Last week, Terrie and I attended a Greater Bergen Realtors mediation where a cooperating broker accused our agent of interfering with the buyer and claimed procuring cause simply for showing the property. The first question the mediator asked was, “did you have a buyer agency agreement signed?” When the answer was “no,” the case was essentially dismissed.
As you’re all aware, the laws enacted August 1 , 2024 changed all the rules When a listing agent shows a property to an unrepresented buyer, they are acting on behalf of the seller. That must be disclosed. No longer can an agent claim procuring cause simply by showing a property. A binding contract exists only when the buyer chooses to work with an agent and agrees to sign a buyer agency agreement.
At Terrie O’Connor Realtors, each of you attended Buyer Agency Bootcamps, preparing you to serve buyer clients while ensuring you use the required documentation that protects your commissions During the mediation, it was clear that the cooperating brokerage had not properly trained its agents, but our sales associate fully understood the buyer agency process and expertly navigated the transaction. Because of her diligence and care, she prevailed in preserving her commissions.
