The National Benefit Fund believes it is a “grandfathered health plan” under the Patient Protection and Affordable Care Act (the “Affordable Care Act”). A grandfathered health plan can preserve certain basic health coverage that was already in effect when that law was enacted in 2010. Being a grandfathered health plan means that this plan may not include certain consumer protections of the Affordable Care Act that apply to other plans, for example, the requirement for an external review process for claims appeals. However, grandfathered health plans must comply with certain other consumer protections in the Affordable Care Act, for example, the elimination of lifetime limits on benefits. The Wage Class III plan is not a grandfathered health plan. Questions regarding which protections apply and which protections do not apply to a grandfathered health plan can be directed to the Plan Administrator at (646) 473-9200. Having given your all on the frontlines of healthcare, you deserve it. This issue of For Your Benefit is designed to support you, with resources and tips for your physical, mental and financial well-being. Our Chief Medical Officer, Dr.Van H. Dunn, has important information to share about the best ways to check in and stay on track.

When things get overwhelming for you or your loved ones, know that we are expanding the array of mental health resources available to support you. Taking care of your emotional well-being is as important to your physical health as it is to your mental health. We all may experience stress, anxiety or depression at different times in our lives, and it is well documented in the medical community that these can lead to heart attacks, strokes, chronic conditions and even death.

CHIEF MEDICAL OFFICER These past few years have been challenging, taking a toll on the physical and emotional health of all of us.

For healthcare workers and their families, it has been especially acute. Now that we have left the harshness of winter behind us and stepped into the sunshine of spring, it is time to renew our commitment to our physical and emotional well-being—one step at a time.

Protect Your Physical Health Catching hidden

During the COVID-19 pandemic, while many conditions early can people got vaccinated against the virus, many missed help you live a routine vaccinations—such as for the flu, HPV, MMR LONGER, (measles, mumps, rubella) and hepatitis—and lifesaving HEALTHEIR cancer screenings. So, if you have not visited your doctor’s office in a while, go ahead and schedule that LIFE appointment. Even if you are feeling great, there could be hidden conditions that your doctor should screen for. Catching these conditions early can keep you on your path to health and help you lead a longer life.

Enjoy the extra daylight and sunshine outdoors by taking a walk.

That is why it is important to have a doctor you can trust, who listens to you and who you feel comfortable talking with. Relationships matter, and so do you.

Protect Your Emotional Health Reducing stress Many of us have suffered from greater levels of stress and anxiety can during the pandemic. An April 2021 national survey from the Kaiser Family Foundation and Washington DECREASE Post showed that almost two-thirds of frontline CHRONIC healthcare workers said that worry related to the CONDITIONS pandemic negatively affected their mental health.

Something as simple as deep breathing can help reduce stress. Reducing stress and anxiety can decrease your risk of high blood pressure, obesity, gastrointestinal distress and other chronic conditions. So, start breathing deeply, and if you would like to talk to someone, you can reach out to our Wellness Member Assistance Program social workers to help you find a therapist or you can go directly to our network or Teladoc to find one.

Knowledge Is Power: Know Your Numbers, Protect Your Health It’s simple: Preventive screenings save lives.

Knowing your health stats, like blood pressure, cholesterol and blood sugar, and checking them against health guidelines, can help you better manage ongoing conditions and alert you to any problems that could be brewing. Use the chart for quick reference of healthy ranges and make sure you’re up to date on recommended screenings and check-ups with your primary care provider.

The Benefit Funds’ Peer-to-Peer Mentoring Programs, administered by InquisitHealth, connect members who want support to keep their Type 2 diabetes or hypertension under control from someone like them who is successfully managing their condition. Mentors coach by phone, text message reminders and check-ins—and can earn up to $16 an hour. If you are interested, think about applying and helping a fellow member a few extra hours a week.

Your Mental Health Matters We may finally be turning the corner on the COVID-19 pandemic, but the impact on our mental and emotional health lingers. Many frontline healthcare workers continue to struggle with stress, depression and burnout. If this sounds familiar, here’s what you need to know to care for yourself.

Many kids aren’t comfortable talking about their feelings—especially with their parents—so most symptoms of mental health struggles show up as new or changed behaviors. Malikah Weston Malikah Weston counted on her health benefits to help her deal with anxiety during the pandemic—and survive a brain tumor.

As a Direct Care Counselor at the Cerebral Palsy Associations of New York State, Malikah Weston has cared for people with developmental disabilities for more than 10 years. “I love what I do, knowing the people I care for will be able to do more,” she explains. And when she needed help, she knew she could rely on her Benefit Fund’s health coverage.

Struggling Through the Pandemic At the height of the COVID-19 pandemic, Malikah began to suffer from anxiety and nightly panic attacks that made it hard to sleep or breathe. “Everything was changing so quickly,” she says. “It was very difficult to learn exactly what was going on, or even just to find personal protective equipment.” A short time later, she lost her brother, with whom she had been extremely close, deepening her distress. Malikah knew she needed help and began therapy sessions—first virtually through Teladoc and later in person—that helped her cope and end the anxiety attacks.

Then less than two months after her daughter, Serenity, was born last spring, Malikah was diagnosed with a brain tumor.

Her doctors told her she needed surgery immediately or would lose sight in at least one eye—and that the situation could be life-threatening. “I was so scared,” Malikah remembers. “It could have been deadly, but my recovery was great. I shocked everyone by being back at work so quickly.

I’m extremely grateful for my benefits!”

Caring for Herself so She Can Care for Others Since both diabetes and high blood pressure run in her family, Malikah carefully monitors her health. She walks 30 minutes each day in a nearby park and is thinking about taking up jogging again, which she used to do in high school. She’s careful about what she eats, too, avoiding salt, eating salads, swapping out soda for water, and making smoothies with cantaloupe, mango, spinach and kale.

Despite all of the challenges she faced, Malikah continued to pursue her dream of one day becoming a case manager or behavioral specialist. Using her training and education benefits, she graduated last June with honors and a bachelor’s degree in Human Services from the New York City College of Technology.

Meanwhile, Malikah continues to enjoy helping those she cares for live healthy, productive lives. She admits it was a struggle to overcome her physical and emotional hurdles, but she says with a smile, “Nothing can stop you from being who you are destined to be. Especially with your 1199SEIU benefits!”

Training and Employment Funds Help You Advance Your Healthcare Career The Training and Employment Funds (TEF) offer a variety of programs that provide you with the skills you need to further your education and keep your career path on track.

Prep Academy Prep Academy prepares you to return to school at various levels of education, including high school and college. Classes focus on reading comprehension, essay writing, math and science.

College Prep College Prep (the highest level of Prep Academy) prepares you to perform college-level work by attending classes on how to take college entrance exams or by completing three-credit math and English courses at various City University of New York campuses.

Health Careers College Core Curriculum (HC4) Program

Clarelle Karaha, a Certified Nursing Assistant at Brookhaven Nursing and Rehabilitation Center. Clarelle enrolled in Prep Academy, passed the licensed practical nurse (LPN) licensing exam and now works at Brookhaven as an LPN.

After two unsuccessful attempts at getting my BSN, TEF helped guide me to a program that finally worked for me. Not only was I able to get my BSN, but I now also have a master's degree!

Lamin Jabang, RN Case Manager at Montefiore Medical Center. Lamin was an RN with an associate’s degree before he received his BSN in 2020 and then a master’s degree in case management.

The Health Careers College Core Curriculum (HC4) Program is a supported program for adult learners with little or no experience in higher education who are pursuing undergraduate degrees in various allied health fields. The HC4 Program works with college partners to enable you to take “core” prerequisite courses required to complete your degree.

Nursing Degree Programs TEF provides case management, academic advising and support for members enrolled in registered nurse (RN) degree programs, Associate of Applied Science in Nursing programs, Bachelor of Science in Nursing (BSN) programs (including RN to BSN), and Master of Science in Nursing programs (including for nurse practitioner and other advanced nursing degrees). Financial assistance is available.

Working with CCF and CCC since 2008, she most recently served as Deputy Executive Director, overseeing programs and services provided to over 20,000 families annually. She also served as Co-director of the 1199SEIU/City of New York Education, Child and Eldercare Fund.

Rossmery comes to her new role as an accomplished champion of children and families through her work in the nonprofit world for nearly 20 years.

La Lucha Durante la Pandemia En el punto crítico de la pandemia de la COVID-19, Malikah comenzó a sufrir ansiedad y ataques de pánico nocturnos que le dificultaban dormir o respirar. “Todo estaba cambiando tan rápido”, comenta. “Era muy difícil comprender exactamente lo que estaba ocurriendo, o incluso solo encontrar equipo de protección personal”. Poco tiempo después, perdió a su hermano, con quien había sido muy unida, lo que profundizó su angustia. Malikah sabía que necesitaba ayuda y comenzó sesiones de terapia (primero de manera virtual a través de Teladoc y luego en persona) que la ayudaron a sobrellevar y acabar con los ataques de ansiedad.

Luego, a menos de dos meses del nacimiento de su hija Serenity la primavera pasada, a Malikah le diagnosticaron un tumor cerebral.

Cuidarse a Sí Misma para Poder Cuidar a los Demás Debido a que la diabetes y la presión arterial alta son hereditarias en su familia, Malikah controla de cerca su salud.

Camina 30 minutos todos los días en un parque cercano y está analizando volver a trotar, lo cual solía hacer en la escuela secundaria. También es cuidadosa con lo que come: evita la sal, come ensaladas, cambia las gaseosas por agua y prepara batidos con melón cantalupo, mango, espinaca y col rizada.

A pesar de todas las dificultas a las que se enfrentó, Malikah continuó persiguiendo su sueño de algún día convertirse en administradora de casos o especialista en comportamiento. A través de sus beneficios de capacitación y formación, el junio pasado se graduó con honores y obtuvo una licenciatura en Servicios Humanos de la Universidad de Tecnología de la Ciudad de Nueva York.

1199SEIU BENEFIT FUNDS SUMMARY OF MATERIAL MODIFICATIONS This Summary of Material Modifications describes changes that affect your welfare benefit plan and updates the Summary Plan Description (“SPD”) that was previously distributed to you. You should keep this summary with your current SPD and SBC until the changes discussed herein expire.

Effective on or about January 1, 2022, the 1199SEIU National Benefit Fund for Health and Human Service Employees, 1199SEIU National Benefit Fund for Rochester Area Members, and 1199SEIU Greater New York Benefit Fund SBCs and SPDs shall be amended to comply with certain provisions of the No Surprises Act of the 2021 Consolidated Appropriations Act as follows: I.

Independent External Review is available to determine whether the plan’s adverse determination was correct with respect to the following types of claims: (a) medical bills for Emergency Services received from Non-Participating Providers, (b) medical bills for a Non-Participating Provider’s treatment at a Participating facility, and (c) air ambulance services by Non-Participating Providers. If this organization decides to overturn our decision, we will provide coverage or payment for your healthcare item or service.

Any reference to a time limit for visiting the Emergency Department following a medical accident, injury, or onset of a serious illness shall be omitted.

The following notice shall be added to each SPD: “You are protected from balance billing by a medical provider if you have an Emergency Condition and receive Emergency Services from a Non-Participating provider or facility. You are also protected from balance billing for certain services rendered by a Non-Participating Provider while receiving care at a Participating hospital or ambulatory surgical center, including emergency medicine, anesthesia, pathology, radiology, laboratory, neonatology, assistant surgeon, hospitalist or intensivist services.

These providers cannot balance bill you and may not ask you to give up your protections not to be balance billed.”

The following bolded underlined language shall be added to, and the strikethrough language shall be omitted from, Sections II and IX of each SPD:

SECTION II.A If you are undergoing a course of treatment or care, or are scheduled for surgery or childbirth, when your Provider stops participating with the Fund, in some cases you will be notified of the contract termination and that you are allowed up to 90 days of continued coverage from the provider or facility at in-network cost-sharing.

SECTION II.B EMERGENCY DEPARTMENTS ARE FOR EMERGENCIES A hospital Emergency Department should be used only in the case of a legitimate medical Emergency Condition. For Emergency Services to be covered by the Plan To be considered an Emergency, your Emergency Department visit must meet the definition of Emergency Condition (see Section IX) SECTION II. C HOSPITAL If you require services from a surgeon or an anesthesiologist, check to make sure they are a Participating Provider. Even when you go to a Participating Hospital, the doctors and anesthesiologists that provide services in the facility may not be Participating and may charge above the Benefit Fund’s allowance. In these cases, the most those providers may bill you is your in-network cost-sharing amount. This applies to emergency medicine, anesthesia, pathology, radiology, laboratory, neonatology, assistant surgeon, hospitalist, or intensivist services. It also applies to certain services provided

by Non-participating providers when there is no Participating Provider at the Participating Hospital who can provide that service. These providers cannot balance bill you and may not ask you to give up your protections not to be balance billed.

If you receive other services at Participating Hospitals or other Participating facilities, Non-Participating Providers cannot balance bill you unless you give written consent and give up your protections. You’re never required to give up your protections from balance billing.

SECTION II. SECTION IX – Definitions Emergency Condition “Emergency Condition” (or “Emergency”) means a medical or behavioral condition, the onset of which is sudden, that manifests itself by symptoms of sufficient severity, including severe pain, that a prudent layperson, possessing an average knowledge of medicine and health, could reasonably expect the absence of immediate medical attention to result in: (i) placing the health of the person afflicted with such condition in serious jeopardy, or in the case of a behavioral condition, placing the health of such person or others in serious jeopardy; (ii) serious impairment to bodily functions; (iii) serious dysfunction of any bodily organ or part of such person; or (iv) serious disfigurement of such person. Emergency care includes healthcare procedures, treatments or services, including psychiatric stabilization and medical detoxification from drugs or alcohol that are provided for an Emergency Condition.

Emergency Services Services provided in connection with an “Emergency Condition,” including screening and examination services provided to a member or his or her eligible dependent who requests medical treatment to determine if an Emergency Condition exists, as well as such further medical examination and treatment as may be required for stabilization. Emergency care may also include post-stabilization services provided in connection with the Emergency Services visit. Emergency care includes healthcare procedures, treatments or services, including psychiatric stabilization and medical detoxification from drugs or alcohol, that are provided for an Emergency Condition. ________________________________________________________________

The 1199SEIU National Benefit Fund for Health and Human Service Employees and 1199SEIU National Benefit Fund for Rochester Area Members believes they are a “grandfathered health plan” under the Patient Protection and Affordable Care Act (the “Affordable Care Act”). A grandfathered health plan can preserve certain basic health coverage that was already in effect when that law was enacted in 2010. Being a grandfathered health plan means that this plan may not include certain consumer protections of the Affordable Care Act that apply to other plans, for example, the requirement for an external review process for claims appeals. However, grandfathered health plans must comply with certain other consumer protections in the Affordable Care Act, for example, the elimination of lifetime limits on benefits. ANNUAL FUNDING NOTICE for the 1199SEIU Health Care Employees Pension Plan Introduction This notice includes important information about the funding status of your multiemployer pension plan (the “Plan”). It also includes general information about the benefit payments guaranteed by the Pension Benefit Guaranty Corporation (“PBGC”), a federal insurance agency. All traditional pension plans, called “defined benefit pension plans,” are required by federal law to provide this notice every year, regardless of their funding status. This notice does not mean that the Plan is terminating. It is provided for informational purposes, and you are not required to respond in any way. Funded Percentage The funded percentage of a plan is a measure of how well that plan is funded. Year-end Fair Market Value of Assets The asset values in the chart above are based on actuarial values measured as of the valuation date. Actuarial values differ from market values in that they do not fluctuate daily based on changes in the stock (or other) markets. Actuarial values smooth out those fluctuations and can allow for more predictable levels of future contributions.

Despite the fluctuations, market values tend to show a clearer picture of a plan’s funded status at a given point in time. The asset values in the chart below are based on market values measured on the last day of the Plan Year. Of this number, 109,111 were active participants, 81,700 were retired or separated from service and receiving benefits, and 82,823 were retired or separated from service and entitled to future benefits.

Funding and Investment Policies Every pension plan must have a procedure for establishing a funding policy to carry out the plan objectives. A funding policy relates to the level of assets needed to pay for benefits promised under the plan currently and over the years. The Plan is funded by contributions made by employers pursuant to collective bargaining agreements with 1199SEIU United Healthcare Workers East, and other written agreements.

Once money is contributed to the Plan, the money is invested by Plan fiduciaries.

Specific investments are made in accordance with the Plan’s investment policy. Generally speaking, an investment policy is a written statement that provides the fiduciaries, who are responsible for Plan investments, with guidelines or general instructions concerning investment management decisions. The investment policy of the Plan is to ensure the solvency of the Plan over time and to meet the Plan’s pension obligations as required.

To meet this goal, the Plan has established a target allocation among asset classes and acceptable ranges around that target.

Critical or Endangered Status Under federal pension law, a plan generally will be considered to be in “endangered” status if, at the beginning of the plan year, the funded percentage of the plan is less than 80 percent or in “critical” status if the percentage is less than 65 percent (other factors may also apply). If a pension plan enters endangered status, the trustees of the plan are required to adopt a funding improvement plan. Similarly, if a pension plan enters critical status, the trustees of the plan are required to adopt a rehabilitation plan. Rehabilitation and funding improvement plans establish steps and benchmarks for pension plans to improve their funding status over a specified period of time.

The Plan was not in endangered or critical status in the Plan Year.

Right to Request a Copy of the Annual Report A pension plan is required to file with the U.S. Department of Labor an annual report (called the “Form 5500”) containing financial and other information about the plan.

Summary of Rules Governing Plans in Reorganization and Insolvent Plans Federal law has a number of special rules that apply to financially troubled multiemployer plans that become insolvent, either as ongoing plans or plans terminated by mass withdrawal. The Plan administrator is required by law to include a summary of these rules in the annual funding notice. A plan is insolvent for a plan year if its available financial resources are not sufficient to pay benefits when due for that plan year. An insolvent plan must reduce benefit payments to the highest level that can be paid from the plan’s available resources. If such resources are not enough to pay benefits at the level specified by law (see “Benefit Payments Guaranteed by the PBGC,” below), the plan must apply to the PBGC for financial assistance. The PBGC will loan the plan the amount necessary to pay benefits at the guaranteed level. Reduced benefits may be restored if the plan’s financial condition improves.

A plan that becomes insolvent must provide prompt notice of its status to participants and beneficiaries, contributing employers, labor unions representing participants and the PBGC. In addition, participants and beneficiaries must receive information regarding whether, and how, their benefits will be reduced or affected, including loss of a lump-sum option. This information will be provided for each year the plan is insolvent.

Benefit Payments Guaranteed by the PBGC The maximum benefit that the PBGC guarantees is set by law. Only vested benefits are guaranteed. Specifically, the PBGC guarantees a monthly benefit payment equal to 100 percent of the first $11 of the plan’s monthly benefit accrual rate, plus 75 percent of the next $33 of the accrual rate, multiplied by each year of credited service. The PBGC’s maximum guarantee, therefore, is $35.75 per month, multiplied by a participant’s years of credited service.

Example 1: If a participant with 10 years of credited service has an accrued monthly benefit of $500, the accrual rate for purposes of determining the PBGC guarantee would be determined by dividing the monthly benefit by the participant’s years of service ($500/10), which equals $50. The guaranteed amount for a $50 monthly accrual rate is equal to the sum of $11 plus $24.75 (.75 x $33), or $35.75. Thus, the participant’s guaranteed monthly benefit is $357.50 ($35.75 x 10).

Example 2: If the participant in Example 1 has an accrued monthly benefit of $200, the accrual rate for purposes of determining the PBGC guarantee would be $20 (or $200/10).

The guaranteed amount for a $20 monthly accrual rate is equal to the sum of $11 plus $6.75 (.75 x $9), or $17.75. Thus, the participant’s guaranteed monthly benefit would be $177.50 ($17.75 x 10).

The PBGC guarantees pension benefits payable at Normal Retirement Age and some early retirement benefits. This notice includes important information about the funding status of your multiemployer pension plan (the “Plan”). It also includes general information about the benefit payments guaranteed by the Pension Benefit Guaranty Corporation (“PBGC”), a federal insurance agency. All traditional pension plans, called “defined benefit pension plans,” are required by federal law to provide this notice every year, regardless of their funding status. Funded Percentage The funded percentage of a plan is a measure of how well that plan is funded. This percentage is obtained by dividing the actuarial value of the plan’s assets by its liabilities on the valuation date for the plan year. In general, the higher the percentage, the betterfunded the plan. Year-end Fair Market Value of Assets The asset values in the chart above are based on actuarial values measured as of the valuation date. Actuarial values differ from market values in that they do not fluctuate daily based on changes in the stock (or other) markets. Actuarial values smooth out those fluctuations and can allow for more predictable levels of future contributions.

Despite the fluctuations, market values tend to show a clearer picture of a plan’s funded status at a given point in time. The asset values in the chart below are based on market values measured on the last day of the Plan Year. The chart also includes the year-end market value of the Plan’s assets for each of the two preceding plan years.

Participant Information The total number of participants in the Plan as of the Plan’s valuation date was 41,919.

Of this number, 16,625 were active participants, 13,292 were retired or separated from service and receiving benefits, and 12,002 were retired or separated from service and entitled to future benefits.

Funding and Investment Policies Every pension plan must have a procedure for establishing a funding policy to carry out the plan objectives. A funding policy relates to the level of assets needed to pay for benefits promised under the plan currently and over the years. The Plan is funded by contributions made by employers pursuant to collective bargaining agreements with 1199SEIU United Healthcare Workers East, and other written agreements.

Once money is contributed to the Plan, the money is invested by Plan fiduciaries.

Specific investments are made in accordance with the Plan’s investment policy. Generally speaking, an investment policy is a written statement that provides the fiduciaries, who are responsible for Plan investments, with guidelines or general instructions concerning investment management decisions. The investment policy of the Plan is to ensure the solvency of the Plan over time and to meet the Plan’s pension obligations as required.

To meet this goal, the Plan has established a target allocation among asset classes and acceptable ranges around that target.

Under the Plan’s investment policy, the Plan’s assets were allocated among the following categories of investments, as of the end of the Plan Year. These allocations are percentages of total assets:

Critical or Endangered Status Under federal pension law, a plan generally will be considered to be in “endangered” status if, at the beginning of the plan year, the funded percentage of the plan is less than 80 percent or in “critical” status if the percentage is less than 65 percent (other factors may also apply). If a pension plan enters endangered status, the trustees of the plan are required to adopt a funding improvement plan. Similarly, if a pension plan enters critical status, the trustees of the plan are required to adopt a rehabilitation plan. Rehabilitation and funding improvement plans establish steps and benchmarks for pension plans to improve their funding status over a specified period of time.

The Plan was certified by its actuary to be in critical status in 2009. The Plan continued to be in critical status in subsequent years because the Plan had accumulated funding deficiencies in each subsequent year. In an effort to improve the Plan’s funding situation, the Trustees adopted a rehabilitation plan on May 31, 2009. The rehabilitation period began on January 1, 2012 and is projected to last for 18 years. The rehabilitation plan provides two alternative schedules, the Preferred Schedule and the Default Schedule, that require changes in Plan benefits and contribution rates. Employers that have not adopted either schedule must pay surcharges.

Generally, the rate at which an employer contributes to the Plan will determine which Schedule of Benefits applies to its employees. Please refer to the rehabilitation plan for further details and for the meaning of certain capitalized terms not defined below.

Preferred Schedule: The Preferred Schedule applies to an employer and its employees when that employer contributes at the applicable rate provided in the Preferred Schedule.

Contribution Rate: The contribution rate for employers adopting the Preferred Schedule was 9.1% of gross payroll, effective September 1, 2014, and increased to 11.%7 of gross payroll, effective July 1, 2015. Consistent with a collective bargaining agreement, effective from October 1, 2017, to September 30, 2018 (the “2017 Collective Bargaining Agreement”), employer contributions to the Plan were further increased by $18 million in 2018, in lieu of increasing the rate of contribution. Effective with a new collective bargaining agreement, the contribution rate remained at 11.7% until September 30, 2019, and pursuant to a collective bargaining agreement that was made effective as of October 1, 2018 (the “2018 Collective Bargaining Agreement”), the contribution rate increased to 12.9%, effective October 1, 2019. Pursuant to a collective bargaining agreement effective

October 1, 2021, the contribution rate decreased to 11.1%. For employers that were subject to the 2017 Collective Bargaining Agreement or a collective bargaining agreement containing the same terms as the 2018 Collective Bargaining Agreement regarding contributions to the Plan, the Preferred Schedule Contribution Rate was 11.7% for the period from October 1, 2017, through September 30, 2019, and, pursuant to the 2018 Collective Bargaining Agreement, effective October 1, 2019, the rate increased to 12.9%.

For employers not subject to the 2018 collective bargaining agreement or a collective bargaining agreement containing the same terms as the 2018 collective bargaining agreement regarding contributions to the Plan, the Preferred Schedule Contribution Rate increased from 11.7% to 12.9%, effective January 1, 2018.

No Change in Benefit Accruals Except for New Plan Participants: For employees that participated in the Plan prior to August 1, 2009, to which the Preferred Schedule applies, there is generally no change in the basic benefit structure that existed before the Plan entered critical status. For employees that became Plan participants on or after August 1, 2009, the monthly benefit accrual rate (payable as a single-life annuity at Normal Retirement Age) that applies to all pension credits earned on or after January 1, 2010, is $19 per year of credited service, effective January 1, 2010, with a maximum of 27 years of credited service, effective January 1, 2011.

Summary of Rules Governing Plans in Reorganization and Insolvent Plans

Effective July 1, 2015, for new Plan participants hired as licensed practical nurses (LPNs) or registered nursed (RNs) on or after August 1, 2009, the monthly benefit accrual rate (payable as a single-life annuity at Normal Retirement Age) that applies to all pension credits earned on or after August 1, 2009, is $30. The rate is increased to $37 retroactive to the date of hire for each LPN and RN who acquires 10 pension credits.

Default Schedule: The Default Schedule applies to an employer and its employees if an employer contributes at the applicable rate provided in the Default Schedule.

The effective date of the Default Schedule for a given employer is referred to as the “Default Schedule Effective Date.”

Contribution Rate: Contributions required under the Default Schedule increased from 9.9% to 10.9%, effective January 1, 2018.

Reduction in Benefit Accruals: The monthly benefit accrual rate that applies to all pension credits of participants that left covered employment before January 1, 2004, is not changed. The monthly benefit accrual rate (payable as a single-life annuity at Normal Retirement Age) that applies to all pension credits earned before the Default Schedule Effective Date, if the participant left covered employment after January 1, 2004, is reduced to the accrual rate that was in effect as of January 1, 2004, (i.e., $35 if your employer was obligated to contribute at the “prevailing rate,” as defined in the Plan document, and $26 if your employer was not). The monthly benefit accrual rate that will be applied to all pension credits earned on or after the Default Schedule Effective Date is $19. The maximum number of pension credits that can be earned under the Default Schedule is 25.

In calculating monthly pension payments, the Plan will first count the pension credits to which the highest monthly benefit accrual rate applies. Notwithstanding the foregoing, there will be no accruals for the 2008 and 2009 plan years.

Reduction and/or Elimination of Adjustable Benefits: The Default Schedule requires the reduction and/or elimination of the following “adjustable benefits”: • Subsidies provided under the Early Retirement Pension; • The Disability Pension; • The 60-month benefit guarantee; • The $1,000 lump-sum death benefit; and • Other similar benefits, rights or features under the Plan.

These reductions will only apply to participants whose benefit commencement date is on or after April 30, 2009, and will only take effect on a prospective basis beginning on a participant’s Default Schedule Effective Date.

The normal retirement benefit (i.e., the “Regular Pension,” as defined in the Plan) payable at Normal Retirement Age is not an adjustable benefit and will not be reduced or eliminated.

Federal law has a number of special rules that apply to financially troubled multiemployer plans that become insolvent, either as ongoing plans or plans terminated by mass withdrawal. The Plan administrator is required by law to include a summary of these rules in the annual funding notice. A plan is insolvent for a plan year if its available financial resources are not sufficient to pay benefits when due for that plan year. An insolvent plan must reduce benefit payments to the highest level that can be paid from the plan’s available resources. If such resources are not enough to pay benefits at the level specified by law (see “Benefit Payments Guaranteed by the PBGC,” below), the plan must apply to the PBGC for financial assistance. The PBGC will loan the plan the amount necessary to pay benefits at the guaranteed level. Reduced benefits may be restored if the plan’s financial condition improves.

A plan that becomes insolvent must provide prompt notice of its status to participants and beneficiaries, contributing employers, labor unions representing participants and the PBGC. In addition, participants and beneficiaries must receive information regarding whether, and how, their benefits will be reduced or affected, including loss of a lump-sum option. This information will be provided for each year the plan is insolvent.

Benefit Payments Guaranteed by the PBGC The maximum benefit that the PBGC guarantees is set by law. Only vested benefits are guaranteed. Specifically, the PBGC guarantees a monthly benefit payment equal to 100 percent of the first $11 of the plan’s monthly benefit accrual rate, plus 75 percent of the next $33 of the accrual rate, multiplied by each year of credited service. The PBGC’s maximum guarantee, therefore, is $35.75 per month, multiplied by a participant’s years of credited service.

Example 1: If a participant with 10 years of credited service has an accrued monthly benefit of $500, the accrual rate for purposes of determining the PBGC guarantee would be determined by dividing the monthly benefit by the participant’s years of service ($500/10), which equals $50. The guaranteed amount for a $50 monthly accrual rate is equal to the sum of $11 plus $24.75 (.75 x $33), or $35.75. Thus, the participant’s guaranteed monthly benefit is $357.50 ($35.75 x 10).

Example 2: If the participant in Example 1 has an accrued monthly benefit of $200, the accrual rate for purposes of determining the PBGC guarantee would be $20 (or $200/10).

The guaranteed amount for a $20 monthly accrual rate is equal to the sum of $11 plus $6.75 (.75 x $9), or $17.75. Thus, the participant’s guaranteed monthly benefit would be $177.50 ($17.75 x 10).

The PBGC guarantees pension benefits payable at Normal Retirement Age and some early retirement benefits. In calculating a person’s monthly payment, the PBGC will disregard any benefit increases that were made under the plan within 60 months before the earlier of the plan’s termination or insolvency (or benefits that were in effect for less than 60 months at the time of termination or insolvency). Notice of Critical Status for the 1199SEIU Greater New York Pension Plan This is to inform you that on March 30, 2022, the Plan actuary certified to the U.S. Department of the Treasury and to the Plan sponsor that the Plan is in critical status for the Plan Year beginning January 1, 2022. Federal law requires that you receive this notice.

Critical Status The Plan is considered to be in critical status because it has funding problems. More specifically, the Plan’s actuary determined that the Plan has an accumulated funding deficiency for the current Plan Year.

Rehabilitation Plan Federal law requires pension plans in critical status to adopt a rehabilitation plan aimed at restoring the financial health of the plan. This is the thirteenth year the Plan has been in critical status. The law permits pension plans to reduce, or even eliminate, benefits called “adjustable benefits” (described below) as part of a rehabilitation plan. On May 31, 2009, the Trustees adopted a rehabilitation plan that includes two schedules, a Preferred Schedule and a Default Schedule. Under the Default Schedule, the Plan reduced or eliminated adjustable benefits.

The Plan is not permitted to pay lump-sum benefits (or any other payment in excess of the monthly amount paid under a single-life annuity) while it is in critical status. If the Trustees of the Plan determine that further benefit reductions are necessary, you will receive a separate notice in the future identifying and explaining the effect of those reductions. Any reduction of adjustable benefits (other than a repeal of a recent benefit increase, as described below) will not reduce the level of a participant’s basic benefit payable at Normal Retirement Age. Adjustable Benefits The adjustable benefits that were reduced or eliminated under the Default Schedule include the following: • Subsidies provided under the Early Retirement Pension; • The Disability Pension; • The 60-month benefit guarantee; • The $1,000 lump-sum death benefit; and • Other similar benefits, rights or features under the Plan.

Employer Surcharge The law requires all contributing employers that do not have collective bargaining agreements incorporating either the Preferred or Default Schedule to pay to the Plan a surcharge to help correct the Plan’s financial situation. The amount of the surcharge is equal to a percentage of the amount an employer is otherwise required to contribute to the Plan under the applicable collective bargaining agreement. With some exceptions, a 5 percent surcharge is applicable in the initial critical year and a 10 percent surcharge is applicable for each succeeding Plan Year thereafter, in which the Plan is in critical status. As noted, the surcharge ends for an employer once its collective bargaining agreement incorporates one of the schedules of the rehabilitation plan.
