City of Joburg accused of disobeying Constitutional Court ruling

THE City of Joburg has been accused of breaking a Constitutional Court ruling which states that municipal debt should not be transferred to the new owner. Rob Ryan said he is desperate about his situation with the city demanding R724000 for the old property owner’s debt. And, he says, he believes he is not alone. He bought a building in Ferndale that had been vacant for

about a year. The building was sold by liquidator, Resolution Trust, on behalf of Standard Bank, the bond holder. The previous owner had run up a municipal bill of about R1million before disconnection. Ryan’s offer to purchase stated clearly that any outstanding municipal accounts were the seller’s responsibility. “The transferring attorney requested figures, got a figure of R485000, which we paid and

a clearance certificate was issued after which transfer took place,” he said. “However, when approaching the city to get an account and the electricity reconnected, we were told that the balance of R724 000 from the previous owner had to be settled first. “On obtaining legal opinion, we were advised that the Constitutional Court ruled in 2017 in Jordaan and others v City of Tshwane, that the debt of the

previous owner cannot be transferred to the new owner. “My lawyers have written to the city but have had zero response. I am now at the point of issuing a summons against the city to get them to engage about resolving my account and connection. “I run the building on generator power at great cost,” he said, adding that he wondered how many other people found themselves in this situation. The city said after an investigation, it advised that the new owner was not liable for the previous owner’s debt. City spokesperson Kgamanyane Stan Maphologela said arrangements can be made for the new owner to complete a new services agreement and pay the deposit and re-installation fee for the services to be connected as per the normal process for new connections. “The customer may advise us which centre he/she will be visiting for us to brief the centre management,” he said. Maphologela added the debt

would be pursued from the previous owner of the property. Councillor Tim Truluck writes in his newsletter: About five years after the handling of billing issues was last regionalised, and subsequently disastrously centralised, it has moved back to the regional offices again. For this, we thank the current mayoral committee member for finance, Funzela Ngobeni. It should go a long way in resolving the billing issues in the city. As at the end of July, there were about 8300 billing problems in the city. This is down from 13100 in January. This should start improving more now that the billing resolutions will be done at the regional offices. There are 31 in the seven city regions which will be able to resolve billing issues without residents having to be shunted from pillar to post. MBALENHLE Mokudubete is looking forward to giving a sterling performance at the final instalment of the MTN Joyous Celebration Tour 23 show taking place on Saturday 21 September at Sun City. Mbalenhle who is affectionately known as Mbali, joined the MTN Joyous Celebration choir in October 2017 during the first rehearsal for MTN Joyous Celebration 22 recording. Although she knew she was a good singer, she didn’t just sit and wait to be discovered. She actively went out and auditioned at Music Factory (Baseline) in Newtown, Johannesburg and because of her determination her life was changed forever.“I had to do something because at home we were depended on my grandmother’s pension grant, so l started getting involved in the industry by being a back-up singer for some established artists so l could help out at home.” Adding that when she heard about the MTN Joyous Celebration auditions, she went for it without any hesitation. “At home, I'm the only person who is employed and through Joyous Celebration and the help of MTN - l can provide for my family,” Mbali affirms. Mbali also recognises the great mentorship that she receives from the MTN Joyous Celebration founders: Mr Jabu Hlongwane, Mr Lindelani Mkhize and Mr Mthunzi Namba who not only teach the choir members music and the notes, but also coach and guide them on how to behave as people who are in the public space, they teach them the business side of the industry as well. Her advice to those who are also working hard towards attaining their dreams is “What you are going through now prepares you for your future and it will only make sense when you get there.” She encourages everyone not be too hard on themselves as she believes that everything happens in God’s time and chance is given to everyone. ORLANDO STADIUM TO HOST 2019 #MTN8FINAL THE iconic Orlando Stadium, that sits at the heart of South Africa’s most famous township, Soweto, will host the 2019/20 MTN8 final.

The #MTN8 Final will be played on Saturday, 05 October 2019. Kick-off time is at 18h00. This will be the first domestic cup final to be hosted at the Orlando Stadium in five years. Absa Premiership Fixture Change: MTN8 Finalists

THE Premier Soccer League has postponed two Absa Premiership mid-week fixtures involving the two clubs that will participate in next week’s #MTN8Final at Orlando Stadium on Saturday. The two fixtures, both scheduled on October 2, will now move to dates that were initially reserved for catch-up fixtures: October 29 and 30 October. Highlands Park was scheduled to play Orlando Pirates on Wednesday, October 2 at Makhulong Stadium at 7.30pm. This fixture will now move to October 29. Kick-off time remains the same. SuperSport United was scheduled to play Bloemfontein Celtic on Wednesday, October 2 at Dr Molemela Stadium at 7.30pm. This fixture will now move to Wednesday, October 30.
