South Florida, with its breathtaking beaches, vibrant coastal cities, and unique ecosystems, has long been a sought-after destination for residents and tourists alike. However, the region’s allure comes with a price: it is one of the most floodprone areas in the United States.

In recent years, the impact of Sea Level Rise has become increasingly evident, posing a significant threat to the region’s Infrastructure, Economy, and the lives of its residents. This article aims to explore the extent of flooding risks in South Florida and delve into the changes in Sea Level Rise that the region has witnessed over time.

The phenomenon of Sea Level Rise is a result of two primary factors: the melting of polar ice caps and the expansion of seawater as it warms. South Florida is on the front lines of this escalating crisis. According to the National Oceanic and Atmospheric Administration (NOAA), Sea Levels in the region have risen by approximately nine inches since 1950, exceeding the global average.

Do I Need Flood Insurance If I Live On The 5th Floor?

When I hear that question, I’m pretty sure we are talking about a condominium building. Most people think of Flood Insurance in relation to Single-Family Homes, though every type of property has some exposure to flooding. Today, we are discussing Flood Insurance for Florida condo buildings and Associations, which is in addition to any individual residence unit insurance an owner may purchase. Flood Insurance is separate from any other coverage, NOT included in an Association’s Hazard & Liability Policies or Windstorm Coverage. Floods are

a completely separate risk, and insurance protection for them requires a separate policy.

Let’s start with a few definitions common to all Flood Insurance:

Flood - As defined by the NFIP - “A general and temporary condition of partial or complete inundation of two or more acres of normally dry land area or of two or more properties (at least one of which is your property) from: Overflow of inland or tidal waters, Unusual and rapid accu mulation or runoff of surface waters from any source, Mudflow or Collapse or subsidence of land along the shore of a lake or similar body of water as a result of erosion or undermining caused by waves or currents of water exceeding anticipated cyclical levels that result in a flood as defined above.”

maintain insurance against possible hazards to the common structure(s) and shared areas which can include the: Entrance and Lobby, Roof and exterior walls, Parking areas, Building structure, Electrical, HVAC, elevator, and other mechanical systems or Offices, fitness/ meeting rooms, clubhouse and other shared onsite amenities.

Flood Insurance is an important part of required coverage for many Condominium Associations in Florida. While there are some carriers now offering their own Flood Policies, the most common form of protection is the NFIP’s Residential Condominium Building Association Policy (RCBAP) which requires that at least 75% of a building’s floor area is residential.

The areas most exposed to flood risk in a Condominium Building are usually: Ground floor entries, meeting rooms, and offices, Elevator shafts that extend below ground level and Parking areas (both under the building and ground-level)

RCBAP Coverage (often called a “master flood policy”) applies to the Association-owned structure, its common elements/areas, and does NOT cover individually-owned units that may be at flood risk. Flood Coverage for individual residence units can be purchased by the unit owner under what is called NFIP’s Dwelling Form.

Since all individual unit owners also own part of the common elements/areas and are members of the COA, they all pay a part of the Association’s Flood Insurance premium in their scheduled assessments (condo “dues”). Yes, even when you live on the 5th floor as our headline question asks.

A couple of years ago, the NFIP modified their risk and premium rate analysis for Single-Family Houses, depending less on Flood Maps and more on individual property physical location, design, and exposure to evaluate risk, and therefore Flood Insurance premium costs. This new method for evaluating individual properties is called Risk Rating 2.0.

However, RCBAP Policies still start with a building’s Flood Zone as shown on the FIRM. Buildings in any A and V Flood Zones are located in Special Flood Hazard Areas. Being in an SFHA means flood risk is one of the hazards for which the Association should carry insurance protection. (V stands for Velocity and refers to moving water from wave or current action. Most Florida beachfront condo buildings are in V Flood Zones.)

Here are 3 basics about the RCBAP program:

• RCBAP is Single-Peril Coverage, meaning it only pays for direct physical loss by (or from) Flood Damage as defined in the policy.

• Is based on Replacement Cost Value, with deductibles calculated as a % of loss value, not maximum policy limits.

• Does NOT cover the Association’s Personal Property such as Lobby/office furniture, fitness room equipment, etc. These items can be covered by a separate contents policy with an additional premium.

RCBAP Coverage does NOT include:

• Any individually-owned residence units or their contents

• Damage from moisture, mold, or mildew caused by inaction to prevent or control it

• Vehicles such as owners’ cars and golf carts

• Swimming pools

• Landscaping trees, plants, fences, decks, walkways

• Financial losses from business interruption

• Permit costs for demolition, renovation, or repair of the condominium property

Florida’s Condominium Act does not require COAs to have Flood Insurance, though it may be considered irresponsible and careless if the Board of Directors does not maintain Flood Insurance for a building located in a SFHA. Each COA’s Governing Documents state the Association’s obligation and requirements for insuring the property and common elements.

This is important - when a Florida condo building is in a Flood Zone that starts with an A or V (SFHA), very few lenders will approve and fund Mortgage on an individual unit in that building unless the Association carries Flood Insurance on the common elements/areas (a “master policy”).

Not many lenders will accept the risk of lending money for the purchase of an individual unit in a condo building that should carry Flood Insurance, though it doesn’t. In this case, individual unit financing is only available from portfolio lenders (usually regional banks) who hold and service the loan as an in-house investment rather than selling it to institutional investors in the secondary Mortgage market.

• Insufficient or no Building Flood Coverage can result in significant Special Assessments to owners in the event of Flood Damage.

• Insufficient/Lapsed RCBAP Coverage can make it difficult or impossible for a buyer to get purchase financing on an individual unit in the building.

It is also important to note that Condominium Associations with multiple separate buildings usually need a separate RCBAP Policy for each building, with its own separate premium cost. Each building by itself has exposure to Flood risk. Even within the same community and same Flood Zone, individual buildings can have very different flood risks.

Florida has many different designs and styles of condominium buildings, which is why Flood Risk exposure is evaluated on a case-by-case basis. There are no 2 buildings that have exactly the same Flood risk.

Consider this - a 15-story condominium building may have 120 individual units with just 5 individual residence units on the ground floor. Another COA also with 120 units may have 15 separate buildings containing 8 units each. In this arrangement, there are 60 individual residence units on the ground floors.

In the high-rise arrangement, there is likely significant ground-floor Association

Flood Policy does NOT cover any individually-owned residence units. For this reason, I suggest that ALL owners of ground floor condo units in A or V Flood Zones carry their own Dwelling Form Flood Insurance.

Finally - Not all Water Damage is Flood Damage.

Flood Insurance only covers rising groundwater and/or tidal surge causing damage to a building and its mechanical equipment. Damage caused by other factors (like wind) is covered by other types of insurance. Windstorm Insurance does not cover flooding, and Flood Insurance does not cover damage from high winds.

Let’s answer our headline question: Yes, owners of residence units on the higher floors of Florida condo buildings DO need Flood Insurance because they also own part of all the ground-floor areas that are exposed to flood risk. The COA’s Flood Policy takes care of this, and all owners contribute to the premium cost. It is strongly advised that condo owners also have insurance protection for their individual residence units, at least a basic HO-6 Condo Policy.

And there we are, a very brief introduc-

This is why many COAs with lowrise buildings do not carry Flood Insurance.

After extensive testing and significant advancements in battery technology, automakers have now introduced electric pickup trucks capable of traveling up to 300 miles on a single charge. Three prominent manufacturers — GM, Ford, and the newcomer Rivian — are releasing their highly anticipated models onto the roads. Furthermore, both Dodge and Tesla have plans in place to release their own electric pickup truck models in the near future.

In a recent study of battery range & load capacity they specifically focused on the new Ford F-150 Lightning, a popular electric pickup truck. When the vehicle was loaded with 1,400 pounds of sandbags, just 110 pounds shy of its maximum capacity, its range dropped by 24.5%. This means that the vehicle’s range decreased from 278 miles to 210 miles. To put this into perspective, 1,400 pounds is equivalent to hauling around 70 bags of mulch or 20 bags of concrete mix.

The findings of the study highlight the impact of physics and driving behavior on the range of EVs. Extra weight requires more energy to move, and the type of driving also plays a role. Highway driving, which typically involves higher speeds and less regenerative braking, will further reduce the range of an EV. Regenerative braking is a feature of EVs that allows them to capture and convert the energy from braking into electrical power, which can then be used to charge the vehicle’s battery.

It’s important to note that EVs perform more efficiently in urban driving conditions, where there are more frequent stops and opportunities for regenerative braking. Gas-powered vehicles, on the other hand, tend to be more efficient at higher speeds. This means that EVs are well-suited for city driving, while gas-powered vehicles are more suitable for highway driving.

In the case of battery electric pickups used as work vehicles, even permanent loads such as equipment racks, toolboxes, and equipment trays built into the vehicle will reduce the range at all times, regardless of whether additional cargo is present.

Despite the range reduction when hauling heavy cargo, EVs remain a viable option for many drivers. “For buyers concerned about range, it’s essential to consider the driving they will be doing and choose the right EV for their needs,” said Jenkins. Each EV model has its own specifications and range capabilities, so potential buyers should carefully assess their needs and consider factors such as daily driving distances and cargo requirements. With current battery technology, the study highlights the impact of heavy cargo on the range of current electric vehicles. While there is a significant reduction in range

South Florida’s Geography makes it inherently susceptible to flooding. The region sits on a low-lying limestone base, and its porous nature allows water to seep through, exacerbating the Flood risk. Furthermore, the area’s extensive network of canals, drainage systems, and artificial waterways, essential for managing water levels, are increasingly strained due to Rising Sea Levels.

Researchers at the University of Miami’s Rosenstiel School of Marine and Atmospheric Science predict that by 2050, South Florida may experience an additional 10 to 17 inches of Sea Level Rise. Such projections have spurred urgent action by local governments, scientists, and community organizations to mitigate the impacts.

Over the past few decades, South Florida has witnessed the consequences of Rising Sea Levels firsthand. High Tides and King Tides, exacerbated by Sea Level Rise, cause regular flooding in low-lying areas. Saltwater Intrusion, where Seawater infiltrates Freshwater supplies, poses a significant threat to South Florida’s drinking water resources.

Miami-Dade’s Plan

Miami-Dade County, home to over 2.7 million residents, is particularly vulnerable to flooding. A 2020 report by the Risky Business Project ranked Miami as the city most at risk in terms of financial losses due to Sea Level Rise. Other coastal cities in South Florida, including Fort Lauderdale and West Palm Beach, face similar challenges.

In 2021 the U.S. Army Corps of Engineers proposed a plan to protect the Miami-Dade coast from flooding and storm surge. The project was in dispute, particularly their idea of a large concrete flood wall. At stake are billions of dollars. One sticking point was a proposed flood wall running parallel to Miami’s waterfront, a looming concrete structure that some local city and business leaders argued would sink property values.

Following the strong opposition from local residents and environmental groups, the U.S. Army Corps of Engineers has agreed to revise the controversial MiamiDade plan to fight Sea Level Rise. Instead of constructing towering walls and flood gates to protect against worsening storm surge and Sea Level Rise, the Corps will explore more natural solutions that can also benefit the deteriorating Biscayne Bay.

In a letter released by MiamiDade County, the Corps expressed its willingness to allocate an additional $8.2 Million and invest up to five years to ensure the effectiveness of the plan.

Assistant Secretary of the Army, Michael Connor, emphasized the need for a balanced approach that not only enhances project performance but also safeguards the environment and upholds equity within the community. This decision comes after Mayor Daniella Levine Cava and others lobbied against the original $4.6 Billion plan, which included a mile-long flood wall along the bay’s shores and flood gates across the Miami River, Little River, and Biscayne Canal.

Miami-Dade County had requested the Corps to allow time for presenting an alternative proposal, taking advantage of the 6040 cost share offered under nationwide efforts to bolster shorelines against increasingly severe storm surges resulting from climate change.

Initiated three years ago with a planning budget of no more than $3 Million, the Back Bay study focused on fortifying Biscayne Bay to withstand Rising Sea Levels and the destructive impact of hurricane storm surge. However, the proposal of floodgates and a meandering flood wall faced widespread opposition, prompting the Corps to reconsider its approach.

Bague, a former member of the South Florida Water Management District’s governing board, commended the Corps for its unprecedented willingness to pivot in response to local concerns. This decision reflects the importance of the region and the numerous ongoing projects supported by the Corps, particularly those related to Everglades Restoration.

While the Corps indicated that the extended planning phase might take up to five years, Mayor Levine Cava expressed hope that a new study could be finalized and incorporated into the upcoming Biennial Water and Infrastructure Act, scheduled for Congress in 2024.

“We’re not starting from scratch; we’re

capitalizing on areas of agreement,” stated Levine Cava. She stressed the need for people to comprehend the high stakes and associated risks, as well as the tradeoffs involved. The revised plan not only focuses on water management but also encourages a forward-thinking approach to address future challenges.

Inspired by the Love of a True Leader

Thursday, the 3rd of Tamuz, marks the 29th Hilula of Rabbi Menachem Mendel Schneerson, the Lubavitcher Rebbe. Known affectionately and simply as The Rebbe, he was probably the most influential Rabbi in history. With his Shluchim emissaries dispatched to every corner of the world, his impact is felt everywhere you turn.

After the decimation of the Holocaust, the Rebbe breathed new life and vitality into the Jewish people, urging them (and demonstrating by example) to celebrate Judaism and live life optimistically, to ‘reclaim’ countless individuals and communities to living a Jewish way of life, and to feel personal responsibility for all others everywhere. In so doing, the Rebbe altered the much-prophesied demise of Judaism, forever shifting the course of history and transforming the landscape of Jewish life.

The Rebbe took breathtaking responsibility for the material and spiritual welfare of Jews in the Soviet Union (including masterminding the exodus of thousands), Morocco, Iran, and more, while reaching out to Jews in Curacao, Japan, and Alaska...

Israel’s leaders turned to the Rebbe for counsel on public health policies; military strategy; economy; relations with the U.S., Egypt, South Africa, Tunisia and more; and, above all, its educational system.

Growing up in the Crown Heights section of Brooklyn, just a few short streets away from the Rebbe, I was fortunate to see the Rebbe all the time. I prayed with him in his Shul, sang by his Farbrengens, stood at his public gatherings and rallies, and watched every glimpse I could. As a child, I would look around at the thousands of people that would constantly come from all over the world to seek his counsel, hear his talks, or just to see his holy face; and I remember thinking how privileged I was to live right there.

Every Sunday for hours,The Rebbe would stand, giving out dollars and blessings to thousands of people from all walks of life. He gave the dollar to be given to a

charity of choice. People would of course exchange that dollar for one of their own to give to charity, and keep the dollar they got from the Rebbe’s hand as a sign of blessing.

The Rebbe was remarkably accessible and counseled countless individuals from a wide array of backgrounds, including statesmen and artists as diverse as Ronald Reagan, Robert F. Kennedy, Yitzchak Rabin, Menachem Begin, Elie

ingrained in our society and inspire millions of Jews and non-Jews. More people than ever are learning his teachings and acting on his wishes of spreading Judaism to Jews, and moral ethics to all people.

As we are in the midst of Hurricane Season please make sure you have your plan, place, and your supplies.

The first Revenue Generating Program was to adopt a citywide parking program. This program was a huge change for many of our residents. It had more benefits that I will highlight than just revenues that helped address some of those cans I have mentioned.

Many people were storing cars and personal recreation vehicles. Some residents were parking their personal cars on the street and renting their condominium spots. Vacation rentals were bringing in many vehicles for units intended for one car. We had residents from other cities storing their work vehicles. We even had one company using 3rd Avenue to run a rental car business. It was truly a mess.

With the parking fees we have ensured that our residents can access monthly parking passes that equate to only a dollar a day and made sure individuals with Disabilities are not burdened. This year we amended the program as promised and made changes to help the workforce particularly home care workers. Her program was implemented and actually opened up spots for residents, their visitors, and local businesses customers.

The first year generated approximately $1 Million. Revenues paid for operations and some of those cans I have mentioned.

The second Revenue Program was the new Certificate of Use Program. Many cities have had this program to ensure properties are being utilized for their intended use. This law will protect buyers from illegal conversion and ensure rental and commercial properties are being used properly, safely and are not homesteaded.

ness. This is different from at home. When I say business, I mean businesses where customers come and go, employees can come and go. Obviously, there are some controls for hazardous businesses and parking regulations, but without the ability to inspect we cannot tell what is inside. More importantly, we cannot ensure that people or surrounding property owners are not being put at risk.

This issue combined with the extensive amount of VRBO made the Certificate of use pro gram essential. The program was approved. Since the recent roll out, $80,000 dollars in review was generated so costs are being covered. I must share that the roll out of this new pro gram was not without glitches. The startup was both manual and technology driven. The rollout resulted in many prob lems with the burden of manual computer entries, payments and printing of certificates. I apologize to those of you who have lost sleep over it and the Staff is working hard to address all your concerns.

One more Revenue generat ing policy was for our Utility Franchise Agreement. This idea came from our wonderful Finance Director Neste. Many cities are struggling regretfully to sell their utilities to private entities to gain Revenue. We own and operate our Utility. The fund pays the Franchise Fee to the General Fund which helped with an infusion of $1.5. This Revenue will continue for years to come.

Another critical issue has been the Building Department. I am happy to say we have filled all positions through a unique contract. Our City did not want to contract out the entire division. I have spoken before about the pitfalls of privatization. This new contract is with the CAP Government. They have worked as sole

The Hollywood Police Department is hosting a Gun Buyback Event this Saturday, June 24th, 2023 from 9:00 a.m. to 2:00 p.m. at the Hollywood Police Department at 3250 Hollywood Boulevard.

• Up to $100 for Shotguns & Antique Firearms

• $150 for Handguns & Rifles

• Up to $250 for Semi-Automatic Rifles

Funds will be distributed in Publix Gift Cards. Guns must be unloaded. Leave the gun in the trunk of the vehicle for removal. No other weapons or ammunition will be accepted. No questions asked. No ID required. This event is in partnership with Crime Stoppers.
