here it is again today.

Florida has over 1,300 miles of coastline and over 650 miles of sandy beaches, according to the Florida Department of State. Some of that beachfront is privately owned (about 60%), while the rest is State, County, or City controlled. For decades, there have been ongoing questions over who can use certain stretches of beach along Florida’s Atlantic and Gulf Coasts.

We will be discussing the ownership of beachfront property and what might be considered “using” a certain stretch of beach. Keep in mind that ownership, allowed use, and enforcement can be VERY different considerations.

Let’s start with a definition of the Mean High Water Line (MHWL), an important measurement when it comes to beachfront property lines. Florida Statutes 177. 27(14) and (15) establish the MHWL as the average height (elevation) of high tide saltwater

Infrastructure Is A Constant Focus For The City

In June, we held the Mayor’s Hometown Heroes Presentation. I want to thank Chief Michel and his Chief of Staff, Grace Mariot for helping to organize the awards. The recognition was for the Men and Women from our City Staff that took their time away from the families to go help other families in need after Hurricane Ian. Many people on the West Coast are still recovering from this horrible devastating Hurricane.

At that time many cities that were not in Ian’s path, united and went to help with rescue, recovery and rebuilding. As we are in Hurricane Season, we all know so well the uncertainties that come after a Hurricane is announced. We all hold our breath wondering when and where it will make landfall. This is even with all of the modern forecasting. So, when they hit, we know we are all united.

We are all so proud of these individuals and their commitment to caring for those that are in need. We took the time out to recognize from our Police Department: Chief Michel, Captain Pedro Abut, Captain Thomas Montellanico, Detective Cheryl Ramsaroop, Sergeant Andrew McClelland, Sergeant Pietro Roccisano, Sergeant Diana Sempere, Officers Daniel Barcelo, Pablo Cardoso, Kevin Hebert, Damian Irigoyen, Lori James, Alain Jean-Baptiste, Christina Pascal, Carolyn Rose and Carmine Tufano. I do hope that all of our residents are being vigilant and are prepared if a storm strikes. Many of our new residents have not gone through Flooding and Hurricanes. This was all so apparent with the recent “1,000-year storm.” I hosted a Public Town Hall Forum to review this incident and the Extensive Flooding that took place during this unprecedented storm. I had an opportunity to speak with 20 to 25 residents who were directly impacted by the Flooding. The main purpose of the meeting was to give a bit of history of Flooding, particularly in the Northeast. I gave a briefing on the New Infrastructure that we have built over the past years in the Northwest, Northeast and Southwest to help pump Flood Waters either out or down into Wells. The other goal of the meeting was to see how we can address the response to Flooding in a more Efficient Manner.

Residents need to understand that due to the volume of rain combined with the saturated grounds there would have still been Flooding. Even with pumping. Pumps do not guarantee there will not be Flooding. Every city had flooded streets. It was at least clear within 24 hours except for the Northeast.

This storm event particularly was the

first time that local governments could not declare a State of Emergency. The only individual that can declare a State of Emergency now is our Governor. He had Legislation implemented in response to COVID-19 that handcuffed Local Governments. This simply is not practical in a state as large and diverse as Florida. Hopefully we can work on an Emergency Notification System that addresses our City.

The Northwest and Southwest, due to the Infrastructure and Geography saw Flooding but not Property Loss. In the Northeast, the pumps do not have the capacity to handle the entire area, including Atlantic Shores Boulevard and Federal Highway. While the streets were dry within 24 hours, we have an area that continues to Flood due to the fact that it is one of the lowest points in our City. The Geography acts like a pool, so everything gathers there.

There were Infrastructure Repairs in this area. The Improvements were to the Gravity System. This was before Storm Drainage was Required to be pumped down. We then Implemented the Pumping Systems on 14th Avenue that pumps downward. We knew that it would not be able to handle the entire Northeast, so the two systems are separate.

At the meeting, I stressed I will bring this up and request to address setting a priority to start Designing and Implementing an Expansion of the Drainage System and/or an additional system to address drainage. We are already in discussions with Hollywood who also was inundated and has no Infrastructure System in their Southeast Area directly North of us as, we all know that water knows no boundaries.

As for some takeaways we shared with residents, the ability to apply for SBA Loans, as well as FEMA Grants to address the Flooding. Sadly, some residents that recently bought in the area had no idea it was a Repetitive Loss Area. We also shared with individuals that they may be able to approach FEMA to have their homes bought out. This is one of those last resorts. FEMA will buy the home for Fair Market Value, but then the land or just remain vacant and where can people move to in this economy?

Many residents inquired as to how they can get Loans to Repair their homes through the CRA. The one Major Issue with utilizing CRA Dollars is actually tied to Income Requirements. This is a doubleedged issue, if there were no Income Caps, the Funds would be exhausted and not available for those who are truly disadvantaged.

Another main discussion was how we can help prevent people from cutting through flooding areas. How we can make sure residents in those areas have a safe place to at least park their cars and wait out the storm. Our City actually lost Police Vehicles due to the level of Flooding. In reality once the streets are Flooded, people should not be accessing them. We spoke about a program that they’re doing in Miami that is actually a sticker program, so Police that are monitoring the roadways know that individuals driving do in fact live in the area and are not utilizing it for a cut through.

It was heartbreaking to hear the stories of many of these residents and what they went through along with their children. We will continue to make sure we work together collaboratively to address these Types of Emergencies. We want to ensure residents are safe and help them to access resources to Harding, their homes against Floods.

Aventura’s Team

The City of Aventura’s Travel Soccer Teams have available Team Member spots for interested boys and girls ages 5-16 that are willing to commit and play through the season, which runs August 2023 through May 2024.

The Aventura Football Club (AFC) is the City’s official club for Travel Soccer Teams where players are placed in a team appropriate for their age group. The AFC is a

member of FYSA (Florida Youth Soccer Association). With support from its Professional Coaching Staff, FYSA provides an appropriate level of development for each player, which includes learning new skills, playing on a team, gaining sportsmanship experience, and having fun. Our focus is not only on the technical and tactical aspects of the game of Soccer, but also on instilling the values of sportsmanship, discipline, and teamwork.

Upon team placement, players will be expected to attend practice on Tuesdays, Thursdays and Fridays for ages 5-11 from 5:15 p.m. – 6:45 p.m. and for ages 12-16 from 7:00 p.m. – 8:30 p.m. with games to be scheduled locally and throughout the state of Florida.

Participants must pay an initial Registration/ Club Fee of $200 that includes a Soccer Affiliation with FYSA for League Games. This is a one-time fee per season.

Participants must also pay Monthly Fees of $160 for Aventura Residents and $216 for Non-Residents. The Monthly Fees are broken down from a 10-Month Season that includes practices and local games. In addition to Travel Soccer Registration Fee and Monthly Fees, participants are required to pay the following Separate Payments as part of the Travel Soccer League and FYSA:

• $65 payment to FYSA for Player Card and Insurance that allows participants to play in League Games and Tournaments. Tournament Fees are separate and not included.

• $180 Payment for Uniforms that includes 2 Training Shirts, 2 Full Uniform Sets home and away, and a backpack.

at a specific location on the shore over a 19-year period. Most of us who go to Florida beaches think of a high-tide mark as how far water comes onto the beach (distance) at high tide on any given day. Same basic concept, just different ways to look at it.

The MHWL measurement uses an average because beach sand and bottom contours change every time the tide goes in or out, and definitely whenever a Hurricane makes landfall. It is usually just surveyors who deal with the technical MHWL, which can be very difficult and involved to precisely locate.

The simpler version of this has become the “wet sand / dry sand” public interpretation of beach access and use. Why is this important?

Because the State of Florida holds all land seaward of the MHWL (“high tide line”) in trust for use by Florida residents and visitors - the public.

Remember that during low tides, some of the dry sand close to the water was wet during the last high tide so the “wet sand / dry sand” rule isn’t literal to circumstances all the time. It is the average high tide line (MHWL) that always applies whether that stretch of beach is currently experiencing a low or high tide.

On coastal Florida beaches, sand that has been wet from normal Ocean or Gulf waves and tide action is always public access and use, dry sand can be either public or private.

Though it’s not quite that simple. It depends entirely on how far a recorded private property line extends toward the water. Privately-owned beachfront property can extend to the MHWL, including all the dry sand. Though not all beachfront private property lines extend all the way to that average high tide line. The recorded Deed has to be examined to see if they do or not.

A quick informal reference can be the County’s aerial photo with lot line overlays, usually available on the County Appraiser’s Office website.

In the Appraiser’s Office aerials to the right, the upper property extends all the way to the MHWL, while the lower one does not. In VERY simple terms, the owners of the upper property may be able to

prevent the public from walking along the dry sand between their house and the high tide line, which is deeded private property in this case. The owners of the lower property do not have the same right to exclude public use because their private property does not extend all the way to the water.

In addition to individual residential owners, other entities may be able to enforce private beachfront rights when their properties extend to the MHWL:

• Hotels and other lodging, food,

• and recreational businesses

• Condominium Associations

• Private clubs

• HOA Master Associations

The County (and/or incorporated City) in which a property is located has the authority to charge owners property taxes. They also establish, recognize, and provide enforcement procedures for individual owners’ property rights...including the rights of beachfront property owners to control who can walk or sit on the dry sand beach in front of their houses.

Counties and Cities also own and maintain large stretches of beach for public use and enjoyment. Everyone can walk, sit, play, and swim wherever they like. In these areas, private beachfront lots end at the vegetation line between dry sand and the property’s private yard, “upland” from the public beach.

There are many areas where you may have to cross private dry sand in order to reach the public wet sand. How does that work? Is there an easement for the public to get to “their” wet sand?

And Then There’s “Customary Use”

In 1974, Florida’s Supreme Court openly recognized the concept of Customary Use of privately-owned beachfront by stating “if the recreational use of the sandy area adjacent to the mean high tide has been ancient, reasonable, without interruption and free from dispute, such use as a matter of custom, should not be interfered with by the owner.”

Attorneys tell us that “...the sandy area adjacent to the mean high tide...” means the dry sand beach, and the use of “ancient” is legally interpreted and considered to be 50 to 70 years. Pretty good chance that people have been walking along any given stretch of Florida’s sandy

shoreline since at least the 1960’s and 1970’s. Note that Customary Use only applies to private beachfront properties that extend all the way to the MHWL. Those properties that do NOT extend onto and include the beach sand are not affected by Customary Use because they do not own the dry sand.

Under this published legal opinion, local Cities and Counties established Customary Use ordinances for stretches of beach that included private property, acknowledging previous public use and protecting future public use. If beachfront private property owners disputed the public’s Customary Use on “their” beach, they had to challenge that use in court.

However in 2018, Florida Statute 163.035 was signed into law, significantly changing the procedure to challenge Customary Use. Now it is much more involved for local governments to affirm and support Customary Use, and easier for beachfront property owners to dispute it. Attorneys have described this change as switching the “burden of proof” from the property owner to the local municipality that established Customary Use. Disputes over Customary Use are now considered on a case-by-case basis, supposedly without reference to previously allowed use.

Here’s an important point - when ownership or control of beachfront private property changes through a sale, inheritance, or new trustee, the new person in charge may want to enforce private property rights more than the previous one. Walking across a certain stretch of dry sand may be allowed one day, and challenged the next day if owners decide to start exercising their private property rights.

Previous owners may have gladly allowed public Customary Use while the new ones want to keep the public from walking across their dry sand. Under the newer application of Customary Use, an owner can dispute and challenge public access at any time, compelling the local municipality to go through the legal system to support City or County reasons for recognizing Customary Use.

Some owners of beachfront property throughout Florida have been known to put up “Private Beach / No Trespassing” signs and fences or rope barriers to prevent the public from walking across their dry sand beaches. There are even cases

of property owners calling local police or hiring private security to keep the public off their section of beach. (I am not making this up.)

Now that we know a little bit about the MHWL, wet sand/dry sand, lot lines, and Customary Use...how does all of that relate to things in actual practice?

• When walking onto a beach from the land side, always look for signs indicating who has authority over the beach. This could be the State, County, City, or some private entity. When there is no sign, try to find out whose beach it really is.

• If you are walking along the shore and come to a “Private Beach” sign or barrier across the dry sand, walk across that stretch close to the water. Respect the sign, then later you may want to verify its claim with local authorities.

• Don’t even think about planting your beach chairs, towels, and umbrella on a beach you know is private. It is most often beachfront hotels, owners associations, and membership clubs that will actively enforce their private beaches.

• In real life, when a private property extends all the way down the dry sand to the high tide line, many (if not most) residential owners understand and accept Customary Use by the public. Often, they don’t mind people walking across their private dry sand, though they may prefer that you don’t bring your beach gear, plant your umbrella, and hang out for the day. Beachfront hotels and owners associations don’t usually mind beachgoers walking along the shore, though only allow hotel guests and members to sit and relax on their dry sand.

Florida has some of the most beautiful beaches in the world. East Coast beaches are different from West Coast beaches; Northern Florida beaches are different from those in South Florida. Enjoy, appreciate, and respect them all.

Love the Everglades Movement is an Environmental NonProfit established over 10 years ago by Reverend Houston R. Cypress and Jean Sarmiento. The organization encourages education and action on the preservation of the Everglades and looks to Reconciliation as an integral aspect of the Greater Everglades restoration project because of its necessity to integrate indigenous knowledge into the overall process. The information is manifold as it relates to traditional ecological knowledge (such as researching and reintroducing native plants into our ecosystem), the arts (how culture and craft can amplify storytelling), and understanding how language and dialect are inherent to our environmental surroundings. The Exhibition at the Center creates a space for learning, engagement, and joy in relationship to the River of Grass.

Targeted For Tyranny

We’re All Suspects Under the Government’s Precrime Program

We’re all being targeted now.

We’re all guilty until proven innocent now.

And thanks to the 24/7 surveillance being carried out by the government’s spy network of fusion centers, we are all now sitting ducks, just waiting to be tagged, flagged, targeted, monitored, manipulated, investigated, interrogated, heckled and generally harassed by agents of the American Police State.

Although these precrime programs are popping up all across the country, in small towns and big cities, they are not making us any safer but they are endangering individual freedoms.

Nationwide, there are upwards of 123 real-time crime centers (a.k.a. fusion centers), which allow Local Police Agencies to upload and share massive

attempts to urge Social Media companies to do more to combat so-called dis- and mis-information, these fusion centers are the unacknowledged powerhouses behind the government’s campaign to censors and retaliate against those who vocalize their disagreement and discontent with government policies.

Already, the powers-that-be are mobilizing to ensure that fusion centers have the ability to monitor and lockdown sectors of a community at a moment’s notice.

For instance, a 42,000-square-foot behemoth of a fusion center in Downtown Washington is reportedly designed to “better prepare Law Enforcement for the next Public Health Emergency or January 6-style attack.” According to an agency spokeswoman, “Screens covering the walls of the new facility will show surveil-

In this way, the novel 1984 has become an operation manual for an omnipresent, modern-day surveillance state in which ordinary Americans find themselves labeled domestic extremists for engaging in lawful behavior that triggers the government’s precrime sensors.

With the help of automated eyes and ears, a growing arsenal of high-tech software, hardware and techniques, government propaganda urging Americans to turn into spies and snitches, as well as Social Media and behavior sensing software, government agents are spinning a

This is how the government is turning a nation of citizens into suspects and would-be criminals.

This transformation is being driven by the Department of Homeland Security, the massive, costly, power-hungry bureaucracy working hard to ensure that the government is all-seeing, all-knowing and allpowerful.

Yet here’s the thing: you don’t have to do anything illegal or challenge the government’s authority in order to be flagged as a suspicious character, labeled an enemy of the state and locked up like a dangerous criminal.

In fact, all you need to do is live in the United States.

It’s just a matter of time before you find yourself wrongly accused, investigated and confronted by police based on a data-driven algorithm or risk assessment culled together by a computer program run by artificial intelligence.

Before long, every household in America will be flagged as a threat and assigned a threat score.

Without having ever knowingly committed a crime or been convicted of one, you and your fellow citizens have likely been assessed for behaviors the government might consider devious, dangerous or concerning; assigned a threat score based on your associations, activities and viewpoints; and cataloged in a government database according to how you should be approached by police and other government agencies based on your particular threat level.

Yet this crime prevention campaign is not so much about making America safer as it is about ensuring that the government has the wherewithal to muzzle anti-government discontent, penalize anyone expressing antigovernment sentiments, and preemptively nip in the bud any attempts by the populace to challenge the government’s authority or question its propaganda.

As J.D. Tuccille writes for Reason, “[A]t a time when government officials rage against ‘misinformation’ and ‘disinformation’ that is often just disagreement with whatever opinions are currently popular among the political class, fusion centers frequently scrutinize peaceful dissenting speech.”

Indeed, while the Biden Administration was recently dealt a legal blow over its

It’s like a scene straight out of Steven Spielberg’s Dystopian Film, Minority Report.

Incredibly, as the various nascent technologies employed and shared by the government and corporations alike—facial recognition, iris scanners, massive databases, behavior prediction software, and so on—are incorporated into a complex, interwoven cyber network aimed at tracking our movements, predicting our thoughts and controlling our behavior, the dystopian visions of past writers is fast becoming our reality.

sticky spider-web of threat assessments, behavioral sensing warnings, flagged “words,” and “suspicious” activity reports aimed at snaring potential enemies of the state.

It’s also a setup ripe for abuse.

For instance, an investigative report by the Brennan Center found that “Over the last two decades, leaked materials have shown fusion centers tracking protestors and casting peaceful activities as potential threats. Their targets have included racial justice and environmental advocates, right-wing activists, and third-party political candidates.”

One fusion center in Maine was found to have been “illegally collecting and sharing information about Maine residents who weren’t suspected of criminal activity.

Combine predictive policing with surveillance, overcriminalization and precrime programs, then add in militarized police trained to shoot first and ask questions later, and as I make clear in my book Battlefield America: The War on the American People and in its fictional counterpart The Erik Blair Diaries, you’ll be lucky to escape with your life.

If you’re not scared yet, you should be.

To kickstart the Recruitment Process, the HBPD is inviting all interested participants and their families to a Special Meeting on Wednesday, August 2nd, 2023. The meeting will take place at Foster Park, located at 609 Northwest 6th Avenue, Hallandale Beach, Florida 33009. This gathering aims to provide attendees with a comprehensive overview of the Explorers Program and answer any questions they may have.

So, what are the requirements for joining this exciting initiative? Prospective participants must be between the ages of 14 and 18 and currently enrolled in High School. It is also essential to maintain a “C” Grade Average to ensure a commitment to academic excellence. Additionally, applicants must have a Clean Criminal Record and successfully complete an Oral Interview and Background Investigation. These criteria are put in place to ensure that the program admits individuals who demonstrate a genuine interest in Public Service and possess the necessary qualities to excel in this field. Once accepted into the Explorers

Program, members can expect to engage in a variety of activities that will broaden their knowledge and understanding of Law Enforcement. Weekly Training

Help! The Temple Is On Fire

Legend has it that Napoleon, the great French leader, was once passing through a small town in Europe, when he heard weeping. Wanting to know what was going on, he followed the sound inside a building, where he found men, women and children sitting on low chairs & benches, crying. The building was a Synagogue and the room which had a magnificent candelabra chandelier at its center, had only a few candles lit.

Bothered by the scene and wanting an explanation, Napoleon inquired about the reason for their sadness. They explained that they were mourning for the destruction of the temple. At that point Napoleon became very angered that people would have the audacity to harm the Temple of such good people, and inquired further to where the damage was, as whatever parts he saw still looked intact. No no, they explained. “We’re mourning for the Holy Temple in Jerusalem, the Beit Hamikdash, that was destroyed by Rome over 1700 years ago. Once a year on Tisha B’Avthe 9th day on the Jewish month of Av, we get together to read the Book of Lamentations and mourn the Temple’s destruction while praying that we very soon merit its rebuilding.”

To this Napoleon responded, “WOW! A people that remembers the destruction of their land and temple after so many hundreds of years, will surely witness its rebuilding.”

Tisha B’Av was actually the day that both Temples were destroyed. The First Temple built by King Solomon was destroyed by the Babylonians (modern day Iraq) in 3338 (423 bce). After completing the building of the Second Temple in 3412 (349 bce), it too was destroyed on the 9th of Av, this time by the Romans in 3829 (69 ce). That was also the day on which the Jews were expelled from Spain in 5252 (1492 ce), the start of World War I in 5674 (1914 ce) and the Gush Katif Expulsion in 5765 (2005 ce).

If you were to witness any such atrocity, how would you respond? What would you say? What would you do?

The Talmud tells us that although the Babylonians & Romans did the dirty work, it was actually the will of G-d, due to the people not behaving in a loving way one to another. Furthermore the Talmud tells us that as long as the Temple is not rebuilt in our time, it’s as if it was destroyed in our time!

In other words, since we still don’t have the Temple rebuilt, it’s as if it’s being

destroyed in front of our very eyes! We are witnesses to those atrocities! Help! The Temple is on fire!!

The good news is that we know what to do. By acting in kind ways to one another, by loving thy neighbor, by simply being good people, we will surely see the Third Temple built in a peaceful Jerusalem. Ah! If we would only merit to enjoy it, this year in Jerusalem!
