Happy New Year!! Hope that 2017 is off to a great start for everyone. I sincerely, hope that everyone had a joyous and meaningful Christmas, while enjoying the holiday season. I would like to invite everyone to come to Corpus Christi the last week of February and be a part of the Last Board Meeting, Opening Session, and training opportunities offered at Annual School. Last year was one the bigger events we have experienced since being in Corpus. And we hope this year there will be even more vendors and attendees. On behalf of TWUA Management Committee, we know you have a choice in training providers and we sincerely appreciate your support and participation in all TWUA events. Annual School would not be possible if not for the generosity of those who assist with providing classroom instructors. The association provides a small travel stipend but for the most part those who teach do so as a donation to TWUA. I want to take this opportunity to recognize and thank everyone who makes Annual School possible. I also want to recognize and thank the vendors and those who purchase booth space. Collectively, vendors account for approximately $65,000 of revenue at Annual School. All of this revenue is used to offset classroom training. Last year there were just over 500 students and the cost of training was $250. If you take the $65,000 (vendor revenue) and divide it among the 500 students – that equates to $130 per student. Added to the $250.00 (registration fee) that would mean training costs would be someone in the ballpark of $380 per student. Based on 2016 numbers. So it is safe to say that vendor support is crucial. When attending any TWUA event, I encourage you to seek out the vendors and acknowledge your appreciation. Yea they would love to have an order, but just to acknowledge that you appreciate their being at a training event, goes a long way. TCEQ has allowed TWUA to count vendor tours as part of the training event. The way this was presented to TCEQ is that the students are able to interact with product representative and enhance the knowledge related to items, equipment, procedures, etc. that are used each day in job performance. So when the student simply rushes through the exhibit hall or uses the hour designated as tour but utilizes this hour for some other purpose it hurts in two ways. First, the vendors will only continue to participate if there is foot traffic and interest in products. Second, if the hour designated as tour time is being abused – the TCEQ approval for tours could be jeopardized for all. I am excited to see Annual School near. I have truly enjoyed touring around the state and meeting and making new friends. I have benefited from seeing first hand how other regions make their events a success. I have learned and took ideas back to Lubbock and shared with the West Texas Board. But I can honestly say, I will not miss the writing of monthly articles. I never really understood when past presidents mentioned they were happy to see this responsibility end. Chad Jameson will be the incoming president and if there are any words of wisdom that I can pass along . . . . start writing now. If you are active with any region. Have served as a officer in a District or Region and are interested in assisting at the state or association level, please let myself or one of the current members of management know so that we can get you the application form and see how future nominations go. Truly thank all those who have made my year as President easier and I hope to see you in Corpus in February.

Father for grace, forgiveness, and for all that you do and all that we take for granted, we pause and say thank you. For the rainfall that Texas has received we give you praise. The effects of this drought are far from over for some, while flooding for others, so we ask that you would redirect clouds and rainfall to these areas of need. Father, no task or obstacle is too great for you, so we ask that you fill our lakes and cause our streams to flow with abundance, while leading us to be a more appreciative society. One that does not take the precious gift of water or those who treat it for granted Amen. As of December 5th, 2016 – In West Texas, Lake Ivie is sitting at 23.6 % (+ 0.2 %). Lake Spence is sitting at 13.5 % (+0.1 %). Lake Sweetwater is sitting at 21.9 % (+0.4 %). White River is sitting at 24.7 % (- 0.6 %). will be an indoor washer tournament at the Omni Hotel. Still having Casino night on Tuesday and the other aspects of Annual School have not changed. We are encouraged by the preregistration and vendor booth activity, so we hope that you will come and be a part of what makes this association great. The Panhandle Regional School in Amarillo will be March 21st – 23rd and Ruben, Cindy, and the entire board would love to have your participation. TWUA is proud to announce the full time staff instructors. Michael Gonzales and Mark Routon, have been named to assist with operator training within the association. Mark is no stranger to TWUA and Michael has been assisting TWUA with class room instruction regularly. Both are excited to accept the challenge and share their knowledge and experience. TWUA welcomes and thanks our new staff members for assisting in the operator training process. This story goes something like this Shark Bait During a research experiment a marine biologist placed a shark into a large holding tank and then released several small bait fish into the tank. As you would expect, the shark quickly swam around the tank, attacked and ate the smaller fish.
Tom and Norma are doing all they can to make the Fort Stockton Regional Event possible. The dates are February 7th – 9th and it is not too late to register and be a part of this operator training event.
The marine biologist then inserted a strong piece of clear fiberglass into the tank, creating two separate partitions. She then put the shark on one side of the fiberglass and a new set of bait fish on the other.
Annual School in Corpus will follow Fort Stockton very quickly. If you have not attended Annual School in a while, please come to Corpus and give it a try. The business portion of the school takes place Sunday evening at the Omni Hotel and classes begin Monday February 27th at the American Bank Center.
Again, the shark quickly attacked. This time, however, the shark slammed into the fiberglass divider and bounced off. Undeterred, the shark kept repeating this behavior every few minutes to no avail. Meanwhile, the bait fish swam around unharmed in the second partition. Eventually, about an hour into the experiment, the shark gave up.
Based on surveys and feedback we are adding two events to Annual School this year. On Monday at the conclusion of class (5:30 p.m.) there will be a meet and greet in the exhibit hall (adult refreshments available) and at 7:00 there
This experiment was repeated several dozen times over the next few weeks. Each time, the shark got less aggressive and made fewer attempts to attack the bait fish, until eventually the shark got tired of hitting the fiberglass divider and

simply stopped attacking altogether. The marine biologist then removed the fiberglass divider, but the shark didn’t attack. The shark was trained to believe a barrier existed between it and the bait fish, so the bait fish swam wherever they wished, free from harm. The moral: Many of us, after experiencing setbacks and failures, emotionally give up and stop trying. Like the shark in the story, we believe that because we were unsuccessful in the past, we will always be unsuccessful. In other words, we continue to see a barrier in our heads, even when no ‘real’ barrier exists between where we are and where we want to go. Remember – We do not need all operators in Texas to be a member of TWUA – JUST YOU! ! ! !

WATER RIGHTS: WHAT’S NOW AND WHAT’S NEXT by RICH OLLER, PE
I’ve been lucky in that my experience from both a public and private perspective has provided me insights that are unique and applicable when adding additional water rights to your water production resources. I know where we’ve been over the past 35+ years; I see where we are now, and I can make educated predictions about what we’ll be dealing with in the future. We have much work to do.
Are We Heading for a Mad Max World? Like oil, potable drinking water is a commodity and is becoming harder to find and develop. All of us in the water industry continually deal with and are confronted with increasing demand and decreasing supply. Whether these decreases are from drought conditions or increased growth and over-allocation of existing supplies, both create concerns in securing water for current and future demands. Groundwater has been controlled in years past by the surface owner of the land, or what is recognized as the “right of capture”. Oil companies seeking water for oilfield fracking and production are challenging this long-standing law. In some cases, the water has been treated as a mineral and the challengers have been successful in claiming use and ownership of the water even though they did not own the surface rights. Water Rights have become a valued resource and there appear to be no limits on where these may be regarding the end user. Typically, water rights were acquired near the end user, but today, water rights are being negotiated and acquired wherever they may be obtainable.

Managing and securing sustainable water now and in the future falls on each city and city management group. City Management is the front line leader in water acquisition, treatment and distribution. Managing this resource is a major component of all city governments. Systematic planning based on historical water use and projected population growth is the responsibility of each city. Equally important is providing adequate funding for infrastructure improvements to assure a safe, reliable water supply for their users. How is this achieved in a time and economy that has the uncertainties that we see and feel today? Oil prices have dropped and state and municipal budgets are feeling the crunch created by the loss of tax revenue from the oil and gas industry. Cities have seen substantial employment losses associated with the oil and gas companies. A close look at the reality of the situation reveals that as far as our infrastructure is concerned, nothing has changed except for more people and larger demands for water. The graph below from the Texas Water Development Board shows 2013 water demand versus population. Demand and population have only increased since then, and that trend will continue.

Texas has implemented two important changes that limit common law on the landowner’s right of capture and use or groundwater: • The landowner cannot capture and use groundwater maliciously with the purpose of injuring a neighbor or use it in a manner that amounts to wanton and willful misuse of the resource.
Types of Water Rights Within Texas, there are two distinct types of Water Rights or Water Development: groundwater or State surface water. By State Water Law definition, groundwater occurs under the surface of the land, and can include percolating water and artesian water, but not the underflow of a surface water river or stream or the underground flow that is confined in channels such as a “confined aquifer”. Groundwater has a unique characteristic in that it is presumed to be percolating, and must be proven otherwise to be considered any other way. Artesian water is groundwater that is confined by an impermeable geological formation causing the path of least resistance to be upward once “tapped” or developed. Underflow is water that is directly connected to the flow of a stream or river and is typically flowing through the soil formations adjacent to the streams or riverbanks moving in the same direction of the surface water flow. As such, it is considered “water of the State” and governed by surface water rules. Underground streams or rivers are further delineated by a defined water course, meaning the underground stream or river must have defined banks that form a geologically defined channel and it must flow. These are rarely, if ever, found in Texas and must be addressed on a case-by-case basis. In 35+ years of personal experience, I have never encountered such a subterranean stream in Texas.
Water Laws: How Did we Get Here? English Common Law was the basis for current Texas Common Law for water use. This basis simply stated that the owner of the land had the right to pump unlimited quantities of water from under his land regardless of the impact February 2017
• The landowner cannot pump groundwater in amounts that will cause subsidence to occur on neighboring land.
How are Laws Enforced Locally? Groundwater Conservation Districts (GCDs) and Subsidence Districts are the favored groundwater controls in the State. Because approximately 85% of the groundwater in the state is within a GCD or subsidence district, many GCDs and subsidence districts have promulgated rules for the development and production of groundwater. While the landowner currently owns the groundwater beneath his land, it is subject to the water laws of the State and to local GCDs and subsidence districts. The common law rule of capture cannot always be taken literally without first determining if the proposed well development is in a specific district and what those rules require. GCDs have set spacing rules for wells and production rules to provide conservation measures for groundwater in the State.
How Do We Move Forward? In securing additional groundwater supplies, Municipalities, Water Districts, and Water Supply Corporations must be sure that all water rights, easements, development standards, and requirements are in place prior to securing the land. Because increasing water demands across the state have increased competition for this limited resource, careful planning and investigation of potential development areas must be undertaken with knowledgeable professionals to guide the purchase of these water rights. Compliance in legal, engineering land acquisition, hydrogeological investigations, and conservation must be fully vetted to secure any new water rights in Texas.

WHAT IS THE OSHA GENERAL DUTY CLAUSE? by OSHA’s General Duty Clause, in its entirety, reads:
“Each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.» —29 U.S.C. § 654, 5(a)(1) This pivotal clause, crucial to the health, safety, and well-being of workers throughout the United States, can be found in the Occupational Safety and Health (OSH) Act, which was signed into law by President Richard Nixon on December 29, 1970. The act led to the formation of the Occupational Safety & Health Administration (OSHA), and was created to ensure employers maintain workplaces free of hazards and that employees enjoy safe working conditions. The General Duty Clause, in particular, maintains that employers are legally obligated to provide workplaces free from hazards. These hazards may be recognized by the employer, by industry consensus standards, or through “common sense” as carrying the potential to cause serious physical harm or death.
When is the OSHA General Duty Clause invoked? The clause is often the basis for a citation when hazards present in the workplace aren’t otherwise covered by OSHA standards. For example: OSHA does not yet have a specific standard regarding ergonomics. Improper lifting tasks that lead to muscle and joint injuries, as well as repetitive motions that may cause carpal tunnel syndrome, can be cited under the General Duty Clause when employers don’t try to mitigate the hazards or protect workers from the impacts of those tasks.
What are the elements of an OSHA General Duty Clause Violation? OSHA issued more than 1,500 citations for General Duty Clause violations in 2015. When can an employer be cited under the General Duty Clause, rather than another, more specific OSHA standard? Several factors must be present for an employer to be cited under the General Duty Clause. Those factors include the following:

The hazard must meet OSHA’s basic definition of a workplace “hazard.” A hazard is an object, condition, or practice that presents a potential source of injury or damage. Examples include a hot surface (which could cause burns), damaged electrical wiring (which could cause shocks or start a fire), or a heavy lifting task (which could cause back strains). Additionally, employees must be exposed to the hazard in order to be cited under the General Duty Clause; if the hazard in question doesn’t directly impact or endanger employees, it may still be cited under another standard.

The hazard must be recognized as such. For a hazard to result in a citation, it needs to be a recognized or known hazard. However, the employer does not need to have recognized the hazard to be cited for it under the OSHA General Duty Clause. The OSHA Field Operations Manual states: “Recognition of a hazard can be established on the basis of employer recognition, industry recognition, or ‘common-sense’ recognition. The use of common sense as the basis for establishing recognition shall be limited to special circumstances.”
Recognition of a hazard may be supported in several ways, including: •
Earlier OSHA inspections of the same employer which covered the same hazard
•
Documented employee complaints or grievances about a certain hazard
•
An employer’s earlier corrective action
•
Statements by safety or health experts familiar with the industry
•
Studies conducted to demonstrate awareness of the hazard
•
State and local laws that may have been in place to mitigate the hazard
•
Equipment warnings and literature that reference the hazard
•
National consensus standards from ANSI, NFPA, and other private organizations
“Common-sense” recognition may occur when, according to the OSHA Field Operations Manual, “a hazardous condition is so obvious that any reasonable person would have recognized it.”
The hazard is likely to cause physical harm or death. This can be established when a death or serious injury actually followed an accident due to an existing hazard, or if serious harm or death would be likely in the event of an accident. Similar situations in other facilities are often used for comparison, allowing OSHA to rely on historical data.
employer failed to pursue that corrective action, then it makes sense to hold the employer responsible. In determining whether corrective actions are feasible, OSHA inspectors may look at what the employer did or didn’t do to mitigate the risk, how other employers and companies accounted for the same risks, and what equipment manufacturers recommend for any hazardous equipment involved.
What are the limitations of the General Duty Clause? The General Duty Clause is a far-reaching regulation, but it may not be invoked in certain cases. Employers can’t be cited under the General Duty Clause when an already-existing OSHA standard covers the hazard in question, nor can citations be issued to impose stricter requirements than what’s outlined by a hazard’s OSHA standard. Instead, the employer will be held to the existing rule. For example, if an employer didn’t provide fall protection for workers on an unguarded platform on an exposed floor 25 feet above a lower level, they would be cited under OSHA’s fall protection standard, rather than the General Duty Clause.

The hazard may be corrected by a feasible method. There must be a feasible, appropriate, and available method to correct the hazard or protect workers from the hazard. If something could reasonably have been done to resolve the problem and the
