On Wednesday, Oct. 5, a three-judge panel in the U.S. Fifth District Court of Appeals sent a chill down the spines of every DACA recipient in the country as it ruled the Obama-era program “unlawful,” affirming a previous ruling by a Texas judge that said the former president overstepped his authority when he created the program through a memo.

In light of recent efforts by the Biden administration to put further executive protections in place for the program, the panel sent the case back to a lower court for consideration of those new elements.

Like Texas Judge Andrew Hanen that ruled before, the entire three-judge panel that called DACA “unlawful” was also made up entirely of Republicans.

Also like Hanen, the panel did not shoot down the program in its entirety, mandating that the government should not “take any immigration, deportation or criminal action” against DACA recipients that it “would not otherwise take.”

Renewal requests for DACA can continue for the time being, but no new applications will be accepted. Given its current trajectory, it is very likely the DACA program will get another date with a much more conservative Supreme Court in the near future. The last time the program was debated in the highest court in 2020, the justices ruled 5-4 in favor of overturning the Trump administration’s termination of DACA, with Chief Justice John Roberts joining Justices Stephen Breyer, Ruth Bader Ginsburg, Elena Kagan and Sonia Sotomayor. In response to the Fifth District Court’s opinion, Biden said he was “disappointed.”

“The court’s stay provides temporary reprieve for DACA recipients but one thing remains clear: the lives of Dreamers remain in limbo,” he continued.

The president and many Democratic members of Congress also used the appeals court’s decision to reignite calls for legislation to provide a pathway to citizenship for DACA recipients and the wider undocumented immigrant population.

“This decision makes 100% clear that the options for preserving DACA in the courts are dwindling and essentially nonexistent at this point. We really need Congress to step up,” said Jess Hanson, a staff lawyer at the National Immigration Law Center.

Regarding the children of undocumented immigrants, the legislation journey in Congress has been an ongoing discussion for the last two-plus decades.
