Blake Ellis: Business Partner Spotlight

RASM slates membership meet The Realtor® Association of Sarasota and Manatee will hold the organization’s annual membership meeting on Friday, Sept. 11 at 11:30 a.m. at the RASM North Office, 10910 Technology Terrace, Lakewood Ranch. A delicious luncheon will be served, and registration will be open in the near future. Watch for your Weekly Update emails for all the details! During the meeting, the election of the 2016 board and officers will also be held (see P. 8 for details). Because no additional nominees were received, the board and officers will be elected by voice vote. Linda Formella, this year’s President-Elect, is automatically approved for the president’s post in 2016. The August 2015 Business Partner Spotlight is on Blake Ellis, program director of the Baking and Pastry Arts program at Keiser University. Ellis attended the Culinary Institute of America where he earned his Associate degree in Baking and Pastry Arts. After college, Ellis accepted a position as a Blake Ellis pastry cook at the RitzCarlton in Sarasota, FL. In 2007, Chef Ellis started a personal chef business, which he still owns and operates. He was hired as an adjunct instructor for the Center of Culinary Arts at Keiser University in 2011. In 2014 he was promoted to his current position. YPN is One!

After first year, organization looks to future

Editor’s Note: This month’s Cover Story article was authored by Jacqueline Abney, the 2015 Chair of the Suncoast Regional Young Professionals Network.

Everything we do, even in the smallest thing, has an impact which in turn creates a ripple effect. If you throw a small pebble into the water on one side of the pond, eventually that ripple will reach the other bank, growing larger as it progresses. When we focus our energy towards constructing a passionate and meaningful career, eventually those actions create a long lasting ripple effect, inspiring a cascade of change in our surroundings. Now over 200 members strong, the Suncoast Regional Young Professionals Network (YPN) began as a small pebble with the hopes of instilling a lasting impact on local lives, not only throughout our industry, but with immediate goals in our communities. The YPN is a dynamic entry point for real estate professionals striving to become more successful in their careers and gain leadership experience. By providing this entry point, NAR was determined to build a new, diverse generation of leaders, strengthening members’ affinity for the Realtor® brand early in their career, and gaining a valuable perspective on generational shifts. YPN’s growth has been driven by Realtors®. YPN has evolved from a national magazine offshoot to a determined, passionate, savvy group of members who use social media effectively and transparently and who are committed to strengthening the Realtor® brand. The local network is comprised of the Realtor® Association of Sarasota and Manatee, and the Venice Area Board of Realtors®. In the last year, the Suncoast Regional YPN has seen tremendous change through the time invested by a handful of young leaders. These volunteers have devoted themselves to creating fun events, educational programs and opportunities for our fellow young professionals to thrive Each month, YPN hosts what we have affectionately

AUGUST 2015

called a “RealTOUR” event, which is all about discovery, connections and fun! We have learned about history through a curated tour of the Ringling Museum, dove into the depths of the Mote Marine Laboratory, sipped wine amongst the vines of Rosa Fiorelli Winery and shared family adventures at the whimsical Children’s Garden. The exploration opportunities in our community are endless and YPN will continue to uncover unique relationship-building experiences such as our upcoming VIP Buccaneers Game excursion. We also like to expand our sphere of connections though events where we have partnered with other local young professional affiliations such as the Young Builder’s Alliance and the Young Leaders Alliance. Education is a very large part of our value to our members. The YPN Caravan Tours are a hands-on experience unique to our RASM YPN chapter. Members have the chance to walk through listings with seasoned agents who cover everything from using comps, pricing, and staging techniques to negotiation and marketing strategies. These caravans are held the third Thursday of every month immediately following the weekly RASM MLS Express session. In addition to the caravan, we host quarterly educational panel discussions and presentations from highly successful members of our industry. We are looking forward to a compelling presentation in September from Shaun Benderson, of Benderson Development, whose company has downright shaped the layout and economic impact of where we live. Giving back and making a difference to others is a necessity to our overall experience in this ripple effect. To date, the Suncoast Regional YPN has raised

thousands of dollars for Habitat for Humanity, and gathered over 119 pounds of canned food for All Faith’s Food Bank to provide food for the 21,000 children who are on meal assistance during the school year. We are currently well under way in the planning of the 2015 Realtor® Bowling Tournament slated for October 30th. The event will directly benefit the RASM Scholarship Fund, Family Promise of South Sarasota, and the Realtors® Political Action Committee. Volunteering and raising donations for needs greater than our own can not only be rewarding, but also fun, and we encourage our members to get involved! Moving forward, YPN wants to focus on a key sentence within our mission statement, “strengthen the appeal and resources for young professionals to thrive in our area.” Sarasota and Manatee Counties are in dire need of attainable housing for young professionals, and our YPN sees this as a prime opportunity to bring about positive change in our own backyard. Our goal is to make attainable housing a top priority to local governments in 2016 through coordination with other young professional groups, utilization of Realtor® Party resources, and public education. We also understand that many young professionals may be unaware of resources available to help attain housing, so we hope to begin a series of educational tools for firsttime homebuyers on how to navigate the process while

emphasizing the importance of working with a Realtor®. It begins with a handshake at one of our monthly networking events, or an inspired discovery emerged from a RealTOUR event, and it turns into a lasting relationship or new business avenue. 2016 President Linda Formella, Michael Saunders & Company An exemplary professional and prominent leader in the Florida real estate industry, Linda Formella brings 18 years of real estate expertise to her new role as President of RASM. Linda’s extensive real estate sales career is enriched by her remarkable level of involvement in the industry at both local and state levels. Currently, she is the President-Elect of RASM, a position she earned following years of dedicated service on the board of directors and multiple committees, including the Professional Development Committee. Linda’s numerous designations and certificates are a testament to her belief in ongoing professional education, and include Accredited Buyers Representative, E-Pro, Senior Real Estate Specialist and Graduate, Realtor® Institute. She is a member of the Institute of Luxury Home Marketing and holds the designation of Certified Luxury Home Marketing Specialist. Linda is a graduate of the University of Missouri and has lived in Bradenton for almost two decades. Happily married to husband Joe for 36 years, Linda is immensely proud of her

two wonderful grown daughters and son-in-law. In her leisure time, she enjoys boating, biking and live music of all types.

2016 President-Elect Xena Vallone, Xena Vallone Realty Xena Vallone is actually a second time Florida resident, originally here in the late 1980s and back again in 2000 with a stay in Buffalo, NY in between to raise her two boys, Steven and Michael. While living in Buffalo she worked as a real estate paralegal for 15 years before she and her husband opened Xena Vallone Antiques, which was a natural fit to her husband’s existing antique restoration business. She began her real estate sales career in 2001 working as a sales agent, then as a Property Manager on Longboat Key before obtaining her Broker license to return to sales and eventually open Xena Vallone Realty in 2009. Xena believes in keeping abreast of issues surrounding real estate and to that end has obtained her ABR and SFR designations, as well as CDPE Certification. Feeling strongly about maintaining the integrity of the industry, the first committee she joined was the Grievance Committee. Today, she is President-Elect after serving in 2015 as Treasurer. She has also served on the Professional Standards and Realtor® Attorney Joint Committees and has previously served on Professional Development. She also previously served on the board as Secretary Wanting to further her leadership skills, she enrolled in the Association’s Emerging Leaders Program and graduated in 2011. She was appointed to serve as a Director for My Florida Regional MLS. She is also a graduate of the Florida Realtors® Leadership Academy. When not volunteering, you can find Xena with her husband enjoying all Sarasota has to offer with their two dogs, a Golden Retriever (Sophie) and a rescued Beagle (Daphne). Travel is something Xena enjoys with her family and she does try to squeeze that in every once in a while. Xena also enjoys and believes in giving back to her Association and the members it serves.

2016 Treasurer Greg Owens, Keller Williams on the Water Greg Owens has been a Realtor® since the fall of 2005, and has served on numerous committees and the MAR/RASM boards for more than five years. Currently, he is a listing agent with Teamworks, a real estate team that is part of Keller Williams on the Water in Bradenton. In addition, he is the Broker/Operating Principal/ Owner of Keller Williams on the Water in both Bradenton and Sarasota. Prior to that, Greg was the Metro Editor at the Bradenton Herald which was his last position as a journalist in a career that lasted 22 years. In addition to being a Realtor®, Greg is a United States Coast Guard Auxiliary Flotilla Commander, and has served on several other local organization boards. As Treasurer, he noted his philosophy will be simple - as a fiscal conservative, he will serve to ensure that member funds are used responsibly. Greg has an extensive history with the Association board in Manatee County, and looks forward to this next step in his leadership role on the RASM board. 2016 Secretary Amy Worth, RE/MAX Platinum Realty Amy Worth, a Broker-Associate in RE/MAX Platinum Realty’s Sarasota office, holds the Graduate Realtor® Institute (GRI), Accredited Buyer’s Representative (ABR), Certified Distressed Property Expert (CDPE), WCR’s Performance Management Network (PMN), and e-PRO designations. She has a bachelor’s in Business Administration from the University of Florida. She has also earned the TRC (Transnational Referrral Certification). Amy served as the 2013 President of the Florida Chapter of the Women’s Council of Realtors® (WCR). She is a 2011 graduate of the Association’s Emerging Leaders Program, and also participated in Florida Realtors® Leadership Academy. Amy joined the Association in 1992, and has served in various capacities with the Association and with the Women’s Council of Realtors®. She served as WCR chapter president in 2005. She has also been on the Association’s Member Benefits Committee in 2010, SARPAAT in2014 and RPAC Committee in 2015. She was on the Association’s board of directors from 2012 through 2015, serving as board Secretary in 2014. 2016 Immediate Past-President Stafford Starcher, RE/MAX Alliance Group Stafford Starcher, originally from North Carolina, moved to Sarasota in 1989 and obtained his real estate license in 1994. After graduating from East Carolina University, Stafford became a high school band director. Teaching was his first love, setting high goals for each student and creating a program that developed a strong sense of self-esteem and the desire to achieve at high levels. sales manager for a leading instrument manufacturer. In 1994, through a real estate transaction, Stafford met Linda. Shortly thereafter they were married, and Stafford acquired his real estate license. He began the process of completing many advanced educational courses to develop his real estate career. Stafford holds a Broker’s License, GRI, CRS, ABR, CSP, SFR, SRES & CDPE designations. He is a graduate of Emerging Leaders Program and the 2012 Florida Realtors® Leadership Academy. Stafford has contributed his time, talents and knowledge to several Committees including the Association’s Professional Development Committee and Grievance Committee. Stafford was elected as the first president of RASM in 2015. Additionally, Stafford currently serves on several Florida Realtor® committees. In his spare time, Stafford enjoys family time with his wife, three boys and grandchildren.

Marie Avery, RE/MAX Alliance Group Marie Avery has been in the real estate industry since 1993. She has taken several continuing education courses throughout her real estate career so that she can provide the most qualified service for her clients. Amongst her achievements, she has the Graduate, Realtor® Institute designation, Certified Luxury Home Marketing Specialist Designation, Certified International Property Specialist designation, Performance Management network and Transnational Referral Certification. Marie Avery Marie served on the Association’s International Committee in 2009-2010, and the Professional Development Committee in 2012-2013. She was also active in the Global Business Council in 2014-2015, and has been very active in technology through numerous seminars and courses. She actively supports the Manatee Chamber of Commerce and won the 2002 Small Business of the Year, 2005 Realtor® of the Year, 2006 Community Service Award, and 2007 Business Women of the Year. Maryann Lawler, Keller Williams on the Water Born and raised in Manatee County, Maryann Lawler is very proud to call Bradenton home. She attended Saint Stephen’s Episcopal School for 13 years, graduating in 2000; then Manatee Community College and the University of South Florida while working part time at the John and Mable Ringling Museum of Art as well as for her mother, a long-time local Realtor®. Three committees guide political activity

As staff liaison to three member committees tasked with handling the “P Word” (Politics), it’s important to share how their role serves as the foundation for all Governmental Affairs activities. Public Policy, Political Action Advisory Committee (PAAC) and Realtors® Political Action Committee (RPAC) are all member committees whose tasks differ but whose objective is the same. They seek to accomplish what’s best for all members, the industry and clients when facing issues of public policy. A brief committee overview - RPAC Committee is charged with raising funds and educating members on the importance of Investing in RPAC; PAAC researches and interviews all willing candidates running for local elected offices in Sarasota and Manatee counties and makes recommendations to RASM Board of Directors regarding candidate endorsements and support; while Public Policy reviews all local regulatory policies, ordinances and programs and advises RASM Board of Directors on positions on these issues. Simply put, the more RPAC dollars we raise, the Adam Davis more Realtor® Party resources we have to be used in can be supporting Realtor® Champions, who once in office will reached at understand and support Realtor® issues. 941.952.3410 No decision is made by solely by staff or reflects the agenda of an individual member or political party. Staff provides information to committee members who 10

research, discuss and vote before a recommendation is made to the Board of Directors. The Board of Directors then follows the same process before a decision is made on whether or not RASM will support a candidate or issue. All issues considered must meet the criteria adopted within the Public Policy Guide (found under Public Policy on RASM Website). All members serving on committees and/or the Board of Directors must sign a conflict of interest form to ensure trust and credibility. This process is put in place to protect the integrity of the Association and promote the value of member input. Not all will agree with every candidate endorsed or issue supported or opposed, but know that all efforts are exhausted in making this a fair process. Also, know that your input is always valued and can be brought to my attention anytime. You live and work in areas that could be impacted, so your insight and examples provide a great benefit to the conversation. If you are interested in serving on one of these committees, 2016 committee registration information will be made available in the coming months. Upcoming changes to the FR-BAR Contract

Say it’s not so, we’re changing the contract again!? Yes, I am afraid that it is true. While the contract is usually revised and updated every two years, this time it has only been one year. The reason for the changes sooner is to make the contract contemporary with the changes being brought about by the Consumer Financial Protection Bureau (CFPB) requirements, originally to be implemented on August 1, 2015, but now delayed until October 1, 2015. As a committee, we started the discussion of the changes that would need to be made at the beginning of this year. There were many meetings, and hours of discussions. At first, we looked at making massive changes throughout the contract to reflect what we believed the CFPB changes would require, but after more deliberation we decided to take a more minimalist approach to our revisions. The reason for the more minimalist approach was that we wanted to wait and see how the CFPB rules are implemented and how they play out in the marketplace. We do expect to make more massive and sweeping changes in a year or so. Let’s take a look at what some of the changes will be when this new contract version comes out later in September. In paragraph 5 (a) the contract currently allows for an extension to closing not to exceed 5 days for TILA requirements, that will be modified to read CFPB Requirements, with an extension not to exceed 10 days. In paragraph 8 (a) where Buyer will pay cash “or may obtain a loan” the words “or may obtain a loan” will be deleted, and a statement has been added to say that if the Buyer does obtain a loan that the CFPB requirements shall not affect closing or the terms of the contract.

Also, in paragraph 8 (b) the default time for obtaining loan commitment is changed from 30 days to 45 days, and in paragraph 8 (b) (ii) the wording was modified so that the 7 day period for either party to cancel when Buyer has failed to give notice of receipt of loan commitment is not extended by the CFPB requirements. Paragraph 9 (c) and (d) will provide for an earlier date for delivery of title evidence and survey. If there is financing it will change from the current 5 days to 15 days. If cash it will remain at the 5 days. Also, there are wording changes that provide for the calculation and disclosure of title premiums which may be reported differently on federally mandated forms and other closing documents. In paragraph 12 (a) the time frame for the inspection has been changed from the pre-printed 15 days to a blank that can be filled in to facilitate a shorter time frame which would be beneficial under the new CFBP requirements. There will be a five day default if it’s left blank. Lastly, in paragraph 18 G. in the definition of Force Majeure the words “and any other cause not reasonably within the control of Buyer and Seller” have been deleted due to it being an overly-broad provision that may allow any lender delay to be interpreted as a basis for extending closing. There will also be updates to some of the Addenda/ Riders, they include; C. Seller Financing, F. Appraisal, and H. Homeowner’s / Flood Insurance. David P. Growth expected to increase into 2016 Due to a stronger labor market and an increase in the formation of households, the National Association of Realtors® is forecasting that the commercial markets will see a gradual incline in growth in the second half of 2015. A lot of this growth will be the result of manufacturing output increases, fueled by lower gas and other energy prices, mixed with a slight gain in consumer income. Dr. Lawrence Yun, NAR chief economist, says “Commercial rents have risen at a moderate pace across the board for several quarters now and vacancy rates have been on a gradual decline.” He also noted, “Similar to last year, economic growth will likely rebound as the year progresses, although perhaps not as robustly as what was seen in 2014. “However, as long as jobs are being added at a respectable pace, gradual increases in demand for the commercial spaces and leasing projects should

continue,” he concluded. National vacancy rates are forecast as follows: - Office vacancy rates are forecast to slightly decline from 15.6 percent to 15.5 percent by the second quarter of 2016. - Industrial Vacancy rates are expected to fall from 8.4 percent to 8.1 in the same time period. - Retail vacancy rates are expected to decline from 9.6 percent to 9.2 percent in the second quarter of 2016 as well. The forecast also calls for the vacancy rate for multifamily to increase from 4.3 percent to 4.4 percent but still below the 5 percent mark which is considered a landlord’s market, with demand justifying higher rents. All in all, the news is good for the remainder of 2015 and into the second quarter of 2016 - signs of a true growth market in commercial real estate.

New marketing strategies may be problematic By Sylvia Golden Norris, Esquire RASM Legal Counsel

A number of new marketing strategies are becoming more popular with Realtors®. These different approaches to advertising an Owner’s property for sale include what are often referred to as “pocket listings”. A pocket listing is any listing that is not distributed in the MLS. Examples include private listing groups (whether established by social media, the internet or even invite only get-togethers), exclusive office listings or “coming soon” notices or ads. All methods of marketing property for sale in a manner that does not include the MLS or that otherwise targets only a limited audience are susceptible to an inference that you are not promoting the Owner’s best interest, which is to sell his or her property quickly at the highest price possible. While none of these marketing strategies are inherently unlawful or immoral, there can be unintended negative consequences for you as a Realtor® when you do not market through the MLS. For example, you may have violated one or more Articles of the Code of Ethics, breached your statutory duties under Florida law or your contractual obligations under the listing agreement, or subjected yourself to a Fair Housing claim or MLS citation. Any of these could result in a fine, a lawsuit or an Ethics or DBPR complaint. Below are precautionary considerations to assist you in meeting your duties to the Owner, satisfying your professional obligations when providing listing services and avoiding any adverse outcome. Florida Law and the Listing Agreement Chapter 475, Florida Statutes, requires real estate licensees, regardless of the type of brokerage relationship offered, to “use skill, care and diligence” and “deal honestly and fairly.” Also, most Listing contracts, including FLORIDA REALTORS® forms, require you “to make a diligent and continued effort to sell the property” and state that the Broker must file and will publish all listings, unless the Owner directs otherwise. When the MLS is not used to advertise a property, an Owner may later assert that you did not meet these obligations because a pocket listing may provide limited exposure. The MLS Rules The vast majority of listings are filed and distributed in the MLS. The MLS provides broad exposure for listed properties as they are published to all MLS Participants, currently totaling 42,000 subscribers, throughout 17 counties. None of the other alternative marketing methods can compete with the widespread promotion of the Owner’s property which the MLS offers.

Further, Article 5.11 of the MLS Rules requires you to file all listings with the MLS. If, after full disclosure, an Owner decides not to place the property into the MLS or to delay insertion in the MLS, for your protection and as required by Rule 5.11, you must still file the listing with the MLS, but the Owner can stipulate to exclude the listing from publication to the MLS Participants. For this option to be exercised, however, you should file the listing along with the Owner’s Waiver of MLS Entry form http://www.mfrmls. com/resources/document-library/doc_download/1113owners-waiver-of-mls-entry (or a writing to the same effect). The deadline to file the Waiver is within 2 business days, excluding weekends or federally recognized holidays, from the Owner’s dated signature or the beginning date of the listing agreement, whichever is later. To be effective the form/writing must be signed by all owners of record and both the Listing Agent and Listing Broker. This form or writing serves as your proof of the Owner’s directive not to publish the property in the MLS. Failure to follow this mandate results in an automatic fine of $500 for each occurrence. Fair Housing While you did not intend to discriminate against a protected class (including senior citizens, handicapped individuals or racial minorities), you may have violated Federal and Florida Fair Housing laws as well as the Code of Ethics. How? Because in June 2015, the U.S. Supreme Court held that a claim for a violation of the Fair Housing Act can be brought if a practice results in a disparate impact for a class of persons protected under the FHA. Further, the claimant is not required to prove any intent to discriminate, only that the action took place and it resulted in discrimination. Therefore, if your business practice regularly incorporates pocket listings, if this action is found to result in a bias in housing access, you could be the target of a Fair Housing claim. To conclude, if you employ pocket listings as a regular marketing strategy or your listings are not typically published in the MLS, while neither practice is illegal nor unethical, be sure you understand the risks and you have met your burden for full transparency and accurate disclosure. You have the responsibility to provide a comprehensive statement of all negative effects that could occur, such as a lower sales price due to a lack of competition. Finally, even if the Owner has been advised of the adverse aspects of marketing their property in this manner, the decision to exclude the listing from the MLS must be based solely on whether these marketing methods are in the Owner’s best interest.

Volunteer for school reading program By Sharon and Ivan Gould Community Outreach Committee “To learn to read is to light a fire” — Victor Hugo This year, the RASM Outreach Committee has looked at several projects to help children in the Sarasota and Manatee area. One place we started was the school system. It’s a little known fact that over 50 percent of children in the Sarasota area are receiving free or reduced price lunches – so statistically over half the children you might see each day are living at poverty level, and their education suffers. But we are not asking for your money – we are asking for your time and your skills to help children who are struggling to learn to read from kindergarten to third grade level. We are working to give them the tools they need to help them educate themselves, and improve their chances of getting a good education and a good job. If they cannot read, and miss out on their education, we could see a lot of bright minds failing to reach their potential. Along with Sarasota County School District, we are launching a project to recruit volunteers from the Realtor® community – including Business Partners, and family members. These volunteers will be asked to spend at least an hour a week during the school year with one or two children, simply reading together. You will be trained how to help the children read, and will have the full support of the Volunteer Coordinator in each school.

The children view this as a privilege and look forward to meeting with their Reading Mentor every week. From personal experience, we know how rewarding it is to see a child flourish and change how they view the world. You can improve lives with just an hour a week and a bit of understanding and empathy.
