M’laya Gov seeks EC view on disqualification of 17 MLAs

SHILLONG, NOV 20: Meghalaya Governor, Ganga Prasad has sought the suggestion of the Election Commission of India on the disqualification of 17 legislators as members of the 60-member House assembly, a Raj Bhavan official said on Monday. A Raj Bhavan communiqué said Prasad referred the matter to the Election Commission, as required under the Article 192 (2) of the Constitution of India on November 16 after the Meghalaya High Court had held invalid the state law providing for appointment of Parliamentary Secretaries. The Court had left it to the Governor to determine if those who held the post should be disqualified from the Assembly. The verdict by a division bench of Chief Justice Dinesh Maheshwari and Justice Ved Prakash Vaish came on a PIL filed by state resident Madal Sumer, challenging the “extra constitutional and illegal” appointment of Parliamentary Secretaries in the state. KOHIMA, NOV 20 (NPN): Public Service Aspirants of Nagaland (PSAN) has once again reminded all departments not to hold any departmental exam until the October 26 Office Memorandum (OM) was revoked. PSAN warned the state government that it will be charged of contempt of court if it chose to ignore the High Court stay order dated July 25 and 28, 2017. As a follow up of the November 17 meeting with the chief minister, PSAN on Monday held a meeting with the chief secretary to discuss their demands. A PSAN member told Nagaland Post that the meeting was fruitful, and that they had informed the chief secretary that revoking the October 26 OM would be the greatest Christmas gift for the youth of Nagaland. In this regard, PSAN said the chief secretary will be submitting a report to the cabinet soon. PSAN will also be submitting a representation to the chief minister on November 21 to expedite the matter. The association will request the cabinet to have a sitting soon since the chief minister was scheduled to travel next week, the member said.

Sumer urged the Governor, the highest constitutional authority of the state, to exercise his power under Article 192 of the Constitution and to take a decision on the issue of disqualification. However, 10 of the 17 legislators who quit as Parliamentary Secretaries following the High Court verdict have said there is no ground for their disqualification as members of the Assembly. Sujit Dey, counsel for the 10 legislators, said that the issue of disqualification becomes “infructuous” since the post of Parliamentary Secretary itself has ceased to exist, and out of respect for the Court verdict, all Parliamentary Secretaries had immediately resigned. Hours after the November 9 verdict, 17 Parliamentary Secretaries quit their post. Chief Minister Mukul Sangma, who accepted their resignation, defended their ap-
pointment saying: “This law has been enacted based on this mandate of the provisions of the Constitution by which we can prevent the members of the august house from getting disqualified for holding an office of profit wherein law says such office will be deemed as not as office of profit.” On July 26, the Supreme Court had declared as unconstitutional a law enacted by Assam in 2004 that allowed the appointment of Parliamentary Secretaries in the rank of Minister of State. On March 12, 2013, Chief Minister Sangma had administered the oath of office to 18 MLAs as Parliamentary Secretaries to assist 12 Ministers after the Congress retained power following the Assembly elections. However, Independent legislator Lamboklang Mylliem resigned from the post on March 29 last year, citing legal grounds. Parliamentary Secretaries Celestine Lyngdoh and Comingone Ymbon were subsequently made Cabinet Ministers. Election to the 60-member Assembly is scheduled to be held in February-March 2018.
CoFA threatens 3-day pen down strike from Nov 21 DIMAPUR, NOV 20 (NPN): Confederation of Four Associations (CoFA) comprising of CANSSEA, FONSESA, NSSA and NF&ASA, has threatened to go on a three-day pen-down strike from November 21, if the state government did not act on their seven day ultimatum served on November 14 for “a decision and recommend the empanelled list of non-SCS Officers to the DoPT/ UPSC” by Tuesday. A joint press statement issued by the presidents of CANSSEA, Dr. Zase Chusi, Er. Y. Tep (FONSESA), Johnny Humtsoe (NSSA) and R.N Yanthan (NF&ASA), action committee convenor, Dr. Ilang, and members Kitto Swu, Er. Neiilabeizo and Temsu Longkumer, stated that the associations on November 20, held a threadbare deliberation on the issue and resolved to stage its first phase agitation (November 21). It will be followed by a second and third Phase till their “legitimate rights were fulfilled,” the signatories stated. CoFA said they were yet to get a positive response from the government till date. In this regard, the associations have decided to go ahead with the first phase of agitation— ‘pen down strike’, if the government failed to respond positively by midnight of November 21. Amendment to omit minerals from Nagaland Forest Act in Winter Session D I M A P U R , N OV 2 0 ( N P N ) : E nv i r o n m e n t , Forest & Climate Change department will take immediate steps to move for amendments to the Nagaland Forest Act, 1968 and the proposed amendments will be placed before the Nagaland Legislative Assembly during its Winter Session this year. According to a press release issued by Geology & Mining director, Wanthang Rengma, forest produce listed as minerals, minor minerals and rocks (including lime stone, laterite, mineral oils and all produce of mines and quarries) in the Act would be removed. He said a joint meeting of Geology & Mining and Environment, Forest & Climate Change departments held at Kohima on October 28 under the chairmanship of chief minister, T.R. Ze-
liang had decided to entrust Geology & Mining department as the administrative authority for management of mineral concession and development in the State. The meeting said minerals listed in First Schedule of the Nagaland (Ownership and Transfer of Land and its Resources) Act, 1990 (NOTLAR Act) and Schedule-I of NMMCR 2004, including sand, gravel and boulders, fell under the prerogative of Geology & Mining department and that it would continue to implement the NMMCR 2004 by granting licence/ permit, levy royalty, monitor and regulate mines/ quarries etc. Rengma said pursuant to the decision, department of Environment, Forest & Climate Change would take immediate steps to move for amendments to the Na-
galand Forest Act, 1968 Further, the statement also expressed its gratitude to Zeliang under whose chairmanship a clear cut decision in line with Article 371A of the Indian Constitution and the NOTLAR Act, 1990 and the NMMCR 2004 and Rules of Executive Business was taken. The department also thanked Chief Secretary Pankaj Kumar for his co-operation. “Henceforth, the department of Geology and Mining will regulate, control and monitor all minerals including coal, petroleum and natural gas in the State and will continue granting mining permit, levy tax/royalty on all minerals within the State. Any other agency collecting royalty on minerals will be treated as illegal and it will attract legal action as per the provisions of law,” Rengma stated.

Sonia slams Modi govt for ‘sabotaging’ winter parl session NEW DELHI, NOV 20 (PTI): Congress president Sonia Gandhi on Monday launched an all-out attack on the government, accusing it of sabotaging the Winter session of Parliament on filmy grounds. Addressing the meeting of the Congress Working Committee, she also accused the government of being “illprepared” to implement the GST, which she described as a “flawed” tax regime. Sonia also hit out at the government over demonetisation, saying the move left millions of people “suffering”. “Modi-gover nment in its arrogance has cast a dark shadow on India’ Parliamentary democracy by sabotaging the Winter session of Parliament on flimsy grounds,” she told the party’s highest decisionmaking body.

KOHIMA, NOV 20 (NPN): Nagaland Public Service Commission has cancelled the exam for three posts of stenographers Gr-III under power department scheduled to be held on November 21, 2017. In a notification, NPSC secretary, Khrupi Sothu stated that the exam was cancelled in compliance to the power department’s letter dated November 17, 2017. In this regard, application form and exam fees will be refunded to the candidates. However, Sothu said exams for stenographer Gr-II under NIC and stenographer Gr-III under Home department will be held as scheduled.
NHM employees call off agitation
DIMAPUR, NOV 20 (NPN): Following the assurance made by the mission director NHM that pending salaries would be released within 10 days (including vertical programme), employees of NHM, Nagaland has called off the total cessation of work from November 21. While announcing its decision, NHM employees have appealed to the government to release the remaining fund for all the vertical programmes on or before November 30, failing which they would re-initiate the protest without prior notice. They also urged the Executive Committee Meeting, SHS, NHM to approve increment, arrears and incentives and release the same at the earliest. It further urged the government to transfer the funds within 15 days as and when the funds are released by the Centre. Meanwhile, the employees have lauded the chief minister, H&FW minister and officials for understanding the problem and in releasing funds for NHM.
MTDOA indefinite ‘chakka bandh’ from today
DIMAPUR, NOV 20 (NPN): The indefinite chakka bandh called by Mokokchung District Truck Owners’ Association (MDTOA) on NH-702 D (Mokokchung-Mariani road) will commence Tuesday from 6 a.m. onwards. All commercials vehicles-- truck and pick-up trucks- have been restricted from plying on NH 702D and in Mokokchung district. In a press note, MDTOA president Sangyumongba Ao and general secretary Imtisumak cautioned shop-owners and businessmen not to take advantage of the bandh by hiking prices of essential items. The association reiterated that the bandh was imposed in the greater interest of the public to demand better roads and for safety of the drivers, handymen and commuters. MDTOA further warned that it would not be responsible for any loss or damage of properties during the bandh period. It also acknowledged the support extended by Mokokchung Town Lanur Telongjem, All Ward Union Mokokchung and the Pick-up Trucks Union, Mokokchung.
Power outage in Kma, Peren dist, Medziphema
DIMAPUR, NOV 20 (NPN): Power department on Monday informed that Kohima town and adjoining areas-- Peren district and Medziphema would be facing a total power shutdown from November 21-23, 6 a.m. to 9 a.m. Informing this in a press note, EE Transmission division Kohima said the shutdown is being carried out for the strengthening and stringing of a new Bus bar at 132/33/11kV sub-station at Kohima. All consumers have been requested to extend their co-operation and to bear with the inconvenience.

NPSC cancels power dept steno exam
KOHIMA, NOV 20 (NPN): With the ever growing issue of employment in the state, parliamentary secretary Employment, Skill Development and Entrepreneurship, Dr. Neiphrezo Keditsu on Monday disclosed that Nagaland as of July 2017 had about 70,000 educated unemployed youth. Keditsu while addressing at the inaugural function of the five days Skill Fest
organized by Oriental College Kohima, said it was imperative for Nagas to shift the focus from government jobs to entrepreneurship. He lauded the principal and staff of the college for organizing such an event, stating that the event showed the deep concern for the students. Keditsu said the unemployment issue in Nagaland has become deplorable. He also lamented that the education system in Nagaland was more of was
a degree oriented course and not career oriented. Reminding the gathering that the Naga forefathers were professional agriculturists, he reiterated that the time has come for all to shift the focus from government jobs to entrepreneurship. For this, he said government of India was also focussed on imparting skill training/education to address the unemployment issue in the country. With resource persons
from various departments prepared to address during the five day event, Keditsu encouraged the students to make the best use of the event to learn from the experts. He also encouraged the students to focus on professional areas like the banking sector which had huge potential. Students need to set high targets and have a realistic approach towards its goal, he said, adding “do not to wait for others to motivate you.” Emphasizing on skill education, Keditsu assured that the government will help in all possible ways those who are trained.
