, there were four barns and his first order of business was to upgrade them and

create a better environment for chickens.

“We added tunnel ventilation,” says garry. “We have 14 fans per house and 140 foot cool pads at each end too. it’s as cool in the barns as it is in a home during the summer.”

garry didn’t stop with four barns. Over time, he built four more, and today White acres has eight barns – six that are 40 feet by 500 feet and two larger ones that measure 54 feet by 500 feet. all the barns use the same ventilation system and together house 185,000 chickens.

Handling litter

With eight barns and nearly 200,000 chickens, garry and his son have become experts at managing litter.

“We have 600 tons per grow-out, which is about every 60 days,” says garry.

g arry is a contract grower for Pilgrim’s Pride, and once the company picks up the grown chickens, g arry, his son and his grandson have approximately two weeks to remove the litter from the barns and prepare for the

next set of chicks.

most of the manure is moved to a storage barn 40 feet wide, 80 feet long and 20 feet high. the storage was constructed specifically to house litter from the poultry barns and can hold up to 800 tons at one time. it has a concrete floor and garry built a ramp to allow semi trucks to come up and collect 25-ton loads.

Currently, garry has a buyer for his litter who picks up 25 tons at a time. the buyer takes it to tennessee and sells it to farmers there who spread it on their row crops.

“We don’t have a lot of row crops in this area, so it works out well,” he says.

how did garry find his buyer?

“i put it on Craigslist that we had litter to sell and it took three days to find someone,” he says with a laugh.

it’s turning out to be a win-win for everyone. garry’s farm is making money off the litter and garry’s buyer – who also hauls grain from tennessee down to alabama – now saves himself an empty haul back by picking up litter at White acres. not to mention, the farmers up in tennessee are getting some

primo fertilizer.

“We sell it for $20 a ton and load it for them,” says garry. “We’re able to sell about 80 percent of our litter.”

Windrow works well

the remaining 20 percent of litter is used for bedding for the incoming chicks and for composting the dead birds.

after a majority of the litter as been removed, garry’s son and grandson use a Windrow machine to handle what’s left in the house.

“We have an lvi windrow machine. When we run it through the barn, it piles the litter into two piles. the litter goes through a heat and then we repeat the process, putting it into one pile and letting it heat,” says garry. “it really helps with getting the hard pan off the floor. it also helps keep the litter drier, and it removes pathogens and a lot of the ammonia as well.”

and the process, he says, takes about six days.

For those who are expecting the windrow to take care of all the ammonia, garry says you should lower your expectation. “Some litter treatment is still

required, but not as much.”

Once the litter is composted (or pasteurized), and spread out four to five inches as bedding, it is ready for the incoming chicks.

County water board assists farmers the windrow system is ideal, says g arry, but unfortunately, it’s also expensive. the machine costs around $17,000 and requires a 70-horsepower tractor to pull it. this is a big expense for some farmers, especially for a piece of equipment that will be used four times a year.

to assist farmers who would like to use the system but can’t afford it, the St. Clair County Soil and Water Board purchased a windrow machine and leases it to farmers for $50 a house. g arry says this system is working well, and farmers just call in and schedule a time.

a nd for those farmers who don’t have the 70-horsepower tractor, g arry, who has a large tractor, makes himself available.

“We’ll go do it for them. they just pay us for our time.”

Composting

the litter remaining in the barn that isn’t used for bedding the barns is used for composting the dead birds.

“We layer the compost and the birds, and the process takes about 80 days,” says garry.

Once the dead birds have been converted into an organic matter, that matter is spread on the farm’s approximately 100 acres of hay fields. the hay that is grown is then fed to the 75 head of registered Charolais cattle that the Staples family raises.

White acres Farm is a Ca FO and is required to take regular soil samples.

“We take soil tests every three years, but we aren’t concerned about phosphorus levels,” says garry. “if we couldn’t sell 85 percent of our litter and had to spread it all, then it would be an issue.”

Testing

in addition to the acres of hay that they spread their litter on, garry is looking at spreading litter on the 260 acres of timber they own.

he says one of the primary reasons he purchased the timberland was to help maintain the quail population that is losing its habitat.

But why stop there? Why not spread litter in the forest, thereby helping the farm dispose of the litter and, at the

same time, helping both the quail and timber production.

garry is selectively logging now, leaving space to run his tractor and preparing for future spreading.

this isn’t a new idea.

“tree farms using litter have seen an increase as forests can absorb and retain relatively large amounts of the elements found in poultry litter without causing environmental problems. the university of arkansas is doing studies to find the long-term effects,” wrote Janet Scharbor in the Change agent.

Environmental award

the Staples family’s hard work and innovation was recognized this year when they received the 2013 u .S. Poultry and e gg a ssociation’s Family Farm e nvironmental e xcellence award.

Taking change in stride

receiving the award is great, but awards aren’t why the Staples family do what they do. they believe if you take care of the land, it takes care of you.

“We keep up the farm like we would a yard,” garry says.

For example, they even maintain the 1,700-foot road in front of the farm, keeping it sprayed and clean.

“We also like to stay a little ahead.” if they see regulations or rules that will be going into effect, they’d rather be ahead of the curve than be one of those forced into it.

“i don’t mind, if it’s going to pay for itself,” says garry.

One of the bigger changes they made recently was going from propane to natural gas. it took a little work, but it’s paying off big. the fuel savings he’s experiencing are in the neighborhood of 40 percent.

Future of farming

garry says the poultry business can be tough, especially for contractors who are getting pushed toward costly changes. But it’s also satisfying. the Staples family enjoys its chickens and garry’s happy he made the decision to “go poultry” 12 years ago.

In addition to the acres of hay the Staples spread their litter on, they are looking at spreading litter on the 260 acres of timber the family owns.

Poultry manure vetted as potential cheap nutrient source for pollution-fighting algae

Carbon dioxide is a major contributor to global warming. By consuming carbon dioxide, plants like micro-algae can play a crucial role in reducing these emissions to the atmosphere. d iverse species of micro-algae live in aquatic environments and certain algae species have shown huge potential for helping the fossil fuel industry, in particular, reduce its emissions.

micro-algae are photosynthetic organisms that need light, water, carbon dioxide and nutrients – mainly nitrogen

and phosphorus. they can feed on compounds like carbon dioxide, nitrogen oxide, sulfur dioxide and volatile organic compounds emitted from such facilities as coal-fired power plants, releasing beneficial oxygen in the process and growing into a plant commodity with considerable commercial potential. addition of nutrients like those in poultry manure makes the micro-algae grow faster and increases its production, like fertilizer added to a corn crop.

“Chicken manure is high in nitrogen, phosphorus and potassium. it contains the main nutrients that algae need,” says, Bob mroz, president and chief executive officer of a maryland-based biotech company called hY-te K Bio, which is developing and marketing patented technology using micro-algae for mitigation of greenhouse gases.

micro-algae have immediate commercial potential in the fight against global warming, but mroz says the real money is in the sale of the micro-algae plant material itself as well as the highquality oxygen it generates through photosynthesis in the bioreactor tanks where it is grown. that’s because microalgae contain valuable chemicals, such as lipids, that have existing commercial uses as a source of omega-3 fatty acid oil; as an additive in cosmetics, nutraceuticals and paint; and as an animal feed supplement. mroz, who is also an electrical engineer and computer programmer, already has an overseas buyer for as much dry micro-algae material as the company can produce.

“the market is ridiculously large,” says mroz, speaking about the demand from a variety of industries to mitigate HY-TEK Bio

University of Maryland scientists collected poultry manure from various area sources to test if they could economically extract the nutrients and deliver them in liquid form.

their greenhouse gas emissions, with 600 coal-fired power plants in the u.S. alone and 50,000 globally. the reality, he adds, is that at present there is little legislative requirement for industries to mitigate their greenhouse gas emissions. So from a business perspective, while hY-te K Bio is primarily focused on marketing the microalgae’s proven greenhouse gas mitigation potential, it also wants to harvest and market the high-value micro-algae plant material itself and the oxygen it produces.

Since 2009, when the company was founded, it has come a long way in a short period of time. it started with two friends, mroz and his vice-president of marketing, Jack French, looking for a cheap source of biofuel to use in an ultralight aircraft and has evolved into a company that has developed a patented process and bioreactor to use micro-algae in greenhouse gas mitigation. the challenge for the company has been to find an inexpensive source of nutrient to fertilize the micro-algae and accelerate its growth to perform as advertised in a greenhouse gas mitigation application. mroz says that as the company worked to develop its technology, it encountered organizations like the Chesapeake Bay Foundation, which expressed its concerns about poultry manure seeping into the region’s water drainage system and causing considerable algae growth in areas like the Chesapeake Bay. Because of this concern, and the availability of grants, hY-te K Bio approached researchers at the university of maryland, which it has been working with extensively for the past four years, to investigate poultry manure’s potential as a cheap nutrient source for micro-algae. the company already has a working demonstration facility with four bioreactors consuming flue gas emissions from a three-megawatt, biogasfueled power plant attached to a City of Baltimore wastewater treatment plant. the city provided a $255,000 grant for the installation.

through grants provided by hY-te K Bio and the maryland industrial Partnership, university of maryland scientists are now testing poultry manure as a natural fertilizer to feed micro-algae.

the overall plan is to develop a pilot project that demonstrates a process that, in addition to showing how the microalgae mitigates greenhouse gases, also demonstrates how the poultry manurederived nutrients can be applied to maintain the growth and health of the micro-algae.

Should the application prove successful and commercially attractive, this research could pay a significant environmental and economic dividend to poultry and egg producers, as well as help to solve a growing global problem. not only would producers of poultry manure have a new and better method for manure disposal, but the process also could create a new potential income stream for them.

dr. Feng Chen, an associate professor at the university of maryland Centre for environmental Science, says there are about 800,000 tons of poultry manure currently being generated annually in the maryland and midatlantic area of the united States. most of the manure is land applied as a form of disposal, but the problem is that sometimes the nutrients leach into the water drainage system. an alternative use of this poultry manure as fertilizer for micro-algae would direct that manure into a new, non-polluting direction. dr. Chen says that if the technology is proven and shown to have commercial potential, the nutrient extracted from the total amount of poultry manure being generated annually in the maryland/ midatlantic area would easily be consumed as a nutrient supply for micro-algae in probably just a few, large industrial installations.

One area that has shown an interest in what the university and hY-te K Bio are accomplishing with the use of microalgae in greenhouse gas mitigation is the massive fossil fuel industry in alberta, which has been identified as a notable contributor of carbon dioxide to the atmosphere, especially in its oil sands mining and processing operations.

the u niversity of m aryland research has just started. i t is being conducted at a basic level through the development of a system to economically extract the nutrients from the raw poultry manure, a process leading to methods of controlled release of the nutrients to the micro-algae to achieve certain performance targets.

dr. Chen is working with dr. russell

hill, director and professor at the institute of marine and environmental technology (imet) at the university of maryland Center for environmental Science. dr. hill says the university has spent the past two decades conducting research related to micro-algae, particularly as it relates to aquaculture. For example, imet is improving a method for growing micro-algae that produces a high-value pigment that is added to the water where salmon are raised in fish farms. it gives the fish muscle the pink color that it normally acquires when the salmon consume micro-algae in a

natural environment.

research in north america related to commercial applications of microalgae has a long history dating back to the energy crisis in the mid-1970s because of its potential use in the production of biofuels. however, since then, it has experienced numerous peaks and valleys of funded research. Both researchers agree that the current elevated interest in the commercial/ industrial use of micro-algae is being driven to a great extent by growing interest in the development of the bioeconomy, including the manufacturing

of products such as biofuels, bioplastics, animal feeds and nutraceuticals, as well as the use of micro-algae to absorb nutrients from waste water. What’s also driving current research is development of technology investigating the plant’s potential in greenhouse gas mitigation. there are many different strains of micro-algae – both good and bad. Some are extremely toxic and sometimes result, for example, in massive fish die-offs. d r. Chen achieved a breakthrough in micro-algae science when he identified the ht B1 strain, which is particularly well suited for use in greenhouse gas mitigation. i t is a local strain, so its use wouldn’t involve introducing a foreign strain into the local ecosystem.

While the research project is still in its early stages, the u niversity of m aryland researchers say that they are “quite encouraged” by the results they have witnessed so far in using poultry manure nutrients to encourage micro-

algae growth. the poultry manure they are using was collected from various commercial operations in m aryland. n ow, the university is working on such issues as how to develop a consistent liquefied nutrient product from raw poultry manure, given the variability of the raw material from one poultry operation to another. m roz says while there is some variability, they all seem to work well as nutrients for microalgae growth. the main issue is cost of production involved in taking it from its raw form to a liquid.

“When you are talking about 500 to 1,000 of these bioreactor tanks to mitigate a power plant, the nutrient has to be really, really cheap,” says mroz. about 400 of the company’s tanks can fit on one acre, “but we can use multi-story facilities to increase land usage.”

in addition to establishing an inexpensive process to convert the raw poultry manure to liquid form for use as a micro-algae nutrient, what hY-te K Bio

hopes to achieve through its research project with the university of maryland is to determine if the brown color of the liquid manure is a deterrent to microalgae growth because the algae needs as much light as possible to grow.

Should the university successfully develop a method to cost-effectively manufacture a clear, odorless liquid nutrient product from raw poultry manure, mroz says, this also has potential as a marketable, commercial product.

dr. hill says the university’s research related to using poultry manure as a nutrient source for micro-algae is novel.

“if greenhouse gas mitigation using micro-algae is ever going to really be used on a large scale, the nutrient requirement will be huge,” says dr. hill. “it could really help to solve the problem of disposal of chicken manure, and potentially it could even put greater value on the chicken manure.”

The results are promising from lab work conducted by the University of Maryland, which shows that poultry manure is a good nutrient source from which to grow micro-algae.

EDF Renewable Energy acquires Heartland Biogas Project

ed F renewable energy, headquartered in San diego, Calif., announced Sept. 5 it has closed on the membership interest Purchase agreement to acquire the heartland Biogas Project with heartland renewable energy, llC. the 20 megawatt-equivalent anaerobic digester and renewable natural gas (rng) facility has commenced construction activities. Biogas deliveries are expected to begin by the end of first quarter 2014. the project, located in Weld County near laSalle, Colo., will use a complete mix anaerobic digester system to produce up to 4,700 mm Btu of biogas daily, making it one of the largest anaerobic digester facilities in the united States. the anaerobic digestion system converts organic feedstock and dairy cow manure into raw biogas. the raw biogas is then processed into pipeline quality rng after being conditioned to pipeline grade, the rng will be supplied to Sacramento municipal utility district (S mud) through a 20-year gas Purchase agreement (g Pa).

“this acquisition marks a significant milestone in the expansion of our renewable portfolio as ed F renewable energy’s first project in the anaerobic digestion segment,” commented r alph daley, vice President, landfill gas holding for ed F renewable energy. “Our experience gained though the management and operation of the greentree and imperial landfill Biogas projects, as well as the european biogas experience of our parent company will provide the knowledge base to efficiently manage the construction and operations. We are fortunate to combine our skills with the anaerobic digestion experience of the heartland renewable energy team.”

energy, llC, confirms the acquisition, saying, “We have a great partner with ed F renewable energy and we look forward to a long-term relationship resulting in the successful construction, startup and operation of this exceptional project.”

ZooShare awarded contract to sell into Ontario grid

ZooShare Biogas Co-operative inc. recently announced the company has received a Feed-in tariff (F it) contract offer from the Ontario Power authority for its 500-kilowatt biogas plant, to be built at the toronto Zoo in 2014.

ZooShare, which plans to generate renewable electricity from zoo animal manure and food waste, is funding the project through the sale of bonds to Ontarians who want to help the environment, support the zoo, and at the same time make a healthy return on their investment. the bonds pay seven percent per year for seven years, but purchasers need to be a co-op member to get them. membership costs $100, and those who join the co-op before Sept. 1 will get $100 off the first bond purchased, essentially making membership free.

each year, the co-operatively owned biogas plant will turn the zoo’s manure output (equal to the weight of 15 pandas) and food waste from grocery stores around the greater toronto area into enough clean, renewable electricity to power 250 homes. resulting emission reductions are equivalent to removing 2,100 cars from the road, and annual contributions to the zoo will total at least $50,000.

Krikke Pork, greenwich, Ohio – howard and Jane Krikke raise replacement gilts for Kalmbach Swine management, based in upper Sandusky, Ohio. Federal Court ruling affirms Chesapeake Bay blueprint

Pennsylvania Federal Judge Sylvia r ambo recently issued a ruling upholding Chesapeake Bay clean-up efforts and rejecting the arguments of the Farm Bureau, the national association of home Builders and others.

the ruling affirmed that the e Pa, working with the states, has the authority to set science-based pollution limits.

less than two weeks after the e Pa established pollution limits for the Bay, as required by the Clean Water act for any body of water not meeting specific water quality standards, the american Farm Bureau Federation and the Pennsylvania Farm Bureau filed a complaint in federal court to throw out the limits – known legally in the Clean Water act as a total maximum daily load or tmdl

not long after the original complaint was filed, the two initiating groups were joined by the national association of home Builders, the national Chicken Council, the national Corn growers association, the national Pork Producers Council, the national turkey Federation, the Fertilizer institute, and the u.S. Poultry & egg association.

the Chesapeake Bay Foundation (CBF) and its partners – including Citizens for Pennsylvania’s Future, defenders of Wildlife, Jefferson County (W v) Public Service district, midshore r iver Keeper Conservancy, and the national Wildlife Federation – intervened in the lawsuit to protect the cleanup.

Coalition suing EPA

a coalition of community, animal welfare and environmental organizations have filed a lawsuit against the united States environmental Protection agency challenging the agency’s withdrawal of a proposed rule that would have allowed the e Pa to collect basic information – like locations and animal population sizes –from factory farms.

the Center for Food Safety, environmental integrity Project, Food & Water Watch, the humane Society of

LWR installing manure system on Wisconsin dairy

the first Wisconsin dairy to install livestock Water recycling, inc.’s (lW r) manure treatment system will be Shiloh dairy in Brillion, Wis.

the lW r manure treatment system will recycle clean water and concentrate the valuable nutrients contained in this Wisconsin dairy’s 30 million gallons of livestock manure.

Shiloh dairy is a large family-owned farm with 1,800 cows and 1,800 heifers that uses a flush flume manure system. the implementation of the lW r system will allow the dairy to continue to expand its operations without acquiring additional land base for nutrient management.

the lW r’s system is expected to recycle 18 million gallons of clean water, six million gallons of liquid nutrient concentrate (ammonium sulfate and potassium), and 6,000 to 12,000 tonnes of solid fertilizer (organic nitrogen and phosphorus) from the manure.

“the nutrient concentrates will supply micronutrients and organics to the soils beyond the n, P, K and S,” said ross thurston, president of lWr the recycled water can be used for cleaning or for watering of cattle, stored for crop irrigation or released. the fertilizer nutrients can be strategically land applied to maximize fertilizer value or sold to generate a new revenue stream.

“We are really excited about the installation of our first system in Wisconsin,” said thurston. “We want to provide farmers with a cost-effective solution to manage their manure. an installation can expect to generate a significant double digit return on investment.”

Pichon optimizes, simplifies control of slurry tankers

in order to simplify and optimize the daily use of its slurry tankers, Pichon has designed and developed a touch screen control box called the tact-master. this new control system enables to automate all the user sequences from vacuuming to spreading. it comes as an extra to the two existing options: the electric control box and the electronic Flowmeter system.

the navigation system is done through a touch screen or a joystick for smoother control and space optimization of the tractor’s cab. the seven-inch screen (16/9 format) also enables to visually follow the various steps of the working sequence.

Four modes are offered on the touch screen (as rolling out menus):

• vacuum mode

• transport mode

each mode can be either automated by a simple impulse on the joystick or manually controlled function by function. during the selection of the spreading tool (dribble bar, injector or splash plate), the automation integrated into the screen carries out a subroutine in relation to the selected tool, allowing the automatic opening and spreading sequence. this compact and centralized control unit, which gathers all the functions of the machine, enables the users to focus on their driving and thus avoids the numerous operations of a standard control box.

Permit not needed, court says

Threatened with huge fines and possible imprisonment, West virginia poultry producer lois alt decided to stand up to the u.S. environmental Protection agency in court. in a case with implications for livestock producers in California and nationwide, alt tried to sort out whether stormwater discharges from her farm actually require a federal permit. her case won support from the West virginia and american farm bureaus, which intervened in the court case on her behalf. recently, alt won an important decision when the u.S. district Court for the northern district of West virginia ruled against the e Pa, saying that ordinary stormwater from alt’s farmyard is exempt from national Pollutant discharge elimination System permit requirements.

alt filed suit against the e Pa in June 2012, after the agency threatened her with $37,500 in fines each time stormwater came into contact with dust, feathers or small amounts of manure on the ground outside of her poultry houses as a result of normal farm operations. the e Pa also threatened separate fines of $37,500 each day if alt failed to apply for an n Pde S permit for such stormwater discharges.

“this lawsuit was about e Pa’s tactic of threatening farmers with enormous fines in order to make them get permits that are not required by law,” said american Farm

Bureau Federation president Bob Stallman. “lois alt was proud of her farm and her environmental stewardship, and she stood her ground. We’re proud to have supported her effort.”

alt operates an eight-house chicken farm with a ventilation system and a covered litter storage shed, a compost shed, and feed storage bins. Some particles of manure have been spilled and feathers have escaped the chicken houses. and, on occasion during rainstorms, runoff has flowed across a neighboring grassy pasture and into mudlick run, which is designated a “water of the united States” under the Clean Water act. alt said when she first received notice of violation from the e Pa she asked what she could do to comply with regulations.

“they couldn’t tell me anything,” she said. “all they could say, repeatedly, was, ‘get a permit,’ no matter which direction i went. We knew it was not right.”

in ordering alt to seek a permit, the e Pa took the legal position that the Clean Water act exemption for “agricultural stormwater discharges” does not apply to farms classified as concentrated animal feeding operations (CaFOs), except for areas where crops are grown. in other words, any areas at a CaFO farm where crops are not grown and where particles of manure are present would have required a permit for rainwater runoff.

“We are pleased the court flatly

rejected e Pa’s arguments and ruled in favor of lois alt,” Stallman said. “the outcome of this case will benefit thousands of livestock and poultry farmers who run their operations responsibly and who should not have to get a federal permit for ordinary rainwater from their farmyards.”

Kari Fisher, associate counsel for the California Farm Bureau Federation, said the case is important for California livestock producers with concentrated animal feeding operations.

“the alt case reiterates that producers do not have to obtain a federal permit for ordinary agricultural stormwater or rainwater leaving the farm,” Fisher said. “it also reaffirms that incidental litter or manure are related to raising poultry and therefore are related to agriculture.”

aFBF attorney danielle quist said that in standing up to the e Pa, alt put herself in a difficult position but didn’t want other farmers and ranchers who are good stewards of the environment to face a similar predicament.

“She didn’t want other farmers to be bullied by the ePa,” quist said. “She stood up for herself, but she also stood up for others. this is a terrific win for farmers and ranchers in West virginia and nationwide.”
