At just 25 years old, Bridget Clancy has already made a significant impact as the Marketing Coordinator at IAS Marketing Services, where she has thrived for nearly three years. Fidelity to Client

By: National Association of REALTORS® Interpretations of the Code of Ethics Agreement Case 1-1: (Originally Case #7-1. Revised May, 1988. Transferred to Article 1 November, 1994.)

Client A complained to a Board of REALTORS® that two of its members, Realtor® B and his sales associate, Realtor® Associate® C, had failed to represent the client’s interests faithfully by proposing to various prospective buyers that a price less than the listed price of a house be offered. His complaint specified that Realtor® B, in consultation with him, had agreed that $137,900 would be a fair price for the house, and it had been listed at that figure. The complaint also named three different prospective buyers who had told Client A that while looking at the property, Realtor® Associate® C, representing Realtor® B, when asked the price had said, “It’s listed at $137,900, but I’m pretty sure that an offer of $130,000 will be accepted.”

Realtor® B and Realtor® Associate® C were notified of the complaint and requested to be present at a hearing on the matter scheduled before a Hearing Panel of the Board’s Professional Standards Committee.

During the hearing, Realtor® B confirmed that he had agreed with Client A that $137,900 was a fair price for the house, and that it was listed at that figure. He added that he had asked for a 90 day listing contract as some time might be required in securing the full market value. Client A had agreed to do this but had indicated that he was interested in selling within a month even if it meant making some concession on the price. The discussion concluded with an agreement on listing at $137,900 and with Realtor® B agreeing to make every effort to get that price for Client A.

Realtor® Associate® C said in the hearing that Realtor® B had repeated these comments of Client A and he, Realtor® Associate® C, had interpreted them as meaning that an early offer of about 10 percent less than the listed price would be acceptable to the seller, Client A. Questioning by the Hearing Panel established that neither REALTOR® B nor Realtor® Associate® C had been authorized to quote a price other than $137,900.

It was the Hearing Panel’s conclusion that Realtor® B was not in violation of Article 1 since he had no reason to know of Realtor® Associate® C’s actions. The panel did find Realtor® Associate® C in violation of Article 1 for divulging his knowledge that the client was desirous of a rapid sale even if it meant accepting

less than the asking price. The panel noted that such a disclosure was not in the client’s best interest and should never be made without the client’s knowledge and consent. •

Spotlight on Giving: Lyndsey Ashley’s Quiet Impact

Each month, the RASM REALTORS® Charitable Foundation (RRCF) receives support from generous donors who quietly help change lives in our community. Lyndsey Ashley, a proud member since 2019, is one such donor.

PASSION FOR REAL ESTATE

As Lead Agent and Founder of the AGNT Group at Keller Williams Coastal Living II, Lyndsey brings her passion for real estate full circle by supporting housing, education, and those in crisis through her monthly gifts to RRCF.

Legal Considerations When Buying or Selling Short-Term Rental Property in Sarasota and Manatee Counties

With the continued popularity of vacation rentals in our area, it’s essential that Realtors® - and their clientsunderstand the legal and regulatory framework surrounding shortterm rental properties. Whether you’re working with buyers seeking an investment property or advising sellers on disclosure obligations, staying informed is critical to a successful transaction.

WHAT IS A SHORT-TERM RENTAL?

In Florida, a short-term rental generally refers to the rental of a residential property for periods of six months or less. These rentals are typically listed on platforms like Airbnb or VRBO and are subject to a unique set of rules and taxes.

STATE AND LOCAL REGISTRATION REQUIREMENTS

To legally operate a short-term rental, property owners must first obtain a license from the Florida Department of Business and Professional Regulation (DBPR). Owners must also register with the Florida Department of Revenue in order to properly remit taxes to the state.

Local governments also impose additional registration requirements. Sarasota County, Manatee County, and the various municipalities within each county may have separate rules. For example, some jurisdictions require local business tax receipts, fire inspections, safety inspections and payment of the registration fee prior to issuing a certificate of registration. It’s essential for buyers to investigate whether the property is currently licensed and compliant, and for sellers to disclose any violations or pending applications.

TAX OBLIGATIONS

Short-term rentals in Florida are subject to both state and local taxes. At the state level, the Florida Department of Revenue collects 6% sales tax plus any applicable discretionary sales surtax (based on the

county rate). In addition, owners must remit the local transient rental tax to the appropriate county:

ƒ Sarasota County: 6% Local Option Transient Rental Tax

ƒ Manatee County: 5% Local Option Transient Rental Tax

These taxes must be collected from guests and remitted directly to the county. If a management company is involved, they may handle tax collection and remittance, but it is ultimately the property owner’s responsibility to ensure compliance.

HOA, CONDO, & INSURANCE CONSIDERATIONS

Even if a property is zoned for short-term rental use, homeowners’ associations (HOAs) and condominium associations can impose their own restrictions that override local permissibility. Many HOAs limit the number of rentals per year or set minimum lease termscommonly 30, 60, or 90 days. Others prohibit short-term rentals altogether. It’s important to carefully review association documents and bylaws before closing, and encourage your buyers to do the same.

Insurance is another often overlooked factor. A standard homeowners policy may not cover claims arising from short-term rental activity. Owners should consult with an insurance agent to obtain proper coverage, such as a landlord or vacation rental policy, to protect against liability, property damage, and business interruption.

PROTECTING YOUR CLIENTS & YOUR BUSINESS

When representing buyers, ensure they understand the local rental restrictions in the municipality the property is located in and whether it is feasible for the property to be used as a short-term rental. For sellers, full disclosure of any current use, registration status, or enforcement actions can protect both parties from legal disputes post-closing.

2025 NAR Policy Pulse: What’s Keeping Realtors® Throughout America Up at Night

Every year, NAR takes the pulse of our state and local associations to zero in on the issues that matter most. The 2025 Policy Pulse survey makes one thing clear: the challenges facing our industry are big, complex, and require bold, coordinated advocacy.

TOP CONCERN: HOUSING SUPPLY

At the top of the list? Housing supply. Realtors® across the country are united in calling for real solutions to get more homes built - but not just any homes, the kinds of homes first-time buyers can afford. The survey shows overwhelming support for federal tax incentives that would speed up permitting, reward builders for constructing starter homes, and even convert underused commercial spaces into housing. Doubling the capital gains tax exclusion also ranked high among preferred solutions.

PERMITTING AND ZONING REFORM

But it’s not just about incentives, it’s about cutting red tape. 93% of respondents believe that shortening permitting times is key to unlocking new development. And while there’s a strong preference for local control of zoning, 70% say that state preemption is acceptable in certain situations. The biggest obstacle? NIMBYism. It continues to stall progress in communities coast to coast.

RASM’S LOCAL ADVOCACY EFFORTS

We’re not sitting this one out: 76% of REALTOR® Associations expect to engage in zoning reform this year. At RASM, we have spent the last few years engaged in zoning reform advocacy. Top of the list was the overhaul of the City of Sarasota’s Comprehensive Land Use Plan, which, as highlighted above, provided incentives for affordable units, sped up the development process to reduce costs of construction, and cut red tape the city previously imposed on construction projects.

RISING PROPERTY INSURANCE COSTS

Another key issue we have experienced within Florida was prevalent in the survey: skyrocketing property insurance premiums. Expensive premiums are raising alarms in nearly every state. Associations throughout the country are pushing back hard on this in 2025. Fortunately, Florida REALTORS® was a key stakeholder in pushing legislation that reformed Florida’s property insurance market. Since that reform in 2022, we’ve seen drops in homeowners’ insurance, new insurers enter the market, and positive indicators popping up throughout the market

INVESTORS AND FIRST-TIME BUYERS

Another red flag: institutional investors snapping up starter homes. Nearly 80% of respondents see this as a serious problem, with over a quarter calling it a major issue. But instead of reaching for punitive measures, most Realtors® favor tax incentives that would encourage these investors to sell homes to first-time buyers. It’s a smart, market-based approach that puts people ahead of portfolios.

FIGHT AGAINST RENT CONTROL MEASURES

Rent control is also on the radar, with more than 60% of associations anticipating fights over rent caps and just-cause eviction policies this year. These policies may be well-intentioned, but they often backfire - shrinking the rental supply and discouraging investment in housing. In Florida, we successfully stamped out a rent control measure that could have caught on like wildfire throughout the state had we not stood in the breach. Orange County, Florida attempted to put in rent control measures. Florida REALTORS® and the local REALTOR® Associations commissioned a study which showed the unintended consequences of such a policy, and even went further in the state legislature passing Senate Bill 102 which prevented municipalities from attempting this type of policy again in the future.

TAX POLICY AND AFFORDABILITY

And let’s not forget the tax front. Opposition is fierce when it comes to new or increased property transfer and development taxes. More than half of state associations are prioritizing efforts to reduce property taxes, keeping homeownership within reach for more families. RASM applauds Florida REALTORS® for always advocating for a tax friendly environment in Florida, locally RASM also monitors and advocates for your clients and property owners through reductions in the municipal millages as well as individual tax incentives, we just saw one in Sarasota aimed at senior citizens

March 2025 Real Estate Market Report: Trends in Sarasota and Manatee Counties

e REALTOR® Association of Sarasota and Manatee (RASM) has released its March 2025 real estate market report, offering a comprehensive analysis of key trends across both counties. According to data from Florida REALTORS®, the housing markets in Sarasota and Manatee counties each showed their own unique trends, setting them apart from each other and from what’s happening in the rest of the country. Despite these differences, both counties maintained relative balance within the singlefamily home sector. A balanced market presents valuable opportunities for both buyers and sellers, fostering a healthier and more competitive real estate environment. In today’s evolving market conditions, working with a trusted Realtor® is essential to navigate opportunities, negotiate effectively, and make informed real estate decisions.

KEY TRENDS IN SARASOTA/MANATEE MARCH 2025:

ƒ Median Sale Price Trends: Median sale prices in Sarasota County continued a downward trajectory across both property types, while Manatee County median prices appear to have stabilized, indicating a potential market bottoming in that region.

ƒ Closed Sales Activity: Single-family home closed sales increased month-over-month in both Sarasota and Manatee counties; however, Manatee County remains below its closed sales volume compared to the same period last year.

ƒ Inventory Growth and Market Balance: Although certain market segments experienced an uptick in closed transactions, active inventory growth continues to slightly outpace demand, resulting in a continued rise in months’ supply of inventory and further shifting conditions toward a more balanced or buyerfavorable market.

SINGLE-FAMILY HOMES

In March 2025, Sarasota County reported 817 single-family home sales, a 38.7 percent increase compared to February and a 13.0 percent increase year-over-year. The median sale price declined by 8.8 percent from March 2024 to $469,450, marking the third consecutive month of price decreases. Cash buyers accounted for 44.7 percent of all closed sales. Despite the increase in closed sales, inventory levels rose, with a 30.8 percent year-over-year increase to 4,412 active listings, bringing the months’ supply to 6.9 months. The median time to contract and median time to sale decreased slightly from last month to 40 days and 82 days, respectively.

In March 2025, Manatee County reported 668 singlefamily home sales, a 33.6 percent increase compared to February, but an 8.5 percent decrease year-over-year. The median sale price increased by 1.5 percent from March 2024 to $506,317, the highest median sales price since June 2024. Cash buyers accounted for 32.3 percent of all closed sales.

Manatee County ended March 2025 with 3,256 active listings, representing a 5.2-month supply of inventory. The median time to contract and the median time to sale stayed constant month-over-month to 46 days and 95 days, respectively.

“No two markets are the same, and what we’re seeing in Sarasota isn’t necessarily what we’re seeing in Manatee,” said Debi Reynolds, 2025 RASM President and Managing Broker at SaraBay Real Estate. “Local knowledge matters more than ever, and our Realtors® bring that critical insight to every client they serve.”

TOWNHOMES AND CONDOS

In March 2025, Sarasota County reported 324 townhome and condo sales, a 36.7 percent increase compared to February, but a 19.8 percent decrease yearover-year. The median sale price fell 10.2 percent to $346,500, with 68.5 percent of sales being cash purchases. Inventory continued to grow with 2,714 active listings and a 9.7-month supply, continuing a further shift into a buyer’s market. The median time to contract and the median time to sale remained steady at 46 days and 84 days, respectively.

In March 2025, Manatee County reported 300 townhome and condo sales, a 19.5 percent increase compared to February, and a 6.4 percent increase yearover-year. The median sale price fell 1.3 percent to $338,395, with 52.0 percent of sales being cash purchases.

Inventory held relatively constant from February with 1,816 active listings and an 8.2-month supply. The median time to contract and the median time to sale increased to 62 days and 106 days, respectively.

SUMMARY

As the market continues to normalize from the postpandemic surge, rising inventory levels and longer time on market point to greater flexibility and negotiating power for buyers—particularly in the townhome and condo sectors. At the same time, steady single-family home activity and strong cash buyer presence suggest sustained local demand. With distinct dynamics playing out across property types and counties, real estate decisions are becoming increasingly nuanced. As always, consumers are encouraged to work with a REALTOR® who understands the local market and can provide expert guidance through every stage of the transaction.

Getting involvedexactly what does this mean to you? More time away from your day-to-day business? Not necessarily. Getting involved means finding out what is going on in your profession first-hand. As we all know, each of us absorbs information in our own way. W hat you hear from one person could be completely different from what you hear from someone else - or even from what you originally believed.

LEARNING THE VALUE OF INVOLVEMENT

When I became an agent 43 years ago, the first lesson I was taught by my trainer was to get involved. I did not know any better, so I followed orders and joined a committee at my local Association. I cannot thank him enough.

COMMITTEE WORK: A PLACE TO START & GROW

I have learned many things first-hand in this business, and I am grateful for my role as a committee member, that I did. It does not matter whether you are brand new or have been in the business for many years; you still can learn. Joining a committee at the Association is a great place to start. Pick a committee that might interest you and see where it leads. If that committee does not suit you, try another. I am fairly certain that I have been on every committee that exists. Even when I find one that I like, I still try out others just to see if there is something else I can learn or contribute to.

EXPLORING BEYOND THE LOCAL LEVEL

After a few years (or sooner), you can expand your horizons and try serving on a Florida Association of REALTORS® committee. They are extremely informative, and you learn things that have not been brought up in your local meetings yet. Did you know that the Florida REALTORS® Winter Meetings are free to attend? You can go and sit in on any of these meetings, and when you leave, you think to yourself, “Wow, am I glad I came.”

NAR & REFERRAL POTENTIAL

The next step is NAR, and just like FAR Mid-Year Meetings held in Orlando, the NAR Legislative Meetings are held in D.C. and are also free for you to attend. To me, that is where the meat and potatoes of our business is actually being derived from. Of course, I would suggest attending all the conventions - not only for the education, but also to connect with agents from the other side of Florida or even from other states, who one day might become valuable referral partners. Referrals can be a significant part of your income, especially in an area as transient as Florida. People are always coming and going, and connecting with other agents who take their business seriously enough to attend these meetings can lead to valuable partnerships.

A REAL-LIFE SUCCESS STORY

True story... an agent in my office who had been in the business for several years had never gone to the National Association of REALTORS® Annual Convention. A few years ago, it was being held in Orlando, and I somehow managed to encourage him to go. He did enjoy himself considerably and learned quite a bit from the classes and sessions that were offered. At the end of conference, there had been a drawing for a brand-new Tesla plus $25,000 cash to pay for the taxes, complements of Homes.com. Can you imagine that my colleague who had never attended a NAR Convention was the winner? While I am not promising you will end up with a brand-new car, I can assure you that you will come away with a lot of knowledge that the person sitting next to you in your office probably doesn’t have! These are the steps that someone who wants to set themselves apart in real estate takes to do so! Think about it and get involved. •

2025 Has Already Been an Exciting Year For The Global Business Council

Two country spotlights were featured, the first of which was the “Spotlight on Dubai” held prior to the Dubai Trade Mission.

SPOTLIGHT ON DUBAI

The Spotlight on Dubai focused on the valuable opportunities available in Dubai. The speakers included a group of professionals in Dubai who provided interesting aspects of doing business in the country. Information about the trade mission and the “International Property Show” promoted by Brian Woods was available.

SPOTLIGHT ON THE DOMINICAN REPUBLIC

The next event was the “Spotlight on the Dominican Republic.” David McCoy, the National Association of REALTORS® Global Business Ambassador to the Dominican Republic, shared numerous updates on the current world market. He stressed that the islands can be quite different in their approach to world issues and economy.

Cheryl Henderson from Punta Cana was a featured guest. She is an entrepreneur in Punta Cana and has been involved in all aspects of real estate in the area. She has a widely viewed blog of interviews with key people throughout Punta Cana. She offered insights into the proper steps to follow if investing in the island. Finding the right people to assist you is of utmost importance. The prices and costs of living are lower in the Dominican Republic, making it a very

desirable place to retire. A note of importance is that the main hospital in Punta Cana accepts most American insurance.

Bob Massanova, Owner of SWF Inspections, shared his valuable insights into Cap Cana, a luxury resort area. “Whether it is for investment purposes or just sheer enjoyment, Cap Cana boasts various amenities available, including concierge services and much more. It is highly recommended for a great investment opportunity.”

OCOA BAY DEVELOPMENT

A new development, “Ocoa Bay,” was introduced. It is southwest of Punta Cana and offers a luxurious hotel, a spa complex, residences, and villas. It is also the only wine resort in the Caribbean area. It currently has an infinity pool, social club restaurant, and state-ofthe-art winery, and large beach area, all surrounded by protected national parks.

ITALIAN CULTURE NIGHT

The Global Business Council enjoyed an “Italian Culture Night” at Bavaro’s Pastaria. Enjoying delicious Italian appetizers, pizza and refreshing drinks, it provided a perfect atmosphere for camaraderie and conversation. Guest speakers enlightened the attendees with stories about Italy, firsthand experiences, travel recommendations, and much more!

VALUE OF TRADE MISSIONS

Lastly, trade missions to other countries provide fascinating opportunities for many of our members to learn about their countries and how they conduct business. Visiting these areas, and enjoying interaction with residents and other agents, it creates lasting connections and future business.
