Though both are residential Owners Associations with elected Boards of Directors, property owner members, and the ability to hire licensed man agement. Property owners in Condo Buildings and HOA Communities always have ongoing questions about their Association’s function, politics, and finances. This is especially true with newer owners who may not yet be familiar with the basics of Florida Association governance and operation. Hallandale Beach Lost Two Dedicated Public Servants

Many of us take for granted the United States Postal Workers. We are never short of complaints about the Post Office and Service Issues. Many of the men and women that work with the service are hardworking dedicated employees that lit erally weather all storms (hurricanes excluded) to get the mail out. I can share that even in my husband’s office we have had to deal with no mail and delayed mail. As Mayor, I also have to field complaints about the mail. Many residents and the City depend on the mail for bills and col lections.

The United States Postal Service is an entity to itself. The Postal Service started in Boston, Massachusetts in the late 1600’s. In 1706 the Continental Congress established the Official Postal Service and Benjamin Franklin was the first Postmaster. In 1702, the Postal Service was codified by Congress with the Postal Service Act. The Act ensured privacy in the mail making it illegal to open some one’s mail and provided that newspapers could be mailed. It provides for open communication and information to citi zens.

The service went through many changes. In 1970, was the biggest change when Congress provided for the ability for postal workers to unionize and other operational changes. The Executive Branch and Congress still control the Postal Service rates, routes and locations. There continues to be a push to totally privatize the service due to the cost of operations. Congress though still has control and have allowed some private contracting.

In my opinion privatization just like attempts to privatize Social Security would be a mistake. Big business controlling functions that ensure protections to the average Joe and Jane are critical. Could you imagine our Mail ballots being controlled by a corporation?

This is not to say that Congress shouldn’t be addressing some of the shortcomings. A bit of trivia might shed light on the need for performance changes. The Pony Express could deliver mail within 8 days. So with the modern transportation systems and technology there is definitely room for improvement. Still, compared to a FedEx letter starting at around $11.00 dollars to USPS at $9.35 and packages overnight at FedEx starting at $61.25 and USPS at $28.75, it’s a good

The postmaster of Hallandale Beach, Bobby Jean Sims, recently retired and then lost her battle to Cancer. Bobby Jean was laid to rest on June 15th. She was raised in Hollywood and graduated from Hollywood Hills High School in 1976. She started her career in the Postal Service as a Clerk in North Miami. She worked her way up the ranks to become the Postmaster of Hallandale Beach in 2015. She was very proud of her two children, daughter Talinay and son Eric. She will truly be missed by her three sisters, grandchildren and her entire extended family. Most importantly, her colleagues came together to celebrate her life. We thank her and them for their continued service to our community.

Steps you can take for a Safe Summer around Water:

• Supervision: Always watch kids closely when they’re in or near the Water.

• Have a dedicated watcher: When gathering

in large groups, assign one adult to watch one or two specific children, so someone is always looking out for kids.

• Choose the right location to Swim: Swim near a Lifeguard. If you’re Swimming in areas without a Lifeguard, don’t do so alone. Make sure someone knows where you are and is keeping an eye out.

• Install Perimeter Protection: Install Fences and Gates around Pools.

• Pay attention to Safety Warnings. If a Beach or Pool has “No Swimming!” signs, take that seriously, even if things look safe. There’s usually a good reason why you shouldn’t take a dip.

He also was known for sharing old quotes as lessons in life, to live your life intentionally. He too will be missed by the community and his fellow workers. He was laid to rest on June 17th.

Over the years, there seems to be a lack of respect for the day-to-day workers we come in touch with. I believe the super majority of people are still kind. We all need to remember that these individuals are mothers, fathers, sons and daughters. They are you and me. We need to stop and take a moment before we lose our patience with people. There are always Laws, Rules and Regulations that impact services. Remember being kind and civil does not cost a dime and like I was taught, you always catch more bees with honey!

I remember both Bobby Jean and Keith fondly. Working in this community for over 30 years I have come across many individuals who serve the community. I must say both, Bobby Jean & Keith were dedicated public servants and will be missed. I remember visiting the Hallandale Beach Post Office on US -1 and Bobby would make sure that if you needed assistance she was there to make it move as quickly as possible. She cared about her job and the people of the community.

Keith Tyrone Jones, Sr. was our Postman in West Hallandale Beach, we would see him almost every day. He was a truly kind man and dedicated to his job. He would go out of his way to make sure all of the mail had the correct postage and if it wasn’t ready when he arrived, he would go to the end of the plaza and come back to us. He always had a treat for the dog in our office. Within the past few years, he would talk with us about his retirement plans and we wished him well and thanked him for all his efforts and kindness. They will both be missed!

Diamonds & Dreams: The Humane Society Of Broward Has Many Programs To Adopt

Looking for a GREAT family dog? If so, check out Spencer. After having a home for 7 years, this fellow was given up because his family no longer had time for him. Spencer is an amazing 78-pound Rottweiler Mix who adores being with people of ALL ages. He is potty-trained, loves to run and play and loves to meet new people. His profile says, “he communicates well and he likes company while he is eating his meals.” Oh and he is good with other dogs.

There are so many beautiful kittens to choose from this week at the shelter including little Fudge (669134). This sweetheart is just 9 weeks old and 2 1/2 pounds, so she has a lot of growing to do. Her coat is a beautiful tortoiseshell coloring – with swirls of orange and black and her sisters Skittles and Tiny Pie are just as cute.

Dunn features a pet each week – yes, 52 pets every year – and underwrites the entire adoption fee for that dog, puppy, cat or kitten. “Diamond in the Ruff” is promoted through J.R. Dolly’s Dream: In the Winter 2016 Paw Prints we introduced Dolly’s Dream Project funded by the Levitetz Family Foundation. The project covers the cost for Spay/Neuter Surgery for American Staffordshire Terriers and Mixes and helps with Surrender Prevention.

Dolly’s Dream has expanded and now

they are underwriting the adoption fee of select Bully Breed Dogs. In addition to underwriting the fee, they will cover the costs for the basic items that the dog will need to succeed in their new home. To over-simplify 2 fundamental concepts of Association governance:

Board members (owners who have been elected to the Association’s Board of Directors) have a Fiduciary Duty to always act in the best interest of the entire Association, using their best judgment to promote and protect the operational, administrative, and financial well-being of the Association. The Board functions as the Executive Branch of the Association’s “government.”

Management Companies and individual Property Managers may be considered as administrative assistants to the Board, hired to help oversee and organize maintenance, record-keeping, communication, and financial accounting for the property and Association.

Boards have decision-making authority when it comes to Association business, while Management Companies / Managers do not.

Management can only act within the limitations of:

• Florida Statutes

• Association Governing Documents

• Instructions from the Board

• in that order!

Board instructions to management cannot conflict with (or violate) Florida Statutes and the Association’s Governing Documents.

Florida’s Condominium Act (FS Chapter 718) and Homeowner’s Association Act (FS Chapter 720) allow both COA’s and HOA’s to contract with Management Companies and/or individual Property Managers to help with the administration, maintenance, communication, and financial accounting for the Association. Management Companies and Managers are paid out of the Association’s operating accounts, perform their duties according to the management agreement/contract they signed, and receive their direct guidance and instruction from the Association’s Board of Directors.

However - hiring a Management Company or Manager does not relieve the Board of its Fiduciary Duty and responsibility to the Association.

In Florida, any company or individual performing management duties and services to an Owners Association must hold a current Community Association Manager or Community Association Management Firm license from the Department of Business and Professional Regulation.

Association-governed community can work under a couple of different arrangements:

• A licensed Manager and a support/maintenance staff are hired and paid directly by the Association. The COA or HOA is responsible for payroll taxes, benefits, and other costs. In this case, the manager is only responsible for that specific property, usually has an onsite office, is on the property weekdays, “on call” weekends. Some condo buildings (often larger properties) even have a resident manager, with an Association-owned unit made available to the Property Manager as part of her/his compensation package. This arrangement often results in a closer working relationship with, and increased Manager accountability to the Board.

• The Association contracts with a licensed Management Company to provide management services and a designated Property Manager who is employed by the company (not the Association). The Management Company is responsible for the individual manager’s payroll taxes, benefits, and other employment costs. Under this arrangement, the company’s Property Manager and staff can have offices on larger properties, though only rarely would a company manager be a resident manager. The Management Company is a contracted vendor to the Association.

Under the second arrangement, the assigned Property Manager could be managing just that property, or be a portfolio manager who provides management services to multiple different Associations and properties. Portfolio managers do not usually spend time at any one property every day. They may only be onsite when reviewing maintenance issues or attending Board meetings.

Management fees are variable and negotiable depending on the services required by the Association. COA’s and

HOA’s with well-informed, efficient Boards who communicate well with owners often require only administrative and accounting services from a Management Company / Property Manager. On the other hand, Associations with unfocused, lesscommunicative Boards tend to need much more in the way of management services.

In considering this week’s headline question, it is important to keep 2 points in mind:

• Management Companies or employee Property Managers are paid with Association operating funds which come from owners’ scheduled (usually quarterly) assessments. The management contract is between the company or manager and the COA or HOA’s corporation.

• The Board has the authority to enter into a management contract if it feels it is in the best interest of the entire Association. An owner vote is NOT required to engage a Management Company/Manager, negotiate the terms of a management agreement, or change management service providers if the Board sees fit to do so. The Board hires, fires, and instructs Management Companies and Managers based solely on a Board decision, not an Association vote.

Are you beginning to see how this article’s headline question may not have an easy answer?

Since Boards have direct input to the Management Company / Property Manager’s duties, responsibilities, and even their job security, some companies and managers tend to think of the Board itself as their employer and do whatever is necessary to keep them happy. In my opinion, this can be short-sighted and seriously compromise the company or manager’s obligations to the entire Association.

When the line between a Board’s function, and the duties of a Management Company / Manager becomes blurred, owners frequently feel confused and frus-

trated. Most of the frustration is caused by owners not knowing which one has the authority and responsibility to address a particular concern. For clarification, read your Governing Documents and Rules for Residents, then consult a FloridaLicensed attorney for application to specific circumstances.

Spoiler alert - the Board has final authority over the Property Manager, whether she/he is an Association employee or works for a contracted Management Company.

It is important to note here that Managers and Management Companies are not allowed to interpret legal documents or offer an opinion on legal matters affecting the Association. This is why it is crucial for all Associations to have a competent attorney who works well with both the Board and management.

Management Companies and Property Managers find it necessary at times to play “referee” between a Board and owners, especially in Associations where there is already a contentious relationship between some owners and the Board.

In these situations, it is very important for management to maintain a neutral approach and strive to provide the most accurate information available to both the Board and owners in the Association.

So where does all this leave us in addressing whether Management Companies and Managers work for the Board or the Owners? The practical answer is both, though not in the same capacity.

Management has a dual obligation to the Board in efficiently carrying out their lawful instructions AND to the entire Association (all owner members) to always discharge their duties diligently, honestly, in good faith, accurately accounting for all funds, with care and full disclosure.

Management Companies and Managers assist Association Boards in protecting the collective interests of all owners, and therefore the Association as a whole.

As I have said in many previous articles - the keys to living in an Associationgoverned building or community are education and participation. Learn all you can about how yours operates, then participate in the business of running it.

How To Enjoy Fresh Maine Lobster This Season

That’s why restaurant owners Katie and Thom Werner are recommending a staple that’s sustainable, fresh and ver satile: Lobster. The Werners own the popular Island Lobster Co. Restaurant in Peaks Island, Maine where Thom works as a commercial fisherman and supplies most of the Lobster served.

The Werner family is well versed in the iconic Maine Lobster fishery, coming from a long line of generational fishing families, with Thom having fished since he was 6 years old. They know Lobster can be intimidating for home cooks, but as peo ple familiar with the product, they empha size Lobster is easy to prepare, delicious and supports communities up and down the coast.

“Lobsters are always sustainably har vested and handled with care by the fish ery,” Katie said. “It’s so important to know where your food comes from and with local Lobster, it’s something you can feel great about enjoying that also directly benefits so many families like ours.”

Lobsters are harvested year-round in Maine and New Hampshire; however, the majority are caught between late June and late December, when theLobsters are the most active.

For those looking to enjoy a simple and classic version of Lobster, the Werners recommend a tried and true method.

“Steamed with some melted butter is always perfect,” Thom said. “You can’t beat the sweet, succulent flavors of Fresh Lobster with that punch of Salty Butter.”

• 1/4 Pound of Fresh Lobster Meat or Meat from 1-Pound Lobster

• 1 Tablespoon of Mayonnaise

• 1 Large Leaf of Romaine Lettuce or

Preheat the oven to 400 F. Line the baking sheet with parchment paper and arrange the Bacon Slices on top. Cook them for 10-15 minutes, or until desired

Prepare a large pot with 2 inches of Salted Water and bring it to a rolling boil. Add the Lobster and steam it for 12 minutes. Halfway through, lift the lid carefully and shift the Lobster to cook it evenly. Break down the Lobster and remove the meat from the shell, yielding about 4 Ounces of cooked meat. Chop the meat

In a large skillet or griddle over Medium Heat, warm the Butter to coat the pan. Place both pieces of the Bun cut sides down on a pan and cook them for about 30 seconds until they are golden. Remove the Buns from the pan and set them aside. In a bowl, toss the Chopped Lobster Meat with the Mayonnaise and set it aside.

Assemble the Cooked Bacon, the Tomato, the Lettuce and the Lobster mix on the toasted Bun.
