RENTING IN COLORADO … LET’S GET STARTED!

1) Before you begin any rental property search, DEFINE your needs:

a) How many bedrooms?

b) How many bathrooms?

c) How much can you afford per month?

d) Do you have pets?

e) How long of a lease can you sign?

f) What amenities are Must-Haves? Washer/Dryer? Parking?

2) CHOOSE an area:

a) Downtown Boulder- Home to the famous Pearl Street Mall- an outdoor pedestrian shopping and entertainment destination offering unique boutiques, art galleries, restaurants, bars, day spas, and buskers. This area offers upscale condo rentals and charming bungalows. This is the most expensive zip code in the Front Range.

b) University Hill and Chautauqua Park- Students, young professionals, families, and retirees who have lived here all their lives share the streets near the heart of the University of Colorado. University Hill offers shops and restaurants to residents and tourists.

c) North Boulder- Spend the day in North Boulder Park or walking around Wonderland Lake. You can find apartments, condos, and houses in this area. Outside of downtown, this area has the majority of new construction within the city limits.

d) South Boulder- A great area to live if you like hitting the hiking and biking trails and want super easy access to the outdoor playgrounds in Boulder. Martin Acres, Shanahan Ridge and Table Mesa are just a few neighborhoods in South Boulder having more affordable house rentals.

e) Gunbarrel- A suburban area 7 miles from Downtown Boulder with a country feel. If you are looking for a quiet, affordable area, Gunbarrel is a great option.

f) Longmont- With a population of over 86,000 people, Longmont is the second largest city in Boulder County. Longmont has a delightful downtown area, golf courses, and the most diverse mix of housing in the area: brand new homes, older homes, upscale condos, and inexpensive apartments. Longmont is the most affordable area to live in the County.

g) Louisville- Voted the 4th best place to live in the Country by Money magazine in 2015! Louisville is 6 miles east of Boulder and has its own downtown area with summer street fairs, tap rooms and restaurants. A diverse mix of rentals is available in Louisville at a more affordable rate than Boulder.

h) Superior- On the other side of the highway from Louisville, Superior is a newer suburban area with great schools and parks. Superior is the closest residential area to the Flatirons Crossing Mall which is the premier indoor mall near Boulder. Superior offers a newer inventory of rental properties and is a popular place to rent.

i) Lafayette- Lafayette has a rich cultural heritage, unique neighborhoods, a vibrant economy, and easy access to an active lifestyle. It has its own downtown area with some of the best Mexican food in Boulder County.

j) Erie- A fast growing suburban town east of Boulder with lots of open space and new rental options.

k) Broomfield- The corporate hub of the area, Broomfield boasts Interlocken Business Park, Flatirons Crossing Mall, multiple golf courses, and a brand-new events center. This suburban area offers a wide range of rental housing that will appeal to anyone’s pocketbook

l) Westminster, Thornton, Northglenn, Arvada, Golden - Suburban areas in between Boulder and Denver with a multitude of rental housing options.

4) Things you will need once you locate a rental:

a) Deposit - Most properties require a security deposit to cover any damage to the property. Apartments generally have the lowest deposits while privately owned condos and homes are usually equal to one month’s rent. If you have a pet and the property allows them, be prepared for an additional deposit.

b) Acceptable credit history - Almost all landlords will require a credit and background check. If you don’t have perfect credit, let your Housing Helpers representative know and they will help connect you with property owners that will be more forgiving. You will probably have to pay a rental application fee so be prepared to bring your check book.

c) Lease - There is no standard lease in the state of Colorado so make sure you read and understand your lease carefully. City of Boulder leases require certain provisions and disclosures such as occupancy limits, interest on security deposits, lawn care, noise disturbance laws, etc. The City of Boulder also requires rental properties to pass a safety inspection and have a rental license.

d) A Check-in/ Check-out Sheet - Make sure that your new landlord provides you with a check-in/check-out sheet so you can document any prior damage to the home that you do not want to be responsible for at move-out.

e) A Utility Connection Sheet - Ask your Wright Kingdom representative for all the information you need to transfer the utilities for the property into your name. Our online relocation guide also has links to the driver’s license bureau, post office, etc.

f) Renter’s Insurance - The landlord does not carry insurance for your personal belongings so you will need to get a renter’s insurance policy. Most policies are less than $20 per month depending on the value of your belongings.

g) Other documents – pet resume, references, identification, etc…

Glossary of Lease Terms

• ARREARS: Overdue rent

• ASSIGN: Transfer the unexpired portion of a lease to a new tenant

• CAUSE OF ACTION: Specific situation that may become the basis for a lawsuit

• CIVIL: A non-criminal legal matter. Housing disputes are generally handled in civil courts

• COVENANT: Promise. Independent covenant: You must perform your obligation even if the other party does not. Dependent covenant: You carry out your obligation on the condition that the other party fulfills its obligation

• CREDIT CHECK – Nearly all rental properties (unless owned and rented by a private individual) will require all prospective tenants to fill out a rental application and pay an application fee for a credit check. This cost is usually between $25.00 and $50.00. This in turn is paid to a credit reporting company, which will check credit and rental history, verify employment and income.

• DEFAULT: To forfeit or lose by omission; to fail to perform a legal obligation

• DEMISED PREMISES: The place being rented

• DETAINER: Withholding another's property against his or her will

• DISPOSSESS: Remove a person from land; the legal action brought for nonpayment of rent

• DISTRAINT (proceed by distress): The landlord takes your personal property to force you to pay or eventually sells it to get his or her money

• EJECTMENT: Physical or legal eviction from land

• EMURE: To take effect

• ENJOYMENT: Possession or occupation of land. Quiet enjoyment: freedom from invasion of privacy by landlord

• EVICTION: Depriving a person of possession of occupancy. Constructive eviction: not actually removing a tenant but making it impossible for him or her to remain because of the conditions, such as serious deterioration

• FEES – There may or may not be additional fees. If there is a fee the fee amounts will vary from property to property. They are generally for cleaning and/or pet fees. They are not refundable.

• GOODS AND CHATTELS: Personal property

• INDEMNIFY AND HOLD HARMLESS: To free from any responsibility or liability

• INURE: Take effect

• LANDLORD – The owner of the rental property.

• LEASE – A legal contract specifying the length of time a tenant will occupy a particular property. If the tenant moves out prior to the ending date specified on the lease, the tenant is still responsible for the rent until the end date specified on the lease. Occasionally, a lease may be "broken", but the tenant is responsible for the rent until a

suitable replacement tenant is found. The tenant may be asked to pay for advertising for the new tenant as well.

• LESSEE: Tenant

• LESSOR: Landlord

• LIABILITY: Responsibility, loss; a negative element

• MONTH-TO-MONTH TENANCY – Almost all properties require at least a three-month lease, and many require six months or more. Those properties that permit month-tomonth tenancy may charge additional rent for this option.

• NOTICE TO QUIT: Notification from the landlord to tenant ordering tenant off the property, usually after thirty days from the first day of the rental period

• NOTICE TO VACATE: Notification from the tenant to the landlord stating the tenant's intention to leave the property, usually after thirty days from the first day of the rental period

• PARTIES TO A LEASE: Those who agree to abide by the provisions of a lease; typically you as a tenant, any roommates, and the landlord

• POSSESSION: Lawful occupation and use of the land, subject to protections of "quiet enjoyment"

• REPLEVIN: Legal action to recover property that was unlawfully seized

• SECURITY DEPOSITS – These vary from property to property but are usually equal to one month’s rent. "Deposit" implies that these Monies will be conditionally refunded when tenant vacates the property. This should be verified at the time the lease is signed.

• SUBLET: Agreeing to permit someone to use a rented property for a term less that the full term of the lease, and to be paid for that permission 30

• SUMMARY PROCEEDING (to recover possession): Eviction. It is called "summary proceeding" because it is a swift and simple procedure for the landlord

• TENANT – The person renting the property from the landlord.

• TENANT AT SUFFERANCE: A tenant who has remained in a unit after a lease or tenancy at will agreement has expired or was terminated

• TENANT WITHOUT A LEASE: A tenant with the landlord's consent to occupy a premises without a lease

• TENANT WITH A LEASE: A tenant with a contract that allows for a certain length of occupancy at a set rent

• TERM OF LEASE: The length of time that a lease shall be in effect; duration of obligation

• WAIVER: Relinquishment of a right, agreeing to give up something to which you are entitled

• WARRANTY OF HABITABILITY: Promise that the property is safe and usable for residential use.
