SC unimpressed with state govt on Lokayukta

NEW DELHI, OCT 29 (PTI): Supreme Court Monday was not impressed with the Nagaland government’s submissions in support of amendments to a local law to ensure the chief minister’s role in selection and appointment of Lokayukta. A bench headed by Chief Justice Ranjan Gogoi, which was hearing a PIL seeking appointment of an anti-graft ombudsman in every state, had earlier summoned Nagaland chief secretary to interact on the issue of change in the local law governing selection and appointment of Lokayukta in the state. “The state says that it will give a go by to the Constitutional principle then we cannot help,” the bench, which also comprised justices S K Kaul and K M Jopseph, said while expressing dissatisfaction with the response of the chief secretary. “If your chief secretary does not understand the simple question then we are sorry. We do not have the time,” it said while

DIMAPUR, OCT 29 (NPN): BSNL employees under the aegis of All Unions and Associations of BSNL (AUAB) will be holding dharnas at all levels across the country on October 30, 2018 to press for a slew of demands. Announcing the plan for the proposed strike at CGMT, NE-II telecom circle, OCB exchange building, behind Supermarket here Monday, AUAB NE-II circle, Dimapur convenor, Sukhai Sema, said that the agitation has been called since BSNL employees had been “deeply agitated” by non-implementation of the assurances given by the union minister of state for communications. The assurances include 3rd pay revision for BSNL employees, implementation of government rules in payment of pension contribution by BSNL, allotment of 4G spectrum to BSNL and pension revision for the BSNL pensioners etc. Sema said by delaying the implementation of the assurances given by the minister, the department of telecom is denying justice to the 1.85 lakh executives and non-executives of BSNL and about 3.5 lakh employees retired from BSNL.

adjourning the hearing to October 31. The top bureaucrat could not give satisfactory answers to the queries posed by the bench on amendment to Section 3(2) of the Nagaland Lokayukta Act, 2017, bringing in the chief minister as one of the persons who will have a role in the selection of the ombudsman. Earlier, the bench had said though it did not want to comment on the necessity of an amendment to a statute as it was the prerogative of the legislature, it had summoned the chief secretary to know the reasons for the change in the law. “We would like to interact with the chief secretary of the state of Nagaland on this aspect of the matter who will be personally present on October 29,” the bench had said. However, the bench Monday said, “The statement made by the chief secretary of Nagaland before the court seems to be inappropriate. Let the chief secretary file a personal affidavit.” It further said the

NEW DELHI OCT 29 (AGENCIES): India and Myanmar have collectively decided to take action against insurgent groups operating within their territories. The two countries also agreed on providing of security cooperation along with international border and facilitating movement of people and trade across the international border, The Sentinel report stated. The decisions assume wide significance for the region as many of the insurgent outfits are still operating from the Myanmar region. Many of the insurgent organisations including ULFA (I), NSCN (K), Manipur and North Bengal based militant organistations still have their bases in Myanmar bordering India. The developments took place following the 22nd National Level Meeting between India and Myanmar that ended on Friday in New Delhi. The Indian delegation was led by Home Secretary Rajiv Gauba and the Myanmar delegation was led by Maj. Gen. Aung Thu, Deputy Minister of Home Myanmar.

NPF reacts to NDPP’s statement DIMAPUR, OCT 29 (NPN): In the ongoing war of words, NPF has now slammed NDPP over the latter’s statement in the media which it termed as “snobbish, immature and hysterical”. The opposition party asserted that at no point of time it ever wanted to degrade itself by fighting over petty issues with a “still born and most immature” political party in the State like NDPP that was apparently at its wit’s end. In a rejoinder issued by its press bureau, NPF said de-registration case of the “most controversial” party in the State had become one of the most closely watched piece of news due to the fact that the “infamous” registration of NDPP was done under questionable circumstances even as Rio and his supporters tried all means to hijack NPF in 2017, which too was nothing short of a fraud. Stating that it was saddened to watch the struggles within NDPP, the opposition party also expressed its amusement at the way the ruling party was trying to portray itself to outside world by putting up a brave front even as its hope for survival as a political party was shrivelled deep inside. As the oldest regional political par-

ty, NPF said it did not wish to comment further on the hearing going on in Election Commission over de-recognition of NDPP. It, however, asked NDPP not to stoop so low and attack its MLAs with mala fide intentions. Wondering what harm Yitachu, who is an expert in legal matters, had done to NDPP, the rejoinder asserted that it was at the sole discretion of NPF as a “matured political party” to extend support to the ongoing case in Election Commission of India and that NDPP had no right to question it on the matter. Scoffing off at NDPP’s “political conspiracy” theories and allegations that leader of opposition TR Zeliang and Yitachu were hobnobbing with Congress in New Delhi, NPF termed these as “figment of wildest imagination”. The opposition party, however, said it felt sorry for NDPP as the latter seemed to be living in a state of delirium these days, reeling in fear as to what would become of the newborn party, adding that such reactions from fearful minds and fearful party were expected. NPF assured the people of Nagaland that truth would prevail soon enough for everyone to behold.

Zeliang denies meeting central Cong leaders DIMAPUR, OCT 29 (NPN): Leader of opposition TR Zeliang has denied meeting any central leaders of Congress in New Delhi as alleged by NDPP. In a communiqué, Zeliang also challenged the ruling party to be specific with its allegation and clarify when, where and which Congress leader he had met in Delhi, if the latter was so certain of him meeting BJP or Congress leaders. Reacting to the ruling party’s press statement on Sunday, the communiqué issued by information & publicity wing of leader of opposition’s office asserted that Zeliang was a bona fide citizen of India and free to visit New Delhi or any other part of the country, if he so desired. And being at a certain place at a particular time in no way rationalised the “dull-witted thesis” of NDPP, it added. The communiqué clarified that a senior lawyer and Congress leader Abhishek Singhvi was engaged by petitioner Zeneisiile Ate Loucii in the NDPP de-registration case.

Organizations support Oct 31 public rally

DUCCF, GBs: Dimapur Urban Council Chaiman Federation (DUCCF) and GBs’ Union (Sadar) have extended support to the proposed public rally on October 31, 2018 called by Public Action Committee (PAC) of the Naga Council Dimapur (NCD). In a press release, DUCCF information & publicity secretary informed colony chairmen and GBs under the municipal area to mobilise colony public and participate in the rally in traditional attire in coordination with respective tribal hohos. It stated that fight against syndicate, multiple illegal collections, lease system etc spearheaded by PAC was for all general public. ACAUT: Backing the proposed public rally, ACAUT Nagaland Monday appreciated the Naga Council Dimapur (NCD) for taking the initiative on the issue of unabated

taxation and appealed to all responsible citizens to attend the rally. ACAUT through its media cell claimed that the problem of unabated taxation had come down tremendously after the October 31, 2013 massive public rally. However, it alleged that the issue of illegal collection still persists with patronage from the state government. “The Government of Nagaland’s inability to combat the issue of unabated taxation and effectively address the issue of the common people has left the public with no choice but to go to streets and protest,” ACAUT said, adding that public street protest was a sign of government’s failure. In this regard, ACAUT has urged the state government to gauge the woes and daily struggles of the common people. (Cont’d on p-11)

presence of chief secretary was not required further. The court is hearing a petition, filed by BJP leader and lawyer Ashwini Upadhyay, which has sought appointment of Lokayukta in every state. It also sought a direction to states to provide adequate budgetary allocation and essential infrastructure for effective functioning of the Lokayuktas. According to the PIL, the Lokpal and Lokayuktas Act 2013, had received presidential assent on January 1, 2014, and came into force from January 16, 2014, but the executive has not established a Lokpal yet. Petitioner alleged that many state governments were “deliberately weakening” the Lokayukta by not providing adequate infrastructure, sufficient budget and workforce. The apex court has been also dealing with the issue of appointment of Lokayuktas in 11 other states, including West Bengal, Meghalaya, Mizoram, Jammu and Kashmir, Tamil Nadu, Telangana and Odisha.

However, Lhoungu said the issuing press release without proper consultation in the party “shows that this is a direct affront to the principles and working system of the Party by some unscrupulous persons bent on creating discord within the party rank and file.” He said those persons appeared to have overacted in order to tarnish his image and records with serious and false allegations. “Such act is highly intolerable and amounts to defamation which is a serious offence against which legal actions can be initiated,” former BJP president said.
