SCWA was honored to host the 2025 SCWA Convention & Car Wash EXPO in Fort Worth. We believe bringing the car wash community together is a gift not to be taken lightly. Our goal each year is to provide a meaningful EXPERIENCE of being together; doing together and learning together.

What I saw rising from the education and discussion sessions was a group of leaders in the industry, excited to be together and sharing a positive confidence.

EFFICIENT PROFITABILITY

Another advantage controllers enable is to-the-inch application of chemicals. This precise application means operators can effectively control their washes’ chemical costs. When set up correctly, equipment only sprays the vehicle, not the gap between vehicles, Davy notes. This to-the-inch application continues through the entire tunnel and applies to such services as ceramic coatings, wax applications and other necessary chemistry. This universal control not only saves on chemistry costs, but it also provides customers a better wash experience.

Coming together as a community helps us form relationships, find support and gain opportunities we might not otherwise have. Not only does a community benefit individuals, but it can play a key role in creating a more vibrant industry.

The positive spirit and enthusiasm of the car wash community was certainly on display during the three days of activities in Fort Worth. As the SCWA President this year I was excited about all wonderful comments of attendees and exhibitors. However, one observation really stands out for me from one of our first time attendees when he told me the SCWA Convention and EXPO was a “fantastic experience”!

Energy efficiency can be another advantage. “Your tunnel controller also helps you save electricity by driving each piece of machinery in the tunnel, activating your vehicle frequency-driven devices and controlling signage and lighting around your facility,” Davy continues. “Additionally, your tunnel controller can help conserve energy by leaving your dryers on when multiple cars are in the tunnel, avoiding costly start-ups of the dryer system. Without wasting chemical or electricity, you are better able to control your per-car costs and make each service more profitable.”

Bath points to efficient look-ahead features in a carwash tunnel that can include the controller keeping the blowers running for the following vehicle. Again, this step saves energy and creates cost savings. “There are many features that can help operators save power, water, etc. When you understand all these modern-day features, your process will benefit as well as your cost savings,” Bath says.

With the ramped-up speeds and maximum loading efficiency needed, it is easy to see the importance of proper control in the world of express tunnel washing. Integrated and cooperative monitoring systems have proven to be a profit protector for many bustling car care operations. How do modern controllers enable these monitoring systems to prevent both loading issues and damage complaints in carwash tunnels?

Here, camera systems can provide on-site tracking and help avoid delays caused by a loader, which prevents slowed productivity and missed rollers. Inside the tunnel, cameras can even stop the conveyor when the vehicle is not where it is supposed to be, Davy states. Stopping the tunnel can prevent costly accidents and the downtime they create. These anti-collision systems allow a carwash to run vehicles closer together, further increasing valuable throughput and revenue on busy days.

As I sat in on the many sessions of the convention I was continually amazed to see the interaction and smiles of our attendees. It was a gathering of the best and the brightest in the car wash industry. I was reminded that leadership and successful business go hand in hand. What I saw rising from the education and discussion sessions was a group of leaders in the industry, excited to be together and sharing a positive confidence. As we clearly saw in the Closing Session panel discussion - we truly have strong industry leaders in the car wash community from coast to coast. Leadership is all about having the ability to solve problems, overcome obstacles, and keep focused on growing our businesses. There is a Japanese proverb which says “He who smiles rather than rages is always the stronger.”

I know we have many people to thank for the success of the 2025 event. First, to the 2024-25 SCWA Board of Directors Convention Committee, great job! EXPERIENCE SCWA 2025 was the best yet. Thank you for your dedication and support this year. Our Board members serve SCWA and the car wash industry by giving their time and assuming the financial expenses of their participation. It is an honor to serve on the Board of Directors; however, it is also a sacrifice in terms of time and financial resources. Each deserves a special thank you!

Vehicle proximity devices, such as sonar, help identify features on vehicles so a wash can provide a better clean, Davy notes. For example, these devices can detect the windshield location, allowing for special windshield wash services or side mirror rinses. It is also possible to identify truck beds, allowing a wash to automatically turn off devices. This can prevent too much soap from being dumped into the truck bed or turn off blowers so they will not blow debris out of the bed onto other vehicles.

If our convention is any indication, 2025 will be a really good year in the car wash industry!

FACT VS MYTH – COMPLIANCE IN THE TRUMP ERA OF ENFORCEMENT LABOR

nder the Trump administration, daily ICE arrests have surged to 600 compared to 300 per day during the Biden administration. More frequent I-9 audits accompany this increase, and Trump’s border czar, Tom Homan, promises to reinstate worksite raids. Immigration enforcement remains a key focus of Trump’s agenda, reflecting one of his central campaign promises.

For carwash businesses, which often employ large immigrant workforces, no owner can afford to think, “It won’t happen to me.” In an era filled with misinformation and uncertainty, it is vital to know the facts about immigration enforcement to protect your business. This guide aims to help you distinguish fact from myth.

How Do Investigations Start?

While some inspections are truly random, often there are specific triggers such as tips and complaints, identify theft, prior violations, and industry sweeps. Tips and complaints

usually come from a disgruntled former employee, a competitor, or a member of the public who might report a business for hiring undocumented workers. ICE does follow up on credible tips. Even anonymous complaints can prompt an investigation.

Innocent bystanders who had their identity stolen will report that their Social Security Number (SSN) is being used at your company. If this happens to your business, do not ignore the problem. Ignoring a report of a false SSN or identity can lead to an ICE investigation and Notice of Inspection. Failing to act makes the company look complicit. Begin by conducting an internal investigation to confirm whether any misuse of the victim’s SSN was an innocent error. If not, address the situation

under the company policies addressing false information, dishonesty, or fraud, allowing you remedial measures where termination is warranted. Submit updated W-2c and W-3c forms for every year the employee’s wages were reported under the victim’s SSN. Additionally, notify and correct the records with both the Social Security Administration and the state workforce agency as the issue may have originated if the victim was applying for state benefits.

If ICE determines that a company will be inspected, they will provide it with a “Notice of Inspection” (NOI), an official notification that it will audit your Form I-9 Records. Employers should focus and prepare for I-9 Audits over workplace raids. While the Trump administration has touted that they would conduct more workplace raids, historically, they’ve been conducted a few times a year compared to thousands of I-9 Audits. I-9 Audits focus on penalizing paperwork and hiring violations. Don’t let this approach fool you into complacency, the results of an I-9 audit can result in hefty fines.

Handling ICE enforcement

If you receive an NOI, it is important to know your rights as a business owner. You will have at least three days to gather your I-9 forms. During this process, you have the right to legal counsel, which will communicate with ICE on your behalf. Remember to stay calm and professional, let ICE know you will cooperate, and create a log of all the documents you provide. Additionally, provide only the information you are asked for in the NOI, don’t volunteer extra records or allow agents to wander the facility beyond the scope of the NOI.

After an Audit, you may receive a “Notice of Suspect Documents” identifying employees who appear unauthorized. If you receive this, allow the employee to correct it. You may also receive a “Notice of Technical Failures” listing paperwork mistakes, you will be given 10 days to correct those mistakes. Lastly, you may receive a “Notice of intent to fine” for substantial mistakes. What makes an error substantial instead of technical is when the employer should have recognized an obvious mistake on the Form I-9 (See above Hall of Shame for examples).

Avoiding I-9 Audit Fines

Employers should create an I-9 compliance checklist to avoid fines or audits. The checklist should include the following steps:

1. Establish and implement a written policy and procedure for maintaining records

2. Apply the policy consistently to all employees to avoid claims of discrimination

3. Hire an experienced law firm to conduct a compliance evaluation.

4. Schedule a company-wide I-9 mock audit to ensure compliance.

When reviewing I-9s, you want to reject any I-9s that contain these mistakes contained in the “Hall of Shame” to avoid hefty fines or criminal charges for knowingly harboring unauthorized immigrants:

• SSNs that start with 9, 666, or 000 and have a signature line

• Any misspelling should flag a document as fraudulent

• Photos must be a headshot of only one person

• Matricula Consular Cards are not an approved document

Identity Confessions

Finally, employers should be aware of a common difficult position they may encounter when employees provide new work authorization and admit that the previous document was not genuine. If you encounter this issue, take appropriate measures based on your company policies (we advise against a one-strike policy in favor of one that empowers management to evaluate each scenario). Next, prepare and complete a new Form I-9 as if it were a new hire, using the original hire date from the previous I-9, and retain the old form with the new form. Lastly, document the reason for the newly confessed identity for your records and notify the employee that they are responsible for complying with applicable tax regulations.

FINAL RESULTS

he millions of businesses that rode out the recent rollercoaster of court rulings and chose not to file their CTA reports to date should be feeling pretty good right now.

If maintained correctly, the final results provided by closed-loop carwashing should rival conventional wash quality, the NWI team states. The path to achieve this quality is not without some increased maintenance requirements and equipment costs. But, these factors should be weighed against the savings of reduced water and sewer costs to determine the feasibility and profitability of closed-loop operation.

Fresh on the heels of FinCEN’s announcement that it was pausing enforcement of the Corporate Transparency Act pending the enactment of new regulations, the Treasury Department shed some additional light on what the new reporting regime will look like.

Ideally, a closed-loop wash is using completely biodegradable chemicals, operating a true restoration system that removes chemicals from the water and following the manufacturer’s required maintenance, Gibney concludes. If so, customers will not be able to tell any difference in wash quality compared to the use of fresh water.

If you have multiple checking or savings accounts, consider consolidating to one of each, preferably at the same bank-more accounts mean higher odds of overdrafts. Especially troublesome are accounts with automated withdrawals or payments-easily overdrawn if no one is paying close attention. If there are lots of CDs, savings accounts and/ or moneymarket accounts at different institutions, some could be easily overlooked.

REGULATORY UPDATE

This is good news all around. Not only is Treasury taking aggressive action to limit the damage the CTA poses to the small business community, but it’s evident our concerns about the law are shared by some pretty important people.

Stick with paper statements. It's perfectly fine for you to access your accounts online, but it's easy for someone else to overlook or be shut out of your online only accounts, which may be difficult to access. Bills and statements that arrive in the mail provide a wonderful fail-safe. That's true even if the financial agent doesn't live near you-your mail can be forwarded to that person by the post office or a trusted neighbor.

DRAFT A ROAD MAP

There are, however, some open questions as to how things play out from here. The Administration clearly has the ability to amend regulations issued by their predecessor, but what about the underlying statute? And what about the many court cases pending that challenge the CTA based on fundamental constitutional issues?

Prepare Your Finances for an Emergency Handoff

The Treasury Department is announcing today that, with respect to the Corporate Transparency Act, not only will it not enforce any penalties or fines associated with the beneficial ownership information reporting rule under the existing regulatory deadlines, but it will further not enforce any penalties or fines against U.S. citizens or domestic reporting companies or their beneficial owners after the forthcoming rule changes take effect either. The Treasury Department will further be issuing a proposed rulemaking that will narrow the scope of the rule to foreign reporting companies only. Treasury takes this step in the interest of supporting hard-working American taxpayers and small businesses and ensuring that the rule is appropriately tailored to advance the public interest.

Could someone step in and successfully manage your financial affairs if you are unable to do so yourself? Of course, you could execute a "financial power of attorney'' designating someone as a "financial agent" to act on your behalf in financial matters if you're incapacitated. But just drafting that document with an attorney, which you should do, doesn't guarantee that this relative, friend or adviser will know what to do. The issue isn't so much whether he/ she lacks financial savvy-it's that figuring out someone else's finances on the fly is a massive challenge. Having a financial plan in place for health emergencies is especially on many people's minds now because of the coronavirus pandemic, but an incapacitating emergency could come up at any time. Here's how to prepare finances for an emergency handoff…

So anyone concerned about the Trump administration’s position on the CTA – particularly after FinCEN appealed a ruling that had prevented the reporting requirements from taking effect – can breathe a sigh of relief.

Here’s how President Trump reacted to the announcement: “Exciting news! The Treasury Department has announced that they are suspending all enforcement of the outrageous and invasive Beneficial Ownership Information (BOI) reporting requirement for U.S. Citizens. This Biden rule has been an absolute disaster for Small Businesses Nationwide. Furthermore, Treasury is now finalizing an Emergency Regulation to formally suspend this rule for American Businesses. The economic menace of BOI reporting will soon be no more.”

SIMPLIFY IN ADVANCE

Consolidate credit cards and bank accounts. Missed credit card payments are among the most common missteps when someone takes over your finances. The more cards you use, the greater the odds that there will be a problem. Cut back to only two, if possible.

And Treasury Secretary Scott Bessent: “This is a victory for common sense. This action is part of President Trump’s bold agenda to unleash American prosperity by reining in burdensome regulations, in particular for small businesses that are the backbone of the American economy.”

Create a concise guide to your finances. Having all of your financial information in one place will save your designated agent a lot of time and greatly reduce the odds that something will be missed. Handwrite this list, or type and print it. But don't save it on your computer or send it via e-mail-that would increase the risk that this sensitive info could be stolen. INTEREST RATES REMAIN THE SAME FOR THE SECOND QUARTER OF 2025 REGULATORY UPDATE

The Internal Revenue Service announced interest rates will remain the same for the calendar quarter beginning April 1, 2025.

For individuals, the rate for overpayments and underpayments will be 7% per year, compounded daily. Here is a complete list of the new rates:

• 7% for overpayments (payments made in excess of the amount owed), 6% for corporations.

• 4.5% for the portion of a corporate overpayment exceeding $10,000.

• 7% for underpayments (taxes owed but not fully paid).

• 9% for large corporate underpayments.

Under the Internal Revenue Code, the rate of interest is determined on a quarterly basis. For taxpayers other than corporations, the overpayment and underpayment rate is the

federal short-term rate plus three percentage points. Generally, in the case of a corporation, the underpayment rate is the federal short-term rate plus three percentage points and the overpayment rate is the federal short-term rate plus two percentage points.

The rate for large corporate underpayments is the federal short-term rate plus five percentage points. The rate on the portion of a corporate overpayment of tax exceeding $10,000 for a taxable period is the federal short-term rate plus onehalf (0.5) of a percentage point.

The interest rates announced today are computed from the federal short-term rate determined during January 2025.

he 2025 edition of the Southwest Car Wash Association Convention & EXPO recently concluded bringing together car washers from 46 different states plus Mexico; Canada; Finland; Netherlands; Virgin Islands and Germany for the first BIG Car Wash event of the new year at the Fort Worth Convention Center.

RETIREMENT OF PAUL FAZIO MEMBER

HIGHLIGHT

Sonny’s Enterprises today announced the planned retirement of Paul Fazio, board chairman, according to a company press release.

This marks the culmination of his extraordinary career in the carwash industry, which spanned more than four decades.

A visionary leader, Fazio was instrumental in shaping both Sonny’s Enterprises and the broader carwash industry.

His steadfast commitment to the company’s employees and clients drove unprecedented growth and helped elevate the entire industry.

“I started in this industry in 1981, working with my father,” said Fazio. “Together, with our incredible team, we grew Sonny’s from a small parts company into the global leader in conveyorized carwash equipment and supplies. Our mission was to make carwashing easy, and we were able to achieve that.”

Fazio continued, “It’s been a wild ride, and I wouldn’t change a thing.”

Chief Executive Officer Curt Hutchins expressed appreciation for Fazio’s leadership: “Paul’s vision and unwavering

dedication to Sonny’s, our customers, and the entire carwash community have been the driving forces behind our tremendous growth. His legacy will continue to inspire us as we build on the strong foundation he created.”

The Board of Directors also commended Fazio’s impact: “Paul’s leadership has been essential in transforming Sonny’s into the industry leader it is today. His commitment to customers and his lasting influence on the organization is deeply appreciated, and we are thankful for his extraordinary contributions.”

Fazio, who previously served as the company’s CEO before transitioning to Chairman, will remain a significant shareholder.

Links Car Wash has acquired three new locations, including its first site in Texas. This milestone reflects the company’s rapid growth and its commitment to bringing high-quality, efficient car washes to new communities.

In addition to the Texas location, Links Car Wash has acquired two new sites in Florida: an established location in St. Petersburg and a newly built site in Tampa. These acquisitions strengthen the company’s presence in Florida while continuing to build momentum for future growth.

Car Pool Car Wash bought by employees

RICHMOND, VA. According to a press release, Car Pool Car Wash in Richmond. Virginia, was purchased by two longtime employees, Mark Harrison and Tyree Brown.

Harrison, chief financial officer of Car Pool Car Wash, and Brown, chief operating officer of Car Pool Car Wash are now equal co-owners.

Harrison and Brown purchased all five locations of the business.

Car Pool Car Wash has helped serve people in and around Richmond for the last 47 years, stated the press release.
