TLCA Restrictive Covenants Ballot

We still have not received votes from all Community Members to approve the Amendment to Make the Restrictive Covenants Permanent. If you have not sent in your ballot, you can cast your ballot by dropping off your ballot at the office or putting it in the drop box in front of the Chalet. Be sure to put your ballot in the privacy envelope that was sent to you. If you have misplaced your ballot, you can come by the office, pick up your ballot and cast your vote all at the same time. If you are not coming up, please mail your ballot to: Tanglwood Lakes Community Association 102 Tanglwood Drive Greentown, PA 18426 A group of volunteers will be calling all those who have not voted. The calls will be from the office. Hopefully, not many of you will have to be called. Approval of the Amendment to the Restrictive is very important. The restrictive covenants expire in about 22 years. The covenants provide the legal basis for the creation of the TLCA Community, including the Board of Directors, Tanglwood Lakes Community Association, Inc., the entity that runs the Community, the power to assess dues and generally manage the Community. •

Without the covenants there is no TLCA, Inc. to manage the Community

There is no Board of Directors to engage contractors to maintain the Community

There is no ability to assess dues by which the Community is maintained

Each individual lot owner would have 1/840 interest in all the Community’s current assets with no management structure by which decisions could be made other than perhaps unanimous consent from all members

The chaos arising from the above would adversely impact property values

The potential chaos caused by expiration of the covenants could start to show up in title reports related to prospective home sales in the next 1 or 2 years if the issue is not addressed

The last item is why we need to change them now. If the potential for no covenants starts showing up in title reports, it will affect people’s property values when they go to sell or refinance their properties.

The text of the ballot is as follows:

To permit the Community to continue to operate in the future as it has operated from the time it was formed, the restrictive covenants must be modified so that they do not expire on April 1, 2043. The Board of Directors has unanimously recommended that the Community vote to make the restrictive covenants permanent by voting to replace paragraph 1 that has the covenants expire on April 1, 2043 in favor of adopting the new language for Paragraph 1 of the Restrictive Covenants to read as follows: 1. These restrictions shall run with the land and shall be in force and effect in perpetuity. If you have any questions, please call the office and speak to Ralph Graf, the Community Manager.
